A financial analysis by Charity Intelligence Canada found Hockey Canada's board of directors approved the transfer of $17 million out a controversial reserve fund between 2016 and 2021.

A controversial reserve fund that Hockey Canada publicly vowed it would stop using to settle sexual assault allegations is significantly depleted after the organization transferred millions of dollars in past years to another account, a new interim report reveals.



Former Supreme Court justice Thomas Cromwell's interim report on Hockey Canada's governance, released last week, contains damning details about the organization's management of its National Equity Fund — a fund Cromwell said is projected be in deficit by 2023.

Hockey Canada commissioned Cromwell's review in response to hockey parents' outrage after learning that the National Equity Fund — made up in part of players' registration fees — was being used to pay out millions of dollars for sexual assault allegations without their knowledge.

Cromwell learned of the existence of a third fund to which Hockey Canada's board of directors approved the transfer of $10.25 million in reserve funds from the National Equity Fund (NEF) in 2016. Another financial analysis has found that at least another $7 million has been transferred from the NEF to the third fund since then.

The money was moved after Hockey Canada's auditors recommended a change to the organization's disclosure on its audited financial statements that "increased the reported balance of the National Equity Fund by several million dollars," Cromwell found.

Cromwell concluded that the organization's board of directors feared that an account with more money would attract more claims.

"Hockey Canada became concerned that this change on the financial statements inflated the NEF balance artificially, which might signal a large pool of funds set aside for potential claimants and thus might increase the likelihood of additional claims," Cromwell wrote in his report.

In November 2016, Hockey Canada's board of directors transferred the money from the NEF to another fund called the Insurance Rate Stabilization (IRS) Fund, which was created years earlier to "act as a buffer against future increases in insurance rates," the report said. The Athletic was the first to report on the new fund and the money transfers.

The board justified the transfer, saying it was a way to expand the scope of the IRS Fund "for the purpose of providing financial support against potential future non-insured claims," Cromwell's report said.

First Police Investigation of Junior Hockey Players in Sex Assault Case 'Cursory at Best,' Expert Says

Questions are being raised about how London police handled the allegations that members of the 2018 Canadian world junior hockey team participated in a group sexual assault at a downtown hotel.

When police in London, Ont., carried out two separate investigations into the 2018 sexual assault allegations that have rocked Hockey Canada, they examined the same series of events, but came to different conclusions.




The first investigation into allegations that members of the 2018 Canadian world junior team participated in a group sexual assault at a downtown hotel concluded in February 2019 that there weren't "reasonable grounds to believe sexual assault occurred."

Three years later, after the allegations became public, London police reopened their investigation.

According to documents filed in court, police now say they have reasonable grounds to believe five junior hockey players sexually assaulted a 20-year-old woman at the hotel.

Melanie Randall, a law professor at Western University in London and a legal expert on sexual assaults, says this about-face shows the original investigation was "cursory at best."

"Some of the things [the police are] looking into now clearly should have been looked into in 2018 and 2019," Randall told The Fifth Estate.

London police Chief Stephen Williams, who initiated the review of the first investigation, declined to comment.

"This remains an open and active investigation, therefore it is not appropriate for Chief Williams to speak to it at this time," a media representative for London police told The Fifth Estate.

The fallout of what is alleged to have happened in that hotel room five years ago still echoes across Canada.

Since the first news reports about the alleged sexual assault came out in May 2022, the board of directors and several managers of Hockey Canada have resigned. The organization's finances and policies have come under scrutiny.

A former National Hockey League player has been charged in Canada with sexual assault, his lawyer has confirmed, the latest development in a case that has brought turmoil to the sport’s Canadian governing body and angered many people

Ex-NHL player Alex Formenton turned himself in to London, Ontario, police Sunday in connection with an investigation into an alleged sexual assault on a woman by several members of the 2018 Canadian World Junior team that occurred more than five years ago.





Formenton’s legal team told The Associated Press that London Police have charged their client and several other players, but did not reveal what charge Formenton was facing.

“Alex will vigorously defend his innocence and asks that people not rush to judgment without hearing all of the evidence,” Formenton’s attorney Daniel Brown said in a statement.

Last week, Formenton and four NHL players from Team Canada’s 2018 World Junior roster were placed on leave, including Devils players Michael McLeod and Cal Foote (no reasons specified), Flames forward Dillon Dubé (mental health reasons) and Flyers goalie Carter Hart (no reasons specified).

In a post on X (formerly Twitter) on Sunday evening, TSN investigative reporter Rick Westhead said that “Several criminal lawyers who specialize in sexual assault cases have told me over the past days they expected former 2018 World Juniors players facing prosecution for an alleged sex assault in London, Ont., might face charges of gang sexual assault and forceable confinement.”

Brown also declined to specify charges when speaking with Westhead, but he said his client has not been charged with gang sexual assault or forceable confinement.

“If Formenton has been charged with common sexual assault, he faces a maximum 10 years in prison if he’s found guilty,” Westhead added. “People convicted of gang sexual assault face a maximum of 14 years. (Toronto lawyer Alison Craig told me it’s not uncommon for sexual assault charges to be upgraded after they are laid.)”

London Police scheduled a news conference for Feb. 5 to address the situation but have declined to comment further.




The 24-year-old Formenton played for the Ottawa Senators from the 2017-18 season through 2021-22. His contract was not renewed, which forced him to play in Switzerland.
