A baby shut away in a shed during lockdown died when his carrycot tipped off a cardboard box head first causing him to suffocate, a hearing heard.


The tiny tot, who was two-months-old, was put in the outhouse by his mother and father as the home was “overcrowded”, causing issues between the two.

Judge Steven Parker told proceedings at a private family court hearing in Liverpool the couple had been arguing as they had a lack of “sleep and intimacy”.

As a result the little boy was put in the shed where he later died in June 2020.

He said: “In haste or recklessly, the carrycot was placed by mother and/or father on an inappropriate and insecure cardboard box in the shed.

The Judge did not name the couple or their little boy

"The cot tipped head first off the upper surface of the box which caused (the baby) to move on his left side/shoulder and his face was pressed up against the carrycot side with his head in an unnatural and unusual position.

"This compromised his breathing or ventilation and led to his death from hypoxia and hypercarbia."

Judge Parker heard the tragic youngser’s parents called the emergency services and said he had been found lifeless in his cot in their bedroom.

The baby's parents said his death was a tragic case of a sudden unexplained death.

But he ruled the baby's parents "failed to adequately supervise" him.

The hearing was told the couple had been arguing over a lack of intimacy

The judge said: “At the time (he) died there was tension in the mother and father's relationship caused by living ... in overcrowded circumstances and during lockdown, lack of sleep and intimacy and poor mental health on the father's behalf.

"These matters led to poor communication and arguments between the mother and father, and reached the point where parents were not coping well and needed a break from caring for (the baby)."

He added the baby was sometimes put on the floor in a room - on his own away from his parents - to "cry and self-soothe".

Judge Parker said the baby's parents denied the baby was "ever put in the shed" and did not accept he was "ever placed in his cot on a surface that was inappropriate".

But the judge ruled the baby's parents "colluded to provide a false account" of the circumstances surrounding the youngster's death.

Judge Parker did not say where the family lived or name the local authority involved.

He said the baby's parents lived in a bungalow and felt they did not have enough support, claiming to have never had face-to-face visits from the health visitor or midwife.

The judge said police investigated the boy's death and said "there was no identified criminality or neglect".

Officers went to the bungalow within half an hour of the youngster being taken to hospital and found his cot "in the garden shed".

He said "no sign of injury" were spotted during post-mortem tests.

Detectives have today begun searching the garden of a Handsworth property


Police investigating the death of a child in 2020 are searching a garden for human remains and have today charged a man and a woman with neglect.

The grisly development was announced on Tuesday afternoon by West Midlands Police, who began the search as part of an investigation after receiving information about a possible burial at the house in Birmingham.

A 40-year-old man has been charged with neglect remanded after appearing at court, while a woman, 41, will also appear at court to face the same charge.

Inquiries are said to be ongoing. The force said in a statement: “Information was received relating to the death of a child at a house in Clarence Road in 2020 and an investigation has been launched.

“Two people, a man aged 40 and a woman aged 41, were arrested on December 9 on suspicion of causing or allowing the death of a child and wilful neglect.

“Both have been charged for neglect and are on bail for the offence of causing or allowing the death of a child.”

The present occupiers of the property on Clarence Road in the Handsworth area of the city are aware of the search but are not connected to the investigation, the force said.

Detective Inspector Joe Davenport, from the force's Public Protection Unit, said West Midlands Police had acted "swiftly" on the information recieved and said inquiries would be ongoing to establish "exactly what has happened".

“I understand that this will come as a shock to the local community but I would ask you not to speculate on the circumstances. We would encourage anyone who has any information to get in touch", he added.

Body of Child Found Buried in Garden as Police Continue Search of Property

Police in Birmingham say they are investigating the death of a child whose body has been found at a private garden in the city

A child's body has been discovered in a garden at a house in Birmingham, police have said.

Officers have been at the property in the Handsworth area of the city for the past week.





A statement released by West Midlands Police on Sunday said that human remains had been discovered at the address on Clarence Street, and confirmed them to be from a child.

The remains will be sent for a post-mortem analysis.

Details of the child's identity, sex or how long they have been dead have not been released.

Two people - a man and a woman - have also appeared in court charged with neglect for causing or allowing the death of a child.

Tai-zamarai Yasharahyalah, 40, appeared at Birmingham Magistrates' Court on December 9 and was remanded for next hearing for pre-trial hearing at Birmingham Crown Court on January 9, 2023.

Naiyahmi Yasharahyalah, 41, appeared before magistrates on December 13.


The house's current residents meanwhile are unconnected to the investigation, the force has also said.

"Officers searching the garden of a property in Handsworth have discovered what are believed to be human remains," a West Midlands Police spokesperson said.

"The body is believed to be that of a child; a post-mortem will be carried out in due course to establish the cause of death."

The force added: "A man, aged 40 and a woman aged 41, were arrested on December 9 on suspicion of causing or allowing the death of a child and a separate case of wilful neglect.

"Both have been charged with neglect and have been remanded in custody.

"The investigation into the offence of causing or allowing the death of a child continues.

"The present occupiers of the property in Clarence Road are aware of the search, but are not connected to the investigation."
