Maurice Hastings: US Man in Prison For 38 Years FREED by New DNA Evidence
A US man who spent nearly four decades in prison for murder has been released after new DNA evidence pointed to a different person. BBC News 30 OCT 2022. ![]() Maurice Hastings served more than 38 years in state prison for the 1983 murder of Roberta Wydermyer in California and two attempted murders. But new DNA evidence instead pointed to another man who died in prison in 2020. Now 69, Mr Hastings has been released from prison after his 1988 conviction was vacated on 20 October. LA County District Attorney George Gascón described his conviction as a "terrible injustice". "The justice system is not perfect, and when we learn of new evidence which causes us to lose confidence in a conviction, it is our obligation to act swiftly," he added in a statement. Roberta Wydermyer was found in the boot of her car with a single gunshot wound to the head in 1983. She had earlier been sexually assaulted. Mr Hastings was subsequently charged with murder and prosecutors sought the death penalty. After a hung jury, a second jury convicted him and he was sentenced in 1988 to life in state prison without the possibility of parole. At the time of the victim's autopsy, semen was detected in an oral swab. Mr Hastings had maintained his innocence from the moment he was arrested, but a request for DNA testing of the swab in 2000 was denied by the district attorney. Eventually he was able to put in a claim of innocence to the DA's Conviction Integrity Unit in 2021 and DNA testing in June found that the semen was not his. The DNA profile instead matched a man who had been convicted of an armed kidnapping where he placed his female victim in a trunk of a vehicle. Following a court hearing on 20 October to vacate his conviction, Mr Hastings told reporters he wasn't bitter and wanted to enjoy the rest of his life. "I prayed for many years that this day would come," the Associated Press quoted Mr Hastings as saying. "I am not pointing fingers; I am not standing up here a bitter man, but I just want to enjoy my life now while I have it."

Two officers from the Inglewood Police Department and an investigator from the Los Angeles District Attorneys office at the time were accused of setting up Hastings. Hastings consistently maintained his innocence, resulting in a protracted legal struggle. He languished in a California prison for 38 years, but has now been awarded $25 million. The settlement was finalised in August, with court documents released on Monday revealing the details. No amount of money could ever restore the 38 years of my life that were stolen from me, Hastings expressed in a statement. But this settlement is a welcome end to a very long road, and I look forward to moving on with my life. At the time of the victims post mortem examination, a sexual assault test was carried out, the district attorneys office noted. Biological samples from the assailant were retrieved. Hastings requested DNA testing of the evidence in 2000. The DAs office rejected the request. Hastings submitted a claim of innocence to the DAs Conviction Integrity Unit in 2021. The DNA testing revealed that the semen WASNT Hastings In 2022, at the age of 69, Hastings conviction was overturned at the request of prosecutors and his solicitors. The DNA was matched to an individual who had been convicted of a separate armed kidnapping and rape of a female victim who was placed in a vehicles boot, similar to Wydermyers killing. The suspect, Kenneth Packnett, was arrested within three weeks after the 1983 murder in connection with an unrelated car theft, Hastings solicitors said. Police discovered jewellery and a coin purse that matched Wydermyers belongings at the time of murder however Packnett wasnt investigated for her murder at the time. Paknett died in 2020, imprisoned on a separate sentence, according to prosecutors. In 2023 a California judge ruled that Hastings was factually innocent He now lives in Southern California, where he is an active member of his church, according to his barristers.
