Each US president has charted a unique course after leaving the White House, taking up vocations from philanthropy to human rights to oil painting.

Donald Trump’s post-presidency appears likely to be taken up by meetings with lawyers and creditors, possible sworn depositions about tax practices or sexual assault allegations and, in some long-tail scenarios, fines, criminal charges, bankruptcy or other legal sanction.

With Trump gone from Washington, and now lacking the immunity protections of the presidency, prosecutors in at least three jurisdictions are either weighing or actively pursuing criminal cases against him, and a fourth prosecutor is investigating allegedly fraudulent business practices inside the Trump Organization.

Trump’s daughter, Ivanka Trump, is reportedly a major figure in two of the investigations, over more than $700,000 in “consulting fees” she allegedly received from the Trump Organization, which then allegedly claimed those fees as tax-deductible business expenses.

“This is harassment pure and simple,” Ivanka Trump tweeted in November, denying the allegations.

Donald Trump has long conducted himself, as a businessman and as president, as if the law did not apply to him or his cronies, dozens of whom he pardoned for crimes on the eve of his departure from office.

But criminal investigations now under way mean that the law might finally catch up to Trump in his post-presidency life, just as a $300m avalanche of debt coming due over four years that Trump has personally guaranteed threatens to sink him financially, according to a New York Times analysis of his tax records,


Trump has denied all wrongdoing, and his son Eric Trump has boasted that the Trump empire is healthy, with liquid real estate assets and branding opportunities overseas.

One solution to Trump’s financial woes might be suggested by the $270m he has raised since November, mostly from small donors, in a false “defend the election” campaign.


“You have a man who would get followed to the ends of the Earth by a hundred million Americans,” Eric Trump told the Associated Press, inflating by almost half the votes Trump received. “He created the greatest political movement in American history and his opportunities are endless.”

The legal hazards facing Trump can also seem endless. The Senate is preparing to hold a trial in Trump’s second impeachment, on charges that he incited the 6 January insurrection at the Capitol.

A conviction in the Senate is not only likely to result in Trump’s being barred from ever again holding office – it could increase the likelihood of criminal charges being brought against Trump by the US attorney’s office in Washington DC, which is investigating the attack on the Capitol.

“We are looking at all actors here, and anyone that had a role, if the evidence fits the element of a crime, they’re going to be charged,” acting US attorney Michael R Sherwin told reporters when asked directly about Trump, who directed the mob to march on the Capitol.

That statement echoed one by the Fulton county district attorney in Atlanta, Georgia, who is weighing an investigation of a phone call Trump made this month in which the president pressured the Georgia secretary of state to overturn the state’s election result.


“Like many Americans, I have found the news reports about the president’s telephone call with the Georgia secretary of state disturbing,” the prosecutor, Fani Wills, said in a statement. “Anyone who commits a felony violation of Georgia law in my jurisdiction will be held accountable.”

The New York state attorney general, Laetitia James, who is conducting a civil, as opposed to a criminal, investigation, of Trump Organization business practices, made a similar statement on national television last month.

Trump cannot avoid justice in the great state of New York,” said James, whose office has previously, and successfully, pursued accusations of fraud within a Trump “university” and a Trump “charity”, leading to a $25m settlement and a $2m damages payment, respectively.


In perhaps the most threatening legal action facing Trump, the Manhattan district attorney, Cyrus Vance, is conducting what his office has described as a “complex criminal investigation” into Trump’s business dealings, including sworn allegations by the Trump lawyer-turned-enemy Michael Cohen that the Trump Organization kept separate sets of books for tax and debt purposes.

Defending a subpoena for eight years of Trump’s tax records, in court documents Vance has cited “public reports of possibly extensive and protracted criminal conduct at the Trump Organization”.

Vance’s investigation also encompasses hush payments Trump caused to be made to the pornographic movie actor Stormy Daniels and former model Karen McDougal. Cohen, who orchestrated the payments, pleaded guilty in federal court in 2018 to campaign finance violations in the scheme and has said he was directed by Trump.

The lawsuits do not stop there. The magazine writer E Jean Carroll, who accuses Trump of raping her inside a New York department store in the mid-1990s, has brought what legal observers see as a powerful defamation lawsuit against Trump for calling her a liar. Trump said in a 2019 Oval Office interview that the rape could not have happened because “she’s not my type”.

Carroll’s lawyer, Roberta Kaplan, is representing clients in two other lawsuits against Trump, including one brought by Mary Trump, the former president’s niece, charging her uncle and two siblings with defrauding her of an inheritance worth millions.

“His terror is that he will no longer be protected by the office and will have to deal with these lawsuits,” Mary Trump told the Washington Post.

Kaplan is seeking sworn depositions from Trump in all three cases.

“When we depose you, you’re not going to get away with that,” she told the Washington Post. “He had the mantle of the presidency, and that’s now gone.”

The Supreme Court cleared the way for a New York prosecutor to obtain former President Donald Trump's tax returns, dealing a massive loss to Trump who has fiercely fought to shield his financial papers from prosecutors.

The documents will be subject to grand jury secrecy rules that restrict their public release.

The ruling is a bitter loss for Trump, even if the tax records are shielded from public disclosure, after he consistently argued that the subpoena issued by Manhattan District Attorney Cyrus Vance was overbroad and issued in bad faith.

It means that the grand jury investigation into alleged hush money payments and other issues will no longer be hampered by Trump's fight to keep the documents secret.

The ruling was issued without comment or dissent.

New York Prosecutor Says Trump Inquiry Now Criminal

The New York attorney general's office says it is investigating the Trump Organization "in a criminal capacity".

A spokesman for the state's top prosecutor says the inquiry is "no longer purely civil".

A spokesman for the state's top prosecutor, Letitia James, said the inquiry into Mr Trump's property company was "no longer purely civil".

Ms James has been scrutinising the ex-Republican president's financial dealings before he took office.

The Trumps deny wrongdoing and say the inquiry by a Democratic prosecutor is a political vendetta.

Ms James' spokesman, Fabien Levy, told the BBC on Tuesday: "We have informed the Trump Organization that our investigation into the Organization is no longer purely civil in nature.

"We are now actively investigating the Trump Organization in a criminal capacity, along with the Manhattan DA. We have no additional comment."

The statement did not say what turned the inquiry from civil to criminal in nature, or whether the former president himself might be personally implicated in any allegations.

Ms James launched a civil inquiry in March 2019 into claims that Mr Trump had inflated the value of his assets to banks when seeking loans, and understated them to lower his taxes.

Her office has also been seeking documents on four Trump Organization properties in Manhattan, upstate New York, Chicago and Los Angeles.

Manhattan District Attorney Cyrus Vance Jr said in court documents last August that his office was investigating alleged "protracted criminal conduct" at the Trump Organization.

Mr Vance's legal filing cited newspaper articles about purported bank and insurance fraud at the company.

The Manhattan district attorney has also been investigating whether any of Mr Trump's financial records were doctored to cover up hush-money payments to two women in 2016 who say they had affairs with him.

Mr Vance's office said in February it had obtained Mr Trump's tax returns as part of the investigation, after a long legal battle.

Throughout his presidency, Mr Trump resolutely refused to reveal his tax returns, despite coming under great pressure to do so.

Throughout his time in office, Donald Trump dismissed any probe into his financial dealings or those of his organisation as a politically-motivated "witch hunt" led by Democrats desperate to see him forced from power.

Yet now that he no longer enjoys protection from prosecution, this latest development will trouble him. That a former US president is facing not one but two criminal investigations is a significant development, one which could have repercussions for his political future.

The New York State Attorney General, Letitia James, clearly believes that there is enough at play to warrant moving the investigation from a civil to a criminal one. When combined with the ongoing examination of the former president's tax returns by the Manhattan District Attorney, Cy Vance,


Trump is looking at a complex and tangled legal battle ahead — one which he remains adamant he shouldn't have to face but which he now almost certainly cannot avoid.

New York Grand Jury Stores Up Trouble for Trump Organization Executives

Glimpses of the deliberations behind closed doors suggest a case is being built against Trumps’ CFO, Allen Weisselberg, which could be bad news for his boss

Following a deluge of bombshell news about Donald Trump-related criminal investigations in New York, including the Manhattan district attorney’s convening of a special grand jury, more details have emerged that might suggest intensifying legal woes for one of the former president’s business lieutenants.

The New York Times reported on Tuesday that the Manhattan district attorney’s office has apparently “entered the final stages of a criminal tax investigation” of Allen Weisselberg, the Trump Organization’s longtime chief financial officer.

The report that prosecutors might be nearing the final stages of their criminal tax inquiry into Weisselberg comes in the wake of reports that Jeff McConney – a senior vice-president and controller for the Trump Organization – has testified before the Manhattan special grand jury.

McConney, “one of the most senior officials” in this company, is also the first Trump Organization staffer called to testify – and is one of “a number of witnesses” who have been before the panel, ABC reported.

McConney’s role as the Trump Organization’s money man could have dramatic implications for an investigation into possible financial crimes at the sprawling business empire. The special grand jury convened by the Manhattan district attorney’s office is expected to decide whether to indict Trump, other executives at his company or the business itself if presented with criminal charges by prosecutors.

The investigation is broad and relates to Trump’s business affairs predating his presidency. The inquiry is examining whether the value of some property in his company’s real estate portfolio was presented in a way that defrauded insurance companies and banks. The investigation is also trying to determine whether sketchy property valuations might have led to unlawful tax breaks, according to the Washington Post.

With Weisselberg, the Manhattan district attorney’s office is reportedly probing whether he received any “fringe benefits” from the company on top of his salary, and if said benefits were taxed adequately.

Although Trump and Weisselberg were usually the “only two people in the room”, when prepping tax paperwork and other financial documents, McConney brought them the “original documents and tranches of raw data”, the Daily Beast reported. So, McConney might have financial information that could potentially be used against Weisselberg or Trump.

Weisselberg’s attorney said “no comment” when asked about the inquiry and Times report.

The Manhattan district attorney’s office declined to comment.

Longtime defense attorneys told the Guardian that such revelations about grand jury witness testimony might give clues about prosecutors’ strategy and thoughts about potential wrongdoing. When prosecutors start calling witnesses before grand juries, it typically means the investigation has hit the stage where prosecutors feel they have a criminal case against someone.

Daniel R Alonso, a partner at Buckley LLP’s New York office whose past work includes serving as chief assistant district attorney with the Manhattan district attorney, said: “You’ve got to start with the proposition that it’s pretty clear they’re targeting Allen Weisselberg, the CFO. If that’s correct, which it seems to be, it’s an obvious move to get the testimony of the controller on record.

“It appears from the reporting that he’s getting immunity,” Alonso said of McConney. “They either don’t think that he has criminal exposure or if he does, they’re more interested in getting people higher up on the food chain if they can.”

And because a controller has daily interaction with a CFO, “there are undoubtedly lots and lots of questions that the [district attorney] has asked him, or will ask him, or lots and lots of documents that they can show him that will make it difficult for him to feign a lack of memory,” Alonso also said.

McConney did not respond to an email request for comment.

Rebecca Roiphe, a former prosecutor with the Manhattan district attorney’s office who now works as a professor at New York Law School, explained that in New York state courts, a witness called before the grand jury can’t be prosecuted for what they testify about.

“You really don’t want to use the grand jury, at least in terms of calling witnesses, at an early stage of your investigation because you don’t want to have to accidentally give somebody immunity,” Roiphe said.

So, if prosecutors are calling witnesses before a grand jury, they have a strong sense of who they want to prosecute – they are not just calling people in a way that could jeopardize a case.

“They must have a sense that they have a criminal case against somebody, because of the grand jury practice of New York,” Roiphe said.

“It seems that it’s a more advanced investigation. It’s not just the detectives and prosecutors thinking in theory about an investigation – they’re actively interviewing witnesses and putting a possible indictment together,” said Jeffrey Lichtman, a longtime criminal defense attorney.

“They don’t just call these people out of the blue.”

There appears to be no shortage of high-profile figures willing to discuss Trump, his businesses, or his cronies.

Michael Cohen, Trump’s former fixer, has met with prosecutors in the Manhattan district attorney’s office. They have reportedly asked Cohen questions about Trump’s business activities. Cohen pleaded guilty to tax evasion, campaign finance violations and lying to Congress.

Jennifer Weisselberg, Allen Weisselberg’s former daughter-in-law, has provided investigators with extensive tax records and other financial documents. A representative for Jennifer Weisselberg said: “She is still being considered as a potential witness and she’s been in conversation with the district attorney about her information and her potential [grand jury] testimony if necessary.”

The adult film star Stormy Daniels – who claimed to have had sex with Trump about 12 or so years ago, and received $130,000 in hush money during the 2016 presidential race not to discuss the alleged affair – said she would readily testify before a grand jury.

“I would love nothing more than my day in court and to give a deposition and to provide whatever evidence that they need from me,” Daniels reportedly said.

Trump has claimed he did not have a sexual liaison with Daniels.

Trump’s attorneys did not respond to requests for comment.

New York Prosecutors Set Deadline For TRUMP on Legal Action

Ex-president’s lawyers have 24 hours Monday to say why the Trump Organization should not face charges, reports claim

New York prosecutors have given lawyers for Donald Trump 24 hours to respond with any last arguments as to why criminal charges should not be filed against his family business, according to a report on Sunday.

The deadline set for Monday was another strong signal that the Manhattan district attorney, Cyrus Vance, and the New York attorney general, Letitia James, are considering criminal charges against the former president’s company as an entity, according to sources quoted by the Washington Post.

On Friday, it was reported that Vance could announce charges against the Trump Organization and its chief financial officer, Allen Weisselberg, within seven days.

Any criminal charges would be the first in Vance’s probe into Trump and his business dealings.

Legal experts have said an indictment against the Trump Organization could bankrupt the company by undermining its relationships with banks and other business partners.

Vance’s office has said it was investigating “possibly extensive and protracted criminal conduct” at the Trump Organization, including tax and insurance fraud and falsification of business records.

Even if no charges were brought, Vance’s investigation could complicate any return to politics by Trump, who has lost some of his ability to communicate publicly after being permanently banned from Twitter and suspended for two years by Facebook.

James’ office has been investigating whether the Trump Organization inflated the values of some properties to obtain better terms on loans, and lowered their values to obtain property tax breaks.

TRUMP ordered to hand tax returns to prosecutors



The specific charges against the company and Allen Weisselberg, 73, are still unclear. They are expected to be made public on Thursday.

Trump is not expected to be implicated personally in the case.

New York City has already cut business ties with the twice-impeached former president.

The Trump Organization is a family holding company that owns hotels, golf clubs and other properties.

Any criminal charges brought against it would mark the first in long-running investigations on alleged fraud by both the Manhattan district attorney and the state attorney general.

Charges by District Attorney Cyrus Vance are expected to focus on whether Mr Weisselberg and other company executives received benefits such as apartment rentals or leased cars without reporting them properly on their tax returns.

Mr Weisselberg and lawyers for the Trump Organization are expected to make their first court appearance on Thursday, according to the New York Times, Wall Street Journal and Associated Press, which quote unnamed sources.

Mr Trump and his allies have said the investigations are politically motivated.

In a statement earlier this week, Mr Weisselberg said the case was looking at "things that are standard practice throughout the US business community, and in no way a crime".

