Donald Trump is planning an assault on the American justice system should he win re-election to the White House
He would seek to destroy the independence of the justice department and turn it into an attack machine for his Make American great again (Maga) movement. At the heart of his plans is the desire to impose his will on the individual prosecutorial decisions taken by the Department of Justice. The move, if successful, would end half a century of accepted practice that prevents presidents from politically interfering with specific cases.
It would allow Trump in his second term to eradicate the federal prosecutions currently being pursued against him as well as against insurrectionists who stormed the US Capitol on 6 January 2021 whom he has championed as “hostages”.
It would also free him to instigate legal investigations as acts of revenge against his perceived political enemies, including Joe Biden and family.
“I will appoint a real special prosecutor to go after the most corrupt president in the history of the United States of America, Joe Biden, and the entire Biden crime family,” Trump said last year.
No evidence has been presented linking Biden to any crime, though his son Hunter Biden did go on trial on Monday accused of falsifying a firearms license application.
Trump repeated the threat that he use the justice system to go after his opponents on Tuesday, telling Newsmax that the prosecutions against him had set a “terrible precedent” that he implied he would turn against Democrats should he win in November. “It’s a terrible, terrible path that they’re leading us to, and it’s very possible that it’s gonna have to happen to them.”
In his first White House term, Trump made clear that he aspired to total control of the DoJ. He failed in that attempt, largely because of the resistance of top justice officials.
Trump’s determination to overcome the norm is now much more advanced than it was four years ago. His disdain for the fundamental building blocks of the justice system was on full display following his New York conviction last week on 34 counts of falsifying business records to cover up an affair with the adult actor Stormy Daniels.
In comments widely echoed by senior Republicans, Trump denounced the trial as “rigged” – an echo of his false claim that the 2020 presidential election was stolen from him.
“His message is that whenever anything comes out in a way that isn’t positive for me, it’s illegitimate,” said Rebecca Roiphe, a law professor at New York Law School. “If people start to believe that, then really, you don’t have any rule of law.”
Independence and impartiality were baked into the justice department in the wake of Richard Nixon’s abuses in the 1970s Watergate scandal, ensuring that while presidents can appoint the attorney general who heads the DoJ, as well as set general law enforcement priorities, they cannot influence individual cases.

That norm has held steady for 50 years, but it remains vulnerable to attack. Roiphe co-authored a study into whether presidents can control the justice department, concluding that while DoJ independence has become a cornerstone of American democracy, it is not so secure that “it couldn’t be dismantled by a president who was firmly committed to doing so”.
Trump allies have been busy in recent months in laying down legal arguments for why he should be permitted to wield absolute power over federal legal decisions. The most significant work has been done by Jeff Clark on behalf of the Center for Renewing America, the rightwing thinktank led by Russ Vought.
Vought, Trump’s former budget director, is considered a contender for White House chief of staff in a second term. He is a central participant in Project 2025, a mammoth effort by a coalition of rightwing groups to prepare a blueprint for a renewed Trump presidency.
In an article titled “The US Justice Department Is Not Independent”, Clark argues that the practice of avoiding direct contact between the White House and the attorney general that has pertained since the Carter administration must be swept away. “Under the constitutional system as it stands, DoJ independence does not exist,” he wrote.
This quasi legal doctrine has been dubbed the “unitary executive theory”, signifying the sole power of the president over all federal government affairs.
Clark was at the center of Trump’s most egregious attempt to seize control of DoJ decision-making during his first term. In January 2021, at the climax of the “stop the steal” campaign, Trump tried to make Clark acting attorney general in place of Jeffrey Rosen who was refusing to play along with his election denial conspiracy.
Clark, a relatively unknown justice official, was only stopped after several senior DoJ officials threatened to resign.
He has written the roadmap that would allow Trump to demand a halt to the federal prosecution for his role in January 6 in which Clark himself is an unnamed co-conspirator.
As Steve Bannon, Trump’s former chief White House strategist, put it on his War Room podcast, the DoJ would be purged and restructured to “get rid of lots of personnel”.
A key early move would be choosing an attorney general open to the idea of the unitary executive theory. Problems with senate confirmation, which is designed as a check on presidential power, could be overcome at least in the short term by appointing an acting attorney general who can operate without congressional approval.
Early moves on the part of the new attorney general would include dismissing the current special counsel Jack Smith. That in turn would pave the way for the termination of Smith’s two federal prosecutions against Trump – the January 6 case and the charges relating to Trump’s hoarding of confidential documents at his Mar-a-Lago resort.
The former president has also proposed forming a taskforce to review the cases of what he has called “every political prisoner who has been unjustly persecuted by the Biden administration”. The trawl would likely be directed at pardoning January 6 rioters.
Trump has indicated that he would deploy prosecutorial powers against Democratic foes, but he also has Republicans in his sights.
The Washington Post reported that in private he has expressed a desire for revenge even against leading figures in his first administration who have since become critics. They include his former chief of staff John Kelly, former attorney general Bill Barr and ex-attorney Ty Cobb.
Roiphe said that the structure of the criminal justice system, including grand juries and trial procedures, would stand in the way of any attempt to prosecute innocent people. But she warned of the possible corrosion of faith in the system that could ensue, with potentially dire long-term consequences.
“That’s what happens in authoritarian states – there is a semblance of a legal system, but it becomes useless,” she said. “If that happens here it would be extremely troubling. We’re not there yet. But I do think a second term could cause significant damage that may or may not be permanent.”

