The Republican presidents pardon of 1,500 defendants on Monday drew outrage from lawmakers who were endangered in the 6 January, 2021 attack, when thousands of Trump supporters stormed the Capitol in an unsuccessful attempt to prevent Congress from certifying his 2020 loss to Joe Biden.

States sue over Trump bid to end birthright citizenship

A coalition of states launched legal actions Tuesday seeking to block Donald Trumps plan to end birthright citizenship in the United States.
The two separate lawsuits involving a total of 22 states, including California and New York, come the day after Trump took office and quickly unveiled a phalanx of executive orders he hopes will reshape American immigration.
Chief among them was an order eliminating the automatic granting of citizenship to anyone born on US soil, a right guaranteed by the 14th Amendment of the countrys constitution.
If implemented, the order would prevent the federal government from issuing passports, citizenship certificates or other documents to children whose mothers are in the country illegally or temporarily, and whose father is not a US citizen or permanent resident.
The Presidents executive order attempting to rescind birthright citizenship is blatantly unconstitutional and quite frankly, un-American, California Attorney General Rob Bonta said as he announced the suit.
We are asking a court to immediately block this order from taking effect and ensure that the rights of American-born children impacted by this order remain in effect while litigation proceeds.
The President has overstepped his authority by a mile with this order, and we will hold him accountable.
The California-led suit, which was filed in federal court in Massachusetts, was joined later Tuesday by one filed in Washington state, and comes alongside a similar suit filed by the American Civil Liberties Union (ACLU) and other advocacy groups in New Hampshire.
The 14th Amendment was adopted in the aftermath of the US Civil War, as part of an effort to ensure the rights of former slaves and their children.
It says, in part: All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.
Trumps order, if it stands, will come into effect 30 days from when he signed it.
Trump also claimed -- WRONGLY -- that the United States is the only country in the world that grants birthright citizenship

Kentucky police are investigating after a series of racist Ku Klux Klan flyers telling immigrants to leave now were distributed across the state on inauguration day.

TRUMP Signs Orders That Leaves Millions of Americans W.O. Healthcare
Within his first 48 hours back in office, Trump has signed several executive orders that threaten the healthcare of millions of Americans.
Amid a flurry of executive orders, some of which were signed live on TV on inauguration night, the US president issued several orders that repeal Biden-era directives that had expanded healthcare access and options for the poor, lower-income and middle-class Americans.
Those orders are expected to affect the medical insurance coverage for upwards of 20m people in the US.
The previous administration has embedded deeply unpopular, inflationary, illegal, and radical practices within every agency and office of the Federal Government, Trump said in the official statement, which referenced several health-related orders.The statement goes on to accuse diversity, equity and inclusion (DEI) policies of having corrupted institutions for Americans.
Those people whose coverage is now deemed at risk are the roughly 24 million Americans who have purchased their health insurance via the Affordable Care Act this year. The ACA, also known as Obamacare, helped to expand Medicaid benefits and provides affordable health insurance to millions of people.
Trumps actions this week will affect all aspects of the ACA, including eligibility requirements, federal subsidies and enrollment deadlines, which determine when Americans can apply for insurance, without repealing the act, which would take action from the US Congress. But the actions are expected to create more barriers and result in healthcare coverage becoming even less accessible.
In a one-page document published by Politico, Trump outlines options for spending cuts. These plans include measures that would reduce the amount of money states have to fund Medicaid and limiting health program eligibility depending on citizenship status. Every option listed involves cutting funding for and access to healthcare coverage.
Some of the Biden-era orders Trump has already repealed include executive order 14009, or the Strengthening Medicaid and the Affordable Care Act, which broadened access for Americans and their families, allowing more parents with young children to be eligible for more extensive coverage. Some estimates suggest that this appeal alone could result in a nearly 25% loss of ACA coverage.
Additionally, Trump repealed executive orders aimed at reducing the cost of prescription drugs for people on the government health insurance programs Medicare and Medicaid that chiefly serve older and lower-income Americans.
The Biden administration also previously introduced the American Rescue Plan Act, a subsidy program that lowered the cost of health insurance premiums.
This broadened the eligibility requirements, extending them to many more people in the US middle class.