If the company is found guilty, however, certain business partners might draw a line under their relationship with the Trump Organization and the company could face fines.

New York City, for example, has already announced it will terminate contracts with the firm to run skating rinks, a carousel and a golf course, in the aftermath of the US Capitol riots.

Daniel Goldman, who was lead lawyer in the US House of Representatives for the first impeachment of Mr Trump in 2019, tweeted that the indictment could spur lenders to call in their loans, driving the Trump Organization to bankruptcy.

The investigations will also take into account eight years of Mr Trump's personal and corporate tax returns, obtained by prosecutors after a long legal battle, which ended in the Supreme Court in February.

Mr Trump, who inherited money from his father and went on to become a property developer, is the first president since Gerald Ford in the 1970s not to have made his tax returns public.

Despite facing a number of investigations, the former president has denied any wrongdoing personally or in his business.

Representatives for the Trump Organization, Donald Trump and Allen Weisselberg did not immediately respond to the BBC's request for comment.

The charges against Allen Weisselberg might seem small fry, but the threat to those higher up the food chain is mounting

Michael Cohen sounded giddy on the latest episode of his podcast, Mea Culpa. Allen Weisselberg, a key lieutenant to Donald Trump, Cohen’s former boss, was about to be charged alongside Trump’s company with tax fraud.

“This case is being prosecuted like a mob case. And that means they are starting at the bottom of the tree, and working their way up, by getting the smaller fish to flip with pressure on people like Weisselberg to rat on their former boss of bosses!” Cohen said, gleefully mixing his metaphors.


Cohen knows this score. Trump has been under investigation by New York’s top prosecutors for three years – in large part thanks to Cohen, once his trusted lawyer. Cohen – who once said he would “take a bullet” for Trump – turned on the former president as he was sentenced to 36 months in prison for crimes including facilitating illegal payments to silence two women who allegedly had sex with Trump.

On the surface, the Weisselberg charges did seem like “smaller fish”. In an interview with Politico, Trump’s lawyer Ronald Fischetti said: “It’s like the Shakespeare play Much Ado About Nothing. This is so small that I can’t believe I’m going to have to try a case like this.”

But surfaces can be deceptive.

After three years of subpoenas, supreme court hearings and existential legal rows about the legality of charging a president of the United States with wrongdoing, New York’s fearsome prosecutorial team have charged a little-known 73-year-old accountant with defrauding taxpayers of $1.7m over 15 years. That is big money for most people, but not an amount that would worry Trump, who Forbes calculates is worth $2.4bn.

Downplaying the significance of this week’s indictment would, however, be a mistake. Alongside Weisselberg, Manhattan district attorney Cyrus Vance, and the New York state attorney general Letitia James also charged the Trump Organization with tax fraud, the start of a process that could crack the secretive Trump empire wide open.

The salvo in the long-brewing legal battle will, at the very least, wrap up Trump for years in legal woes, and at worst could destroy his family business and put not just Weisselberg but the Trump family members who run his business and Trump himself in the dock.

The indictment would “raise the unprecedented prospect of a former president having to defend the company he founded and has run for decades against accusations of criminal behavior,” Cohen cooed.

No longer insulated by claims of presidential protections, Trump faces a flotilla of legal actions. Alongside the charges brought this week against Weisselberg and the Trump Organization, Vance and James are investigating questionable payments to former Trump sex partners and whether the value of real estate in his company’s portfolio was manipulated to defraud insurance companies and banks and to generate unlawful tax breaks.

In some ways, the charges against Weisselberg give us a glimpse of the bumpy road ahead for the former president.

“This has been framed as a ‘fringe benefits’ issue,’” said University of Chicago Law School professor Daniel Hemel, an expert on taxation and federal courts. “Another way of looking at it is that the Trump Organization was paying its CFO [chief financial officer] under the table.”

Such a move – if proven – would be an extraordinary thing for a company the size of Trump’s to have done, and will likely lay the groundwork for what’s ahead.

Ironically, one parallel case Hemel pointed to was the prosecution of Leona Helmsley, the late Manhattan hotel empress and long-time sparring partner of Donald Trump.

Helmsley v Trump was a Manhattan feud for the ages. Trump was an admirer of Harry Helmsley, the billionaire property tycoon who once owned the Empire State Building. Leona Helmsley not so much. He once called her a “disgrace to humanity”. Helmsley simply said:


“I hate Donald Trump.”

In 1988 the Helmsleys were charged with evading more than $4m in income taxes. In another historical twist, the charges were brought by Rudy Giuliani, then federal prosecutor and more recently one of Trump’s staunchest allies.

The following year, Helmsley – her husband was too sick to stand trial – was sentenced to four years in jail after being found guilty on 33 counts of tax evasion including fraudulently charging a $1m marble dance floor for their private mansion to their hotel and real-estate empire.

“These are things that are unequivocally not business expenses,” said Hemel. Even Trump agreed, saying shortly after Leona Helmsley’s death that it was “foolish” for her husband to have committed tax evasion “because he was such a rich man”.

Given that sentiment, why would the Trump Organization – allegedly – cook the books for such relatively small sums?

The coming cases may provide an answer. Both Weisselberg and the company deny any wrongdoing, and have said they will fight the case in court, but the cases will blow open Trump’s finances, something he has fought hard to prevent, even going as far as to go against recent presidential precedent and refusing to release his tax returns.

But while there are many similarities between the polarizing property plutocrats Trump and Helmsley, Trump’s case is in many ways unusual.

First, said Hemel, it’s highly unusual a business as large as Trump’s would engage in these kinds of alleged tax frauds. With its army of lawyers and accountants, it should have been easy enough for his advisers to find perfectly legal ways to avoid paying taxes – just as ProPublica’s revelations have shown his billionaire peers have done.

Second, when a tax-avoidance scheme is exposed as potentially open to prosecution, it is highly unusual for businesses to fight those charges. The normal course of action is to apologize and pay up.

Add on that in this case the man at the top is a former president of the United States and: “Everything about this case is unusual and everything about it is political,” said Hemel. “That doesn’t mean the district attorney is wrong to go after it.”

In the high-stakes chess game Vance and James are now playing against Trump, this is an opening move that immediately threatens one of their opponent’s key pieces.

Weisselberg has worked for the Trump family for close to 50 years. Outside the family, and arguably inside, no one knows how the Trump business really operates better than him. His two sons have worked with Trump. Jennifer Weisselberg, one of his son’s ex-wives, is a key witness for the prosecution and has handed over what her lawyer, Duncan Levin, describes as 10 banker’s boxes of evidence to the authorities.

The pressure is on for Weisselberg to flip but his indictment also puts pressure on Trump insiders lower down the tree.

Robert Mintz, a former federal organized crime prosecutor and now partner at law firm McCarter & English, said: “Complex white-collar fraud cases are very difficult to prove, and generally require more than financial records to demonstrate clear evidence of criminality. Prosecutors typically build these cases with the benefit of a cooperating witness who can walk them through the documents and add an insider’s perspective to the conspiracy.”

As Cohen pointed out this week Trump can no longer hold out the promise of a presidential pardon to his allies. Facing potential ruin and jail time, will Weisselberg stay true? And as the charges keep coming, where will others decide their loyalty lies?

“Loyalty is hard to maintain when it can put you in jail,” said Hemel.

The US Department of Justice on Friday ordered the Internal Revenue Service to hand Donald Trump’s tax returns to a House committee, saying the panel had “invoked sufficient reasons” for requesting them.

‘Just say the election was corrupt,’ Trump urged DoJ after loss to Biden


The news was a second blow for Trump in a matter of hours, after released DoJ memos revealed that as part of his campaign to overturn his election defeat by Joe Biden, he pressured top officials to falsely label the 2020 election as corrupt, then “leave the rest to me”.

House speaker Nancy Pelosi applauded the DoJ’s order to the IRS to release Trump’s tax returns to the ways and means committee.

“Today, the Biden administration has delivered a victory for the rule of law, as it respects the public interest by complying with Chairman [Richard] Neal’s request for Donald Trump’s tax returns,” Pelosi said in a statement.

“Access to former President Trump’s tax returns is a matter of national security. The American people deserve to know the facts of his troubling conflicts of interest and undermining of our security and democracy as president.”

Candidates for president traditionally disclose their tax returns, although they are not legally compelled to do so. Trump kept his out of the public eye when he ran for the White House in 2016, saying they were under IRS audit, and did not release them while in office.

Once Democrats took control of the House in 2018, amid the investigation of Russian election interference and links between Trump and Moscow by the special counsel, Robert Mueller, they began to seek the records in court.

Trump fought hard to keep his tax returns out of the public eye but the New York Times obtained some of the records, which showed Trump paid almost nothing in federal income taxes in the years before he entered the White House.

In a memo on Friday, the DoJ Office of Legal Counsel said Neal, the Massachusetts congressman who chairs the ways and means committee, had “invoked sufficient reasons for requesting the former president’s tax information”.

Under federal law, the OLC said, the Department of the Treasury “must furnish the information to the committee”.

The 39-page memo was signed by Dawn Johnsen, installed by the Biden administration as the acting head of the OLC.

Trump’s treasury secretary, Steven Mnuchin, said he would not turn over Trump’s tax returns because they were being sought for partisan reasons.

The House ways and means committee sued for the records under a federal law that says the IRS “shall furnish” the returns of any taxpayer to a handful of top lawmakers. The committee said it needed Trump’s taxes for an investigation into whether he complied with tax law.

Trump’s justice department defended Mnuchin’s refusal and Trump intervened to try to prevent the materials from being turned over to Congress. Under a court order from January, Trump would have 72 hours to object after the Biden administration formally changes the government’s position in the lawsuit.

Bill Pascrell, a New Jersey Democrat who chairs the House ways and means subcommittee on oversight, said: “It is about damn time. Our committee first sought Donald Trump’s tax returns on 3 April 2019 – 849 days ago. Our request was made in full accordance with the law and pursuant to Congress’s constitutional oversight powers.”

Daniel Goldman, an attorney who counselled Democrats during Trump’s first impeachment inquiry and trial, said: “The former OLC opinion supporting Mnuchin’s ability to withhold Trump’s tax returns was perhaps the most egregious and baseless opinion of many bad ones during the Trump era.”

Michael Stern, a former senior counsel for the House Office of General Counsel, told Politico Trump had options to stop the release of his returns.

“I think Trump will be given an opportunity to either file a new case or file something in this case in which he states his legal grounds for objecting to his tax returns being produced,” he said, adding:


“It’s definitely not over yet.”

Elsewhere, the Manhattan district attorney, Cyrus Vance Jr, has obtained copies of Trump’s personal and business tax records as part of a criminal investigation.

Trump tried to prevent his accountants from handing over the documents, taking the issue to the supreme court. The justices rejected Trump’s argument that he had broad immunity as president.

Speaking to Reuters about the DoJ order, Richard Painter, a University of Minnesota law professor who was ethics counsel to George W Bush, said


It seems the Biden justice department is no longer going to simply kowtow to Donald Trump”.

“Every other president has disclosed their tax returns” he said, “and finding out what the conflicts of interest are on the president or a former president who may have made decisions that now have to be revisited – that’s critically important.”

Fruman was charged in 2019 with arranging hundreds of thousands of dollars in donations to Republicans and Pacs while trying to get Americans interested in investigating Biden’s son in Ukraine.

A man who helped Rudy Giuliani try to unearth damaging information about President Joe Biden in Ukraine is expected to plead guilty in a case alleging illegal campaign contributions to US politicians, according to a court filing.

Igor Fruman was charged in 2019 with arranging hundreds of thousands of dollars in donations to Republicans and political action committees while trying to get Americans interested in investigating Biden’s son in Ukraine.

A court filing Monday said a hearing had been scheduled for Wednesday for Fruman to change his plea in the case. The court filing did not include details on which charges were involved in Fruman’s change of plea.

His attorney and spokespeople for the US attorney in Manhattan didn’t immediately return messages seeking comment.

Fruman and an associate, Lev Parnas, worked with Giuliani to try to convince Ukraine to open an investigation into Hunter Biden over his connection to a Ukrainian energy company.

Giuliani, a Republican, has acknowledged working extensively with the pair in connecting with Ukranian figures but said he had no knowledge of any illegal campaign contributions they may have made. Giuliani is not charged in the case.

Federal investigators in April seized electronic devices from Giuliani as part of a long-running investigation into whether his dealings with Ukrainian officials might have required to register as a foreign agent.

Giuliani has said he did nothing wrong and that the investigation is politically motivated.

Regulators are probing Digital World Acquisition Corp, the firm set to merge with Trump Media and Technology Group (TMTG).

According to a filing on Monday, the US Securities and Exchange Commission (SEC) requested documents about its investors and trading.

TMTG plans to launch a social media app called Truth Social early next year.

The filing states that the SEC also asked to see information detailing the relationship between Digital World and TMTG.

It also said that the Financial Industry Regulatory Authority (FINRA) is probing the deal as well.

The SEC told the BBC it does not comment on the "existence or nonexistence of a possible investigation".

The BBC has contacted TMTG for comment.


The SEC was requested by Democratic Senator Elizabeth Warren last month, to investigate the proposed merger of the two firms for potential violations of securities laws.

Digital World is a so-called special purpose acquisition company (Spac) or "blank cheque company".

Spacs, which became a major story in the US stock market at the start of this year, are shell companies that are set up with the sole purpose of merging with a private firm to take it public. However, they have lost much of their lustre after some of the companies that merged with them failed to deliver on their ambitious financial projections.

On Saturday, Mr Trump's firm said it had secured $1bn from "a diverse group of institutional investors" without revealing who they were. According to reports, the social media venture is now valued at almost $4bn.

The former US president is still banned from Twitter and Facebook following the 6 January attack on the US Capitol.

At the time he was banned Mr Trump had 89 million followers on Twitter, 33 million on Facebook and 24.5 million on Instagram, according to a presentation on his company's website.

Accounting Firm Dumps Trump Over Dubious Financial Statements

Donald Trump's accounting firm has cut ties with the former president and said a decade of financial reports should "no longer be relied upon".


The firm, Mazars, said in a letter to the Trump Organization that it could not stand behind statements it had prepared for Mr Trump from 2011-20.




But Mazars said it had not concluded they contained material discrepancies.

The letter was revealed in a court filing as part of a fraud investigation into the Trump Organization.

In the filing, New York Attorney General Letitia James repeated her request that the former president and his daughter, Ivanka, give evidence under oath. Her office has already questioned Mr Trump's son, Eric Trump.

Ms James last month said her civil inquiry into the Trump family firm had uncovered what she claimed was "significant evidence" of misleading business practices, including over-valuing certain assets.

In its letter, Mazars wrote that the findings of Ms James' investigation had contributed to the conclusion that the statements should no longer be relied upon.

The firm also said it performed its work in "accordance with professional standards", and compiled the reports based on information provided by the Trump Organization.

"While we have not concluded that the various financial statements, as a whole, contain material discrepancies, based upon the totality of the circumstances, we believe our advice to you to no longer rely upon those financial statements is appropriate," the letter said.

It added that the firm would no longer be working with the Trump Organization.


The financial documents are at the heart of the New York attorney general's civil investigation and a second, criminal inquiry by the Manhattan District Attorney's office.

In January Ms James, a Democrat, accused the Trump Organization of using "fraudulent or misleading asset valuations" to get loans, insurance and tax breaks.

