Just last week, E. Jean Carroll beat Trump in his appeal of the $5 million jury award in one of her defamation cases.

Now, Ms. Carroll just won another victory in the 2nd Circuit Court of Appeals in her $83.3 million defamation case against Trump.

Specifically, the court rejected AG Bondi and the DOJs attempt to get Trump out of the case and insert the DOJ into the case as the defendant.


The video discusses the importance of this court loss for Trump/Bondi/the DOJ. One wonders if Trump is second guessing the wisdom of making Bondi his Attorney General when Bondis DOJ is losing Trump related cases in court an overwhelming majority of the time.

Of course, Im sure Trump would never, ever throw Bondi under the bus . . .



American Bar Association Sues Trump

The American Bar Association just sued Trump for his unconstitutional executive orders punishing law firms.


Give that multiple judges have already ruled that such executive orders are unconstitutional, rulings that the Trump administration did not appeal, it seems like the ABAs suit should be a lay down winner on the merits.

The challenge for the ABA may be getting to the merits, as they will first have to prove they have standing to bring the suit, as the video discusses.

Trump Lost in Case You Havent Heard About

Donald Trump just suffered a very important legal loss in a case you probably havent heard about, a prosecutor said.


Former federal prosecutor Joyce Vance published a Substack piece dated for Friday, highlighting the crucial legal matter and explaining how it will impact the president.

'I want to focus on a case you probably havent heard about, California v. Department of Transportation. It was brought by Democratic state attorneys general from across the country in the District of Rhode Island, Vance wrote, adding that, District Judge John McConnell, Jr., dealt the Trump administration a major loss in the case, which will stymie its efforts to coerce states into supporting its immigration policies.'


The Judge entered a preliminary injunction that prevents the administration from withholding Department of Transportation funding from states that refuse to help the administration enforce its interpretation of immigration laws.


According to the attorney, in April, Trumps Transportation Secretary, Sean Duffy, issued the Duffy directive, which requires states that are recipients of transportation grants to cooperate with Immigration and Customs Enforcement ICE operations.

In the new order, she said, Judge McConnell ordered the administration to stop enforcing the IEC and prohibited it from withholding or terminating federal funding on that basis.

Of course, the Trump administration is free to and undoubtedly will appeal the injunction, the analyst added.

But Judge McConnell specifically noted that the court will retain jurisdiction to monitor the Trump administrations compliance with this preliminary injunction. The Judge also denied the administrations request to stay this Order





The Judges, even those he appointed, just keep on stuffing Trump at every sneaky turn he tries to overcome their decisions ....and the poor old American tax payers foot his EXORBITANT legal bills

Writer E. Jean Carroll sued Donald Trump twice in federal court, and juries ruled against him both times. The first verdict, in May 2023, held Trump liable for sexual abuse and defamation and awarded Carroll $5 million.


The second, in January 2024, addressed only defamation from earlier statements and resulted in an $83.3 million award. Both verdicts survived appeal at the Second Circuit, and as of early 2026, Trumps petition asking the Supreme Court to review the case remains pending.


The Allegation and Trumps Response







The Westfall Act Delay

In September 2020, the Department of Justice intervened and tried to substitute the United States as the defendant in place of Trump personally. The government argued that Trumps statements fell within the scope of his duties as president, invoking the Westfall Act, a federal law that shields government employees from personal liability for actions taken while doing their jobs. If this argument had succeeded, Carrolls defamation claim would have been dismissed because the federal government cannot be sued for defamation.

Judge Lewis Kaplan rejected this move in October 2020. He concluded that the president was not an employee of the Government as that term is defined in the relevant statute, and that even if he were, publicly attacking a private citizens sexual assault allegation was not the kind of work the federal government employs anyone to do. The case ping ponged through the appellate courts for years while this issue was litigated, keeping the first lawsuit frozen.


Carrolls lawyers argued that Trumps 2019 denials had inflicted severe reputational harm and invited a wave of public harassment and death threats that fundamentally changed her life. After hearing testimony on the extent of this damage, the jury returned its verdict on January 26, 2024. They awarded Carroll $83.3 million in total damages

Compensatory damages: $18.3 million, including $11 million earmarked for repairing Carroll?s public reputation and $7.3 million for other harm
Punitive damages $65 million, intended to punish the conduct and discourage similar behavior




Supreme Court Review and Current Status


Trump filed a petition asking the Supreme Court to review the case on November 10, 2025. The petition has been distributed for conference multiple times since early 2026 but as of spring 2026, the Court has not acted on it. The repeated redistribution is not unusual for high-profile petitions; the Court sometimes relists cases for several conferences before issuing a final decision to grant or deny review.

Under federal law, post-judgment interest accrues on civil judgments from the date they are entered, calculated at a rate tied to the one-year Treasury yield for the week before the judgment was entered.9 If the Supreme Court declines to hear the case, the combined judgments of approximately $88.3 million plus accumulated interest would become immediately enforceable.


Hes busy

It is deeply damaging to the fabric of our Republic for President Trump, in the midst of a historic presidency, to have to take his focus away from his singular and unique duties as Chief Executive to continue fighting against decadesold, false allegations and the myriad wrongs throughout this baseless case, his lawyers wrote in their final filing before the high court decides as soon as this month whether to hear Trumps appeal.

This mistreatment of a President cannot be allowed to stand.

Trump is in a league of his own

The extent to which Trump has relied on defamation and other civil lawsuits is unprecedented, according to William & Mary Law School professor Timothy Zick.

No other political candidate or president has wielded the civil lawsuit as a political sword quite as Trump has, Zick recently wrote. When it comes to civil litigation, Trump is in a league of his own.





Trump was already famous for his legal skirmishes over everything from his golf courses to his tax bills to Trump University before his first term as president.
