For while the Prime Minister dined alone after another summit mauling, Angela Merkel, Emmanuel Macron and the rest of their European chums were drinking the night away and enjoying the city's famous beers.

Europe’s two most powerful leaders stayed out drinking on an unseasonably balmy Brussels night until just after 1am - longer than they afforded May's Brexit speech earlier that evening.

Ministers Plan Law Overriding Brexit Commitments


Ministers are planning new legislation that could override a key part of last year's EU withdrawal agreement.

Finishing talks with the EU without striking a deal would still be a "good outcome", the PM will say.


The move could change the nature of new Northern Ireland customs arrangements intended to prevent a return to checks at the border with the Irish Republic.

Downing Street said it was a standby plan in case EU-UK trade talks fail.

Meanwhile, Boris Johnson said that, if a trade deal is not reached by 15 October, both sides should "move on", which would still be a "good outcome".

Although the UK formally left the EU in January, it has continued to follow rules set in Brussels during a transition period - which ends on 31 December - while discussions over a long-term trade agreement continue.

Another round of talks - the eighth - begins on Tuesday, aimed at securing a deal to allow companies to trade without taxes or customs checks.

But Mr Johnson is expected to tell EU leaders it must be agreed in time for the European Council meeting on 15 October if it is to be in force by 1 January.

"If we can't agree by then, then I do not see that there will be a free trade agreement between us, and we should both accept that and move on," he will say.


'Good Putcome for The UK'


The UK has said it wants a deal with the EU which resembles Canada's, which gets rid of most, but not all, tariffs on goods traded.

But Mr Johnson will say no deal means having a "trading arrangement with the EU like Australia's", using terms set by the World Trade Organisation. In practice, this would mean taxes on exports and customs checks.

"That would be a good outcome for the UK," the prime minister will say.

During trade talks, the UK and EU have been at loggerheads over two issues in particular - the future of fisheries and state aid, the money given by governments to help companies.

The EU says the UK is trying to give itself an unfair advantage by applying different rules on state aid, but the UK insists it should have control over this as a sovereign country.

Michel Barnier, the EU's chief negotiator, told French radio on Monday: "The British would like the best of both worlds - export their products to the European market on their terms."


'Electrifying Development'


Meanwhile, the government will publish its Internal Market Bill - designed to protect trade arrangements between the four parts of the UK - on Wednesday.

This could contradict the Northern Ireland Protocol, set up to prevent a hard border between Northern Ireland and the Irish Republic, which many fear could be detrimental to peace.

The protocol says Northern Ireland will follow some EU customs rules - meaning customs declarations for goods moving from Northern Ireland to Great Britain, as well as some new checks on goods going from Great Britain into Northern Ireland - after the transition period.

The Financial Times said the bill would "eliminate" the legal force of the Withdrawal Agreement, struck less than a year ago between the UK and EU, in areas including state aid and Northern Ireland customs.

BBC political correspondent Chris Mason described the proposed bill as an "electrifying development in the Brexit process".

European Commission President Ursula von der Leyen tweeted that she trusted the UK government "to implement the Withdrawal Agreement, an obligation under international law and prerequisite for any future partnership".

She added that the Northern Ireland Protocol was "essential to protect peace and stability on the island and integrity of the single market".


What does Brexit Mean for The Northern Ireland Border?

The Northern Ireland part of the Brexit deal, known as the protocol, was agreed in October last year.

It is designed to prevent a hard border in Ireland - or even any new checks at the Irish border.

It does this by effectively keeping Northern Ireland in the EU's single market for goods.

This will mean products entering Northern Ireland from the rest of the UK will be subject to new checks and controls - the so-called Irish Sea border.

However the precise nature of these checks needs to be agreed by the EU and UK and this is being negotiated in parallel with the trade talks between the two.

The government says it's still committed to the protocol but it could make its own decisions on how it is implemented if it cannot reach agreement with the EU.

Labour's Jonathan Ashworth told BBC Radio 4's Today programme: "Boris Johnson told us he had an oven-ready deal. And he fought a general election telling us he had an oven-ready deal. [This] now suggests that he was misleading people in that general election.

"And Parliament supported the Withdrawal Agreement earlier on this year. He has made promises and signed a treaty around these arrangements for Northern Ireland, and he now seems to be backing out of that."

Northern Ireland Deputy First Minister Michelle O'Neill tweeted that any threat of backtracking on the protocol would be a "treacherous betrayal which would inflict irreversible harm on the all-Ireland economy and the Good Friday Agreement".


Scottish First Minister Nicola Sturgeon said the move would "significantly increase" the likelihood of a no-deal Brexit, and the "resulting damage to the economy will be entirely Tory-inflicted. What charlatans".


Government sources told the BBC the legislation was "not intended to derail the talks", and a spokeswoman said the UK would continue to approach talks with the EU in good faith.

"As a responsible government, we are considering fallback options in the event this is not achieved, to ensure the communities of Northern Ireland are protected," she said.

A Cabinet minister has admitted that plans to change parts of the Brexit deal relating to Northern Ireland will break the law, just hours after the head of the Government’s legal department quit in protest.

