Paedophiles Use Secret Facebook Groups to Swap Images

Paedophiles are using secret groups on Facebook to post and swap obscene images of children, the BBC has found.

Children's Commissioner for England Anne Longfield said Facebook was not doing enough to police the groups and protect children.

Facebook's head of public policy told the BBC he was committed to removing "content that shouldn't be there".

A BBC investigation found a number of secret groups, created by and run for men with a sexual interest in children, including one being administered by a convicted paedophile who was still on the sex offenders' register.


The groups have names that give a clear indication of their content and contain pornographic and highly suggestive images, many purporting to be of children. They also have sexually explicit comments posted by users.

We found pages specialising in pictures of girls in school uniform - accompanied by obscene posts.

Images appeared to be stolen from newspapers, blogs and even clothing catalogues, while some were photographs taken secretly, and up close, in public places. One user had even posted a video of a children's dance show.


How do Facebook groups work?

Secret groups cannot be found using the search facility and only members can see what content is inside them.
Only people invited by existing members can join the group.

The Internet Watch Foundation creates a list of web pages with child sexual abuse content and any found to be on Facebook groups are taken down automatically, Facebook says.

Any other material reported to the social network as inappropriate goes through an internal review procedure to check if it is in breach of their standards.

Facebook says it removes content that includes "solicitation of sexual material, any sexual content involving minors, threats to share intimate images and offers of sexual services".

We set up our own fake profile and managed to gain access to some of these groups.



Using Facebook's own reporting facility, we told the company about images and comments we thought were unacceptable.

In one secret group called "XXXXXXXXXXX",- (info. REMOVED), we found a picture of a girl in a vest, aged 10 or 11, accompanied by the words "yum yum".

Facebook responded that it did not breach "community standards" and the image stayed up.


In other secret groups we found pictures of children in highly sexualised poses. There were also innocent pictures stolen from other Facebook sites, school homepages and newspapers and most were accompanied with obscene posts. They also did not breach Facebook's community standards.


We reported a whole group too - called "XXXXXXXXXXX" - (info. REMOVED) with obscene content - and that did not get taken down either.


In total we reported 20 images. Users took some down themselves - Facebook removed four - leaving half still up.

We were so concerned about some material we found that we handed it over to the police. We also alerted both the Internet Watch Foundation and the National Crime Agency to the contents of our findings.


'My daughter's photos were shared by paedophiles'

Diane (not her real name) discovered innocent pictures of her daughter had been stolen from her own blog site. They were then posted on a site used by paedophiles and swapped by members, who also posted sexual comments about them.

She said: "I was horrified. Thinking that these innocent snapshots of my (then) 11-year-old daughter had become the subject of vile comments and disgusting exchanges between members of these groups was really upsetting.

"But equally upsetting is the fact that Facebook allows these secret groups to exist, unmonitored and unchecked, making them rife for abuse by paedophiles.

"There must be a duty of care to users to make sure that paedophiles can't hide on these secret groups, stealing and sharing images of children they find online."


Children's Commissioner for England Anne Longfield said: "I'm shocked those don't breach community standards, any parent or indeed child looking at those would know that they were not acceptable."

She said she did not believe Facebook was doing enough to protect children.
"I don't think at the moment, given what we know about the vulnerability of so many children to predators, that they are doing enough," she said.

Her view was echoed by former police commander Andy Baker, former deputy chief executive of the Child Exploitation and Online Protection Centre.
"I'm not on Facebook, and one of the reasons I'm not is because of what they don't do," he said.


'Network of opportunities'


He was especially concerned by the existence of secret groups.
"It just opens a complete network of opportunity to paedophiles, that's why these secret groups should not exist."

We asked Facebook for an interview but our request was refused, so we spoke to Rishi Saha, the company's head of public policy, at an event to mark safer internet day.

He told the BBC: "When it comes to specific groups I think it's really important that we investigate the groups, so if you're able to share the details of these groups with me then I can work with my colleagues who do the investigations on these and make sure we're investigating them and we're removing the content that shouldn't be there."

Mr Saha added that Facebook would "deal directly with law enforcement to make sure they're aware of these groups and follow the proper process".
"I think it's really important that we do that and I can give you that commitment that we're going to do that," he said.

A source told Reuters the information includes copies of advertisements and data about the buyers of the ads.

Facebook revealed it sold approximately $100,000 in political ads to 470 accounts and pages that were affiliated to each other and likely operated out of Russia. It has since shut down these fake accounts.


Another $50,000 was spent on 2,200 'potentially politically related' ads, likely by Russians.

On Wednesday Facebook disclosed it found some accounts were linked to the Internet Research Agency.

The Saint Petersburg, Russia-based agency is known as a 'troll farm' that churns out pro-Kremlin propaganda.


Ellen Weintraub, a member of the Federal Election Commission, said U.S. voters deserve to know where the ads are coming from and that the money behind them is legal.

'It is unlawful for foreign nationals to be spending money in connection with any federal, state or local election, directly or indirectly,' Weintraub said in a phone interview to Reuters.

Last week while former presidential candidate Hillary Clinton said last week that Facebook had a 'long way to go' in disclosing the extent of Russian interference.





Facebook admitted last week it found $100,000 of ads bought by pages that were affiliated to each other and likely operated out of Russia. Special counsel Robert Mueller is heading the investigation into Russian meddling in the US election


She told Rachel Maddow the company has 'just begun to own up. They have a long way to go before they get where they need to be.'

In response to those comments, a Facebook spokesman told Vanity Fair: 'We continue to investigate and will continue to work with the relevant investigative authorities.'

Facebook CEO Mark Zuckerberg has previously denied the social network's newsfeed played a role in influencing the 2016 election.

In April, Facebook implemented a button to tag news as fake. However, the effectiveness of this tagging is questionable according to a Yale study.

Pirate Facebook Held Liable for Copyright Infringing

Facebook Held Liable for Copyright Infringing ‘Links’ in Italy

Similar to other sites that rely on user-generated content, Facebook has to battle a constant stream of unauthorized copyright material.

When it comes to targeting infringement, Facebook has rolled out a few anti-piracy initiatives in recent years. The company has a “Rights Manager” tool that detects infringing material automatically. In addition, it also processes some takedown requests manually.


Not all of these notices result in a takedown. For a variety of reasons, Facebook may choose not to intervene. In Italy, this resulted in a drawn-out legal battle which has now come to a conclusion at the Court of Rome.

The case in question was filed by Mediaset, the media conglomerate founded by former Italian prime minister Silvio Berlusconi. Mediaset noticed that links to copyrighted clips of the cartoon “Kirarin Revolution” were posted on Facebook.

The actual content was hosted by YouTube, but Mediaset’s legal team went after Facebook instead. It asked the social network to remove the postings of a particular Facebook group, which were shared with derogatory comments about the people involved in the show.

This week the Court of Rome ruled that Facebook is indeed liable for failing to remove the copyright-infringing hyperlinks. The company was ordered to pay €9,000 in damages as a result. As Facebook is also held liable for defamation, the total damages add up to €35,000.

While the damages amount is not groundbreaking, for Mediaset this was a matter of principle.

TorrentFreak spoke to Mediaset lawyer Alessandro La Rosa, who handled the case together with colleagues at the Previti law firm. The Court of Rome’s order shows intermediaries such as Facebook can be held liable when they fail to respond in copyright infringement allegations.

“Despite Facebook’s role as a passive hosting provider, in this case, it’s obliged to take down and prevent access to illicit information uploaded on its website. The provider is expected to carry out its economic activity with the due diligence that’s reasonably expected to identify and prevent the reported illegal activities,” Mr. La Rosa tells us.

Mediaset sent the first notice regarding the infringing activity in 2010, but Facebook decided not to take any action at the time. Although the offensive group was identified, the takedown requests didn’t include a link to the infringing content, Facebook argued.

The Court considered this defense but concluded that a link to the infringing hyperlink isn’t necessary. Facebook was alerted to the group and the alleged activities and could have taken action based on this information.

“According to the Court, the identification of URL is only technical data which doesn’t coincide with the individual harmful content present on the platform, but only indicates the ‘place’ where this content is found and, therefore, isn’t an indispensable prerequisite for its identification,” Mr. La Rosa says.