Mr Trump's lawyers are trying to stop Ms James from questioning the former US president and his children, and he has sued her to try to halt the probe.

A spokesperson for the Trump Organization said the letter from Mazars renders the investigations moot, because it suggests that the financial statements do not contain material discrepancies, according to CBS News.
Mr Trump, a Republican, has previously said both inquiries are politically motivated and has referred to Ms James' investigation as a "hoax".


Trump’s Taxes: Why They Matter to a Criminal Probe





A criminal investigation into the financial affairs of former US President Donald Trump and his family business gained momentum last year.



On 22 February 2021 the Supreme Court ordered Mr Trump to hand over his tax returns and other financial records to prosecutors in New York.





The ruling was a setback for Mr Trump, who had sought to prevent prosecutors from seeing his records for months.

The records are considered to be central to the criminal investigation.

They could be "a pretty important piece of the puzzle", Daniel R Alonso, a former US federal and New York state prosecutor, told the BBC.

You may be asking: what is this criminal investigation, and what is the significance of Mr Trump's records?


Here, we explain what it's all about.

What is The Investigation?


Let's start with the basics.


This is a criminal investigation being carried out by prosecutors in the state of New York.

Cyrus Vance, the former Democratic district attorney of Manhattan, was the lead prosecutor in the investigation until the new district attorney took over on 1 January.

This is Alvin Bragg, who is now leading the case.

He and his team are merely looking into the possibility of crimes at the moment.

Mr Trump, a Republican, has continuously denied wrongdoing and suggested the investigation is politically motivated.

As part of the investigation, they are examining the financial and tax affairs of Mr Trump and his family business, the Trump Organization.

The family business and its finance chief have been charged with helping executives evade taxes.

Lawyers for the firm and the finance chief have pleaded not guilty to tax fraud.

Criminal probe into Trump's 'find the votes' call


It is one of two known criminal investigations into Mr Trump. The other concerns alleged attempts by Mr Trump to overturn results from November 2020's presidential election in the state of Georgia.


How did we get here?


The investigation began in 2018, when Mr Trump was still president.

At first, the investigation examined the Trump Organization's role in hush-money payments made during the 2016 presidential campaign to two women who said they had had affairs with Mr Trump.


Michael Cohen - Mr Trump's former personal lawyer - was jailed for his role in the scheme under federal, or national, laws in 2018.


Meanwhile, the district attorney has been assessing whether the Trump Organization broke any state laws in New York in relation to the payoffs.

So that's it? No, not quite.


The investigation has widened to include other possible crimes.



The New York Times, citing unnamed sources, said last year that Mr Vance, the district attorney at the time, had "been examining whether Mr Trump, his company and its employees committed insurance, tax and banking fraud, among other crimes".

This is where the tax and financial records come in.



The investigating team needs them to establish if any crimes have been committed.

For months they have been trying to obtain eight years' worth of Mr Trump's personal and corporate tax returns.

In July 2020, the Supreme Court ruled that Mr Trump's records could be examined by the prosecutor's office.

But lawyers representing Mr Trump challenged that ruling, suggesting that the court filing was "wildly overbroad" and issued in bad faith.


On 22 February last year, the court rejected that argument.

The Supreme Court ruling has paved the way for prosecutors to begin combing through Mr Trump's financial records


The ruling meant that the district attorney could now gain access to the records, allowing him and his team to pore over them.

"The significance is quite large," Mr Alonso said of the ruling. "I mean that in the sense that it is significant and there are going to be a lot of documents. These documents could be in the millions."

In a succinct statement addressing the ruling, the former district attorney Mr Vance said: "The work continues."

By contrast, Mr Trump dismissed the investigation as a "political witch hunt".


What could prosecutors learn from the tax records?


The records will give prosecutors a fuller picture of Mr Trump's financial affairs.

For example, prosecutors may be able to explore certain investigative theories, seek interviews with witnesses, and establish whether any state laws have been violated.

As well as Mr Trump's tax returns, analysis by accountants and their communications with their client could be included in the tranche of records, Mr Alonso said.

"All that stuff is going to be important, given the allegations that are out there," he said.

We know from court filings that Mr Vance had mentioned tax fraud as a hypothetical crime, should evidence be found to support it.

Mr Vance has been looking into the financial affairs of Mr Trump and his family business for two years


Many wealthy Americans use loopholes to reduce the amount of tax they are legally bound to pay.

But the records could be crucial in determining the legality of accounting methods Mr Trump and his company may have used.

It will take time for investigators to review the records. The investigation has run beyond the end of Mr Vance's term as an elected district attorney. Mr Bragg has since inherited the case and is leading it.

So, as you can probably tell, much remains unclear.


How serious could this be for Trump?


"It's not one to be taken lightly," Mr Alonso said. "Clearly, it's a substantial investigation."

At this point, it is not clear whether prosecutors will file any criminal charges against Mr Trump, his company, or his business partners.

The investigation may come to nothing.

However, if prosecutors do find evidence of wrongdoing, criminal proceedings are a possibility.

In New York, some types of tax fraud can be charged as crimes known as felonies, which can carry lengthy prison sentences.




Hypothetically, Mr Trump could be summoned to court for a criminal trial in New York, in the event he is charged.

This outcome - albeit theoretical at this point - would seriously undermine Mr Trump's chances of a political comeback.

At the moment, though, Mr Trump's tax records merely give the district attorney's office the opportunity to expand its investigation, nothing else.

Donald Trump and two of his children have been ordered by a New York judge to appear for a deposition within the next three weeks, as part of the billowing investigation over alleged fraud in the valuation of assets belonging to his family business.



The ruling by Judge Arthur Engoron to force Trump and his two eldest children – Donald Jr and Ivanka – to comply with subpoenas amounts to a sharp escalation of the legal perils that are rapidly tightening around the former president.


The family has been striving to fend off demands for documents, information and testimony from the New York state attorney general, Letitia James. She is investigating whether the Trump Organization used “fraudulent or misleading” valuations of its assets to attract loans and reduce its tax burden.

Following a two-hour hearing on Thursday, Engoron delivered a blunt rebuttal to arguments put forward by Trump lawyers that the former president should not be subjected to questioning in the civil case because the information could be used against him in criminal proceedings that are running in parallel. The judge went so far as to say that had James not subpoenaed them, it would have been “a blatant dereliction of duty”.

Responding to the news, James said that it showed that “no one will be permitted to stand in the way of the pursuit of justice, no matter how powerful they are”.

Under the judge’s ruling, Trump must now testify within 21 days and hand over “documents and information” within 14 days. The development is the second severe blow for the former president in the space of a week.

On Monday, it was revealed that the longtime accounting firm for the Trump Organization, Mazars USA, had broken off ties with the family business, saying that it could no longer stand by 10 years of annual financial statements that it had prepared for the group.

The accountants said that they had reviewed the “totality of the circumstances” and reached the conclusion that “we are not able to provide any new work product” to the Trumps.


The New York attorney general’s office says, Tuesday, Jan. 18, its civil investigation has uncovered evidence that former President Donald Trump's company used “fraudulent or misleading” asset valuations to get loans and tax benefits.


Trump Organization’s accountants cut ties, calling years of filings unreliable


Now Trump and his two children must face questioning by James, New York state’s top prosecutor who has relentlessly pursued alleged irregularities in the family’s finances. The event is likely to present the former president with a legal and political conundrum.

Should he answer James’s piercing questions, he risks potentially implicating himself in a criminal investigation into Trump accounts that is being conducted by James in tandem with the Manhattan district attorney Alvin Bragg. If he pleads the fifth amendment and remains silent that could also be difficult for him.

Responding to the ruling in a statement on Thursday, Trump accused James’ office of “doing everything within their corrupt discretion to interfere with my business relationships and with the political process”.

Trump called the ruling “a continuation of the greatest witch-hunt in history and remember, I can’t get a fair hearing in New York because of the hatred of me by judges and the judiciary. It is not possible”.

In legal arguments before Engoron delivered his decision, lawyers for Trump argued that he could not feasibly plead the fifth without hurting his potential criminal defense.

“If he goes in and follows my advice, which will be you cannot answer these questions without … immunity because that’s what the law provides, and take the fifth amendment, that’ll be on every front page in the newspaper in the world. And how can I possibly pick a jury in that case?” said Ronald Fischetti, Trump’s criminal defense lawyer.

Politically, the deposition is also likely to be awkward. In the past, Trump has poured scorn on those who remain silent under questioning. During his 2016 presidential election campaign, he ridiculed the practice, saying “the mob takes the fifth. If you’re innocent, why are you taking the fifth amendment?”

Michael Cohen, an ex-vice president of the Trump Organization, said the issue raised problems for his former boss. “Let’s not forget Trump’s declaration that only guilty people plead the fifth. I wonder if that applies to him and his children as and when they remain silent,” Cohen told the Guardian in response to Engoron’s ruling.

The judge referred to Cohen in his decision, pointing out that it was the testimony of Trump’s former personal lawyer before the House oversight committee in February 2019, in which Cohen accused Trump of “cooking the books”, that triggered the James investigation in the first place.

Cohen, who spent three years in prison himself for fraud and other offences, told the Guardian that it was “only in Trump’s delusional world that law enforcement should not be permitted to depose him and members of his family. Their concerns stem from their inability to tell the truth and risk additional perjury charges.”

Trump has consistently denounced the investigation by James, who is a Democrat, as a partisan witch-hunt. On Tuesday he slammed the investigation yet again, calling it a “sham investigation of a great company that has done a spectacular job for New York and beyond”.

Such an aggressive posture has worked for Trump over the years in staring down many of the legal challenges brought against him. But in this case, Thursday’s ruling is likely to put new wind into the sails of the James investigation and make an easy get-out clause less likely.

The James investigation, combined with its criminal Manhattan equivalent, are now top of the league of a plethora of legal troubles facing the former occupant of the White House. A Guardian tally this month found that Trump was facing a total of 19 legal challenges, six of which involve alleged financial irregularities.

New York's top lawyer has asked a state judge to hold Donald Trump in contempt of court, for failing to turn over files for an investigation into his business practices.

A judge previously ordered Mr Trump to provide the files as part of Ms James's probe into the Trump Organization.

The former president's lawyer called the motion "frivolous".

The New York attorney general opened a civil inquiry in 2019 into claims that - before he took office - Mr Trump had inflated the value of his assets to banks when seeking loans.

Mr Trump and his family have denied wrongdoing and the former president has called the inquiry a "witch hunt".

In February, a judge ruled that Mr Trump, his son Donald Trump Jr, 44, and daughter Ivanka Trump, 40, must answer questions under oath in the New York investigation into their business practices.

They appealed the order to appear but did not object to a separate part of the ruling that the former president comply with a subpoena "seeking documents and information". Those were meant to be produced by 31 March.

In court documents filed on Thursday, the New York attorney general said Mr Trump has not produced the requested documents and has raised objections "based on grounds such as overbreadth, burden, and lack of particularity".

"The judge's order was crystal clear: Donald J Trump must comply with our subpoena and turn over relevant documents to my office," Ms James said in a statement.

Ms James has repeatedly blamed Mr Trump for creating unnecessary delays in the legal process.

Mr Trump's lawyer, Alina Habba, said in a statement sent to Reuters that: "We are prepared to adamantly oppose the frivolous and baseless motion filed by the attorney general's office.

"Our client has consistently complied with the many discovery requests served by the attorney general's office over the years."

The civil case is separate to a Manhattan criminal investigation into the Trump Organization's practices.

New York Attorney General Letitia James had asked the court to hold Mr Trump in contempt after he missed a March deadline to present certain documents.

Mr Trump's lawyer said she would appeal the ruling.

"Everything that your honour and the attorney general said that we haven't done - we have done," attorney Alina Habba said in court.

After a "very diligent" search, there were simply no more relevant documents to provide, she said.

Ms James, a Democrat, opened a civil inquiry in 2019 into claims that - before he took office - Mr Trump, a Republican, had inflated the value of his assets to banks when seeking loans.

The stakes have been raised in this year's long legal wrangle between Trump and New York's dogged state attorney general.


Letitia James has accused the former president of stonewalling - and now she's successfully made it that much more costly for him not to comply with her requests.


$10,000 a day adds up quickly, and if that isn't enough to convince him to provide the requested materials, the judge could yet increase the fines further.

That's not out of the realm of possibility given the judge's remark that - while Donald Trump takes his business seriously - so does the judge.



Mr Trump and his family have denied wrongdoing, and the former president has called the inquiry a "witch hunt". In court on Monday, Ms Habba called the civil probe as a "fishing expedition".

Justice Engoron said a contempt finding was warranted because of what he called "repeated failures" to hand over the requested materials.

"Mr Trump... I know you take your business seriously, and I take mine seriously. I hereby hold you in civil contempt," he said, although the former president was not in the courtroom.

The attorney general's office called the ruling a "major victory" in the legal battle against Mr Trump.

"Today, justice prevailed," said Ms James. "For years, Donald Trump has tried to evade the law and stop our lawful investigation into him and his company's financial dealings.

Today's ruling makes clear: no one is above the law."

The civil case is separate to a Manhattan criminal investigation into the Trump Organizations' practices.

New York’s highest court has rejected Donald Trump’s last-ditch effort to avoid testifying in the state attorney general’s civil investigation into his business practices, clearing the way for his deposition next month.



The state’s court of appeals said there was no “substantial constitutional question” that would warrant its intervention in the matter, following an intermediate appellate court’s ruling last month enforcing a subpoena for Trump’s testimony.

The court also dismissed a motion by Trump’s lawyers to stay the subpoenas, saying that doing so would be “academic”, since it wasn’t taking up the former president’s appeal in the first place.


Trump and his two eldest children, Ivanka and Donald Trump Jr, agreed last week to answer questions under oath starting 15 July unless the court of appeals decided to step in.


A message seeking comment on Tuesday’s ruling was sent to Trump’s lawyer. Alan Futerfas, a lawyer for Ivanka and Donald Trump Jr, declined comment. A message was also left with a spokesperson for Letitia James, the attorney general.

The appellate division of the state’s trial court ruled 26 May that the Trumps had to undergo a deposition, upholding a lower court’s ruling that James’ office had “the clear right” to question Trump and certain other figures in his company, the Trump Organization.

James has said her three-year investigation has uncovered evidence that the Trump Organization exaggerated the value of assets including skyscrapers, golf courses and even his Manhattan penthouse to get loans, insurance and tax breaks for land donations.

A lawyer for her office told a judge last month that evidence could support legal action against the former president, his company or both, though the attorney said no decision had been made.

Trump has decried the investigation as part of a politically motivated “witch-hunt” against him.

Federal investigators have searched Donald Trump’s Mar-a-Lago resort in Palm Beach, Florida, including the contents of a safe, the former president said in a statement on Monday, the latest indication of an intensifying criminal investigation by the Justice Department into his affairs.


The FBI executed a search warrant Monday morning at Trump’s residence that came as part of an investigation into Trump’s potentially unlawful removal and destruction of White House records after his presidency, according to two sources familiar with the matter.


CPAC began in 1974, and is a conference that brings together and hosts conservative organizations, activists, and world leaders in discussing current events and future political agendas.


The move by the Justice Department to search Mar-a-Lago over the removal of 15 boxes of presidential records from the White House, including classified documents, as well as the destruction of other materials, marks a dramatic escalation in the inquiry.

