A Brit dad-of-two is facing the death penalty in Iraq for collecting souvenirs during a geology tour.

Jim Fitton, 66, is being held in Iraq over smuggling allegations during his first visit to the country for a geology and archaeology tour.

The retired geologist made his initial appearance at a Baghdad court on Sunday, alongside German national Volker Waldmann, but the expected trial did not go ahead and was postponed till next Sunday to allow the defence more time to submit evidence.

Fitton's son in law Sam, 27, said the family, who are originally from Bath, were pleased the court seemed to be taking the seriously.

He said: "We had the initial hearing on Sunday where both charges were read and the cross-examination took place - but the rest of the trial was postponed till next week in order to allow us to admit more evidence for Jim's defence.

"It's hard to say it’s good news - we have been optimistic and been let down over and over again throughout this process.

"But we are certainly not disappointed with what happened yesterday - Jim was given the opportunity to defend himself and the court seems to be taking him seriously."

On the preliminary hearing on Sunday 15, Mr Fitton told judges he had not acted with criminal intent after collecting 12 stones, as he said he "suspected" the items he collected were ancient fragments, reveal local reports.

The OAP also collected shards of broken pottery while visiting a site in Eridu, in south east Iraq, and told the court: “at the time I didn’t know about Iraqi laws” or that taking the shards was not permitted.

Given his past profession, the court heard Fitton was in the habit of collecting such fragments as a hobby and had no intention of selling them on.

Responding to his claims, head judge Jaber Abdel Jabir said: “These places, in name and by definition, are ancient sites.

“One doesn’t have to say it is forbidden.”

Both Waldmann and Fitton could face the death penalty for their actions, however legal experts believe that is unlikely.

The case has gained interest in the UK, and was raised in the House of Commons by Bath MP Wera Hobhouse during an urgent question session last week.

Wera said in a statement: "Jim Fitton is potentially facing the death penalty.

"I urge the minister to do everything they can do to stop this nightmare before it turns into a tragedy."

"I'm afraid the government gives the impression they're not particularly interested or worried - ministerial engagement has been slow".

Jim Fitton currently resides in Malaysia with his wife Sarijah. His children - Joshua and Leila, and Leila’s husband Sam Tasker - have set up a petition to press the UK government to assist with the case, which has collected over 272,100 signatures.