It’s worth noting that Mediaset never attempted to remove the actual infringing clip from YouTube. Mediaset mostly wanted Facebook to deal with the Facebook group which posted the infringing material in a defamatory context.

Mediaset is happy with the outcome according to its legal team. Since the verdict is partly based on EU law, Mr. La Rosa believes that it will help other rightsholders to make a case against Facebook and similar platforms going forward.

Facebook is currently considering whether to file an appeal. The company can easily pay the damages, but it may be worried about the broader implications of the ruling.

“We are examining the decision of the Court of Rome,” a Facebook spokesperson told Adnkronos in response, adding that it takes the protection of copyright holders “very seriously”.

Facebook Sued Over Failure to Respond to DMCA Takedown Notices

Seattle-based artist Christopher Boffoli is no stranger when it comes to suing tech companies for aiding copyright infringement of his work.

Over the years he has filed lawsuits against Cloudflare, Twitter, Google, Pinterest, Imgur, and others. All these cases were eventually dismissed, presumably after both sides resolved the matter behind the scenes.

While no settlement details have been made public, it’s likely that the photographer has been getting something in return, as he filed a similar case this week. The latest target is yet another familiar Silicon Valley name: Facebook.

In a brief complaint filed at the District Court for the Western District of Washington, Boffoli accuses the social media platform of failing to remove copyright infringing photos. This, despite the claim that the photographer reported dozens of links to unauthorized copies of his work on Facebook between August and October of last year.

Facebook initially replied to these notices stating that the content had been removed, but that wasn’t the case. After more than three months, the pirated photos were still online, the complaint says.

“As late as January 9, 2020 — more than 100 days after receiving Boffoli’s first notice — Facebook had not removed or disabled access to the Infringing Content,” Boffoli’s attorney writes.

After the attorney alerted Facebook about the problem, the material was eventually removed last month. Apparently, it remained online all this time due to a technical error.

“On or about January 30, 2020, Facebook removed or disabled access to the Infringing Content only after communication from Boffoli’s attorney. Facebook admitted it failed to previously remove the material despite notice and stated that its failure to do so was due to a technical error,” the complaint explains.

By then it was already too late, however. Instead of accepting the error, Boffoli has now taken the matter to court where he demands actual or statutory damages for the copyright infringements. With at least four photos in the lawsuit, the potential damages are more than half a million dollars.

In addition, the photographer requests an injunction to prevent future copyright infringements and wants Facebook to destroy all copies that it has in its possession.

The timing of the notices is interesting as it coincides with another incident involving the photographer. Last September we reported that Facebook had removed one of our articles, which used a meme based on a public domain image of Boffoli.

The meme in question referenced the backlash after the photographer filed a lawsuit against Imgur in 2014. When that case was made public, someone responded by uploading 20,754 of his photos to The Pirate Bay. Ironically, Facebook did remove the image and the link to our article years later, even though it was clearly fair use.

That incident shows that Facebook did respond to takedown notices.

According to the new lawsuit, however, that wasn’t always the case.

Facebook to Pay $52m to Content Moderators Over PTSD

Facebook has agreed to pay $52m (Ł42m) to content moderators as compensation for mental health issues developed on the job.

The agreement settles a class-action lawsuit brought by the moderators, as first reported by The Verge.


Facebook said it is using both humans and artificial intelligence (AI) to detect posts that violate policies.

The social media giant has increased its use of AI to remove harmful content during the coronavirus lockdown.

In 2018, a group of US moderators hired by third-party companies to review content sued Facebook for failing to create a safe work environment.

The moderators alleged that reviewing violent and graphic images - sometimes of rape and suicide - for the social network had led to them developing post-traumatic stress disorder (PTSD).

The agreement, filed in court in California on Friday, settles that lawsuit. A judge is expected to sign off on the deal later this year.

The agreement covers moderators who worked in California, Arizona, Texas and Florida from 2015 until now. Each moderator, both former and current, will receive a minimum of $1,000, as well as additional funds if they are diagnosed with PTSD or related conditions. Around 11,250 moderators are eligible for compensation.

Facebook also agreed to roll out new tools designed to reduce the impact of viewing the harmful content.

A spokesperson for Facebook said the company was "committed to providing [moderators] additional support through this settlement and in the future".

Moderating the Lockdown


In January, Accenture, a third-party contractor that hires moderators for social media platforms including Facebook and YouTube, began asking workers to sign a form acknowledging they understood the job could lead to PTSD.

The agreement comes as Facebook looks for ways to bring more of its human reviewers back online after the coronavirus lockdown ends.

The company said many human reviewers were working from home, but some types of content could not be safely reviewed in that setting. Moderators who have not been able to review content from home have been paid, but are not working.

To offset the loss of human reviewers, Facebook boosted its use of AI to moderate the content instead.

In its fifth Community Standards Enforcement Report released on Tuesday, the social media giant said AI helped to proactively detect 90% of hate speech content.

AI has also been crucial in detecting harmful posts about the coronavirus. Facebook said in April that it was able to put warning labels on around 50 million posts that contained misleading information on the pandemic.

However, the technology does still struggle at times to recognise harmful content in video images. Human moderators can often better detect the nuances or wordplay in memes or video clips, allowing them to spot harmful content more easily.

Facebook says it is now developing a neural network called SimSearchNet that can detect nearly identical copies of images that contain false or misleading information.

According to the social media giant's chief technology officer Mike Schroepfer, this will human reviewers to focus on "new instances of misinformation", rather than looking at "near-identical variations" of images they have already reviewed.

Twitter for the first time took action against a series of tweets by Donald Trump, labeling them with a warning sign and providing a link to further information.

Since ascending to the US presidency, Trump has used his Twitter account to threaten a world leader with war, amplify racist misinformation by British hate figures and, as recently as Tuesday morning, spread a lie about the 2001 death of a congressional aide in order to smear a cable news pundit. Throughout it all, Twitter has remained steadfast in its refusal to censor the head of state, even going so far as to write a new policy to allow itself to leave up tweets by “world leaders” that violate its rules.

The company’s decision on Tuesday afternoon to affix labels to a series of Trump tweets about California’s election planning is the result of a new policy debuted on 11 May. They were applied – hours after the tweets initially went out – because Trump’s tweets violated Twitter’s “civic integrity policy”, a company spokeswoman confirmed, which bars users from “manipulating or interfering in elections or other civic processes”, such as by posting misleading information that could dissuade people from participating in an election.




Trump responded on Tuesday evening with a pair of tweets that repeated his false claims about voting and accused Twitter of “interfering in the 2020 Presidential Election”. “Twitter is completely stifling FREE SPEECH, and I, as President, will not allow it to happen!” he wrote. Federal law protects the rights of internet platforms to moderate the third-party speech they publish.

Trump’s tweets include numerous false statements about California’s plan to expand access to voting by mail in November due to the coronavirus outbreak. The tweets now feature a light blue exclamation point icon, with the message “Get the facts about mail-in ballots”. The alert label may not be visible when the tweets are embedded in another web page, such as below.

Clicking on the alert will link users to a “Twitter-curated page” that variously describes Trump’s claims as “unsubstantiated” and false. The Twitter page also aggregates tweets from a number of journalists and publications explaining why Trump’s statements are false.

Trump’s claims about California on Tuesday were blatantly wrong. The state is not sending a ballot to anyone who lives in the state but rather those registered there. Sam Mahood, a spokesman for the secretary of state, Alex Padilla, said in an email only active voters in the state would be mailed ballots.

As states prepare for an unprecedented surge in mail-in voting because of the Covid-19 pandemic, Trump has repeatedly made baseless claims that this will lead to fraud. Voter fraud is extremely rare and one analysis found just 143 convictions involving mail-in ballot fraud since 2000, representing 0.00006% of the ballots cast during that time period.

Trump, who voted by mail in Florida in March, has made it clear that he opposes any effort to make it easier to vote by mail for all eligible voters, including sending an absentee ballot application to all voters, a measure the Republican National Committee does not oppose. In March, he said Democratic efforts in Congress to expand mail-in voting would make it so “you’d never have a Republican elected in this country again”. Studies have shown neither Democrats nor Republicans benefit from a switch to a vote-by-mail system.