“My beautiful home, Mar-A-Lago in Palm Beach, Florida, is currently under siege, raided, and occupied by a large group of FBI agents,” Trump said in a bitter statement on Monday evening, adding: “They even broke into my safe!”


Trump has previously come under scrutiny for his flagrant violations of the Presidential Records Act of 1978 – mandating the preservation of White House documents – but the search for the first time, appears to indicate potential legal jeopardy for Trump over his records practices.


The statute governing the willful and unlawful removal or destruction of presidential records, though rarely enforced, carries significant penalties including: fines, imprisonment and, most notably, disqualification from holding current or future office.

A spokesperson for the Justice Department declined to comment.

The former president was not at Mar-a-Lago at the time of the raid and was at his golf club in Bedminster, New Jersey, one of the sources said. By the time Trump issued the statement, suggesting the raid was ongoing, the FBI had already left the property.

During his presidency, Mar-a-Lago was known as Trump’s “winter White House”. Trump and his wife, Melania, returned to the Florida resort after leaving Washington and since then, the president has made it the center of his political dealings.

The raid comes as Trump has been laying the foundations for another presidential run in 2024, and in the wake of a series of damning public hearings that laid out his and his allies’ roles in the events leading up to the Capitol attack last year.


In a furious statement, Trump compared the FBI raid to “Watergate” and sought to blame it on “Radical Left Democrats” who he said “desperately don’t want me to run for president in 2024 … who will do anything to stop Republicans and Conservatives in the upcoming midterms elections”.

The FBI is headed by Christopher Wray, who was appointed by Trump before he left office.



The Justice Department has been quietly examining the prospect of opening a criminal investigation into the matter of Trump’s removal of documents since at least April, according to a source with knowledge of the inquiry.






The National Archives and Records Administration transferred records in January from the Trump White House to the House January 6 committee.



In January, as the National Archives and Records Administration (Nara) prepared to transfer records from the Trump White House to the House select committee investigating January 6, it found around 15 boxes worth of materials had been improperly taken to Mar-a-Lago.

The records were eventually returned to Nara after negotiations with Trump’s lawyers – only for officials to then discover that the former president had taken with him some documents clearly marked as classified and sensitive for national security.

Also in the boxes: a letter left for Trump by his predecessor as president, Barack Obama, “love letters” from Kim Jong-un of North Korea, and a model of Air Force One with red-white-and-blue livery Trump chose but was scrapped by the Biden administration.

“Because Nara identified classified information in the boxes,” the chief archivist David Ferriero said in a letter to Congress at the time, “Nara staff has been in communication with the Department of Justice.”

The saga also prompted the House oversight committee, led by congresswoman Carolyn Maloney, to open a separate investigation that noted “removing or concealing government records is a criminal offense”. Trump must be held accountable, the New York Democrat said.


The news appeared set to inflame Trump supporters and add fuel to Republican claims that the former president is being unfairly targeted. A small group of Trump supporters were seen gathering outside Mar-a-Lago on Monday evening after the news broke, according to the Palm Beach post.

Mr Trump had sued in an effort to block the interview at the New York attorney general's office on Wednesday.



State officials accuse the Trump Organization of misleading authorities about the value of its assets in order to get favourable loans and tax breaks.


Mr Trump denies wrongdoing and has called the civil probe a witch hunt.

An hour after he was pictured arriving at the Manhattan office where he was questioned under oath, Mr Trump released a statement in which he criticised New York Attorney General Letitia James and the broader investigation.

"Years of work and tens of millions of dollars have been spent on this long simmering saga, and to no avail," he said. "I declined to answer the questions under the rights and privileges afforded to every citizen under the United States Constitution."

Ms James' office confirmed that the interview took place on Wednesday and that "Mr Trump invoked his Fifth Amendment right against self-incrimination".

"Attorney General James will pursue the facts and the law wherever they may lead," the statement added. "Our investigation continues."


His deposition comes just days after the FBI executed an unprecedented search warrant at his Florida estate, Mar-a-Lago, as part of a separate investigation that is reportedly linked to his handling of classified material.

While the attorney general's investigation is a civil one, a parallel investigation is being carried out by the Manhattan District Attorney's office which could result in criminal charges.

Legal analysts suggest Mr Trump may have declined to answer questions on Wednesday because his answers could have been used against him in that criminal investigation. The former president invoked the Fifth Amendment, which protects people from being compelled to be a witness against themselves in a criminal case.





Trump on People Pleading The Fifth Amendment: 'Disgraceful'


The questioning lasted around four hours, and included lengthy breaks, his lawyer Ronald Fischetti told US media.

Trump began by reading a statement into the record condemning the attorney general and her investigation and invoking his Fifth Amendment rights.

He proceeded to say "same answer" to every question he was asked.



Ms James' office has said that the depositions - a legal term that means testimony not given in court - were among the last remaining investigative procedures to be carried out.

Once the investigation concludes, the state attorney general could decide to bring a lawsuit seeking financial penalties against Mr Trump or his company.

Ms James had sought Mr Trump's deposition - and that of two of his children, Ivanka and Donald Trump Jr - for more than six months while the family resisted subpoenas through the New York court system.

Lawyers for Mr Trump had also attempted to sue Ms James in a bid to prevent her from questioning the former president and his children.



But in February, a New York Supreme Court judge ruled that all three must sit for depositions. Ivanka and Donald Trump Jr were questioned earlier this month.

The judge said the investigation had uncovered "copious evidence of possible financial fraud" giving the attorney general a "clear right" to question under oath the former president and two of his children involved in the business.


Ms James hailed the judge's decision as a victory, saying that "justice has prevailed".

The investigation, which was first opened in 2019, seeks to prove that Mr Trump and the Trump Organization misrepresented the value of assets in order to obtain favourable loans and tax breaks. The alleged fraud is said to have taken place before Mr Trump took office.

His target? You've guessed it - Hillary Clinton. Some of her former staffers had exercised their right to silence during a congressional inquiry.

The boot is now on the other foot, as they say.



"I once asked," said his statement on Wednesday - published while his deposition by the New York attorney general was still ongoing - "If you're innocent why are you taking the Fifth Amendment?"

"Now I know the answer to that question," he concluded, suggesting that he had been left with no choice.

There are parallels here - in terms of Mr Trump's response - with the separate investigation into his handling of official documents, thought to have been the reason for the recent search of his Florida estate.

While his allies have been demanding answers from officials over the unprecedented action, he could choose to provide some himself. That's because he'll have a copy of the warrant and the inventory of material removed from his property.

Yet his public statements suggest he's been left in the dark, and he has repeatedly attacked the process.

His supporters may believe the narrative that he is being persecuted. But - as Trump himself once did - others may see his refusal to answer questions as a sign there's substance to the case against him.

The FBI took 11 sets of classified files in a search of ex-US President Donald Trump's estate in Florida this week, according to a search warrant.





The cache includes documents marked "TS/SCI", a designation for top secret material that could cause "exceptionally grave" damage to US national security.

Trump denies any wrongdoing and said the items were declassified.

It was the first time an ex-president's home was searched in a criminal probe.


The list of items was made public on Friday afternoon after a judge unsealed a seven-page document that included the warrant authorising the search of Mr Trump's Palm Beach residence, Mar-a-Lago.


It said more than 20 boxes of items were taken on Monday, including a binder of photos, a handwritten note, unspecified information about the "President of France" and a clemency letter written on behalf of long-time Trump ally Roger Stone.


As well as four sets of top secret files, the list includes three sets of "secret documents" and three sets of "confidential" material.

The warrant indicates that FBI agents were looking into potential violations of the Espionage Act, which makes it illegal to keep or transmit potentially dangerous national security information.

The removal of classified documents or materials is prohibited by law. Mr Trump increased the penalties for the crime while in office and it is now punishable by up to five years in prison.

The warrant notes that the locations searched at Mar-a-Lago include an area called the "45 office" and storage rooms, but not private guest suites being used by Mr Trump and his staff.

The justice department had asked a court to make it public on Thursday, a move considered rare amid an ongoing investigation.

It was approved by a judge on 5 August, three days before it was carried out on Monday, 8 August.

On Friday night, Mr Trump's office issued a statement maintaining that he had used his authority while president to declassify the documents.

"He had a standing order that documents removed from the Oval Office and taken into the residence were deemed to be declassified," the statement said.

"The power to classify and declassify documents rests solely with the President of the United States.

"The idea that some paper-pushing bureaucrat, with classification authority delegated by the president, needs to approve of declassification is absurd."

Legal experts have told US media it is unclear whether this argument would hold up in court. "Presidents can declassify information but they have to follow a procedure," Tom Dupree, a lawyer who previously worked in the justice department, told the BBC.

"They have to fill out forms. They have to give certain authorisations. They can't simply say these documents are declassified. They have to follow a process [and it is] not clear that was followed here."

A spokesman for Mr Trump, Taylor Budowich, said the administration of President Joe Biden "is in obvious damage control after their botched raid".

Mr Budowich accused the administration of "leaking lies and innuendos to try to explain away the weaponisation of government against their dominant political opponent".

Mr Trump's conservative allies have also condemned the raid as a political hit job as he considers another run for the presidency in 2024.


Law enforcement agencies around the country are reportedly monitoring online threats against government officials that have emerged in the wake of the FBI search.

US Attorney General Merrick Garland, who personally approved the warrant, defended federal agents on Thursday as "dedicated, patriotic public servants".

"I will not stand by silently when their integrity is unfairly attacked," he told reporters.

FBI agents searched Mar-a-Lago to find out if Mr Trump improperly handled government records when he left office.

It was the first time an ex-president's home was raided in a criminal probe.

Eleven sets of classified files were recovered from the search one week ago at the estate in Palm Beach, according to the warrant, which was released on Friday.

Now, several news organisations have applied to have the affidavit unsealed.

But prosecutors said on Monday that such a move would "cause significant and irreparable damage to this ongoing criminal investigation".

"If disclosed, the affidavit would serve as a roadmap to the government's ongoing investigation, providing specific details about its direction and likely course, in a manner that is highly likely to compromise future investigative steps," they wrote in a court filing.

They also said the affidavit must stay sealed because the inquiry involves "highly classified materials".

On Monday, Mr Trump said the FBI took three of his passports during the raid - a step that would ordinarily only be taken if investigators deemed a suspect a flight risk.

"This is an assault on a political opponent at a level never seen before in our Country. Third World!" Mr Trump posted on his social media platform, Truth Social.

A law enforcement source later confirmed to CBS News - the BBC's US partner - that passports belonging to Mr Trump had been taken by investigators on 8 August.

In an email from the justice department to Mr Trump's team, an official said: "We have learned that the filter agents seized three passports belonging to President Trump, two expired and one being his active diplomatic passport" - and that they had been made available for pickup on Monday.

US media reports suggest the passports have now been returned.


The FBI search has triggered an angry backlash from Trump allies, with many demanding the affidavit be publicly unveiled.

Republican Senator Mike Rounds told NBC on Sunday: "The justice department should show that this was not just a fishing expedition, that they had due cause to go in and to do this, that they did exhaust all other means."

Congressman Jim Jordan, an Ohio Republican, told Fox News that 14 FBI agents had come forward to him to blow the whistle on purported politicisation at the justice department.

Search warrants typically must be signed off by a judge, once prosecutors have demonstrated they have probable cause to believe a crime has been committed.

The warrant used in the Trump raid was made public on Friday - a highly unusual move during a criminal investigation, which Attorney General Merrick Garland said was down to "substantial public interest".

In Monday's court filing, prosecutors cited threats against the FBI as another reason to keep the affidavit from public view.


"Information about witnesses is particularly sensitive given the high-profile nature of this matter and the risk that the revelation of witness identities would impact their willingness to co-operate with the investigation," said the court filing.

The FBI and Department of Homeland Security issued a memo on Friday night to law enforcement around the country noting an "increase in violent threats posted on social media against federal officials".

Former US President Donald Trump has asked a judge to freeze the justice department's investigation of files seized from his Mar-a-Lago home.

In a lawsuit, his legal team asked that an independent lawyer be appointed to oversee the documents that FBI agents took earlier this month.



Eleven sets of classified files were taken from Mr Trump's Florida estate on 8 August, according to the FBI.

Mr Trump is being investigated for potentially mishandling documents.


US presidents must transfer all of their documents and emails to a government agency called the National Archive - and the FBI is investigating whether Mr Trump improperly handled records by taking them from the White House to Mar-a-Lago after he left office.

He has denied any wrongdoing and said the items were declassified.

In the 27-page document filed in a Florida court, Mr Trump's legal team accuses the justice department's search as "simply wanting the camel's nose under the tent so they could rummage for either politically helpful documents or support efforts to thwart President Trump from running again".

Mr Trump is suing for more detailed list of exactly what was taken from his estate and is asking for the government to return any item which was not in the scope of the search warrant.

His lawyers have also asked that a "neutral" third-party attorney - known as a special master - be brought in to determine whether the seized files are covered by executive privilege, which allows presidents to keep certain communications under wraps.

Special masters are normally appointed in criminal cases where there are concerns that some evidence may be protected under attorney-client privilege, or other protections that could make it inadmissible in court.



The Department of Justice (DoJ) said in a brief statement that prosecutors were aware of Mr Trump's lawsuit, and would respond in court. The "search warrant at Mar-a-Lago was authorised by a federal court upon the required finding of probable cause", said spokesman Anthony Coley.

It comes as the New York Times reported on Monday that agents had so far recovered over 300 documents with classified markings from Mr Trump, including material from the CIA, the National Security Agency and the FBI.

Mr Trump's legal action was filed in West Palm Beach, Florida, on Monday, before a judge that Mr Trump nominated to the bench in 2020.

It says: "President Donald J Trump is the clear frontrunner in the 2024 Republican Presidential Primary and in the 2024 General Election, should he decide to run."

"Law enforcement is a shield that protects Americans," it continues. "It cannot be used as a weapon for political purposes."

The "shockingly aggressive move" on Mar-a-Lago by about two dozen FBI agents took place "with no understanding of the distress that it would cause most Americans", said Mr Trump's lawyers.

His legal team accused the government of leaking "ever-changing, and inaccurate, 'justifications'" for the search to favoured media outlets.

The court filing argues that Mr Trump had been co-operating with agents before the FBI turned up unannounced at his home.

His lawyers say the warrant was overly broad and the search violated the Fourth Amendment to the US Constitution, which protects Americans against unreasonable search and seizure.

Mr Trump's legal team says that three days after the search they contacted an FBI agent that had visited Mar-a-Lago in June to ask for his help in passing along a personal message from the former president to Attorney General Merrick Garland.

The brief message recorded in Monday's lawsuit said that Mr Trump had heard "from people around the country about the raid".

"If there was one word to describe their mood, it is 'angry'," the message from Mr Trump continued.

"The heat is building up. The pressure if building up. Whatever I can do to take the heat down, to bring the pressure down, just let us know."

The judge that approved the warrant - an unprecedented criminal investigation of a former US president's home - is still determining whether to release the affidavit, the sworn evidence that was presented as a justification for the FBI search.

On Monday, Magistrate Judge Bruce Reinhart said proposed government redactions to the affidavit were so extensive as to make it "meaningless" if disclosed, though he said he still believed it should not remain completely sealed given public interest in the case.