Brandon Lewis, the Northern Ireland Secretary, told MPs that plans to override elements of the Withdrawal Agreement with domestic legislation would breach international law in a “very specific and limited way”.

However, he insisted the Government was “fully committed” to implementing the agreement and was merely delivering on its commitments to ensure Northern Ireland enjoyed “unfettered access” to the UK’s internal market.

The admission provoked a major backlash from senior Tory MPs, among them Theresa May, who warned it risked undermining trust in the Government as it sought to strike trade deals with countries around the world.

Separately, David Sassoli, the President of the European Parliament, warned there would be “serious consequences” if the UK attempted to undermine the withdrawal agreement.

His comments were echoed by Nathalie Loiseau, a close ally of French President Emmanuel Macron and an MEP on the Brexit co-ordinating group, who said: “You don’t ‘break international law in a specific and limited way’. You do break it or you don’t. You can’t be half illegal, as you can’t be half pregnant.”

Jean-Claude Juncker, the former European Commission president, said no deal was now the “most possible and probably only outcome of the negotiations.”

Legal experts also suggested the move raised questions over the future of Suella Braverman QC, the Attorney General and Robert Buckland, the Justice Secretary, who are bound to uphold the rule of law.

However, Brexiteers including Sir Iain Duncan Smith said the Government was “within its rights” to revisit the agreement, while Sir Bernard Jenkin suggested Boris Johnson should tear it up altogether if the EU insisted on an “unreasonable interpretation”.

The row erupted as it emerged that Sir Jonathan Jones, the Treasury solicitor and permanent secretary to the Government’s legal department, had resigned.

While the Attorney General’s Office refused to comment beyond confirming that Sir Jonathan will step down in April, multiple Whitehall sources claimed he had quit amid a row over changes to the Brexit deal.

It also emerged that Rowena Collins Rice, the director general of the Attorney General’s office, was also departing, although the department insisted it was part of a long-term process.

Sir Jonathan is understood to have disagreed with Ms Braverman’s interpretation of the legal implications, with insiders claiming external advice from a leading QC had also warned that the plans risked breaching international law.

However, Downing Street is said to have accepted the advice of Ms Braverman. Lord Falconer, Labour’s shadow attorney general who previously worked with Sir Jonathan, said: “This resignation indicates that senior government lawyers think that the government are about to break the law.”

Sir Jonathan is the sixth leading civil servant to stand down this year, with Sir Mark Sedwill, the outgoing head of the civil service, having completed his last day in the post.

The Internal Markets Bill will seek to limit Brussels’ influence over the UK’s state aid regime, the need for customs declarations, and checks and tariffs on goods crossing the Irish Sea.

The Government has said the changes are minor clarifications and provide a “safety net” should no agreement be reached before the end of the transition period.

However, when asked by Sir Bob Neil, the Tory chairman of the Commons justice committee, whether the changes breached the UK’s international obligations, Mr Lewis told the Commons: “Yes, this does break international law in a very specific and limited way.”

He added that the powers the Government was taking would enable ministers to "disapply" the legal concept of "direct effect" - which requires the enforcement of EU law - in "certain, very tightly defined circumstances".

“There are clear precedents for the UK, and indeed other countries, needing to consider their international obligations as circumstances change,” he added.

However, Sir Bob later said that any breach of international law was “unacceptable, regardless of whether it’s in a ‘specific’ or ‘limited way’.

His concerns were echoed by Mrs May, who said: “The UK Government signed the Withdrawal Agreement with the Northern Ireland protocol, this Parliament voted that Withdrawal Agreement into UK legislation.

"The Government is now changing the operation of that agreement. Given that, how can the Government reassure future international partners that the UK can be trusted to abide by the legal obligations of the agreements it signs?"

Sir Roger Gale, the Conservative MP for North Thanet, tweeted: "Seeking to renegotiate the Northern Ireland protocol will be regarded worldwide as an act of bad faith.

"Britain is an honourable country and that honour is not for sale or barter."

Tobias Ellwood, the Tory chairman of the defence committee, also warned that breaching international law would damage Britain's efforts to call out China and Russia over their transgressions.

A member of the One Nation caucus of around 100 moderate Tory MPs added: “A number of people struggle to comprehend a Conservative Government knowingly breaking the law.”

Two Royal Navy ships are patrolling waters around Jersey and a French naval vessel is heading towards the island, as fishermen protest over their post-Brexit rights.

About 60 French and Jersey boats are blocking the island's St Helier port, with a freight vessel unable to leave.

French fishermen say their rights are unfairly restricted by licences issued by the island under a new system.

Jersey's External Affairs Minister Ian Gorst said he will meet the fishermen.

HMS Severn, which has previously been used to shadow Russian navy warships off the English coast, can be seen from the port, sitting off about a mile from the French boats. HMS Tamar is nearby and both ships are maintaining a presence and not making any effort to intervene.

No 10 said it sent the two Navy vessels to "monitor the situation".

France has threatened to cut off electricity to the island over the row.