Trump also attacked efforts to increase mail-in voting in Michigan and Nevada last week. He falsely said Michigan was sending absentee ballots to all registered voters; in fact the state was only sending an absentee ballot application. Trump later deleted his tweet and reposted a new one accusing the secretary of state of unlawfully sending the applications, something the secretary of state says is well within her authority.

Trump’s campaign manager, Brad Parscale, lambasted Twitter’s decision in a statement, framing it as an attempt by “Silicon Valley” to “obstruct and interfere with President Trump getting his message through to voters”. Parscale also asserted that Twitter’s “clear political bias” was a reason that the Trump campaign pulled its advertising from Twitter “months ago”.

Twitter banned all political advertising in November 2019, more than six months ago. At the time, Parscale decried the global policy change as “another attempt by the left to silence Trump and conservatives”.

Experts on misinformation raised questions about whether Twitter’s measure would be effective. Mike Caulfield, head of the Digital Polarization Initiative of the American Democracy Project, noted that the “Get the facts” phrasing could further entrench misinformation with its “legitimizing tone”.

“Get the facts implies there is a debate where facts are being marshalled in evidence,” he wrote on Twitter. “It elevates the claim.”

Claire Wardle, the director of First Draft News, also questioned whether Twitter’s information page would be effective in changing any minds.

“If we are to consider the reasoning behind this, it’s not a belief that this will change anyone’s minds, it’s to provide necessary context to a tweet that should be taken down, but if they did that would lead to more conspiratorial thinking,” she said. “They’re stuck between a rock and hard place.”

US President Donald Trump will sign an executive order on social media firms on Thursday, the White House has said.

It comes after he threatened to shut down social media platforms he accused of stifling conservative voices.

The latest dispute flared on Tuesday after Twitter added fact-check links to his tweets for the first time.


The order's details have not been shared and it is unclear what regulatory steps the president can take without new laws passed by Congress.

The White House officials gave no further information when questioned by reporters who were travelling with Mr Trump on Air Force One on Wednesday.

Before leaving Washington for Florida to watch a space launch that was postponed due to bad weather, Mr Trump again accused Twitter and other social media of bias, without offering evidence.

Mr Trump also continued his criticism of social media platforms on Twitter, ending a tweet with: "Now they are going absolutely CRAZY. Stay Tuned!!!"

The long-running dispute between Mr Trump and social media companies flared up again on Tuesday when one of his posts was given a fact-check label by Twitter for the first time.

He had tweeted, without providing evidence: "There is NO WAY (ZERO!) that Mail-In Ballots will be anything less than substantially fraudulent."

Twitter added a warning label to the post and linked to a page that described the claims as "unsubstantiated".

On Wednesday Mr Trump threatened to "strongly regulate" or even "close down" social media platforms.

He tweeted to his more than 80 million followers that Republicans felt the platforms "totally silence conservatives" and that he would not allow this to happen. In an earlier tweet, he said that Twitter was "completely stifling free speech".

Twitter's chief executive Jack Dorsey responded to criticism of the platform's fact-checking policies in a series of posts, saying: "We'll continue to point out incorrect or disputed information about elections globally."

Mr Trump wrote a similar post on Facebook post about mail-in ballots on Tuesday, and no such warnings were applied.

In an interview with Fox News on Wednesday, Facebook's chief executive Mark Zuckerberg said censoring a social media platform would not be the "right reflex" for a government concerned about censorship. Fox said it would play its full interview with Mr Zuckerberg on Thursday.

Twitter has tightened its policies in recent years as it faced criticism that its hands-off approach was helping fake accounts and misinformation to thrive.

Some of America's biggest technology companies have also been accused of anti-competitive practices and violating their user's privacy. Apple, Google, Facebook and Amazon face antitrust probes by federal and state authorities and a US congressional panel.

Shares in both Twitter and Facebook fell in Wednesday's trading session in New York.

Facebook, Twitter and Google did not immediately reply to requests from the BBC for comment.

Donald Trump has fired a shot across the bows of “big tech” companies by signing an executive order that aims to narrow their protections from liability over the content posted on their services.



The move came as the US president stepped up his attacks against social media giants after Twitter fact-checked him for the first time over a false assertion that mail-in voting leads to widespread voter fraud.

The order has three main parts. First, it directs the Commerce Department to petition the Federal Communications Commission to open a proceeding on the scope of Section 230.

Second, it also allows the Federal Trade Commission to take complaints about political bias by tech companies, and to investigate them to see whether they’re moderating content in a way that ensures neutrality.

And finally, federal agencies would be required to review their spending on social media advertising, which some see as a financial warning to companies like Twitter and Facebook.

If the law is eventually changed, there could be considerable consequences on how companies get rid of abusive content from their platform.


However, critics said it was the president’s latest effort to spur controversy and create a distraction as the country passed the grim milestone of 101,000 deaths from Covid-19. The Trump administration has faced widespread accusations that it has mishandled the crisis.

“Currently, social media giants like Twitter received unprecedented viability shield based on the theory that they are a neutral platform, which they are not,” the US president said in the Oval Office on Thursday. “We are fed up with it. It is unfair, and it’s been very unfair.”

Under Section 230 of the Communications Decency Act, tech companies currently enjoy broad immunity from civil lawsuits stemming from what users post because they are treated as “platforms” rather than “publishers”.

Trump’s executive order is designed to pressure regulators, including the Federal Communications Commission and the Federal Trade Commission, to come up with new rules that would curtail that immunity. It is likely to face legal challenges.

As he prepared to sign the order, the president added: “They’ve had unchecked power to censor, restrict, edit, shape, hide, alter virtually any form of communication between private citizens or large public audiences.

“There is no precedent in American history for so small a number of corporations to control so large a sphere of human interaction.”

Twitter responded by calling the executive order a “reactionary and politicized approach to a landmark law” .

”#Section230 protects American innovation and freedom of expression, and it’s underpinned by democratic values,” the company said in a tweet. “Attempts to unilaterally erode it threaten the future of online speech and internet freedoms.

The move was welcomed by observers who argue that Facebook and Twitter should be held responsible for their content and subject to the same laws as the New York Times and other mainstream outlets.

But many in the business and technology sectors argue the order could curb freedom of speech on the internet and it conflicts with existing law – which only Congress, not the president - can change.

Matt Schruers, the president of the Computer and Communications Industry Association, told the Associated Press: “The irony that is lost here is that if these protections were to go away social media services would be far more aggressive in moderating content and terminating accounts. Our vibrant public sphere of discussion would devolve into nothing more than preapproved soundbites.”

Gary Shapiro, the president and chief executive of the Consumer Technology Association, said: “We oppose today’s unconstitutional, ill-considered executive order. The free speech protections in Section 230 of the Communications Decency Act are the legal underpinning of our vibrant US online economy and our nation’s global digital leadership.

“America’s internet companies lead the world and it is incredible that our own political leaders would seek to censor them for political purposes. These same politicians extensively advertise on them and just a few minutes online will reveal these platforms contain a multitude of political views.

“Section 230 protects these companies as well as any start-up website which hosts others’ speech – from community bulletin boards to social media sites to the Fox News comments section.”

The US Chamber of Commerce said in a statement: “We believe that free speech and the right to engage in commerce are foundational to the American free enterprise system.

“Regardless of the circumstances that led up to this, this is not how public policy is made in the United States. An executive order cannot be properly used to change federal law.”

Many sceptics regard Trump’s action as politically motivated ahead of the November election. He and other conservatives have long accused social media companies of liberal or pro-China bias, even as Twitter has this week allowed the president to tweet baseless conspiracy theories accusing a TV host of murder.

Ted Cruz, a Republican senator from Texas, said “big tech” can no longer go unchecked. “For too long, social media platforms like Twitter have hid behind their opaque algorithms and Section 230 immunity to target speech with which they disagree and advance their own political agendas,” he added.

“This doesn’t just stifle Americans’ free speech; it shapes what Americans see, hear, and ultimately think about the major issues facing our country, including how those issues should be addressed and who should be elected to address them.”

Brad Parscale, the Trump 2020 campaign manager, said on Thursday: “Social media has been allowed to operate unchecked for years while enjoying the protection of federal law.

“These Silicon Valley giants have set themselves up as the arbiters of truth, censoring or labeling posts they disagree with, but they have shown that they cannot be trusted to be honest and fair. We have known for a long time that social media companies have it in for conservatives in general and President Trump specifically.”