Trump has previously maintained he had done nothing wrong, arguing that all of documents he took from the White House when he left office in January 2021 had already been declassified by himself.

A US judge has ordered investigators to release a redacted version of court papers used to justify a search of ex-President Donald Trump's Florida home.




The public version of the affidavit, a court document that includes evidence presented by prosecutors, could reveal new details about the inquiry.

The Department of Justice opposed releasing an unredacted version amid its ongoing investigation.

The FBI search was part of a probe into the potential mishandling of documents.

Mr Trump has denied wrongdoing and insists the classified files that investigators say were found at Mar-a-Lago in Palm Beach had already been declassified by himself.

On Thursday, US Magistrate Judge Bruce Reinhart ordered the affidavit to be released with redactions by noon (16:00 GMT) on Friday.

He said prosecutors had demonstrated a "compelling reason" to black out parts of the document, which would reveal the identities of witnesses, law enforcement agents and uncharged parties, as well as "the investigation's strategy, direction, scope, sources and methods".

His ruling came shortly after the justice department confirmed that it had submitted to the judge a copy of the affidavit with proposed redactions.

Even in redacted form, the affidavit could provide clues as to why Mr Trump allegedly took classified documents with him in the chaotic final days of his presidency and what he did with them while they were stored in Palm Beach.

The rest may have to wait for when - or if - any criminal charges are filed.

The warrant itself was released on 12 August alongside an inventory of recovered items that showed 11 sets of classified files were removed from the estate.

Several news organisations have applied for the affidavit to be unsealed, citing public interest given the historic nature of the search of a former president's home.

The Department of Justice, however, had resisted the move, arguing that its release could cause "irreparable damage" to its ongoing investigation. It also said the necessary redactions would render the document "meaningless".

Donald Trump greeted the Friday release of a heavily redacted affidavit used to secure a search warrant for his Mar-a-Lago home earlier this month with his usual dose of anger, misdirection and falsehoods.

The document says the agents were worried that highly sensitive government documents Mr Trump had taken from the White House could compromise "clandestine human sources"....


WASHINGTON — Fourteen of the 15 boxes recovered from former President Donald Trump's Florida estate early this year contained documents with classification markings, including at the top secret level, according to an FBI affidavit released Friday explaining the justification for this month's search of the property.


The 32-page affidavit, even in its heavily redacted form, offers the most detailed description to date of the government records being stored at Trump's Mar-a-Lago property long after he left the White House and reveals the gravity of the government's concerns that the documents were there illegally.

"The government is conducting a criminal investigation concerning the improper removal and storage of classified information in unauthorized spaces, as well as the unlawful concealment or removal of government records," an FBI agent wrote on the first page of the affidavit in seeking a judge's permission for a warrant to search the property.

The affidavit does not provide new details about the 11 sets of classified records recovered during the Aug. 8 search at Mar-a-Lago but instead concerns a separate batch of 15 boxes that the National Archives and Records Administration retrieved from the home in January.

In those boxes, according to the affidavit, officials located 184 documents bearing classification markings, including 25 documents marked as top secret. Agents who inspected the boxes found markings related to information provided by confidential human sources as well as information related to the Foreign Intelligence Surveillance Act.

Taken together, the affidavit reveals additional details about an ongoing criminal investigation that has brought fresh legal peril for Trump just as he lays the groundwork for another presidential run. It also shows in stark detail the volume of sensitive government documents that were stored at Mar-a-Lago instead of being turned over to the National Archives.

The FBI submitted the affidavit, or sworn statement, to a judge so it could obtain the warrant to search Trump's property. Affidavits typically contain vital information about an investigation, with agents spelling out the justification for why they want to search a particular property and why they believe they're likely to find evidence of a potential crime there.

In a separate document unsealed Friday, Justice Department officials explained that it was necessary to redact some information to "protect the safety and privacy of a significant number of civilian witnesses, in addition to law enforcement personnel, as well as to protect the integrity of the ongoing investigation."

Affidavits routinely remain sealed during pending investigations, making the decision by Magistrate Judge Bruce Reinhart to reveal portions of it all the more striking.

In an acknowledgment of the extraordinary public interest in the investigation, Reinhart on Thursday ordered the department by Friday to make public a redacted version of the affidavit. The directive came hours after federal law enforcement officials submitted under seal the portions of the affidavit that they wanted to keep secret as their investigation moves forward.

Documents previously made public show the FBI retrieved from the property 11 sets of classified documents, including information marked at the top secret level. They also show that federal agents are investigating potential violations of three federal laws, including one that governs gathering, transmitting or losing defense information under the Espionage Act. The other statutes address the concealment, mutilation or removal of records and the destruction, alteration or falsification of records in federal investigations.

It's possible that the affidavit, particularly in its unredacted form, could shed light on key unanswered questions, including why sensitive presidential documents — classified documents, among them — were transported to Mar-a-Lago after Trump left the White House and why Trump and his representatives did not supply the entire tranche of material to the National Archives and Records Administration despite repeated entreaties.

It could also offer additional details on the back-and-forth between Trump and the FBI, including a subpoena for documents that was issued last spring, as well as a June visit by FBI and Justice Department officials to assess how the materials were being stored.

The Justice Department had earlier contested arguments by media organizations to make the affidavit public, saying any disclosure could contain private information about witnesses and about investigative tactics. But Reinhart, acknowledging the extraordinary public interest in the investigation, said last week that he was disinclined to keep the entire document sealed and told federal officials to submit to him in private the redactions it wanted to make.




In his order Thursday, Reinhart said the department had made compelling arguments to leave sealed broad swaths of the document that, if disclosed, would reveal grand jury information; the identities of witnesses and "uncharged parties"; and details about the investigation's "strategy, direction, scope, sources and methods."

But he also said he was satisfied "that the Government has met its burden of showing that its proposed redactions are narrowly tailored to serve the Government's legitimate interest in the integrity of the ongoing investigation and are the least onerous alternative to sealing the entire Affidavit."

The FBI searched Donald Trump’s Mar-a-Lago resort in Florida this month after speaking to a significant number of witnesses and finding probable cause that national defense information and evidence of obstruction existed at the former president’s property, according to newly unsealed court filings on Friday.





The details contained in the affidavit used to secure a warrant to search Mar-a-Lago – partially redacted to protect the ongoing criminal investigation into Trump’s unauthorized retention of government secrets – offered the clearest insight yet into the basis for the FBI’s seeking permission to search the resort.

“There is probable cause to believe that additional documents that contain classified NDI or that are presidential records subject to record retention requirements currently remain at the premises. There is also probable cause to believe that evidence of obstruction will be found,” it said.

The affidavit made the case that the FBI needed to forcibly retrieve the United States government’s most sensitive secrets, especially after it came to suspect Trump and his team were holding on to classified documents despite repeated efforts – including with a subpoena – to secure their return.

Most pressing, according to the affidavit, was that the FBI had identified probable cause that documents containing national defense information were scattered across Mar-a-Lago, potentially jeopardizing intelligence gathering and revealing the identities of human clandestine sources.

The specific mentions of the most private areas at Mar-a-Lago – for instance Pine Hall, which is not particularly widely known – suggests the FBI had close operational knowledge from a source about where the documents were being kept and potentially being moved around the resort.

While the exact origin of that information appears to have been kept redacted, in an accompanying legal memo explaining its redactions, the justice department revealed for the first time that the FBI had interviewed a “significant number of civilian witnesses” before seeking the warrant.

The affidavit also mentioned an additional significant reason for needing the document to initially be kept under seal: “The FBI has not yet identified all potential criminal confederates and not located all evidence related to its investigation.”

In making the case that the FBI needed to search Mar-a-Lago, the affidavit – produced by an FBI agent working in the bureau’s Washington field office – also showed how Trump had previously retained government secrets at Mar-a-Lago after he was no longer president.

The FBI noted that after Trump finally returned around a dozen boxes of materials to the National Archives this year, an FBI triage found 184 unique classified documents, including 25 marked top secret, 92 marked secret, 67 marked confidential, and some with Trump’s distinctive handwriting.

The documents also included some with markings like “SI” for special intelligence, “HCS” for intelligence from human clandestine sources, “NOFORN”, for “Not Releasable to Foreign Nationals”, “FISA” for the “Foreign Intelligence Surveillance Act”, and “ORCON”, which restricts non-US dissemination.

“Of most significant concern was that highly classified records were unfoldered, intermixed with other records, and otherwise unproperly [sic] identified,” it warned.

According to the affidavit, the FBI essentially concluded that Mar-a-Lago was the scene of potential violations of the Espionage Act, obstruction of justice, and a statute that criminalizes the unauthorized removal or retention of government records more generally.

The affidavit became public after federal Judge Bruce Reinhart, who approved the warrant and is overseeing the case, ordered the justice department to submit the redacted version before noon, leading to a tense and breathless wait for the court in West Palm Beach to unseal the documents.





Trump Was Unhappy About The Affidavit.

In a statement on his social media website, Trump, in strident language that is typical to him, blasted the release of the document. He called it a “total public relations subterfuge” by the FBI and the justice department and accused the judge of having personal animosity towards him.

“WITCH HUNT!!!” the former president said in a subsequent post, using one of the most common phrases he deploys to portray himself as the victim of a hostile conspiracy, and he again described the FBI search as a “break-in”.


President Joe Biden weighed in after being asked if it was ever appropriate for a president to bring home classified material, saying that “it depends on the document and it depends on how secure” the location was. He had a “completely secure” site at his home and on Friday was taking home a copy of his daily intelligence briefing, he said, but those records would later be returned to the military.



The partial release of the affidavit used for the Mar-a-Lago search is a significant juncture for the justice department, which had opposed unsealing any part of the affidavit until it was overruled by Reinhart, and the attorney general, Merrick Garland, who personally approved the warrant after days of deliberations.

The justice department had originally opposed unsealing the affidavit at all and filed a redacted version only after being forced by Reinhart last week.

Trump had indicated previously that he had supported unsealing the affidavit but his lawyers never filed a formal motion to that effect, instead leaving the effort to a coalition of media outlets that pushed to have the affidavit become public.

Trump has since filed a separate motion to have a so-called special master appointed to determine what seized materials prosecutors can use as evidence in the investigation. The motion also aims to force the justice department to provide a more detailed list of what was retrieved by the FBI.

Trump’s lawyers said their motion should be granted because the redacted affidavit “provides almost no information that would allow [Trump] to understand why the raid took place, or what was taken from his home. The few lines that are unredacted raise more questions than answers.”

The U.S. intelligence community will measure the national security risks of former President Donald Trump possessing top secret documents at his Mar-a-Lago residence in Florida.




The assessment was unveiled in a letter by Director of National Intelligence Avril Haines who confirmed the review to Reps. Carolyn Maloney, who chairs the House Oversight Committee, and Adam Schiff, who chairs the House Intelligence Committee.

“The Department of Justice and the Office of the Director of National Intelligence are working together to facilitate a classification review of relevant materials, including those recovered during the search,” Ms. Haines wrote in a letter, first obtained by Politico.

Ms. Haines asserted that her assessment will be independent and won’t interfere with the Justice Department’s criminal investigation into the matter. Court documents indicated the agency is probing Mr. Trump on potential violations of the Espionage Act, the Presidential Records Act and obstruction of justice.

Mrs. Maloney and Mr. Schiff welcomed news of the intelligence community stepping in, encouraging a swift review done in tandem with the Justice Department’s probe.

The move signals the first step the Biden administration has taken that engages with Congress, regarding the investigation of the president.

It comes just after a federal judge unsealed a redacted version of the affidavit that justified the Justice Department’s reason for obtaining a search warrant to raid Mar-a-Lago.

According to the document, Mr. Trump held several top secret documents at his residence, which included some that included the former president’s handwriting.

Mr. Schiff previously warned that unsealing the affidavit could increase threats toward officials and jeopardize the Justice Department’s investigation.

The congressman also blamed Mr. Trump‘s “incendiary rhetoric” for a recent armed attack on an FBI field office in Ohio earlier this month.

Republicans, including Mr. Trump, have urged more transparency, downplaying the revelations made in the heavily redacted affidavit.

“The raid on my home, Mar-a-Lago, is one of the most egregious assaults on democracy in the history of our country which, by the way, is going to places in a very bad way, it has never seen before,” Mr. Trump wrote Saturday on his TruthSocial account.

The intelligence community’s review is expected to look at whether any unauthorized individuals had access to the documents in question.



The Senate Intelligence Committee also requested the intelligence community to conduct a damage assessment over Mr. Trump‘s handling of the documents, as well as requesting the Justice Department to see the documents that were seized from Mar-a-Lago.

The request made was bipartisan, signed off by Sens. Mark Warner, Virginia Democrat who chairs the panel and Marco Rubio, Florida Republican and ranking member of the committee.

Former US President Donald Trump may have concealed documents during an FBI search of his property in June, Department of Justice officials say.

In a court filing, the department said "efforts were likely taken to obstruct the government's investigation".


They alleged agents were "explicitly prohibited" from searching a storage room at Mr Trump's Mar-a-Lago mansion.

Other records were likely "concealed and removed" from a storage room, the officials said.


The 54-page filing was released on Tuesday, before a court hearing on Thursday.


In it, Justice Department counterintelligence chief, Jay Bratt, said the FBI were able to recover a number of classified documents that Mr Trump's team had not handed over, despite previous requests.

"That the FBI, in a matter of hours, recovered twice as many documents with classification markings as the 'diligent search' that the former president's counsel and other representatives had weeks to perform...casts doubt on the extent of cooperation in this matter," he said.

US presidents must transfer all of their documents and emails to a government agency called the National Archive - and the FBI is investigating whether Mr Trump improperly handled records by taking them from the White House to Mar-a-Lago after he left office in January 2021.

Mr Bratt added that the "commingling" of Mr Trump's personal items with classified documents is "relevant evidence of the statutory offenses under investigation".

Mr Trump has denied any wrongdoing and said the items were declassified.

He had been suing for a detailed list of exactly what was taken from his estate, and is asking for the government to return any item which was not in the scope of the search warrant.

But Mr Bratt said that any presidential records seized in the search warrant "belong to the United States, not to the former president".

Mr Trump's lawyers have asked that a "neutral" third-party attorney - known as a special master - be brought in to determine whether the seized files are covered by executive privilege, which allows presidents to keep certain communications under wraps.

Special masters are normally appointed in criminal cases where there are concerns that some evidence may be protected under attorney-client privilege, or other protections that could make it inadmissible in court.

The latest court filings made by the Department of Justice on Tuesday are in response to Trump's lawsuit.

Christina Bobb and Evan Corcoran face scrutiny over their communications with the justice department, legal experts say

Two lawyers for Trump could become witnesses or targets in the obstruction investigation connected to the criminal inquiry into the former president’s unauthorized retention of highly sensitive government documents at his Mar-a-Lago resort in Florida, according to legal experts.



The lawyers – Christina Bobb and Evan Corcoran – face becoming ensnared in the investigation because they liaised with the justice department during the government’s months-long effort to retrieve boxes of presidential records and classified documents from Trump’s Florida home.

At issue is an interaction that took place on 3 June in which, according to a court filing submitted by the justice department in a separate but related case on Tuesday, the two lawyers made representations that they had complied with a grand jury subpoena that subsequently proved to be false.