This message comes about one month before Trump is slated to be sentenced in Manhattan criminal court on 34 charges of falsifying business records to conceal hush money paid to adult film star Stormy Daniels ahead of the 2016 presidential election.
It remains unclear if Justice Juan Merchan will sentence the presumptive Republican nominee in the upcoming presidential election to serve time in prison.
Falsifying business records is a class E felony which does not require jail time and, coincidentally, caps sentencing to the length of a presidential term: four years.
The guillotine — the notorious execution device that loomed over the French Revolution and removed the heads of Louis XVI and Marie Antoinette — does not appear in New York state's penal code.
It does appear in a Rolling Stone report from February 2023 in which anonymous sources say Trump had discussed with his staff the possibility of firing squads, mass executions and guillotines.
When Trump's campaign message hit social media Wednesday, Acosta's followers professed themselves stunned. An order of nuns is fighting back after a Trump operative accused its monastery of being at the center of a scheme to defraud the election in Pennsylvania. LIAR Republican Cliff Maloney publicly stated that the home of the Benedictine Sisters of Erie in Pennsylvania had dozens of voter registrations ? yet nobody lived there.
In reality, 55 sisters live there full time ? and 53 of them are legally registered to vote.
?To be unjustly accused of voter fraud is just really disgusting, ugly,? Sister Stephanie Schmidt, the order?s prioress, told The Washington Post.
?A simple web search would alert him to our active presence in a number of ministries in Erie.?
Maloney had posted to nearly 58,000 followers on X that the monastery was an empty building that was being used for fraud.
He said his army of canvassers had ?discovered? it when they knocked at the door. ?NO ONE lives there,? he exclaimed.
Schmidt said she immediately started receiving complaints from across the country.
?If you?re not a critical thinker, you could just say, ?Oh, look at that. There?s these sisters trying to get away with a scam,?? Schmidt, 72, said.
?We have to be careful of what we believe. We have to do our homework.?
Maloney still refused to be convinced that the registered votes were legal.
?If we confirm that, great, I encourage them to vote,? he told The Post Wednesday. ?If we don?t confirm that, we?ll look at the next step to take to make sure that only legal votes are cast.?
He said his accusations came after a door-knocker arrived at the monastery and reported, ?I had a hard time because all I kept seeing was a church but no house.?