But, critics say, after Twitter’s intervention on Trump’s false claims about mail-in voting, the company merely became the latest convenient punchbag for him to cultivate victimhood, rile up his base – and deflect attention from the coronavirus pandemic death toll.

Ron Wyden, a Democratic senator from Oregon, warned: “Donald Trump’s order is plainly illegal. After driving our country into an economic and health care disaster, Trump is desperately trying to steal for himself the power of the courts and Congress to rewrite decades of settled law around Section 230. All for the ability to spread unfiltered lies.”

Facebook employees are staging a rebellion over Mark Zuckerberg’s refusal to act against Donald Trump, expressing their dissatisfaction with their boss on social media in a rare display of dissent from within the company.

Disagreement came from employees at all levels of the company, including some senior staff. Particular criticism was levelled at Zuckerberg’s personal decision to leave up the Facebook version of a tweet sent by Trump in which the president appeared to encourage police to shoot rioters. By contrast, Twitter hid the message behind a warning.

Andrew Crow, the head of design for Facebook’s Portal video-phone, tweeted: “Giving a platform to incite violence and spread disinformation is unacceptable, regardless who you are or if it’s newsworthy. I disagree with Mark’s position and will work to make change happen.”

Jason Stirman, a member of the company’s R&D team and the former chief executive of the “mental training” app Lucid, also posted on Twitter, saying: “I don’t know what to do, but I know doing nothing is not acceptable. I’m a FB employee that completely disagrees with Mark’s decision to do nothing about Trump’s recent posts, which clearly incite violence. I’m not alone inside of FB.

There isn’t a neutral position on racism.”

On Friday Zuckerberg said he disagreed with Twitter’s interpretation of Trump’s statement, which included the phrase: “When the looting starts, the shooting starts.” Where Twitter had read the statement as incitement – encouraging police to shoot at protesters – Zuckerberg said he read it as a warning to protesters that the police would be shooting at them.

The distinction meant that the post fell on the right side of Facebook’s rules, Zuckerberg said, and would not be removed.


“Personally, I have a visceral negative reaction to this kind of divisive and inflammatory rhetoric,” Zuckerberg added. “I disagree strongly with how the president spoke about this, but I believe people should be able to see this for themselves, because ultimately accountability for those in positions of power can only happen when their speech is scrutinised out in the open.”

The Facebook founder’s statement galvanised responses from within his organisation. “Mark is wrong, and I will endeavour in the loudest possible way to change his mind,” said Ryan Freitas, the director of product design for Facebook’s News Feed. Others who spoke out included the director of product management, Jason Toff, and the product designer Sara Zhang.

Some appealed to the company’s oversight board, a quasi-independent body that Facebook has funded to act as a “supreme court” capable of ruling on difficult questions around content moderation.
But on Saturday, the board said it would not be able to intervene in time, but was “working hard to set the board up to begin operating later this year”.


The number of Facebook employees complaining publicly is small in absolute terms – a fraction of the company’s 45,000 or so employees – but is a rare external display of dissatisfaction with the leadership of Zuckerberg, who controls 57.9% of the voting rights on Facebook’s board. The complaints are mirrored in internal discussions, according to reports in the New York Times and the Verge, where workers accused the company of applying its rules unevenly so as to avoid angering Trump.

Late on Sunday night, Zuckerberg committed a $10m donation from Facebook to groups working on racial justice.
“It’s clear Facebook also has more work to do to keep people safe and ensure our systems don’t amplify bias,” he said in a post to his Facebook page.
“I hope that as a country we can come together to understand all of the work that is still ahead and do what it takes to deliver justice – not just for families and communities that are grieving now, but for everyone who carries the burden of inequality.”

After years of relative quiet, it appears to have re-emerged in the wake of violent protests in Minneapolis over the death of George Floyd, promising to expose the "many crimes" of the city's police to the world.

However, it's not easy to pin down what, if anything, is genuinely the mysterious group's work.


Who are Anonymous?

The "hacktivist" collective has no face, and no leadership. Its tagline is simply "we are legion", referring to its allegedly large numbers of individuals.

Without any central command structure, anyone can claim to be a part of the group.

This also means that members can have wildly different priorities, and there is no single agenda.

But generally, they are activists, taking aim at those they accuse of misusing power. They do so in very public ways, such as hijacking websites or forcing them offline.

Their symbol is a Guy Fawkes mask, made famous by Alan Moore's graphic novel V for Vendetta, in which an anarchist revolutionary dons the mask to topple a corrupt fascist government.


What Actions Have They Taken?

Various forms of cyber-attack are being attributed to Anonymous in relation to the George Floyd protests.

First, the Minneapolis police department website was temporarily taken offline over the weekend in a suspected Distributed Denial of Service (DDoS) attack.

This is an unsophisticated but effective form of cyber-attack that floods a server with data until it can't keep up and stops working - in the same way that shopping websites can go offline when too many people flood it to snap up high-demand products.

A database of email addresses and passwords claiming to be hacked from the police department's system is also in circulation, and being linked to Anonymous.

However, there is no evidence that the police servers have been hacked and one researcher, Troy Hunt, says the credentials are likely to have been compiled from older data breaches.

A page on the website of a minor United Nations agency has been turned into a memorial for Mr Floyd, replacing its contents with the message "Rest in Power, George Floyd", along with an Anonymous logo.





On Twitter, unverified posts have also gone viral, apparently showing police radios playing music and preventing communication.

However, experts suggest it is unlikely to be a hack, and could instead be the result of a stolen piece of hardware being commandeered by protesters on the scene - if the videos are genuine in the first place.

Anonymous activists are also circulating years-old accusations against President Trump, taken from documents in a civil court case that was voluntarily dismissed by the accuser before it went to trial.


Have They Acted Over Race Issues Before?


Despite there being no single unified approach among Anonymous' members, the group has targeted groups over race relations in the past.

In 2014, when the shooting of Michael Brown in Ferguson, Missouri, prompted widespread protests, members of Anonymous threatened to target the city if protesters were harmed.

They then disabled the city's website, compromising communications at city hall, and targeting the city's police chief.

Later that year, they "declared war" on the Ku Klux Klan (KKK), releasing personal details of alleged members online.

Some Anonymous members also attacked the campaign group Black Lives Matter's website over alleged "anti-white racism".



Is This Return Credible?

George Floyd's death has led to what the BBC's New York correspondent Nick Bryant described as the most widespread racial turbulence and civil unrest since the assassination of Martin Luther King in 1968.

It is against this backdrop that a Facebook page claiming to be linked to Anonymous released a video about Mr Floyd's death, alleging a string of other crimes involving Minneapolis police, and threatening to act.

The same Facebook page posted similar videos about UFOs and "China's plan for world domination" in recent weeks which - like the George Floyd video - feature an electronically-disguised voice discussing previously published news stories.

But it received much wider attention after the Minneapolis police department's website appeared to be knocked offline.


Is This The Kind of Cyber-Attack That Anonymous is Typically Associated With?

The first major Anonymous operation to make headlines was against the Church of Scientology in 2008, in which it used DDoS attacks to knock some of the organisation's websites offline, along with prank calls and empty fax messages designed to disrupt their communications.

In the years that followed, in the aftermath of a global financial crisis, the group acted in support of the Arab Spring protest movements, targeted Sony Entertainment over its attempt to crack down on hacking of the PlayStation 3 console, and supported the Occupy Wall Street protests, among others.

They have continued to lend support to similar causes, and staged anti-establishment rallies around the world, but their prominence in mainstream media had diminished in recent years.

The revolutionary image and willingness to take on powerful entities, however, appears to be striking a chord during the current crisis in the United States.

As a result, it will no longer feature in the app's Discover section. The firm said it would "not amplify voices who incite racial violence and injustice".

The decision follows Mr Trump saying that "vicious dogs" and "ominous weapons" would have been used on protesters if they had breached the White House fence.

It follows Twitter's decision to hide some of the president's posts.

Snapchat's parent company Snap said: "Racial violence and injustice have no place in our society and we stand together with all who seek peace, love, equality, and justice in America."

The move is likely to feed into tensions between the White House and social media, which escalated when Twitter added fact-checking tags to some of the President's tweets last week.


