How Much Prison Time Could TRUMP Get?,,, It's Complicated ...

Of The More Than SIX Dozen Felonies That TRUMP is Accused of, Many of Others, Often Result in Harsh Sentences AP/Politico 16 NOV 2023 ![]() Trump now faces 78 felony charges across three criminal cases — many of them carrying the potential for hefty prison time. If Trump were convicted on all counts and given the maximum statutory penalty for each one, he would face a whopping 641 years in prison. And that’s not counting additional criminal charges he may face in Georgia, where the district attorney in Fulton County may be on the verge of indicting him this month. But the reality of any prison term that Trump could plausibly receive is far more complicated. In both state and federal courts, judges have wide latitude in sentencing. None of the crimes Trump has been charged with carry a mandatory minimum sentence, and defendants with no prior criminal record — a status that, at least for now, applies to Trump — rarely receive the maximum. And if the 77-year-old former president were convicted of multiple counts within the same case, any sentences for those counts might run simultaneously, rather than being stacked on top of each other. More broadly, sending Trump to prison could raise unprecedented practical and legal issues that would be on any judge’s mind. For one thing, there is the extraordinary logistical challenge of jailing a former president who is entitled to around-the-clock Secret Service protection. For another, there is the potential constitutional crisis that could ensue if Trump were re-elected to the White House in 2024 and then ordered by a judge to serve out a prison term. Those concerns aside, some of the felonies Trump is accused of — particularly in the two federal cases brought by special counsel Jack Smith — routinely entail significant sentences. Legal experts anticipate that Smith’s team, if they obtain convictions against Trump, will seek substantial prison time in both cases they have brought, one involving his retention of classified documents and the other involving his bid to overturn the 2020 election. Trump himself has even touted the threat of a significant prison sentence in recent fundraising emails, with his campaign and a PAC saying in late July, “While my primary opponents continue to take cheap swipes at me as the Department of Justice plots ways to throw me in JAIL for up to 561 YEARS, I am asking YOU to stand with me at this pivotal moment in the election.” The charges that might carry the most severe penalties for Trump involve obstruction of justice. In both federal cases, Smith has accused him of violating various provisions of the federal statutes that prohibit obstructing official proceedings or obstructing investigations. All of the obstruction charges — which include allegedly impeding the government’s attempts to retrieve the classified documents and disrupting the Jan. 6, 2021, session of Congress — have a 20-year maximum sentence. While Trumps’ lack of a criminal record could weigh in favor of a sentence much lower than that, prosecutors might argue that so-called aggravating factors — like Trump’s alleged efforts, in both cases, to pressure others to commit crimes — support a stiffer term. Trumps’ willingness, or lack thereof, to accept responsibility if convicted also would play a role in a judge’s sentence. Trump faces 91 charges across four criminal trials. While he is not expected to face all four in 2024, some trial dates have been set. The first is 4 March for his alleged role around the January 6 insurrection. In that prosecution in Washington DC, he faces four criminal counts related to an attempt to stay in power after the 2020 election: conspiracy to violate civil rights, conspiracy to defraud the government, the corrupt obstruction of an official proceeding and conspiracy to perpetrate that obstruction. Glenn Kirschner told Sky News: "I think the odds of a conviction are extremely high. It's important to recognise who the witnesses are against Donald Trump. These are not Donald Trump's enemies or opponents, these are not angry Democrats. "Interestingly, the people we know are likely to be on the witness list are almost exclusively Republicans. Some of them are his own former cabinet members, his former attorney-general, his former vice president. I believe the testimony we will see will come from a chorus of Republican voices. It makes it much more difficult for Donald Trump, a fellow Republican, to say 'they're all out to get me'." The filings show the Save America leadership PAC, which Trump has used as a legal slush fund, owes $1.1 million to five different law firms and last month paid nearly $3.3 million more for legal consulting, with its biggest debt – $837,000 – owed to Blanche Law, the firm founded by his lead counsel in the hush money trial, reported The Daily Beast. The PAC paid nearly $854,000 to defense counsel Todd Blanche's firm over two weeks in April, when his Manhattan criminal trial began, and the attorney also represents him in the Mar-a-Lago classified documents case and his federal election interference case in D.C. Save America also owes $168,000 in debt from last month to a firm associated with Steven Yurowitz, another attorney on the hush money case, and $96,000 to Dhillon Law Group, the firm founded by California Republican National Committee member Harmeet Dhillon, who last year ran unsuccessfully for RNC chair. Dhillon told The Daily Beast the PAC was current in all of its obligations to the firm and she was "proud" to have them as a client. The PAC's legal debt jumped by $245,000 from March to April, but the filings also showed it had paid off some of those debts and eliminated its debt to the law firm Robert & Robert for its work on the New York fraud case. Save America paid close to $3.3 million to nearly a dozen firms for legal consulting in April, including more than half a million dollars to Chris Kise, who has worked on both the hush money and classified documents cases, and $390,000 to John Lauro, who is working with Blanche on the election interference case. The PAC also paid $174,000 to James Otis Law Group LLC, the firm founded by D. John Sauer, who argued Trump's immunity claim before the U.S. Supreme Court, and $140,000 to the firm belonging to Trump lawyer and spokesperson Alina Habba. RELATED:

Donald Trump has surprised his own advisers with audacious requests for cash from wealthy Republican donors as he seeks to pay his exorbitant legal costs. Trump has been promising donors tax cuts or other policies that would benefit them and then seconds later asking for more money than his campaign or the Republican Party can legally accept, such as his request for $1 billion from oil industry executives in exchange for enacting the policies they wanted. The law technically allows Trump to ask for only contributions of $3,300 or less for his campaign, but he can appear at events for his super PAC where admission is much higher as long as he doesn't directly ask for the money, but campaign finance lawyers say the Federal Election Commission, which has three Republicans and three Democrats, would not likely investigate his fundraising during an election year. Four sources close to Trump say he's keeping a close eye on who gives to his campaign and has told allies how much he expects them to raise, he has repeatedly pressured some of them, including oil magnate Harold Hamm, to raise more, saying they're "behind" and that he "needs the money." During one meeting that stretched for hours, Trump promised to cut taxes for corporations and enact policies to benefit oil companies, and he warned that he was being outraised by Democrats.