That day, the justice department’s chief of counterintelligence, Jay Bratt, and three FBI agents travelled to Mar-a-Lago to collect the documents that had been subpoenaed, the filing said, and Bobb and Corcoran turned over a taped, Redweld envelope of classified materials.

But before Bratt departed, Bobb produced and signed a letter certifying that all and any documents responsive to the subpoena were being turned over, while Corcoran indicated that the records the government had sought were confined to one storage room, the filing said.

The trouble for the two Trump lawyers is that the justice department then developed evidence through multiple sources that additional presidential and classified documents remained at Mar-a-Lago – which proved to be the case when the FBI searched the property two months later.

In its own filing on Wednesday night, Trump’s lawyers decried the search as having taken place in “the midst of the standard give-and-take” between a former president and the National Archives and Records Administration over presidential records. It said the department had “gratuitously” made public certain information, including a photograph of classified documents taken from the home.

According to the search warrant and court filings, the justice department is investigating among other crimes whether there was potential obstruction of justice with respect to how Trump and his lawyers have seemingly been resistant to return documents belonging to the government.

The justice department’s account of the 3 June episode – what it has described as a “likely” effort to conceal presidential and classified documents sought by the government – raises the prospect that both Bobb and Corcoran could become witnesses in the obstruction investigation.

But the case, and how the justice department might approach the issue, remains complex.

The question for federal prosecutors becomes whether the two Trump lawyers willfully misled the justice department so that Trump could keep the documents, or whether the lawyers made the representations because they themselves were misled by Trump.

To establish the exact circumstances surrounding Bobb’s confidence in signing the certification, and Corcoran’s confidence in his statements, legal experts said, the justice department would probably have to subpoena both of the lawyers for communications and testimony.

Such a step would immediately run into an issue about attorney-client privilege, since the kind of information the justice department would be trying to extract for a potential obstruction case targeting Trump would be protected communications between Trump and his lawyers.


The privilege exists to protect the rights of defendants who might have committed an offense, since they need to be able to speak candidly with their lawyers about what happened without the fear that prosecutors could use their discussions against them at a trial.

The protection can be removed through the so-called crime-fraud exception. But even if there were a crime-fraud exception in Trump’s case, his lawyers could still invoke their fifth amendment right against self-incrimination if they had knowingly misled the government on his behalf.

Ultimately, the issue for the justice department is whether the attorney general, Merrick Garland, gives his approval to move ahead with an extraordinary prosecution for obstruction against the former president, and whether Garland does so against his lawyers.

If Garland chooses to take that step, federal prosecutors would probably move to find ways to compel Bobb and Corcoran’s testimony to reveal whether Trump obstructed the return of presidential records and classified materials, the legal experts suggested.

If Garland decides against pursuing an obstruction indictment, then, even though justice department investigators might seek testimony from Bobb and Corcoran anyway, they are unlikely to secure meaningful information unless it also litigates the privilege issues in court.


People close to the former president’s top lawyers broadly did not appear to believe either Bobb or Corcoran would be compelled to testify against Trump and remove themselves from the legal team. And as of Wednesday, neither had retained their own counsel, one of the people said.

A judge has granted Donald Trump's demand for a "special master" to oversee the case into his handling of classified materials.

Trump is being investigated for allegedly taking documents with him when he left the White House.

But the "special master" is an independent lawyer who decides if any of the records are covered by attorney-client or executive privilege.



The move is seen as a blow to prosecutors and a win for Mr Trump.

The former president had asked for the special master to be appointed, while prosecutors had strongly opposed it - and the appointment is likely to slow down the justice department's ongoing criminal investigation.

That is because the judge has banned the government from reviewing or using the seized materials for its investigation until the special master's independent review has been completed.

Department of Justice officials previously said that documents stored at former President Donald Trump's Florida home were likely to have been concealed as part of an effort to obstruct an FBI investigation.

The authorities say these documents should have been handed over to the National Archives - which US presidents are legally obliged to do upon leaving office.

Mr Trump, meanwhile, denies any kind of wrongdoing, arguing that as president he had declassified all the documents, and that they were kept securely at his Mar-a-Lago home.

The Department of Justice resisted Mr Trump's request saying that any presidential records seized in the FBI's 8 August search of Mar-A-Lago "belong to the United States, not to the former president".

It is not clear how long the special master's review will take.

Mr Trump's lawyers have argued some of the documents are covered by attorney-client privilege - a part of US law that allows people to keep conversations with their lawyers private.

His legal team have also claimed "executive privilege" over the documents, which allows presidents to keep certain communications under wraps.

However, some legal experts argue that these moves are merely a tactic to delay proceedings - since the documents have already been looked at.

Before the decision was handed down, law professor and US constitutional law expert Aziz Huq told the BBC the demand for a special master was simply "throwing sand in the gears".


"It's unclear why a special master is required. A special master is usually used before the government sees the underlying material, and here the government has seen them," the former law clerk for Supreme Court Justice Ruth Bader Ginsburg said.

Former federal prosecutor and former deputy attorney general for New York, E Danya Perry, said: "What really strikes me here is it's too late... you can't unscramble the egg or put the genie back in the bottle. These documents have been reviewed."

Mar-a-Lago – the Palm Beach resort and residence where Donald Trump reportedly stored nuclear secrets among a trove of highly classified documents for 18 months since leaving the White House – is a magnet for foreign spies, former intelligence officials have warned.


A US judge on September 5, 2022, granted Donald Trump's request for the appointment of a "special master" to independently review material seized in an FBI raid on his Florida home, dealing a blow to prosecutors.

The Washington Post reported that a document describing an unspecified foreign government’s defences, including its nuclear capabilities, was one of the many highly secret papers Trump took away from the White House when he left office in January 2021.

There were also documents marked SAP, for Special-Access Programmes, which are often about US intelligence operations and whose circulation is severely restricted, even among administration officials with top security clearance.

Potentially most disturbing of all, there were papers stamped HCS, Humint Control Systems, involving human intelligence gathered from agents in enemy countries, whose lives would be in danger if their identities were compromised.

The Office of the Director of National Intelligence is conducting a damage assessment review which is focused on the sensitivity of the documents, but US officials said it is the job of FBI counter-intelligence to assess who may have gained access to them.

That is a wide field. The home of a former president with a history of being enthralled by foreign autocrats, distrustful of US security services, and boastful about his knowledge of secrets, is an obvious foreign intelligence target.

“I know that national security professionals inside government, my former colleagues, [they] are shaking their heads at what damage might have been done,” John Brennan, former CIA director, told MSNBC.

“I’m sure Mar-a-Lago was being targeted by Russian intelligence and other intelligence services over the course of the last 18 or 20 months, and if they were able to get individuals into that facility, and access those rooms where those documents were and made copies of those documents, that’s what they would do.”

Last month, the Organised Crime and Corruption Reporting Project reported that a Russian-speaking immigrant from Ukraine was able to mingle with the former president’s family and friends at Mar-a-Lago, posing as Anna de Rothschild, presenting herself as being an heiress of the banking dynasty.

Inna Yashchyshyn, the daughter of a truck driver who emigrated to Canada, regaled those around her with tales of vineyards and estates and growing up in Monaco, and even met the former president in person, getting herself photographed with him on a golfing green.

There is no evidence that Yashchyshyn was a spy, but the episode underlined how easy it is to get into Mar-a-Lago.

During Trump’s presidency, two Chinese women were caught trespassing there on separate occasions.

One of them, Yujing Zhang, was in possession of four mobile phones, a laptop, an external hard drive, and a thumb drive later found to carry malware.

In her hotel room, investigators found nine USB drives, five SIM cards and a “signal detector” device for spotting hidden microphones or cameras.

She was found guilty of unlawfully entering a restricted building and making false statements to a federal officer, and deported to China in 2021.


The guests, invited or otherwise, are not the only security concern. In 2021, the Trump Organization sought 87 foreign workers for positions at Mar-a-Lago, with wages starting at $11.96 an hour.

“Any competent foreign intelligence service, whether those belonging to China, those belonging to Iran, to Cuba, certainly including Russia are … and were interested in gaining access to Mar-a-Lago,” Peter Strzok, former deputy assistant director of counter-intelligence at the FBI, told MSNBC.

In recent polls, American voters ranked “threats to democracy” as the most important issue facing the country. At a time of climate collapse, inflation and a pandemic, this is a remarkable statement on the fragility of America’s fundamental rights and freedoms.

The country is seeing a dizzying number of assaults on democracy, from draconian abortion bans to a record number of book bans. Politicians who spread lies and sought to delegitimatize the 2020 election are pursuing offices that will put them in control of the country’s election machinery.

Meanwhile, the supreme court is enforcing its own agenda on abortion, guns and environmental protections – often in opposition to public opinion.

Dearie, 78, will be "special master" and decide whether any documents are off limits in any legal proceedings.

He had been proposed by Mr Trump's team and the US Department of Justice previously said it did not object.

The former US president is being investigated for his handling of classified materials.

Department of Justice officials previously said that documents stored at Mr Trump's Florida home were likely to have been concealed as part of an effort to obstruct an FBI investigation.

The authorities say these documents should have been handed over to the National Archives - which US presidents are legally obliged to do upon leaving office.

Mr Trump denies any kind of wrongdoing, arguing that as president he had declassified all the documents, and that they were kept securely at his Mar-a-Lago home.

Who is the special master reviewing seized Trump files?


The request for a special master - an independent lawyer who decides if any of the records are covered by attorney-client or executive privilege - was made by Mr Trump's team.

Earlier this month, a judge granted Mr Trump's request - and banned the US government from reviewing or using the seized materials for its investigation until the special master's independent review has been completed.

On Thursday, US federal Judge Aileen Cannon appointed Mr Dearie and also ruled that the Department of Justice was not allowed to resume the files review.

The department had earlier said it would take the case to an appeals court if Judge Cannon ruled against their request.

It means the justice department's ongoing criminal investigation will now be slowed down because the government cannot review or seize materials for its investigation until the special master's review has been completed.

The Department of Justice resisted Mr Trump's request saying that any presidential records seized in the FBI's 8 August search of Mar-A-Lago "belong to the United States, not to the former president".

It is not clear how long the special master's review will take.

Mr Trump's lawyers have argued some of the documents are covered by attorney-client privilege - a part of US law that allows people to keep conversations with their lawyers private.

His legal team have also claimed "executive privilege" over the documents, which allows presidents to keep certain communications under wraps.

However, some legal experts argue that these moves are merely a tactic to delay proceedings - since the documents have already been looked at.

The NY attorney general filed a fraud lawsuit against Donald Trump, his business, and three of his children.


Former President Donald Trump's son Eric lashed out at New York Attorney General Letitia James immediately after she filed a lawsuit Wednesday accusing him and his family of years of business fraud at the Trump Organization, where he's an executive.

"Letitia James is the most corrupt Attorney General in United States History - she campaigned on the promised to sue my father… watch for yourself!" he wrote on Truth Social.

The former president's son, who is executive vice president of the Trump Organization, posted a video of James, created by Donald Trump's Save America PAC, that says she campaigned on suing Trump and shows her saying "his days are numbered."

During James' campaign for attorney general in 2018, she said she would investigate Donald Trump and his business. The day after she was elected, she was more explicit, saying: "We're definitely going to sue him."

The lawsuit, which comes after a 3-year investigation, names the former president, his business, and his three eldest children and says it has evidence of over 200 instances of false and misleading valuations of their assets.

James' office said "Trump falsely inflated his net worth by billions of dollars to further enrich himself and cheat the system."

James said the conduct detailed in her suit may violate state and criminal law, including "issuing false statements to financial institutions and bank fraud." She said state investigations would refer these allegations to the US attorney for the Southern District of New York and the IRS.

A US judge reviewing records seized from Donald Trump’s Florida home asked the former president’s lawyers on Thursday to provide any evidence casting doubt on the integrity of the documents. Trump has previously made unsubstantiated claims the documents were planted by FBI agents.



Senior federal judge Raymond Dearie, appointed by another judge to vet the documents to assess whether some should be withheld from investigators as privileged, also asked the justice department to certify by Monday a detailed property inventory of materials the FBI seized in the court-approved 8 August search of Trump’s Mar-a-Lago residence in Palm Beach, Florida.

Dearie asked Trump’s lawyers to submit by 30 September a list of specific items in that inventory “that plaintiff asserts were not seized from the premises”. Dearie also asked them to submit any corrections to the government’s list by that date, including items they believe were seized at Mar-a-Lago but not listed in the inventory.

Trump claims presidents can declassify documents ‘by thinking about it’



“This submission shall be [Trump’s] final opportunity to raise any factual dispute as to the completeness and accuracy of the detailed property inventory,” wrote Dearie, serving as an independent arbiter known as a special master.

The search was conducted as part of a federal criminal investigation into whether Trump illegally retained documents from the White House and tried to obstruct a probe when he left office in January 2021 after his failed 2020 re-election bid.

Trump has called the investigation politically motivated. He has also claimed, without providing evidence, both that he had declassified any documents found at Mar-a-Lago and that the FBI planted documents.

On Trump’s request, US district judge Aileen Cannon appointed Dearie to vet the materials. The justice department has said more than 11,000 documents were seized, including about 100 documents marked as classified.

A federal appeals court ruled on Wednesday that the justice department can resume reviewing those classified records in its criminal investigation. The Atlanta-based 11th US circuit court of appeals also precluded Dearie from vetting those documents marked classified.

Ex-US President Donald Trump has asked the Supreme Court to intervene in the dispute over sensitive documents seized by the FBI during a search of his Florida estate in August.

TRUMP wants the justices to allow a court-appointed arbiter, known as a special master, to review the handful of files with classification markings.

Last month an appeals court exempted those 103 papers from the review.

The court is expected decide on the matter within days.



In August, the FBI searched Mar-a-Lago in Palm Beach in an investigation into whether Mr Trump and his aides mishandled government records or national security secrets.

In the weeks since the unprecedented incursion into a former president's home, the Trump legal team has been challenging the Department of Justice (DoJ) by contending that the material is shielded from scrutiny under a legal doctrine known as executive privilege - which allows some presidential records to be kept private.

A Florida judge last month granted Mr Trump's application for a special master, Brooklyn Judge Raymond Dearie, to vet the 11,000 documents taken from Mar-a-Lago.

But the 11th US Circuit Court of Appeals later sided with the DoJ and said Judge Dearie could not review the 103 documents with classification markings.

Lawyers for Mr Trump argued in their 37-page filing on Tuesday that the special master should have access to the classified records to "determine whether documents bearing classification markings are in fact classified, and regardless of classification, whether those records are personal records or Presidential records".

Mr Trump's latest legal move was filed under the Supreme Court's emergency docket, and the justices are thought likely to make a decision relatively quickly. The DoJ must file a response to the Trump filing by 11 October.

There is no guarantee that the court will take up Mr Trump's request.

The court is dominated by six conservative justices, three of them appointed by Mr Trump.

But so far it has rejected his previous attempts to block disclosure of his White House records, and dismissed lawsuits to invalidate Mr Trump's defeat in the 2020 presidential election.

NEW YORK (Reuters) - Former U.S. President Donald Trump's company on Tuesday lost a bid to dismiss an initial group of 18 prospective jurors for the real estate firm's criminal trial on tax fraud charges after arguing that the pool was tainted by observing one juror candidate who said she was biased.

attan district attorney's office last year charged the Trump Organization and Allen Weisselberg, its then-chief financial officer, with awarding "off the books" benefits to some senior executives, enabling certain employees to understate their taxable compensation and the company to evade payroll taxes. Weisselberg in August pleaded guilty to charges including grand larceny and tax fraud while admitting to concealing $1.76 million in income.