The president subsequently signed an executive order seeking to curb legal protections offered to the industry.

Twitter later hid one of the president's tweets for breaking its rules on "glorifying violence".

Snapchat's action will also put further pressure on Facebook.

Its chief executive Mark Zuckerberg has resisted internal and external calls to intervene in regard to posts on its platform. Mr Zuckerberg has said the firm's free speech principles mean the president's posts should be left up unaltered.


President Trump has more than one million followers on Snapchat, according to the Bloomberg news agency. It said the app is seen as being a "key battleground" by Mr Trump's re-election campaign because it offers a way to reach first-time voters.


The president's account will not be suspended or deleted.

However, the fact it will not feature in Discover means that his posts will only be seen by people who subscribe to or search for his account directly.

Snapchat based its decision on remarks Mr Trump had posted to Twitter rather than its own platform.

On Monday, Snap's chief executive Evan Speigel had sent a memo to staff in which he detailed his views on the civil unrest sparked by the killing of George Floyd.

"Every minute we are silent in the face of evil and wrongdoing we are acting in support of evildoers," Mr Speigel wrote.

"As for Snapchat, we simply cannot promote accounts in America that are linked to people who incite racial violence, whether they do so on or off our platform."

"Our Discover content platform is a curated platform, where we decide what we promote," he added.

More than 140 scientists funded by Mark Zuckerberg have said Facebook should not be letting Donald Trump use the social media platform to “spread both misinformation and incendiary statements”.

The researchers, who include more than 60 professors at leading US research institutions and one Nobel laureate, sent the Facebook CEO a letter on Saturday asking him to “consider stricter policies on misinformation and incendiary language that harms people”, especially during the current turmoil over racial injustice.

The letter calls the spread of “deliberate misinformation and divisive language” contrary to the researchers’ goals of using technology to prevent and eradicate disease, improve childhood education and reform the criminal justice system.

Their mission “is antithetical to some of the stances that Facebook has been taking, so we’re encouraging them to be more on the side of truth and on the right side of history, as we’ve said in the letter”, said Debora Marks of Harvard Medical School, one of three professors who organized it.

The others are Martin Kampmann of the University of California, San Francisco, and Jason Shepherd of the University of Utah. All have grants from a Chan Zuckerberg Initiative program working to prevent, cure and treat neurodegenerative disorders including Alzheimer’s and Parkinson’s disease.

They said the letter had more than 160 signatories. Shepherd said about 10% were employees of foundations run by Zuckerberg and his wife, Priscilla Chan.

The letter objects specifically to Zuckerberg’s decision not to act on a post by Trump that stated “when the looting starts, the shooting starts”. The letter’s authors called the post “a clear statement of inciting violence”.

Zuckerberg has faced significant backlash, including from Facebook staff, over the choice not to remove Trump’s post this week amid nationwide protests over police brutality. Twitter had both flagged and demoted a Trump tweet using the same language.

In a statement, the Chan Zuckerberg Initiative noted that the philanthropic organization was separate from Facebook and said “we are grateful for our staff, partners and grantees” and “respect their right to voice their opinions, including on Facebook policies”.

Some Facebook employees have publicly objected to Zuckerberg’s refusal to take down or label misleading or incendiary posts by Trump and other politicians. But Zuckerberg has so far refused.

On Friday, Zuckerberg said in a post that he would review “potential options for handling violating or partially-violating content aside from the binary leave-it-up or take-it-down deci
sions”.

Facebook Says it Has Removed Adverts for US President Donald Trump's Re-Election Campaign That Featured a Symbol Used in Nazi Germany;

The company said the offending ad contained an inverted red triangle similar to that used by the Nazis to label opponents such as communists.

Trump's campaign team said they were aimed at the far-left activist group antifa, which it said uses the symbol.




A red triangle was once a common sight at Nazi concentration camps, a part of history now thrust into the national spotlight by a banned political campaign ad.



Facebook said the ads violated its policy against organised hate.

"We don't allow symbols that represent hateful organisations or hateful ideologies unless they are put up with context or condemnation," the social network's head of security policy, Nathaniel Gleicher, said on Thursday.

He added: "That's what we saw in this case with this ad, and anywhere that that symbol is used we would take the same actions."

The ads, which were posted on the site on pages belonging to President Trump and Vice-President Mike Pence, were online for about 24 hours and had received hundreds of thousands of views before they were taken down.

Mr Trump has recently accused antifa of starting riots at street protests across the US over the death in police custody of African American George Floyd.

The president said last month that he would designate the anti-fascist group a "domestic terrorist organisation", although legal experts have questioned his authority to do so.

Antifa is a far left protest movement that opposes neo-Nazis, fascism, white supremacists and racism. It is considered to be a loosely organised group of activists with no leaders.

Most members decry what they see as the nationalistic, anti-immigration and anti-Muslim policies of Mr Trump.

A Move Likely to Infuriate the President


This is the latest salvo in an increasingly fraught relationship between the technology giants and the White House.

Last month, Twitter put a warning on one of the president's tweets about rioting in Minneapolis - saying it had "glorified violence".

Mr Trump hit back by talking about the "unchecked power" of big tech. He said that Section 230 - a law that protects social media companies from being legally responsible for the online content of users - should be revoked.

But forget Twitter for now, Facebook is the platform that Mr Trump really cares about. The social network is where a majority of his online political advertising budget goes.

The move will likely infuriate the president. It also acts as a warning that Facebook does - and will - moderate some political content.

As the 2020 election draws nearer, it's likely more and more focus will be placed on what it does - and does not - take down.

Earlier this month, Facebook employees spoke out against the tech giant's decision not to remove or flag a controversial post by Mr Trump relating to the protests over Mr Floyd's death.

The president posted a comment on the social network saying that he would "send in the National Guard" and warned that "when the looting starts, the shooting starts".
But Facebook said it did not violate its company policy.

Mr Trump had tweeted the same comments, but Twitter placed a warning over the content, which it said "glorified violence".

Some Facebook staff said they were "ashamed".

BIG Companies Boycott Facebook For Failing to Control TRUMP & Hate Speech

A growing list of companies are pulling ads from Facebook claiming the social media giant has failed to stop the spread of hate speech and white supremacy on the platform.

Coca Cola, Ben and Jerry's, Hershey's, Starbucks, the North Face, Honda and even Meghan and Harry have all joined the #StopHateforProfit campaign led by a number of civil rights groups.

The campaign has so far cost Facebook's owner Mark Zuckerberg more than $7 billion, losing him his spot as the third richest person on the planet.

The platform makes 99 per cent of its profit from advertising, with the boycotting companies having a huge impact on Facebook's revenue.

"Up until this point [Mark Zuckerberg] has said we're not responsible for what people put up there, we're not a media company, we're just a technology platform, which is of course absolute rubbish, they're one of the largest media companies in the world," marketing executive Dee Madigan told A Current Affair.

Facebook has now announced an expanded policy on hate speech that will ban ads that discriminate against minorities.

The platform will also apply warning labels to posts that are newsworthy but violate its policies.

A spokesperson for Facebook told A Current Affair they've opened themselves up to a civil rights audit, and have banned 250 white supremacist organisations.

They admit there is more work to do.

"I think a lot of us find Facebook very problematic, but there's nowhere else where so many of our memories are stored because it was one of the first ones. It's a bit like the mortgage you have with the bank you hate. You kind of want to move, but the idea of doing it and putting everything into another space is just too much. So at the moment, Facebook's probably okay, but that'll start to change," she said.

Facebook claims it removes about three million items of hate speech content each month, 90 per cent of which disappear before being reported. Some content, they admit, slips through the cracks. Tech expert Charlie Brown says the company has so many users, it simply can't keep up.

"Firstly, they use the community to flag content, they use a particular behaviour that the algorithm looks at.

Finally, Facebook also has real human beings, sitting there, looking at the content at removing or authorising it to be on the platform. Interestingly, that group of people, the police of Facebook, has recently settled an action with Facebook over mental stress of doing that job," Mr Brown told A Current Affair.

Trump’s Meme Post Survives on Facebook Despite New York Times Complaint

A few days ago, the mainstream media jumped all over the news that the New York Times had removed a Trump ‘meme’, posted by President Trump, on Twitter.