?We do take issue with claiming false information as true in an effort to discredit differing views or affiliations,? the order said in a statement.
?We want to be on public record as having called out this fraud so that if the outcome of next month?s election is contested in Pennsylvania our integrity will not be called into question.?
Schmidt said ?each sister votes her conscience? and, though the order commits to?working for peace and justice, especially for the rights of women and children, and the climate crisis,? it is not aligned to any party.
?Glad they put the statement out,? Maloney said. ?I respect that, but we?re going to dive a little deeper, confirm that that?s correct.?
Schmidt said the sisters are planning legal action.

Trump has told several campaign aides that hes furious with his senior advisor Chris LaCivita and plans to sever ties with him as soon as the election is over.
LaCivita is one of two aides considered to be in charge of running Trumps campaign to become president.
But a report last month by the Daily Beast claimed LaCivita is raking in cash from the campaign, with several deals reportedly paying him $22 million in just two years.

Relationship between the two has become tense, and was worsened by LaCivitas liking of a tweet that called for Trump to be removed for insurrection.

It wasn?t the urging of multiple allies or her history of blatantly racist comments that got controversial right-wing influencer Laura Loomer booted from Donald Trumps campaign, according to a new report.
Loomer sparked panic among many of the former presidents friends, allies and donors as she was seen several times accompanying him on his campaign trail in early September.
But it wasnt their urgings that he stop their association with her that convinced him, wrote Tim Alberta for The Atlantic Saturday.
Nor was it her history of highly offensive comments, many of which were read to Trump by his aides after he was seen with her at a 9/11 ceremony at Ground Zero, Alberta reported. Among those comments were that 9/11 was an inside job and that she was a proud Islamophobe.
What sealed Loomers fate, according to two people who were part of these conversations, wasnt just her racist diatribes but also her appearance, wrote Alberta.
Trump, who is generally appalled by plastic surgery, was disgusted to learn about the apparent extent of Loomers facial alterations. Claims Loomer has undergone several surgeries to alter her appearance.

A group of anti-government extremists who showed up in western North Carolina promising to provide disaster relief after Hurricane Helene is now threatening to destroy cell-phone towers and sabotage military vehicles. The group, Veterans on Patrol, attracted attention by setting up a disaster relief staging area in the parking lot of the Ingles grocery store in Lake Lure, about 50 miles from Asheville.
But locals, including some who initially cooperated with the group, began to complain about threats and harassment.
Over the past three weeks, members of the group, which falsely claims that Helene was caused by a weather weapon,have been making conspiracy-driven claims that the U.S. military is attempting to kill U.S. citizens with directed energy weapons.
Veterans on Patrols channel on the encrypted social-media platform Telegram posted a message on Thursday displaying photos of what appears to be a cell tower on a mountaintop.
The message asserted that locals are in Live Exercises where the United States Military is permitted to destroy your homes, bodies and minds, while suggesting that equipment on the tower is solely for providing the U.S. military the means to murder Americans.
Focus on tearing down their weapons, the message reads. It continues, All it takes is one weapon tower being toppled with the stated reason spoken boldly.
Another message posted in the groups Telegram channel appears to advocate for sabotaging military vehicles and assets.
Simple acts of pouring sugar into fuel tanks of military equipment, backup power systems, and personal vehicles of military personnel can wreak havoc on those who murdered all these people out here, reads the message, which was posted on Wednesday.
Soldiers from Fort Liberty and Fort Campbell have deployed to western North Carolina to assist in the disaster response, along with National Guard members from nine states.
Veterans on Patrol is led by Michael Lewis Arthur Meyer, who has a long history of anti-government extremism, dating back at least 10 years. Meyer, according to the extremism watchdog group Southern Poverty Law Center, is not a veteran. The Oct. 22 post claimed that stolen elections are a real phenomenon, along with weather weapons,Satanic pedophiles and adrenochrome," which refers to a QAnon conspiracy theory that a cabal of elites tortures children to extract a chemical from their bodies which is then used as a recreational drug.
In another post last week, a Veterans on Patrol member nicknamed Shepherd claimed that the U.S. Air Force command is instructing pilots to deploy additional weather weapons.The post goes on to say, These people dont have 2 weeks to wait for vote and 3 months to hopefully wait for a Regime change.
Meyer founded Veterans on Patrol in Arizona in 2015, according to the Southern Poverty Law Center. Prior to presenting itself as a disaster response group in the aftermath of Helene, Veterans on Patrol has claimed its efforts were directed towards rescuing children from sex trafficking, addressing veteran suicide and dubious claims that the military is maliciously harming civilians.
In 2018, was arrested by the police in Tucson, Ariz. for trespassing and an outstanding warrant for an assault charge, after occupying a tower on an industrial property. A press release from the Tucson Police Department claimed that Meyer found an abandoned homeless encampment on the property, and fictitiously declared, without evidence or corroboration, that the area was the site of a sex-trafficking ring.
In the summer of 2024, before Hurricane Helene, Veterans on Patrol was active in Spokane, Wash. In Telegram message from July 2, 2024, Veterans on Patrol announced to the police that it would no longer be safe for one of its officers to work his beat. The channel also posted the home addresses of city council members.

