Police Officers Named & Charged Over The Death of Ex-Aston Villa Star Dalian Atkinson

Two police officers were charged last week after an inquiry into the death of former Aston Villa star Dalian Atkinson

A court order protecting the identity of two police officers charged after an inquiry into the death of Dalian Atkinson has been lifted by a judge at Birmingham Crown Court.

Judge Simon Drew QC overturned the Contempt of Court Act order, allowing the naming of West Mercia Police Constables Benjamin Monk and Mary Ellen Bettley-Smith, after submissions by media organisations.

Both officers were present at the hearing, at which their lawyers agreed that anonymity could not be justified, instead arguing that their home addresses should not be revealed in media reports.

A further hearing will be held to decide the issue of addresses on Thursday.

Monk, 41, is accused of murdering the former Premier League star. He faces an alternate charge of manslaughter whilst Bettley-Smith, 29, is accused of causing actual bodily harm (ABH).

Mr Atkinson, 48, who also played for Ipswich and Sheffield Wednesday, died after being Tasered outside his dad’s home in Telford, Shropshire.

His family claimed after his death that the device was deployed at least three times.

The Independent Office for Police Conduct placed the two officers under criminal investigation days after the tragedy.

They were interviewed under caution, most recently last summer, and also served with “gross misconduct” notices.

Last October it emerged a file of evidence had been passed to the Crown Prosecution Service to consider potential criminal charges.

The CPS announced the charges last Thursday shortly before the officers appeared at Birmingham Magistrates’ Court.

They were referred to during the proceedings as Constable A, charged with murder and manslaughter, and Constable B.

Constable A was released on unconditional bail after making a later appearance at Birmingham Crown Court.

Constable B indicated a not guilty plea to a charge of assault and she was also granted bail.

They are next due to appear at the same court on December 9.

Lawyers for the two officers successfully argued for their names and addresses to be kept confidential, claiming their "right to life" could be "infringed" if publicly identified.

But that reporting restriction has now been lifted after a further hearing.


Relatives said Mr Atkinson was suffering from ill health and had a weak heart before he was Tasered.

In a statement after his death his siblings described him as a “kind, caring and protective brother”.

They added: “He always brought life and energy to family gatherings - when Dalian turned up, we knew there would be laughter and banter.”

Kate Maynard, a solicitor for the Atkinson family, said they welcomed the charges against the two officers.

But she added they “regretted that already more than three years have passed since Dalian died”.

Deborah Coles, director of the charity Inquest, also welcomed the charging decision by the CPS.

She added “We hope the next stages of this prosecution are pursued promptly and the upmost scrutiny of the officers actions is ensured.”