The NYT owns the right to the underlying photo that was taken by photographer Damon Winter and used in a 2015 feature on the President.


While the newspaper admitted that there are fair-use considerations with these type of memes, it saw Trump’s post as copyright infringement and submitted a DMCA takedown notice to which Twitter swiftly complied.


Fair Use?

In a fast-paced news cycle, this story is pretty old by now. However, the claim lodged against President Trump is unique enough to warrant a follow-up. Especially because the meme in question was, and still is, being widely used by others.

When we reached out to the NYT wast week the paper informed us that it would investigate other uses of the same meme – which run to the many thousands – to see of these qualify as fair use or not.

“We are looking at the other social media accounts that are using it to determine whether they, too, are in violation of copyright laws. That requires a case-by-case fair use analysis, which is ongoing,” NYT spokesperson Eileen Murphy tells TorrentFreak.

While we don’t know the outcome of this investigation, a search on Lumen’s takedown notice repository reveals that Trump’s tweet remains the only image targeted. As such, it looks like the President’s post was specifically targeted.

This may not come as a surprise, considering the tension between some mainstream media outlets and President Trump. However, these tensions generally don’t involve copyright claims.


Earlier this week we asked NYT whether it has reached a decision in the fair use analyses of other users who posted the same image. The newspaper didn’t answer directly but says that it intends to act if action is “justified”.

“In each instance, we are required to make an individual assessment of the usage. When we think some sort of action is justified, we intend to act,” a NYT spokesperson tells us.





Facebook Hasn’t Taken the Meme Down

Thus far, the newspaper hasn’t sent any new takedown requests to Twitter. However, it did confirm that a takedown notice was sent also to Facebook, where President Trump posted the same meme.

Interestingly, this post is still online today.

Following up on this, we reached out to Facebook to ask if the platform sees this post as fair use, which it could be, but the company didn’t respond. For now, the Facebook post survives.

One has to wonder whether the NYT’s approach is this situation was smart if their intention was to prevent copyright infringement.

By issuing the takedown request the newspaper elevated the tweet to world news. This triggered many others to repost the meme, which amplified the (possibly fair use) ‘infringements’ in what can be considered an exemplary case of the Streisand Effect....

Another Trump Tweet Removed But This One Has a $150,000 Copyright Lawsuit Attached

For the overwhelming majority of Twitter users, receiving even a very small number of copyright complaints against their account can mean its loss, with Twitter invoking its repeat infringer policy to avoid liability under the DMCA.

For US President Donald Trump, however, special treatment is available on the platform. While contentious tweets do get removed, Trump’s account remains intact, despite a steady stream of rightsholders filing DMCA notices.

Yesterday, however, one of his allegedly-infringing tweets resulted in more robust action.


Allegedly-Infringing Tweet Was Posted in August

With the 2020 United States presidential election campaign in full swing, Trump is taking every opportunity to paint Democratic opponent Joe Biden in an unfavorable light. These political attacks often take place via Twitter and last month Trump kept up the pressure, posting an animated video of a speedy train carrying his campaign logo ahead of Joe Biden on a railroad handcar, struggling to keep up.

While that kind of imagery is nothing new in US politics and seems to have been custom-created, the background music in the video – the 1982 hit ‘Electric Avenue’ by British singer-songwriter Eddy Grant – was a previously-existing work. In fact, according to a lawsuit filed by the artist in a New York court yesterday, the use of the track was an act of blatant copyright infringement.

The complaint, filed in the Southern District of New York, has Edmond Grant, two companies named Greenheart Music Limited (one based in the UK, the other Antigua, both owned by Grant) suing both Donald Trump and his campaign, Donald J. Trump For President Inc.

The complaint states that after Trump tweeted the video on August 12, the next day Grant and Greenheart Music sent a letter to the defendants demanding the removal of the video and insisting that they refrain from using Electric Avenue moving forward.

The lawsuit further alleges that at the time of its filing on September 1, the video was still available on Twitter. This is curious since according to information published by the Lumen Database, on August 13 Twitter received a DMCA takedown notice from Sony/ATV Music Publishing demanding the removal of the tweet.

It has now been actioned with the offending tweet being removed, but Lumen only received a copy from Twitter today, perhaps suggesting something unusual with its processing.


Electric Avenue DMCA





“Plaintiffs’ Recording, which embodies the Composition, can be heard on the Infringing Video starting at the 15 second mark and continues for the duration of the video. The Infringing Video therefore makes unauthorized use of the Composition and the Recording and infringes upon Plaintiffs’ copyrights in both,” the complaint reads.

“Defendants’ conduct is unlawful; it is proscribed as such by the United States Copyright Act. Neither the President nor the Company is above the law,” it adds.


A Very Popular Video, Complaint Alleges


According to estimates presented by the plaintiffs, the video has been viewed more than 13.7 million times, “liked” more than 350,000 times, and re-tweeted 139,000 times. This, despite Trump and his campaign being put on notice via an August 13 letter sent by Grant’s attorney to cease-and-desist their infringing conduct.

“Defendants have failed and/or refused to comply with Plaintiffs’ demands set forth in the August 13, 2020 letter, have continued to infringe Plaintiffs’ copyrights in the Composition and the Recording, and, upon information and belief, will continue to infringe Plaintiffs’ copyrights in the Composition and the Recording unless enjoined by this Court,” the complaint adds.


Permanent Injunction and Damages


Describing the actions of Trump and his campaign as “willful and intentional”, the lawsuit demands a permanent injunction to prevent further infringement plus a damages amount to be determined at trial.

That could range from a minimum of $750 per infringement but could stretch to $150,000 per infringement in statutory damages, plus costs and attorneys’ fees, the complaint warns.

Interestingly, the cease-and-desist sent by Grant’s legal team on August 13 offered to settle the matter quickly, in order to avoid the relatively expensive option of a lawsuit. Whether that option remains on the table is unclear but from its text, it appears that Grant was personally upset, not just by the alleged infringement of Electric Avenue, but also by the context in which it was used.


Perhaps More Than ‘Just Another’ Copyright Lawsuit


Electric Avenue was written by Grant in response to the now-historic riots that took place in Brixton, London, during 1981. They were widely attributed to racism, poverty, and tensions between black youths and the mainly white police force of the time.

The cease-and-desist sent by Grant’s team in August suggests that the use of Electric Avenue in the Trump campaign video “indicates a fundamental misunderstanding of the very meaning of the underlying work” and notes that just by being affiliated with Trump’s campaign, Grant’s reputation is being damaged. As a result, a large response could follow.

“If you know my client’s reputation then you know that this Infringing Use in connection with the name ‘Trump’ in a political context is a serious transgression and could subject you to upwards of $100,000,000 in monetary damages,” the letter warned.

Donald Trump could lose more than just the presidency this January. Twitter has confirmed that, if Trump leaves office, he will no longer receive special treatment as a “newsworthy individual”.

Twitter’s policy around newsworthiness protects certain people – such as elected officials with more than 250,000 followers – from having their accounts suspended or banned for rule infractions that would otherwise lead to severe penalties.

That policy is what has led to the company muting, but not removing, at least 12 tweets from the US president over the past week that cast doubt on the democratic process.

But, Twitter has confirmed, the policy does not apply to former elected officials. They have to follow the same rules as everyone else, and if a tweet breaks those rules, it gets removed. Were Trump to continue breaking Twitter’s rules regularly post-presidency, his account could be suspended.

“Twitter’s approach to world leaders, candidates and public officials is based on the principle that people should be able to choose to see what their leaders are saying with clear context,” a spokesman told the Guardian. “This means that we may apply warnings and labels, and limit engagement to certain Tweets. This policy framework applies to current world leaders and candidates for office, and not private citizens when they no longer hold these positions.”

That will present Trump with a choice once he leaves office: either tone down the rhetoric or face the prospect of his hugely influential following being taken away from him.

Meanwhile, lawmakers and human rights groups have renewed calls to suspend the president’s account even before a possible transition of power in January.

On Wednesday, the Democratic representative Gerry Connolly of Virginia called on Twitter in a tweet to “suspend his account”.

“This is pure disinformation. Valid votes are being counted. This is America, not Russia,” he said in response to Trump tweets that included baseless suggestions of voter fraud.