Trump abruptly fired the air force general CQ Brown Jr as chair of the joint chiefs of staff on Friday, sidelining a history-making Black fighter pilot and respected officer as part of a campaign to purge the military of leaders who support diversity and equity in the ranks.
The ouster of the second Black general to serve as chair of the joint chiefs comes three months after Pete Hegseth, the secretary of defense, outlined a plan for ridding the US military of diversity, equity and inclusion efforts during a podcast interview.
First of all, you've got to fire the chairman of the joint chiefs, Hegseth said during a November interview on the Shawn Ryan Show. Any general that was involved, general, admiral, or whatever, that was involved in any of that DEI woke **** has got to go.
Although Hegseth had been meeting regularly with Brown since the former Fox News host took over the top Pentagon job last month, he had openly questioned whether Brown had been named chair because he was Black.
Was it because of his skin color? Or his skill? We'll never know, but always doubt which on its face seems unfair to CQ. But since he has made the race card one of his biggest calling cards, it doesnt really much matter, Hegseth wrote in one of his books.
Brown had been praised, including by Time, for breaking racial barriers in the military and for his warfighter credentials. When he was sworn in as the air force chief of staff in 2020, during the first Trump administration, Brown acknowledged previous US military service members who had been denied advancement because of their race, Time reported. It is due to their trials and tribulations in breaking barriers that I can address you today as the air force chief of staff, Brown said.
In 2020, Trump himself had celebrated Browns confirmation on social media as the USAs first ever African American military service chief and noted that he had appointed him to that role. Browns experience as the former commander of Pacific air forces also meant he was highly qualified to deter China and reassure allies in the Indo-Pacific, Time noted that year.

The Financial Times reports that Navarro has recently floated kicking Canada out of the Five Eyes intelligence sharing program that also includes the United Kingdom, Australia, and New Zealand.
Removing Canada from Five Eyes would mark a dramatic escalation in the current feud between the United States and Canada and would likely permanently damage relations between the two nations for years to come.
Formed during the Cold War, the alliance facilitates the exchange of sensitive intelligence and security information among its member countries to enhance national security and counter global threats.
It is unclear how Navarro would succeed in this measure given that the other nations who participate in the program would surely object.
Shashank Joshi, The Economists defense editor, writes on X that the Financial Times reporting backs up other things he had heard about Navarros intentions.

It does not say how many lawyers at the law firm which did not immediately respond to a written request for comment, might have such a clearance.
A spokesperson for the firm said: We have reviewed the Executive Order. It is patently unlawful, and we intend to challenge it.