During the first day of jury selection on Monday, one juror candidate who said in open court that she had strong feelings about Trump that would prevent her from being fair in the trial was called to Judge Juan Merchan's bench for a private discussion, and then dismissed from the pool.

Michael van der Veen, a lawyer for the Trump Organization, said on Tuesday before the jury entered that the other jurors in the pool were "visibly chilled" by observing that interaction and may not have answered the question honestly.

Justice Juan Merchan, the judge overseeing the trial in a New York state court, said he was closely observing the prospective jurors and disagreed with van der Veen. That came after prosecutor Joshua Steinglass of the Manhattan district attorney's office said it was "preposterous" to argue that watching one juror leave tainted the remainder of the pool.

"I can appreciate that in your opinion the other jurors were visibly chilled," Merchan said, addressing van der Veen. "I can't say I observed that."

Prosecutors and defense lawyers later on Tuesday were expected to begin questioning the 18 prospective jurors, the next step in what is expected to be a weeklong process to seat a 12-member panel.

In heavily Democratic Manhattan, lawyers for the Trump Organization are expected to be on the lookout for "stealth jurors" who hide the true extent of their anti-Trump feelings in the hopes of getting seated on the panel, experts told Reuters.

Trump, a Republican considering another run for the presidency in 2024, is not charged in the case. He has called the prosecution politically motivated.

The Justice Department investigation continues into whether documents from the Trump White House were illegally mishandled when they were brought to his Mar-a-Lago resort in Florida after he left office.



An independent lawyer has been appointed to oversee the US justice department's criminal investigations into former President Donald Trump. Jack Smith most recently served as a war crimes prosecutor at The Hague





Jack Smith, a former war crimes prosecutor, was named special counsel by Attorney General Merrick Garland in a news conference.


He will lead inquiries into how Mr Trump handled classified documents and his alleged role in the Capitol riot.



Mr Trump, who is the subject of several other probes, denies any wrongdoing.

Mr Smith will ultimately decide whether the former Republican president, who announced his 2024 candidacy just three days ago, will face criminal charges.

"In certain extraordinary cases it is in the public interest to appoint a special prosecutor to independently manage an investigation and prosecution," Mr Garland said on Friday.

"Due to recent developments, including the former president's announcement that he is a candidate in the next election, and the sitting president's intention to be a candidate as well, I have concluded that it is in the public interest."

He said the move would give the public confidence in the investigation.

In a statement on Friday evening from his Florida estate Mar-a-Lago, Mr Trump slammed the "horrendous abuse of power" by a "corrupt and highly political" justice department in appointing a "super-radical left" special counsel.

Mr Smith is a former prosecutor in New York and most recently served as a chief prosecutor in The Hague where he investigated war crimes in Kosovo.

He will be returning to the US to begin his work immediately, Mr Garland said. To pre-empt claims of partisan bias, the justice department said Mr Smith was a registered political independent.




Serious Business for Trump

Merrick Garland's decision to appoint a special counsel indicates that this administration is painfully aware that these cases involve the highest of political stakes.

A move by Joe Biden's justice department to charge a man who could be facing off against him in the 2024 presidential general election would be viewed by as much as half the country as suspicious, regardless of any assurances of impartiality.

Handing this off to a special counsel, and giving that counsel power to do as he sees fit, provides the Biden administration at least a measure of insulation against such allegations.

It also suggests the justice department believes there is sufficient evidence to prosecute Mr Trump, as a case without merit could have been simply abandoned without action.

All this is serious business for Mr Trump and his closest allies, just days after he launched his third bid for the White House.

Special counsel inquiries tend to take on lives of their own, and find new prosecutorial avenues to explore, as did Robert Mueller's Russia probe and similar investigations during the George W Bush and Bill Clinton presidencies.

Mr Garland has set in motion a whirlwind whose ultimate course will be difficult to predict.



"I intend to conduct the assigned investigations, and any prosecutions that may result from them, independently and in the best traditions of the Department of Justice," Mr Smith said in a statement shortly after his appointment.

"The pace of the investigations will not pause or flag under my watch," he added. "I will exercise independent judgement and will move the investigations forward expeditiously and thoroughly to whatever outcome the facts and the law dictate."

Mr Trump's Mar-a-Lago, where he announced his presidential bid on Tuesday night, was searched by FBI agents in August. They seized top secret documents and are investigating whether he may have broken the law by keeping the documents there after he left the White House.

The justice department is also running a separate criminal investigation into the 6 January 2021 Capitol riot and broader efforts to overturn the 2020 presidential election - but this has largely been shrouded in secrecy.

Meanwhile, a committee in Congress has been examining the attack that saw supporters of Mr Trump storm the Capitol building in Washington in an effort to stop the certification of President Joe Biden's victory.

The committee has hinted at the possibility that it will recommend to the justice department that Mr Trump face criminal changes for his alleged role in the riot.

The justices rejected Mr Trump's bid in October to block a lower court's ruling that granted the panel's request for his financial records.

The decision means the US treasury department can deliver the tax returns from 2015-20 for Mr Trump and some of his businesses to the Democratic-controlled committee.

Democrats Beat The Buzzer - Barely

Donald Trump was almost able to run out the clock on the congressional request to view his tax returns.

Almost.


With just over a month left of Democratic control of the House of Representatives, the Supreme Court has given the green light for the treasury department to provide the documents to the Ways and Means Committee.

Given that the treasury department is run by the Biden administration, the process of handing over the documents should proceed expeditiously.

Democrats won't have long to review them before Republicans take over on 3 January, however.


And coming up with any proposed changes to federal law regarding presidential tax returns - the stated purpose of the congressional request - seems a pointless effort with the little time remaining before congressional adjournment.

But a few weeks may be long enough to unearth evidence of any unusual or potentially improper accounting by Mr Trump - and for those details to leak to the public.

And that, many assume, was the real motive behind the request.




Trump has notched two other defeats this year from the conservative-dominated Supreme Court, three of whose justices he appointed.

In October, the court refused to weigh in on the legal fight over the FBI search of Mr Trump's Mar-a-Lago home. Agents served a warrant at the estate in August on suspicion that the former president improperly handled classified documents.

In January, the court refused to act to stop the National Archives from handing over documents to the committee investigating the 6 January 2021 riot by Trump supporters at the US Capitol.

Mr Trump has rejected the Ways and Means Committee's hunt for his taxes as politically motivated.

The chairman of the committee, Congressman Richard Neal, said in a statement that lawmakers "will now conduct the oversight that we've sought for the last three and a half years". He did not say whether the committee plans to publicly release Mr Trump's tax statements.

Last year, a Trump-appointed judge on the court of appeals in Washington DC ruled that the House did have a legitimate need to review the forms.

The committee argued it needed to see Mr Trump's records to determine if tax officials were properly auditing presidential candidates, and whether any new legislation was necessary.

They had argued to the lower court that Mr Trump's refusal blocked Congress from conducting oversight of the executive and judicial branches.

Former President Donald Trump absorbed a stunning defeat at the Supreme Court over his long-running campaign to hide his tax returns, which are now set to land before a Democratic-run House committee.
Republican-appointed appeals court judges, meanwhile, appeared cool to his latest bid to slow the Mar-a-Lago classified documents case.

Justice Department prosecutors have reached out to representatives of former Vice President Mike Pence to seek his testimony in the criminal investigation into efforts by former President Donald Trump and allies to impede the transfer of power after the 2020 election, according to people familiar with the matter





Top-Secret Documents Found at Trumps' Mar-a-Lago Resort Could Affect Canada

Vincent Rigby saw a lot over his 30-year career in public service, much of it working with some of the most sensitive and secret intelligence issues in Canada.





But for all that experience, the former national security adviser to the prime minister found himself in a state of disbelief in August when he saw the FBI search the home of former U.S. president Donald Trump and leave with boxes of highly sensitive, classified information.

"I was absolutely stunned that based on the media reports that I saw, he had in his possession what are reputed to be very, very sensitive documents and it's just something that is unheard of," Rigby said in an interview with The Fifth Estate.

"Just disbelief that somebody could take those out of the White House, stick them, I presume, on a plane or in a truck, drive them down to Florida and then put them … effectively in a basement, it's just disbelief," said Rigby, now a visiting professor at the Max Bell School of Public Policy at McGill University in Montreal.

The material has set off a damage assessment by the U.S. intelligence community as it tries to understand what classified information was contained in the documents the former president had in his possession.

But the concern extends beyond just U.S. intelligence. The United States is a member of the Five Eyes, an intelligence-sharing organization that also includes Canada, the United Kingdom, Australia and New Zealand.


Vincent Rigby, a former national security and intelligence adviser to Prime Minister Justin Trudeau, says that because Canada shares so much intelligence with the United States, Canadian agencies should be concerned about the material recovered from the Florida home of former U.S. president Donald Trump.


Rigby said any potential security breach for one member has a ripple effect within the entire group and would also reverberate through the halls of the dozen or so agencies that share and collect intelligence in Canada, including the Canadian Security and Intelligence Service (CSIS), and the Communications Security Establishment (CSE).

"In a worst-case scenario, there's Canadian intelligence, that's a direct implication," said Rigby who played a critical role in Canada's intelligence community as the national security and intelligence adviser to the prime minister from January 2020 until his retirement in September 2021.




Unprecedented Search

On Aug. 8, the FBI took the unprecedented step of searching the home of a former U.S. president. With heavily armed Secret Service agents standing guard outside, teams of FBI agents searched Trump's Mar-a-Lago property.

During the August search, the FBI combed through the posh club, which doubles as Trump's primary residence, recovering 100 documents with classification markings, including 18 marked top secret, 54 marked secret and 31 marked confidential. The documents were found in Trump's bedroom, an office and a first-floor storage room, according to court filings.

According to an inventory filed as part of a legal battle over the documents recovered, the material found includes some of the highest classification levels of U.S. intelligence, including material that's highly compartmentalized and only available to a select few.

The search was part of an investigation by the FBI and the U.S. Justice Department into the storing and mishandling of national defence information and possible obstruction of justice.

The probe was sparked by an almost year-long effort by the National Archives and Records Administration (NARA) to recover presidential records removed by Trump after he left the White House in January 2021.

In January 2022, Trump's lawyers returned 15 boxes of records. In those boxes, archivists found more than 100 documents with classification markings, comprising more than 700 pages, according to a letter from NARA to Trump's lawyers.

It's not clear if any intelligence directly related to Canada is among the documents. The Fifth Estate contacted CSIS, Global Affairs, Public Safety Canada and the minister responsible for public safety, Marco Mendicino, for comment.

Instead, The Fifth Estate was sent a response from the Privy Council Office, which reports directly to the Prime Minister's Office.

"At this stage, it would be inappropriate for the Government of Canada to comment on an ongoing U.S. law-enforcement investigation," the Privy Council Office said in the statement.

"Should the Government of Canada be made aware of any security breaches, appropriate protocols and procedures are in place to deal with them."

But experts say that because Canada relies so heavily on the U.S. for intelligence, any impact on its ability to collect information would be felt north of the border.

"Knowing the prime minister, he may well have reached out and had some pointed questions, if not directly from him, from a staff in the Prime Minister's Office: 'Do we need to be concerned? Are there any issues here? What's at stake?'" said Rigby, cautioning that he doesn't know if the prime minister has been briefed.

As national security and intelligence adviser, he was also responsible for co-ordinating the security intelligence community within Canada and liaising with allies, especially the U.S.

Rigby said if he was still in Ottawa in his former job, he'd likely be putting a call into his counterpart, U.S. national security adviser Jake Sullivan, "to say: 'OK, can you just give us a little bit of insight here as to what are these documents? And should we be concerned from a Canadian perspective?'"



Implications For Canada

The concern isn't theoretical, in part because what is reportedly in at least some of the documents relates directly to a current national security issue in Canada.

The Washington Post reported that some of the material recovered "described highly sensitive intelligence work aimed at China."

Chinese interference in Canadian elections and other national security concerns have been top of mind in Ottawa recently. At a meeting of the procedure and house affairs committee earlier this month, Michelle Tessier, deputy director of operations for CSIS, told members of Parliament about their concern about the Chinese Communist Party.

"They are an actor in foreign interference," Tessier told the committee on Nov. 1, "and we have said that publicly and I can state again that we are concerned about the activities regarding threats against the security of Canada, including foreign interference by the Chinese Communist Party."

Rigby said the activities China could be involved in range from foreign interference and espionage to disinformation, misinformation, cyberattacks and more.

He said China is also very aggressive in its intelligence collection so it would likely target information in Trump's possession to help it understand what the U.S. knows about its operations.

"If this intelligence is not stored properly, if it's sitting in a basement room somewhere without being properly locked up, it can potentially be grabbed by foreign intelligence agencies. And it can put not just the U.S. at heightened risk, but the Five Eyes, our allies and Canada included."




Detailed inventory shows 10,000 documents, classified records found at Trump's Mar-a-Lago



Artur Wilczynski, a former associate deputy chief of signals intelligence at the Communications Security Establishment, says information shared among the Five Eyes, like intelligence on China, is essential for Canadian security interests. Losing access to that would have an effect on the ability to manage risk, he said.

"If some of that information that's essential to make decisions is no longer available because sources are compromised, then you do not have all the information that you should have in order to make an informed decision," Wilczynski told The Fifth Estate.

A major reason so many in the intelligence community worry that information could be compromised is that it was stored at Trump's home in Florida, the private club known as Mar-a-Lago.

The FBI expressed concern that the facility lacked a Sensitive Compartmented Information Facility, also known as an SCIF, a specially designed area to store and view top secret information.

Mar-a-Lago is well-known among intelligence experts for substandard security, which has seen a host of dubious characters gain access over the years, including a woman posing as a wealthy heiress (who had among other documents, a forged Canadian passport) and a Chinese national who was found to have numerous electronic surveillance and computer hacking devices

A former CIA case officer tells The Fifth Estate how he would go about infiltrating former U.S. president Donald Trump's Mar-a-Lago club to try to gain access to top secret information stored there.



That easy accessibility makes it a prime target for foreign intelligence agencies to try to gain access to the former president and any material he may have in his possession, says Peter Strzok, a former FBI deputy director for counterintelligence.

"I find it hard to believe that certainly when you think about China, when you think about Russia, that they would not have extended extraordinary efforts which continue to this day to get access to Trump," Strzok told The Fifth Estate.

"Whether that is people close to him, whether that is his electronics, his email, his texts, whether that is the places that he frequents, that he lives, those efforts were significant in all likelihood, and continue to be significant."

Easy accessibility of Mar-a-Lago makes it a prime target for foreign intelligence agencies to try to gain access to the former president and any material he may have in his possession, Peter Strzok, a former FBI deputy director for counterintelligence, told The Fifth Estate.

Bruce Heyman, a former U.S. ambassador to Canada and a vocal Trump critic, was shocked but not surprised when he heard about the FBI search at Mar-a-Lago.

"This is in a resort property in Florida … a place where people go to have weddings and parties, and we have the highest level of security documents sitting around, laying around the house. I mean, this is absolutely appalling."

