The ‘black hole’ of child abduction: Japan’s child custody laws


There are many wonderful things about Japan, but the way the country deals with child custody disputes is not one of them.

The Japanese have a bizarre law that allows a disgruntled parent who separates from a spouse to literally abduct the children and run away.


In those circumstances, it makes kidnapping legal. Worryingly, an increasing number of Australians, whose relationships with their Japanese partners have ended, have found themselves permanently cut off from their kids. It’s a heartbreaking situation

Japan is one of the only countries in the world that protects and maintains a sole custody system (Cosier & Grant, 2022). As a result, national laws in the East Asian country fail to comprehensively protect the rights of both parents through divorce and marital separation.

In the wake of increasing cross-cultural and cross-national marriages and despite scrutiny from the international legal community, non-custodial parents are facing the traumatic reality of complete isolation from their children’s lives following divorce.


The Sydney Morning Herald and The Age’s Eryk Bagshaw reports that there might finally be some hope for change. And it’s in no small way thanks to some extraordinary efforts in Canberra.

She told police Terauchi kept her prisoner in a flat in downtown Tokyo





She escaped when he went to go shopping and forgot to lock the door




The 15-year-old was reported missing by her family two years ago, after being seen speaking to a young man near her home, now believed to have been Terauchi.

Her family later received a handwritten note, which read: 'I need a little break from home and from school. I'll be at my friend's house for now. Please do not come searching for me,' JapanTimes reports.

Terauchi arrested after witness called police about man 'covered in blood'

Terauchi had reportedly attempted to commit suicide using a box-cutter after the teenage girl fled his home

He was taken to hospital with a minor self-inflicted injury to the neck, and police plan to formally charge him with kidnapping once he recovers.

Terauchi reportedly graduated from university this month, having studied for his degree while allegedly keeping the girl locked in his apartment.