Trump issued an executive order punishing a law firm he doesnt like, prohibiting the firms attorneys from interacting with federal agencies and even from entering federal buildings.
On Wednesday, U.S. District Judge Beryl Howell temporarily blocked enforcement of the challenged sections of the executive order. Judge Howell stated that the order appeared to be an unconstitutional act of retaliation and likened it to a bill of attainder. She emphasized that the executive order could have a chilling effect on the legal profession by intimidating lawyers from representing clients disfavored by the President.
The courts ruling freezes portions of the executive order, including provisions that restrict Perkins Coie personnel from entering federal buildings and require government contractors to disclose business with the firm. The lawsuit and the temporary restraining order highlight the ongoing legal battle between Perkins Coie and the Trump administration over issues of constitutional rights and the independence of the legal profession.
In ruling against Trump and in favour of the law firm, Judge Howell said:

Its not the first time Trump has activated the National Guard to quell protests.
In 2020, he asked governors of several states to send troops to Washington, D.C. to respond to demonstrations that arose after George Floyd was killed by Minneapolis police officers.
This time, however, Trump is acting in OPPOSITION to Gov Newsom, who under normal circumstances would retain control and command of Californias National Guard.
While Trump said that federalizing the troops was necessary to address the lawlessness in California, the Democratic governor said the move was purposely inflammatory and will only escalate tensions.
Generally, federal military forces are not allowed to carry out civilian law enforcement duties against U.S. citizens except in times of emergency.
An 18th century wartime law called the Insurrection Act is the main legal mechanism that a president can use to activate the military or National Guard during times of rebellion or unrest. But Trump didnt invoke the Insurrection Act on Saturday.
Instead, he relied on a similar federal law that allows the president to federalize National Guard troops under certain circumstances.
The National Guard is a hybrid entity that serves both state and federal interests. Often it operates under state command and control, using state funding. Sometimes National Guard troops will be assigned by their state to serve federal missions, remaining under state command but using federal funding.
The law cited by Trumps proclamation places National Guard troops under federal command. The law says that can be done under three circumstances.. When the U.S. is invaded or in danger of invasion; when there is a rebellion or danger of rebellion against the authority of the U.S. government, or when the President is unable to execute the laws of the United States, with regular forces.
But the law also says that orders for those purposes shall be issued through the governors of the States.
Notably, Trumps proclamation says the National Guard troops will play a supporting role by protecting ICE officers as they enforce the law, rather than having the troops perform law enforcement work.
The Insurrection Act and related laws were used during the Civil Rights era to protect activists and students desegregating schools. President Dwight Eisenhower sent the 101st Airborne to Little Rock, Arkansas, to protect Black students integrating Central High School after that states governor activated the National Guard to keep the students out.
George H.W. Bush used the Insurrection Act to respond to riots in Los Angeles in 1992 after the acquittal of white police officers who were videotaped beating Black motorist Rodney King.

