Cellphone US Sues TIK TOK For Harming Children/TIK TOK Sues US Over Law Forcing Sale

TIK TOK SUED by 13 US States For Harming Childrens' Mental Health

Thirteen US states and Washington DC are suing TikTok over claims it is harming childrens mental health and not doing enough to protect them.

TikTok Sues US Government Over Law Forcing Sale or Ban

The social media company and its Chinese parent, ByteDance, sued to challenge the new law, saying it violated users First Amendment rights.

AP 9 OCT 2024

The lawsuits allege the video-sharing app is designed to be addictive and keep teenagers glued to the screen.

TikTok said the claims were "inaccurate and misleading" and pointed to features such as default screen time and privacy settings for under-16s.

"Young people are struggling with their mental health because of addictive social media platforms like TikTok," said New York attorney general Letitia James.

She also alleged young people had died and been injured copying stunts they had watched. Her counterpart in Washington DC, Brian Schwalb, called it "an intentionally addictive product".

His lawsuit accuses TikTok of causing "profound psychological and physiological harms" - including depression, anxiety and body dysmorphia.

Those suing under the new action are: California, Illinois, Kentucky, Louisiana, Massachusetts, Mississippi, New Jersey, New York, North Carolina, Oregon, South Carolina, Vermont, Washington state, as well as Washington DC.

Other US states have previously launched similar child protection cases against TikTok.

The legal action is another blow for the app, owned by Chinese firm Bytedance, which already faces a potential US ban over fears it could give data to the Beijing government - something it insists will not happen.

TikTok, ByteDance Sue to Block US Law Seeking Sale or Ban of App

TikTok and its Chinese parent company ByteDance sued in U.S. federal court seeking to block a law signed by President Joe Biden that would force the divestiture of the short video app used by 170 million Americans or ban it.

The companies filed their lawsuit in the U.S. Court of Appeals for the District of Columbia Circuit, arguing that the law violates the U.S. Constitution on a number of grounds including running afoul of First Amendment free speech protections.

The law gives ByteDance until 19 Jan. to sell TikTok or face a ban.

"For the first time in history, Congress has enacted a law that subjects a single, named speech platform to a permanent, nationwide ban," the companies said in the lawsuit.

The lawsuit said the divestiture "is simply not possible: not commercially, not technologically, not legally. ... There is no question: the Act (law) will force a shutdown of TikTok by 19 January 2025, silencing the 170 million Americans who use the platform to communicate in ways that cannot be replicated elsewhere."

The White House and Justice Department declined to comment on the lawsuit.