David Cicilline, a Democrat and Rhode Island representative, also called for Twitter to suspend Trump’s account for “posting lies and misinformation at a breathtaking clip”. Cicilline is the chair of the House antitrust subcommittee and has targeted Twitter with pointed questioning in recent hearings.

On Thursday, the Lawyers’ Committee for Civil Rights Under Law and the watchdog group Common Cause submitted a joint letter to Jack Dorsey, the Twitter CEO, requesting Trump’s account be temporarily suspended to prevent the spread of misinformation about the election.

“We fear that, in the absence of action by Twitter, the president may be successful in his goal of delegitimizing the integrity of our democratic processes for many, and not just Twitter users but other voters and members of the public, sowing uncertainty about the voting and elections process, and potentially inciting violence against civil servants or others,” the groups wrote.

A Twitter spokesperson said the company has received the letter and “intends to respond”.

Twitter Takes Down Trumps’ ‘YMCA Dance’ But Leaves Original Online

When Trump took office in early 2017, copyright holders hoped to have found a new ally in their fight against piracy.

The Copyright Alliance made this very clear in a public letter stressing that few presidents, if any, have had a more sizable and diverse copyright portfolio.

Today, nearly four years later, Trump is better known for the copyright infringement allegations that have been made against him than the policy he helped to create. With Trump, however, even the copyright infringements appear to be political.


Trump’s Copyright Infringements

In the past, many creators and artists would have been flattered if a US president had used their work in public but with Trump, things are different. Many musicians don’t even want to be associated with the president even if they get paid for it.

This has resulted in several lawsuits. In addition, there has been a flurry of takedown requests asking Twitter to remove music and other media tweeted by the president.

Today we can add another complaint to the list, one with a twist. The takedown notices, which are first reported here, target a tweet published by Trump on election day. It consists of the three words “VOTE! VOTE! VOTE!” and ‘retweets’ a video compilation of Trump dancing to ‘YMCA’ from the Village People.

It is no secret that the Village People are not all fans of the president as the group’s label ‘Scorpio Music’ recently threatened to file a lawsuit over the allegedly unauthorized use of their track during campaign rallies. And indeed, soon after Trump tweeted his message, not one but two takedown notices came in.


Takedowns Target ‘Trump Dance’

We tracked down the notices in the Lumen Database. The first one was sent by the anti-piracy company Web Sheriff, which often represents the Village People. Soon after, another one was sent by the Sheriff, this time on behalf of music publishers ‘Can’t Stop Production’ and ‘Scorpio Music.’

The notices were sent on November 4 but remained unpublished until this week, when Twitter removed the allegedly infringing video as well. The accompanying “VOTE! VOTE! VOTE!” text was deleted too, but likely by Trump himself or someone with access to his account.





By now, this type of takedown hardly comes as a surprise and, given the legal threats, they might even be expected. That said, it is worth highlighting that this is yet another example of selective copyright enforcement.


Selective Copyright Enforcement


Traditionally, DMCA takedown notices are used to stop copyright infringing activity. In this case, however, they’re being used as a tool to distance a song from a controversial person, as the original content remains online.

Both takedown notices only target Trump’s tweet. This is strange because the Trump account didn’t publish it first, it merely shared a message what was posted by SOMETHiNG WiCKËD, which remains online today, including the ‘infringing’ video.

If copyright infringement was the issue here, it would make sense to remove the original tweet as well, not just the one that Trump reposted. But the original video with the YMCA song is still up at the time of writing, with over 45 million views and counting.


Not The First Time


This is not the first time we’ve seen Trump’s tweets being selectively targeted. Previously, The New York Times asked Twitter to remove one of its photos, which had been used as a popular meme for years. This image was tweeted by numerous other people as well, but these were not removed.

The controversial Trump dance video also became a meme by itself, with many people replicating his moves and posting the results on social media. As far as we know, these all remain online too.

While it’s understandable that some people don’t want to be associated with certain people or messages, this isn’t how Congress envisioned the DMCA takedown process to be used. That said, the rightsholders likely have a valid claim. They just appear to be a bit selective.

Twitter and Facebook took unprecedented actions to address the spread of misinformation and the incitement of violence by Donald Trump on their platforms on Wednesday, after supporters of the president stormed the US Capitol.

Both companies locked Trump’s accounts and removed several posts from the president that cast doubt on the election results and praised his supporters, who forcibly took to the government building as lawmakers attempted to tally votes for the election.

Facebook has suspended Trump from posting to his account for 24 hours. Instagram, which is owned by Facebook, also locked Trump’s account. Twitter locked Trump out of his account for 12 hours and is requiring him to delete three tweets the company says violates its policies. If he does not delete them, his account will remain suspended indefinitely, the company said in a public statement. If Trump again violates the policies, his account will be permanently suspended from Twitter.

A statement from Trump promising an “orderly transition” following Congress certifying Biden’s win was posted to Twitter by deputy chief of staff for communications Dan Scavino.

The action is the most aggressive yet from Twitter and it comes after it joined Facebook and YouTube in removing a video post from Trump’s account in which the president praised the protestors.

Earlier on Wednesday, Twitter blocked several of Trump’s posts from being shared, citing a “risk of violence”.

As his supporters gathered on Wednesday to protest the certification of the 3 November election results, Trump in a tweet accused Vice-president Mike Pence of lacking “the courage to do what should have been done”.

In the video he shared on social media later in the day, Trump urged his supporters to “go home”, but also gave legitimacy to the falsehoods that fueled Wednesday’s attempted insurrection, calling the election “stolen” and telling the angry mob, “we love you”.

Later on Wednesday, Trump again falsely claimed his “election victory” was “unceremoniously” and “viciously” stripped away.

“In line with our civic integrity policy and recent guidance, we have placed a label on the tweet, and have significantly restricted engagement with the tweet due to the risk of violence,” a Twitter spokesman said. “This means this tweet will not be able to be replied to, retweeted, or liked.”

Facebook took a number of measures throughout the day, including the unprecedented decision to remove a post made by the president. “This is an emergency situation and we are taking appropriate emergency measures, including removing President Trump’s video,” said Guy Rosen, Facebook’s vice-president of integrity, in a tweet. “We removed it because on balance we believe it contributes to, rather than diminishes, the risk of ongoing violence.”

Facebook also said it would be removing content that praises the storming of the US capitol, calls to bring weapons to locations across the US, videos and photos from protestors at the Capitol, and any “attempts to restage violence” in the coming days. It has banned the hashtag #StormtheCapitol, which was used to organize Wednesday’s actions and designated it as “dangerous”, a category the platform usually reserves for hate groups and terrorists.

Facebook has also increased rules for content moderation in private Facebook groups, where extremism experts have long warned many such militarized actions are planned. The platform is now increasing the requirement of Group administrators to review and approve posts before they can go up and disabling comments that have a high rate of hate speech.

Still, dozens of “Stop the Steal” Facebook groups and events remain live on the site.

Online activism group Color of Change launched a petition on Wednesday calling on social media firms to remove the president, saying they have ignored years of warnings about the dangers of white supremacists using these platforms to recruit, organize and fundraise.

“Big tech companies are complicit in the insurrection in DC today,” said Rashad Robinson, president of Color of Change. “Enough is enough. It’s time for Facebook and Twitter to kick Trump off their platforms.”

Twitter’s suspension of Trump’s account came after it faced intense pressure on Wednesday to suspend the president’s account as tensions in Washington rose.

“Threats of and calls to violence are against the Twitter rules, and we are enforcing our policies accordingly,” Twitter said.

The company’s safety account, which shares updates and enforcements of company policy, also said it is working to rein in violent language on the platform as the attempted coup continues to unfold.

Twitter in the past has flagged several Trump tweets sharing misinformation or calling for violence. Most notably, the president’s May 2020 tweets encouraging violence against protesters demonstrating against police violence were hidden and prevented from being shared.

But the company has also faced criticism for failing to remove tweets quickly enough and calls to remove the account entirely. Though Twitter doubled down on its enforcement of policies against misinformation and calls to violence in the weeks leading up to the presidential election, it was slower to take action in days and months following. On 11 November, the site took more than an hour to flag a highly misleading video shared by Trump. It was retweeted more than 70,000 times before the platform took action.