A federal judge ruled Donald Trump illegally deployed the California national guard to suppress protests against immigration raids in Los Angeles and ordered the force to be returned to the control of the state governor, Gavin Newsom.
The order by the US District Judge Charles Breyer, a former Watergate prosecutor,marked a major defeat for the Trump administration although it was paused by a three judge panel at the US court of appeals for the ninth circuit while they assess the case.
Regardless of whether the appeals court upholds Breyers ruling after its emergency hearing set for 17 June over Zoom, the matter is certain to become a pitched legal and political battle destined to reach the US supreme court.
In issuing a temporary restraining order against Trump, Breyer found the president had failed to show there was a rebellion in Los Angeles that required him to federalize the guard and failed to comply with the procedural steps to notify the governor.
His actions were illegal both exceeding the scope of his statutory authority and violating the Tenth Amendment to the United States Constitution. He must therefore return control of the California National Guard to the Governor, Breyer wrote.
The request for the injunction is part of a lawsuit filed by the state of California challenging Trumps move to call up more than 4,000 national guard troops and about 700 active duty marines based in Twentynine Palms, California, over Newsoms objections.
Our success today in court is a win for all Americans, Newsom said in a statement shortly after the order. The presidents action to turn the military against its own citizens threatened our democracy and moved us dangerously close to authoritarianism.
The decision came hours after a hearing in federal district court in San Francisco where the justice department argued Trump had the sole and unreviewable power to decide whether there was a rebellion that needed federal intervention.
Breyer rejected both arguments in his sweeping 36 page opinion, effectively rebuking the justice department for trying to suggest the conditions to take control of the guard had been met as long as Trump had decided himself that was the case.
The presidents discretion in what to do next does not mean that the president can unilaterally and without judicial review declare that a vacancy exists in order to fill it. That is classic ipse dixit, Breyer wrote, adding that the definition of rebellion had clearly not been met.
Breyer was also skepticalof the justice departments contention that Trump had followed the procedural step of ordering the guard through the governor by only directly notifying the adjutant general of the California national guard, to whom Newsom had delegated authority.
Regardless of whether Defendants gave Governor Newsom an opportunity to consult with them or consent to the federalization of Californias National Guard, they did NOT issue their orders through him, Breyer wrote

Trumps directive, issued in conjunction with an unprecedented military deployment on domestic soil, literally invited federal troops to commit felonious assault on American citizens. Because such a blatantly illegal and unconstitutional directive falls outside Trumps preclusive constitutional authority as defined in Trump v. United States, he will find no presumptive immunity for the bloodshed he causes.
A presidents role as Commander in Chief of the U.S. military falls under his exclusive constitutional authority, but encouraging soldiers to execute American citizens would not fall within this authority because it is patently unlawful.
A president enjoys broad authority to direct the military with very few limitations, but one such limitation is that his orders may not contravene the Constitution or the laws of the United States.
Although the line between official and unofficial conduct requires further legal analysis, there is no immunity shield for blatantly unconstitutional acts, and there never will be. If Trump hadnt traded competent legal advisors for bobble headed Fox News sycophants, counsel would have told him that by now.
Despite lamentations from the dissent, the Roberts Courts immunity ruling did not license Trump to commit murder. While Trump would argue that he has unchecked authority to declare bogus national emergencies, even under Justice John Roberts unitary executive license, Trump is only presumptively immune for actions taken in pursuit of his constitutional role as president.
Article II of the Constitution vests the president with the duty to take Care that the Laws be faithfully executed, and to preserve, protect and defend the Constitution. Encouraging federal troops to assault, physically abuse, or murder citizens is not an act to faithfully execute the laws, it is the opposite.
Under the Constitution, no one in the national government including Trump may deprive another of life, liberty, or property, without due process of law. A presidential command to dismantle this constitutional protection could never, even under Roberts permissive structure, be deemed a core constitutional function cloaked in immunity.
In Trump v. United States, the Court made very limited factual findings. Instead of addressing how Trump assembled and incited the January 6 mob to violence, the court basically only ruled that the president was immune on charges related to Justice Department communications, not for the violent acts that followed.
The court did not rule that Trump could organize a mob to attack the capital, or that Trump could murder his political adversaries, racial minorities, or members of the opposing political party. Post immunity, Trumps executive power still remains subject to constitutional constraints.
What Trump is doing to incite political violence under his maximalist approach to power will produce both predictable and unpredictable results.
Along with offering signing bonuses of $50,000, and student loan forgiveness of $60,000, ICE is now recruiting Trump loyalists to join the fun in deporting illegals with your absolute boys directly tapping MAGAs thirst for aggression.
The most violent day in our capitals recent history was January 6, 2021. On that date, Trump lied about the outcome of the 2020 election to incite mass violence. This year, he's lying about a crime wave in D.C., a migrant invasion in LA, and other manufactured emergencies to incite mass violence.
Five people died from Trumps three hour attack on J6, and those cases are still pending.
