Steven Avery (Image: Netflix) Top lawyer Ms Zellner has been acting on behalf of convicted murderer Avery, from Manitowoc County, Wisconsin, for the last few years. Teresa Halbach... She insists DNA testing of a pelvic bone, thought to belong to victim Teresa Halbach, would prove 56-year-old Avery's innocence. She believes it would show that the murder and mutilation did not happen at the Avery family's car lot, but instead was "planted" to "frame him." However, a damning letter she wrote has now been published revealing the transcript of a voicemail she claims was sent to her by mistake from State prosecutors about the pelvic bone. She has previously contacted them to confirm whether the State is in possession of it or whether it was returned to Ms Halbach's family. But she says her calls have gone unanswered. Now, in the letter dated February 13 and sent to the Court of Appeals of Wisconsin, she alleges Attorney Mark Williams inadvertently called her instead of Assistant Attorney General Thomas Fallon - in which he says 'not to respond' to her about the bone. She writes: "...as the attached transcript and CD illustrate, the State is trying to deceive undersigned counsel and this Court about the status of the pelvic bone, which was recovered in 2005 from the Manitowoc Gravel Pit." She goes on to reveal the message from Mr Williams. She states he said: "Hi Tom, this is Mark Williams. I'll send you an email later today, but I don't think we should do anything or respond to her at all until tomorrow, uh, when we look into the bag - and see exactly the pelvic bones are in there or not. "So I wouldn't respond until we look into the bag tomorrow morning and then we can talk about it before we send a response. Thanks a lot. Bye." Quote:
Avery was found guilty in 2007 (Image: Collect) Ms Zellner, who has one of the highest success rates for overturning wrongful convictions in the United States, believes this voicemail shows Mr Fallon has "misrepresented that the State was in possession of the human pelvic bone." Avery was arrested in 2005 on suspicion of murdering 25-year-old Ms Halbach, who vanished after visiting the Avery's Salvage Lot to photograph a car for Auto Trader magazine. He was found guilty in 2007 and sentenced to life imprisonment without possibility of parole, alongside nephew Brendan Dassey , now 29. Avery was initially imprisoned in 1985 for a sexual assault and attempted murder. Eighteen years into his 21-year sentence, new DNA evidence came to light which exonerated him. In 2003, Avery filed a $36 million civil suit against Manitowoc County, its former sheriff, and its former district attorney for wrongful conviction and imprisonment. In November 2005, with that case still pending, Avery was arrested for the murder of Ms Halbach, and in 2007 he was convicted and sentenced to life imprisonment without possibility of parole. Ms Zellner is confident that the new evidence she is bringing forward will be enough to free Avery, but adds that witness tips still continue to be invaluable even 13 years after the investigation began.
