Jennifer Garcia can’t keep her mind from drifting to little Gabriel. She had repeatedly reported signs of abuse but still wonders whether she could have done more to help save Gabriel.

When the familiar pit returns to her stomach, she bubbles with anger. She thinks of the people convicted of torturing and murdering Gabriel — the boy’s mother, Pearl Sinthia Fernandez, and her boyfriend, Isauro Aguirre.


Late at night and in the silence of her early morning drives, the first-grade teacher thinks of her former student. She assigns each child in her classroom a number — he was No. 28. She tries to focus on his kindness — on the times he offered to help her staple homework packets and tutor his classmates. She tells her new students about him, explaining when she assigns numbers why she now skips 28.

“They are evil,” Garcia said Thursday in a downtown Los Angeles courtroom as she glared at Fernandez, who sat stone-faced with her hands cuffed on her lap at the defense table. “I know who’s truly to blame.”

The scene in the courtroom served as a dramatic coda to a tragedy that became a symbol of bureaucratic failure, propelled far-reaching reforms within L.A. County’s child welfare system and led to unprecedented criminal charges against social workers who handled the boy’s case.

At the end of the hearing, Superior Court Judge George G. Lomeli sentenced Fernandez, 34, to life in prison without parole and Aguirre, 37, to be executed for the 2013 torture killing of Fernandez’s 8-year-old son —

Abuse that the judge characterized as “horrendous, inhumane and nothing short of evil.” It was the worst abuse he’d seen in nearly 20 years on the bench, he said, telling the defendants he hoped they woke up in the middle of the night plagued by their actions.

“I hope you think about the pain you caused this child and that it tortures you,” Lomeli said. “I rarely say that.”

LOS ANGELES, CA: Isauro Aguirre, 37, with his attorneys appeared in court with girlfriend Pearl Sinthia Fernandez, 34, who was sentenced to life in prison without the possibility of parole for her role in the death of her son, Gabriel.


Aguirre was sentenced to be executed in the Los Angeles Superior Courtroom of Judge George Lomeli on 7 June 2018. Gabriel Fernandez, whose 2013 torture and fatal beating prompted sweeping changes in the county's child welfare system.

A judge rejected a resentencing request by a Palmdale woman who pleaded guilty to first-degree murder in the death of her 8-year-old-son, who died after months of beatings, starvation and torture, including being forced to eat cat feces and sleep handcuffed in a small wooden drawer.



Pearl Sinthia Fernandez, 37, was sentenced to life in prison without parole three years ago for her role in Gabriel Fernandez’s 2013 murder. Her boyfriend, Isauro Aguirre, 40, was sentenced to death. His automatic appeal to the California Supreme Court is pending.

As part of her February 2018 plea, Fernandez gave up her right to appeal. But in a petition filed April 1, she asked the judge to review her sentence in light of recent changes to state law that affects some people convicted of murder under theories that do not require intent to kill, including felony murder or a natural and probable consequences theory.

Fernandez indicated in the petition that she was not her son’s actual killer and did not act with intention to kill or assist in his killing. She also checked a box stating she was not a major participant in the crime or did not act with reckless disregard to human life during the course of the crime.

Los Angeles County Superior Court Judge George Lomeli, who presided over the murder trial, said at a hearing Tuesday that he reviewed the petition and concluded Fernandez was “not entitled to resentencing relief.”

“It has been established by her own admission during her guilty plea that the murder was intentional and involved the infliction of torture over a period of several months,” Lomeli said, adding that the record supports the theory that Fernandez was a “major participant in the murder of a child victim.”






‘Nothing Short of Evil’ - Judge

Deputy Dist. Atty. Jonathan Hatami, who prosecuted the case, opposed Fernandez’s request, saying evidence and the law weighed against her.

Gabriel died from blunt force trauma and child abuse over a long period, Hatami said, citing the medical examiner’s report.

“So clearly Pearl was involved in that child abuse, starving Gabriel, keeping him in the box for eight months, not taking him for medical aid, pepper-spraying him in the face, hitting him with a baseball bat — so many things were brought out in the trial,” Hatami said.


“Evidence-wise, Pearl Fernandez tortured and killed Gabriel,” he said. “Both her and Isauro Aguirre did that. They were equally culpable for that.”

Cherie Kiyomura, a family friend who helped organize a rally that attracted dozens outside the courtroom, said she’s endured an emotional roller coaster.

Unsure of what would happen, Kiyomura entered the courtroom with a “sickening feeling.”


“Walking out of there, with finally some justice for Gabriel, was the best feeling that we’ve had in such a long time,” she said.