Facebook has also faced criticism for its role in promoting misinformation and allowing armed groups to organize. Facebook CEO Mark Zuckerberg faced intense criticism for the company’s decision to leave up the presidents’ message inciting violence against protesters demonstrating against police violence, as companies like Twitter removed them.

Facebook also began to remove militias from its platform in 2020 August, months after it was found thousands of extremist groups were using the site to organize anti-Democratic, armed actions, a shooting in Kenosha, Wisconsin organized on Facebook left two dead, and the violent kidnapping of Michigan governor Gretchen Whitmer was planned on the platform.

Surrounding the storming of the Capitol on Wednesday, Facebook was again targeted with blame as many of the events and protests that led to the action were organized there.

“The violent protests in the Capitol today are a disgrace,” a Facebook spokesman said. “We prohibit incitement and calls for violence on our platform. We are actively reviewing and removing any content that breaks these rules.”

Donald Trump was reportedly left “ballistic” after Twitter permanently suspended him as the US president’s allies accused the social media company of Orwellian censorship.

Locked out of his favourite mode of mass communication and facing mounting calls for his removal from office, Mr Trump was isolated and silent in the White House on Saturday.

The online crackdown also saw the Trump campaign’s Twitter account suspended and the YouTube channel for a podcast from Steve Bannon, Mr Trump’s ex-chief strategist, disabled.

Meanwhile, concerns are growing that the January 20 inauguration when Joe Biden is sworn in as president could be disrupted after Trump supporters called online for a “Million Militia March”.

Democrats next week are set to start the process of impeaching Mr Trump for encouraging the mob which stormed the US Capitol, with likely success in the House of Representatives.

On Saturday night Congress said impeachment could begin on Monday after House Democrats reached 180 cosponsors for the move.


Could Donald Trump be impeached or removed under 25th Amendment?

Donald Trump's opponents are split on whether he should be impeached or whether the 25th Amendment should be invoked to remove him from office.

Both moves would potentially require a majority in both houses of Congress to be successful.

For the 25th amendment to be invoked, Mr Pence and the majority of the cabinet, which has 23 members, would need to declare that Mr Trump is unfit for office. They would be required to inform Congress in writing, and Mr Pence would take over immediately.

If Mr Trump then wrote to Congress declaring that he was fit to do the job and the Cabinet opposed that statement, Congress would have to decide. It would require a two-thirds majority of both the House and the Senate to remove Mr Trump and give his powers to Mr Pence.

But because they have 21 days to decide, it is thought the leaders of both houses could simply run down the clock on Mr Trump's final days in office. Mr Pence would remain in power throughout the process.

The 25th Amendment has never been used in these circumstances, and has only been invoked on three occasions when a president has fallen ill.

For the president to be impeached, the House of Representatives would need to bring charges that Mr Trump engaged in a "high crime or misdemeanour".

Legal experts have said invoking the 25th Amendment would be immediate, compared to a long impeachment process.


A Senate trial on whether to remove him could begin after Mr Biden's inauguration, when the Democrats will control the chambre. Although still unlikely, if convicted Mr Trump could be barred from running to be president again.

Debate was heated over Twitter's actions with Mr Trump “ballistic”, according to a senior administration official quoted anonymously in Politico, and suggesting he may start his own social media site. Hillary Clinton, the Democrat defeated by Mr Trump in the 2016 presidential election, simply posted a tick in response.

Mark Warner, a Democratic senator, called it an “overdue step”. But some prominent Trump supporters were scathing. Jason Miller, a longtime Trump adviser, called it “disgusting”. Donald Trump Jr, the president’s son, referenced author George Orwell’s dystopian book, saying: “We are living Orwell’s 1984.

Free-speech no longer exists in America.” Nikki Haley, who served as Mr Trump’s UN ambassador, tweeted: “Silencing people, not to mention the President of the US, is what happens in China not our country. Unbelievable."

Former US First Lady Melania Trump has been "bitter and chilly" toward her shamed husband - and barely spends any time with him after leaving the White House, it is claimed.

The couple reportedly spend most of their days apart at Donald's Mar-a-Lago resort in Florida as rumours continue to swirl that they are close to divorce.

The sulky ex-President snubbed his successor's inauguration to fly away to Florida, and is aiming to settle down at his resort, to the annoyance of neighbours.

An insider claimed that while Donald spends most of his days on the golf course, Melania is relaxing with extensive pampering sessions.

She is said to be annoyed at all the favourable coverage Dr Jill Biden, wife of the current President, is getting.

But there are signs that she may be launching new projects.

Last night a new Twitter account emerged named Office of Melania Trump, announcing: "Mrs. Melania Trump is announcing the opening of The Office of Melania Trump. Please follow this account for news and updates."

It is currently unclear what her work will focus on.

Describing her daily routine, an insider told CNN: "She goes to the spa, has lunch, goes to the spa (again) and has dinner with Donald on the patio.

“Rinse and repeat. Every day."




A former White House official told CNN Melania, who shares a 14-year-old son, Barron, with Donald, has been "bitter and chilly" towards her husband for some time.

But while onlookers have speculated for months that Melania is "totally done" with her husband, the couple celebrated their 16th wedding anniversary days after leaving Washington.

Donald is currently being tried in the US Senate for inciting an insurrection after fanatics launched a sickening siege on the Capitol last month.

He could be barred from standing from public office in the future - which would scupper his ominous warning to return to politics "in some form".

YouTube to Lift Trump Ban if Violence Threat Falls, Says CEO

YouTube's chief executive has said the platform may lift Donald Trump's suspension, if the threat of "real-world violence" decreases.


Susan Wojcicki said the company will look at government warnings and violent rhetoric to determine when it's safe to lift the suspension.

Following the Capitol Hill riot on 6 January that left five dead, Mr Trump's account was suspended.

YouTube said he had violated their incitement of violence policy.

"It's pretty clear that right now where we stand, that there still is that elevated risk of violence," the YouTube chief said during an interview with the Atlantic Council on Thursday.




Ms Wojcicki clarified that the former president's conduct had not led to a full ban on the platform.


The company operates under a three strike system and an account must receive all three strikes within 90 days to be permanently removed.

The suspension in January was Mr Trump's first strike.

Rudy Giuliani, the former personal attorney to Mr Tump, received his second strike earlier this week for claiming the 2020 presidential election was stolen.

Typically, a first strike results in a seven day suspension of an account, but Mr Trump's has been prolonged due to a continued risk of violence.

After a large group of pro-Trump supporters stormed the US Capitol building on 6 January, the former president was de-platformed across many social media outlets.

Mr Trump was banned from Twitter and suspended from Facebook.

Facebook's Oversight Committee is currently looking at whether that suspension should be made permanent - however it's not yet clear when they will rule.

Criminal charges have been filed for a reported 221 people involved in the riot.

Facebook Bans 'Voice of TRUMP' From Platform

Facebook has removed a video of Donald Trump from the page of his daughter-in-law Lara Trump.

The social media giant banned Mr Trump from its platform in January following riots by his supporters on the Capitol building in Washington.

Lara Trump, a new Fox News contributor, posted a video of herself interviewing Mr Trump on a range of issues.

She later posted a screenshot of an email she received from Facebook warning her of the ban.

"In line with the block we placed on Donald Trump's Facebook and Instagram accounts, further content posted in the voice of Donald Trump will be removed and result in additional limitations on the account," an email from "Katelyn" read.


Lara Trump, who is married to Mr Trump's son Eric, instead posted the interview for her own online show The Right View on the video platform Rumble and linked to it from her Facebook page.

"And just like that, we are one step closer to Orwell's 1984. Wow," she commented on her Instagram account.

Facebook's suspension of Mr Trump's account on 7 January - a day after the Capitol riots - is being reviewed by its new Oversight Board, which was set up to rule on controversial moderation decisions.

Defending the ban at the time, Facebook chief Mark Zuckerburg said: "We believe the risks of allowing the president to continue to use our service during this period are simply too great."

Donald Trump was also banned from Twitter and YouTube.

Donald Trumps' ban from Facebook and Instagram has been upheld by Facebook's Oversight Board.

But it criticised the permanent nature of the ban as beyond the scope of Facebooks' normal penalties.

It has ordered Facebook to review the decision and "justify a proportionate response" that is applied to everyone, including ordinary users.