Under a long-standing interpretation of the 14th Amendment to the Constitution, nearly anyone born inside the US is automatically given citizenship. Trump hopes to end that rule for children born to parents who are in the country illegally or temporarily.
Four states - Washington, Arizona, Illinois and Oregon - asked for the order to be paused while the federal court considers the states' legal challenge.
During arguments, Judge Coughenour asked a lawyer for the Trump administration where were the lawyers when the executive order was drafted by Trumps team, and chastised him for his claim that the order is constitutional.
It BOGGLES my mind, the judge said.
The executive order will be put on hold for 14 days pending further legal proceedings.
Trump, who has issued a range of unilateral actions since returning to the US presidency on Monday, has long vowed to make this particular change.
His executive order called on US government departments and agencies to deny the granting of citizenship to the children of migrants who are either in the US illegally or on temporary visas.
It would have applied to children born on 19 February and onwards, according to legal filings in the case by the Department of Justice (DoJ).
There have been reports that the administration was planning to enforce the order by withholding documents, such as passports, from people it deems ineligible for citizenship.
The judges order also put a stop to any enforcement of the order by federal agencies.
In their lawsuit, the four states challenging the order argue that the 14th Amendment and US law automatically confer citizenship upon individuals born in the United States and that the president does not have the power to amend the Constitution.
They add that if the order is implemented, residents of those states will suffer immediate and irreparable harm.
The individuals who are stripped of their United States citizenship will be rendered undocumented, subject to removal or detention, and many will be stateless, the lawsuit states.
Trumps Department of Justice argued that the case brought by the states does not warrant the extraordinary measure of a temporary restraining order, but the judge disagreed.
The 14th Amendment, adopted in 1868, states in part: All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States.
The DoJ argued that the clause and subject to the jurisdiction thereof, excludes children of non-citizens who are in the US unlawfully, and added that the order is an integral part of Trumps goal to address the countrys broken immigration system and the ongoing crisis at the southern border.
There were 255,000 children born to undocumented mothers in the US in 2022, according to the states legal challenge.
The amendment has been interpreted by courts as granting citizenship to anyone born on US territory, with very limited exceptions such as the children of foreign diplomats.
Without a direct amendment to the US Constitution - which requires a two-thirds vote in both chambers of Congress, plus the approval by Americas states - experts say the issue is likely to be ultimately decided by the courts.
Lawyers for the federal government said they planned to appeal the ruling, and that they expected the case to end up in front of the US Supreme Court.
The birthright citizenship amendment dates back to the days after the US Civil War, and settled the question of the citizenship of freed, American-born former slaves.

Trump has invoked the wartime Alien Enemies Act of 1798 to deport five Venezuelan nationals from the US.
The White House issued a presidential proclamation on Saturday targeting Venezuelan members of gang Tren de Aragua, saying: Tren de Aragua (TdA is a designated Foreign Terrorist Organization with thousands of members, many of whom have unlawfully infiltrated the United States and are conducting irregular warfare and undertaking hostile actions against the United States.
Civil liberties organizations have accused Trump of invoking the 1798 act unlawfully during peacetime to accelerate mass deportations and sidestep immigration law.
Hours later, a FED Judge temporarily blocked Trump?s administration from using the act to carry out its intended deportations of the Venezuelans. Judge James Boasberg of the federal district court in Washington DC agreed to issue temporary restraining order that prevents the Venezuelans deportation for 14 days.
Given the exigent circumstances that the court has been made aware of this morning, it has determined that an immediate Order is warranted to maintain the status quo until a hearing can be set, Boasberg wrote in his order.
Boasbergs decision comes in response to a lawsuit filed the same day by the American Civil Liberties Union and Democracy Forward. The organizations charge that the Trump administration unlawfully invoked the Alien Enemies Act.

TRUMP Continues to ATTACK Judges - Federal Judge: Trumps Attacks on Judges Could Hurt His Cases
A Federal Judge on Monday wont lift his block on deportation flights of alleged members of Venezuelas crime gang Tren de Araragua under the 1798 Alien Enemies Act.
Chief U.S. District Judge James Boasberg in Washington, D.C., wrote in a 37 page ruling that Venezuelans whom the Trump administration wants to deport under the act should get a hearing on whether they are gang members.
A three-member appeals court heard arguments for one hour late Monday and didnt issue a ruling.
'Nazis got better treatment under the Alien Enemies Act than has happened here' Judge Patricia Millett, who was appointed by President Barack Obama, said in noting during World War II that Nazis appeared before hearing boards under Franklin D. Roosevelts administration.
Five plaintiffs are suspected gang members but were not on the deportation flights. They remain in custody in Texas and appeared before a judge.
Boasberg said the plaintiffs likely will succeed in court.
The Court need not resolve the thorny question of whether the judiciary has the authority to assess this claim in the first place, Boasberg wrote in his ruling. That is because Plaintiffs are likely to succeed on another equally fundamental theory. Before they may be deported, they are entitled to individualized hearings to determine whether the Act applies to them at all.

Solicitor General D. John Sauer was placed under fire from Supreme Court Justices Sonya Sotomayor and Elena Kagan at the so called birthright citizenship hearing.
You said to us we'd have to wait until there was a final judgment, Sotomayor said. You're not sure you would respect the judgment of every circuit. You're not sure that you would respect even a final judgment of the Supreme Court.
Sauer replied, I don't think theres a, so to speak, really, really unconstitutional exception to the strictures of article three or the scope of equitable authority. And the court should not recognize one, because what we see, not just in this case, but in the 39 others, is that the district courts who issue these injunctions all passionately disagree with the thing thats being challenged in that.
Justice Kagan then pressed, Lets assume that you lose in the lower courts pretty uniformly as you have been losing on this issue
She added, I noticed that you didnt take the substantive question to us. You only took the nationwide injunction question to us. Why wouldnt you take the substantive question to us?
Pressing Sauer more Kagan added, You're losing a bunch of cases. This guy over here, this woman over here, you know, they'll have to be treated as citizens, but nobody else will.
Why would you ever take this case to us?
Sauer attempted to answer but was swiftly cut off.
You're ignoring the import of my question, Kagan said. Im suggesting that in a case in which the government is losing constantly, theres nobody else whos going to appeal. They're winning. Its up to you to decide whether to take this case to us.
She added, If I were in your shoes, there is no way Id approach the Supreme Court with this case. So you just keep on losing in the lower courts, and whats supposed to happen to prevent that?
The Justices are hearing arguments on the 14th Amendment, which grants citizenship to anyone born in the United States.
Sauers argument is that the 14th Amendment was for the children of slaves and not undocumented migrants.

A federal trade court on Wednesday blocked Donald Trump from imposing sweeping tariffs on imports under an emergency powers law.
The ruling from a three judge panel at the New York based court of international trade came after several lawsuits arguing Trump has exceeded his authority, left US trade policy dependent on his whims and unleashed economic chaos.
The Worldwide and Retaliatory Tariff Orders exceed any authority granted to the President by IEEPA to regulate importation by means of tariffs, the court wrote, referring to the 1977 International Emergency Economic Powers Act.
The court does not pass upon the wisdom or likely effectiveness of the presidents use of tariffs as leverage. That use is impermissible not because it is unwise or ineffective, but because federal law does not allow it
The Trump administration has reportedly filed a notice of appeal, and White House officials responded to the ruling with public statements challenging the courts authority in the case..
It is not for unelected judges to decide how to properly address a national emergency, Kush Desai, a White House spokesperson, said in a statement to Reuters.
Financial markets, in contrast, cheered the ruling. The US dollar rallied following the courts order, surging against currencies such as the euro, yen and the Swiss franc in particular. Wall Street futures rose and equities across Asia also rose.
The ruling, if it stands, blows a giant hole through Trumps strategy to use steep tariffs to wring concessions from trading partners, draw manufacturing jobs back to US shores and shrink a $1.2TRIL US goods trade deficit, which were among his key campaign promises.
Without the instant leverage provided by the tariffs of 10% to 54% that Trump declared under the IEEPA, which is meant to address unusual and extraordinary threats during a national emergency, the Trump administration would have to take a slower approach of lengthier trade investigations under other trade laws to back its tariff threats.
The decisions of the court of international trade, which hears disputes involving international trade and customs laws, can be appealed to the US court of appeals for the federal circuit in Washington DC, and ultimately the US supreme court.
At least seven lawsuits are challenging the levies, the centerpiece of Trumps trade policy. Tariffs must typically be approved by Congress, but Trump says he has the power to act because the countrys trade deficits amount to a national emergency. He imposed tariffs on most of the countries in the world at one point, sending markets reeling.
The plaintiffs argued that the emergency powers law does not authorize the use of tariffs, and even if it did, the trade deficit does not meet the laws requirement that an emergency be triggered only by an unusual and extraordinary threat. The US has run a trade deficit with the rest of the world for 49 consecutive years.
Trump imposed tariffs on most of the countries in the world in an effort to reverse Americas massive and longstanding trade deficits. He earlier plastered levies on imports from Canada, China and Mexico to combat the illegal flow of immigrants and the synthetic opioids across the US border.
His administration argues that courts approved then president Richard Nixons emergency use of tariffs in 1971, and that only Congress, and not the courts, can determine the political question of whether the presidents rationale for declaring an emergency complies with the law.
Trumps liberation day tariffs shook global financial markets and led many economists to downgrade the outlook for US economic growth. So far, though, the tariffs appear to have had little impact on the worlds largest economy.

The Supreme Court delivered a significant setback to President Donald Trump on Friday, ruling that he exceeded his constitutional authority when imposing broad tariffs under emergency powers legislation.
The justices voted 6/3 that Trumps tariff approach violated the International Emergency Economic Powers Act, a 1977 law governing presidential emergency authority over economic matters.
Chief Justice John Roberts authored the majority opinion, joined by three liberal justices and two conservative colleagues, Justices Neil Gorsuch and Amy Coney Barrett.
Roberts stated The president asserts the extraordinary power to unilaterally impose tariffs of unlimited amount, duration and scope. He noted that the Trump administration points to no statute in which Congress previously authorized IEEPA language to apply to tariffs.
Justices Clarence Thomas, Brett Kavanaugh, and Samuel Alito dissented.
He lamented that the decision is nonsensical, claiming that the Court admitted he can do anything he wants as president other than charge other countries tariffs for US goods.