US Court Strikes Down Appointment of Special Master to Review TRUMP Records

A US appeals court has ended a "special master" review of documents seized from Donald Trump's Mar-a-Lago estate.

Decision marks decisive defeat as judges opine the request should never have been granted in the first place

The ruling is a win for the US Department of Justice, which is probing if Mr Trump took classified documents with him when he left the White House.



The "special master" is an independent lawyer who decides if any of the records are covered under attorney-client or executive privilege.

Investigators can now review the documents in full.

The ruling was made on Thursday by a three-judge panel in the Atlanta-based 11th Circuit US Courts of Appeal, after the Department of Justice challenged a September decision that granted Mr Trump's request for the special master review.

In its ruling, the appeals court wrote that there was no "judiciary license to interfere in an ongoing investigation".

"The law is clear. We cannot write a rule that allows any subject of a search warrant to block government investigations after the execution of the warrant. Nor can we write a rule that allows only former presidents to do so," the court wrote.

A special master review would have delayed the Department of Justice's inquiry into Mr Trump's handling of classified documents, as the government was banned from reviewing or using the materials until it was complete.

Raymond Dearie, a 78-year-old New York judge who was first nominated by Republican President Ronald Reagan in 1986, was assigned as the special master with his case.

It is unclear if Mr Trump and his lawyers will appeal against Thursday's ruling.

Mr Trump is being investigated for allegedly taking national classified documents with him to his private Florida home in Mar-a-Lago after he left the White House.

The authorities say these documents should have been handed over to the National Archives - as required of US presidents upon leaving office.

The FBI seized 15 boxes of White House documents in January, which officials said contained "highly classified reports", some of which were "intermixed with other records" and contained Mr Trump's "handwritten notes".

They also seized another 20 boxes in August.

In total, the Department of Justice alleged that 11 sets of classified documents were taken from the White House by Mr Trump.

The former president denied any wrongdoing, and argued that he had declassified all the documents as president and that they were kept securely at his Mar-a-Lago home.

When requesting a special master, Mr Trump's lawyers argued some of the documents are covered by attorney-client privilege - meaning they can be withheld under a US law that allows people to keep conversations with their lawyers private.

TRUMP Organization Found Guilty of Tax Crimes After New York Trial

Former US President Donald Trumps family real estate company has been found guilty of tax crimes.

The Trump Organization was convicted on all counts on Tuesday after two days of jury deliberations in New York.


The business is synonymous with the former president, but neither Trump nor his family members were personally on trial.

Vowing to appeal the verdict, Trump said he was "disappointed" and again described the case as a "witch hunt".




Allen Weisselberg worked for Donald Trump for decades


The company was convicted of enriching its top executives with off-the books benefits for more than a decade.

Untaxed perks included luxury cars and private school fees, prosecutors said, which made up for lower salaries and therefore reduced the amount of tax the business was required to pay.

The company is expected to face a fine of around $1.6m (£1.3m) and may also face difficulty in securing loans and financing in the future.


Trump previously criticised the trial as being politically motivated. He also attacked his long-serving former chief financial executive Allen Weisselberg after he pleaded guilty in August and testified against the business.

In his most recent statement, attacking the verdict, the former Republican leader asked why the Trump Organization should be prosecuted for Mr Weisselberg's "personal conduct" - accusing him of "committing tax fraud on his personal tax returns".

"There was RELIANCE by us on a then highly respected and expensive accounting firm, and law firm, to do this work," Mr Trump said in the statement issued by his office.


"This case is unprecedented and... is a continuation of the Greatest Political Witch Hunt in the History of our Country," he said, adding that New York City was now a "hard place to be a Trump".


Prosecutors accused the Trump Organization - which operates hotels, golf courses and other properties around the world - of having a "culture of fraud and deception" during the six-week trial.

They said it ran a scheme that allowed some executives to "understate their compensation" so that their taxes "were significantly less than the amounts that should have been paid".

"The smorgasbord of benefits is designed to keep its top executives happy and loyal," prosecutor Joshua Steinglass told the jury during closing arguments.

Two subsidiaries of the Trump Organization - Trump Corp and Trump Payroll Corp - were convicted on all 17 charges of tax fraud and falsifying business records


Allen Weisselberg, who worked for Donald Trump for decades, pleaded guilty to tax crimes in August

Mr Weisselberg, 75, testified against the company as part of a plea deal he struck with prosecutors that will mean he spends no more than five months in jail.

He will be jailed at the notorious Rikers Island prison and must pay back more than $1.7m (£1.4m) in concealed income.

Following the verdict, the judge set a sentencing date of 13 January.

Mr Trump and his three eldest children are facing a separate civil lawsuit which could see them banned from doing business in the state.

New York Attorney General Letitia James, who is leading that civil case, issued a statement hailing Tuesday's verdict as a "big victory".

"[It] shows that we will hold individuals and organisations accountable when they violate our laws to line their pockets," she said.

Manhattan District Attorney Alvin Bragg praised the verdict on Tuesday, saying the case was "about greed and cheating".

"For 13 years the Trump Corporation and the Trump Payroll Corporation got away with a scheme that awarded high-level exeecutives with lavish perks and compensation while intentionally concealing the benefits from the taxing authorities," he said.

Newly released tax returns for former President Donald Trump have shed light on his business losses, complicated tax set-ups and tax payments during his White House years.

Six years of Donald Trump’s federal tax returns show the former president paid very little in federal income taxes




However, they are unlikely to have a major political impact as he eyes another presidential run, experts say.

The documents confirmed that Mr Trump paid no federal taxes in 2020 and only $750 (£622) in 2016 and 2017.

He paid close to $1m in 2018, however.




A long legal battle led to the release of the records, and Mr Trump criticised the disclosure, warning that it will deepen the US political divide.

He added that the returns "show how proudly successful I have been and how I have been able to use depreciation and various other tax deductions as an incentive for creating thousands of jobs and magnificent structures and enterprises."


Although there's no law requiring it, it is tradition for presidents to publish their tax returns.


US presidents are paid a salary like any worker, but many also earn income from their personal businesses and investments.

The newly released documents include tax returns and related documents for Donald Trump, the Donald J Trump Revocable Trust and seven corporate entities.

They represent only a fraction of the former president's over 400 separate business interests.


Previously released figures show that Mr Trump paid a total of $1.1m (£906,587) in federal income taxes from 2016 to 2019, all but $1,500 of which was paid in one year. He paid no taxes in 2020, the final year of his presidency.

The documents also show that Mr Trump, who had international business dealings, held bank accounts in Ireland, the United Kingdom and China for a period that ran from 2015-17.

The overseas accounts were notable, as Mr Trump held the White House in 2017, giving him significant power over US foreign policy.

From 2018 onward, Mr Trump only reported having an account in the UK.



What Donald Trump Reported on His Taxes







The records also show that the Internal Revenue Service - the US federal entity responsible for collecting taxes - did not audit Mr Trump during the first years of his presidency, only beginning in 2019 after Democrats sought to gain access to his tax records.

The finding led to criticism from Democrats. Don Beyer, a member of the committee that oversaw the record release, said that the IRS' auditing system was broken and that "Congress has so much work to do to make tax enforcement in this country fairer."

In a memo cited in an earlier report, the IRS noted that "it is not possible to obtain the resources available to examine all potential issues" associated with Mr Trump's hundreds of business interests.

Maryanne Monforte, a professor of accounting practices at Syracuse University, said the tax returns represent a quagmire even for professionals.

"He's the quintessential businessman and he's got his hands in everything," she said. "He started out in real estate, and that creates a level of complexity between valuations, revenues, losses and depreciation. That all means his return has an added layer of complexity that you might not see with other billionaires."


Does Releasing The Tax Records Matter?


However, experts from both sides of the US political spectrum believe that the returns will have little impact on Mr Trump's popularity among his core supporters.

"It won't matter what was in there at all, short of anything that would be a clear legal violation," said Doug Heye, a former Republican National Committee spokesman.

"There's no Trump supporter who's going to say 'oh, I can't vote for him now'," he said. "Even though we haven't seen Trump's taxes, we've been through this before. This isn't changing anyone's minds."

"Trump voters aren't going to be moved by anything," said Democratic strategist Ameshia Cross.

For them, "Quite frankly, I don't think this matters," she said, though undecided voters - or Republicans seeking an alternative to Mr Trump - may perceive the documents as showing that his business acumen "wasn't actually what he was making it out to be".

"That would mean that the entire campaign that he ran on was basically a lie," she said. "This showcases something that he had been trying to hide for years."


How much taxes have other presidents paid - and how does Trump compare?


In some years, Mr Trump paid a far smaller proportion of his income than other recent presidents. In 2018, he and his wife earned $24.3m in adjusted gross income. But he paid just under $1m, giving him a tax rate of just 4.1%. In America, spouses file together.

In other years, because he reported huge business losses, Mr Trump's tax burden was actually greater than what he earned on paper. For example, in 2017, he lost money but still paid taxes.

In comparison, Barack Obama and his wife Michelle Obama's taxable income peaked in 2009, when they took home $5.5m, and paid about 30% in taxes. Most of their income came from the sales of Mr Obama's two books, Dreams from My Father and Audacity of Hope.

As his book sales dwindled, Mr Obama's taxable income declined considerably - in 2015, the couple earned just $447,880, almost all from his presidential salary, and paid about 18% of their income to the IRS.


What Presidents Earned in Office







George W Bush did not write his presidential biography until after he left office - while he was president, he and his wife Laura Bush averaged an income of about $800,000 a year. About half came from salaries, and the other half came from interest and investments. They had an average tax rate of 27.8%.

Bill Clinton and his wife Hillary Clinton started off in 1992 making just under $300,000 a year, mostly from salaries, and paying 23.6% of their income to tax. In 1996, Mrs Clinton's book helped the couple earn over $1m, but their tax rate actually declined to 18.5%.

Trump Organization Fined $1.6m For Tax FRAUD

Jurors had found the Trump Organization guilty of fraud and falsifying business records in December.

The company is synonymous with the former president, but neither he nor his family were part of the trial.

The only person charged in the scheme was the company's former chief financial officer, Allen Weisselberg.

Mr Trump still faces legal trouble, including a separate New York lawsuit against him and his children over allegations of fraud.

Two subsidiaries of the Trump Organization - Trump Corp and Trump Payroll Corp - were found guilty by a New York jury of enriching its top executives with untaxed benefits, like luxury cars and private school fees, for 15 years.


These benefits made up for lower salaries, prosecutors argued, and therefore reduced the amount of tax the business was required to pay.

It is the first-ever criminal conviction of one of Mr Trump's companies.

The fine, ordered by Justice Juan Merchan of the Manhattan criminal court on Friday, is the maximum the judge could have imposed for this case.


The penalty is nominal compared to the company's earnings - the Trump Organization reportedly made $446m in 2019 - but the conviction may cause difficulties for the entity to secure loans and financing in the future.

In a statement, Manhattan's District Attorney Alvin Bragg Jr said the sentencing represents "a significant chapter" in the ongoing investigations into Mr Trump and his businesses.

He added that Weisselberg and the Trump Organization "benefitted from sweeping fraud for well over a decade", and the conviction and sentencing is a reminder to corporations that they "cannot defraud tax authorities and get away with it."

Weisselberg, the long-time chief financial officer of Mr Trump's company, was sentenced to five months in prison for his role in the tax fraud scheme. He had pleaded guilty to concealing more than $1.7m in off-the-books income.


In a statement after the sentencing, the Trump Organization maintained that it had not done anything wrong and said it will appeal the conviction.

"These politically motivated prosecutors will stop at nothing to get President Trump and continue the never ending witch-hunt which began the day he announced his presidency," the statement said.

In a separate but related matter, New York state's attorney general Letitia James has sued Mr Trump and his children over allegations of fraud. Mr Trump is also being investigated by the US Department of Justice over his handling of classified documents after his presidency.

In both cases, Mr Trump has denied any wrongdoing. He has also countersued Ms James for "intimidation".

Former US president Donald Trump and his family have been accused of failing to report foreign gifts worth nearly $300,000 during his presidency.

According to a report by Democrats on the House Oversight Committee released on Friday, Trump and his family received 117 unreported foreign gifts, valued at roughly $291,000.

Trump's daughter Ivanka Trump, son-in-law Jared Kushner ad their children were also listed as recipients of some of the foreign gifts.

More than 100 unreported foreign gifts include items from Chinese President Xi Jinping, Saudi Crown Prince Mohammad bin Salman, Indian Prime Minister Narendra Modi and other foreign government officials.


"The discovery of these unreported foreign gifts raises significant questions about why former President Trump failed to disclose these gifts to the public, as required by law," the report said.

Court date for former President DONALD TRUMP’s trial for allegedly mishandling classified documents: May 20, 2024 in Fort Pierce, Fla.

The case was initially scheduled for mid-August of this year. Cannon noted in her filing that she wanted the trial date moved because “the interests of justice served by this continuance outweigh the best interest of the public and Defendants in a speedy trial.”





The new timeline is a blow to Trump, whose legal team requested the court push the trial until after the 2024 presidential election.

Instead, should the timing stick, the trial would come amidst Trump’s campaign for the White House — well past most states’ presidential primaries, but before the summer’s national nominating conventions.

That could be something of a worst-case scenario for the GOP: With the primaries mostly complete by mid-May, the party’s most likely presidential candidate will be in a highly publicized criminal trial just five months before Election Day.

But the timing isn’t exactly a win for special counsel JACK SMITH, either. Cannon called Smith’s proposed schedule “atypically accelerated and inconsistent with ensuring a fair trial.”

Meanwhile, in Georgia … With indictments possible in the coming days, Trump’s attorneys filed a Hail Mary of a motion in an attempt to quash Fulton County DA FANI WILLIS’ investigation into the former president’s efforts to overturn the election in 2020 in Georgia, reports WaPo’s Holly Bailey.

The motion, which was reassigned to a court outside of Fulton County, alleges that Willis “fundrais[ed] for her reelection campaign on the back of this case.” If granted, it would bar the Fulton County DA’s office from continuing its investigation, and throw out both the evidence and final report of the special grand jury convened by the office.

This latest filing comes just days after the Georgia Supreme Court unanimously rejected a similar motion from Trump’s team, which sought to bar Willis from the case and throw out the findings.

And, in New York … Former Trump attorney MICHAEL COHEN agreed to settle his lawsuit against the Trump Organization over disputed legal fees stemming from the Mueller investigation, NYT’s Ben Protess, Jonah Bromwich and Kate Christobek report. The 2019 suit, in which Cohen accused the organization of failing to follow the terms of an agreed-upon deal and cover more than $1 million in legal costs, was set to go to trial next week.

“The settlement is not yet finalized and the details will be kept confidential. The judge in the case, JOEL COHEN — who is no relation to Mr. Cohen — said that he would delay the trial pending a final agreement.”

Even so: “A separate lawsuit that Mr. Trump filed against Mr. Cohen in Florida federal court remains active, and Mr. Cohen is still expected to be the star witness against the former president in a Manhattan criminal trial next year.”

And, at the White House … President JOE BIDEN and his advisers continued their strategic silence on Trump’s legal woes. Jonathan Lemire writes that though the decision “is rooted” in the president’s promise to not intervene with the DOJ, “it also hints at what is likely to become a broader Biden campaign strategy: There will be plenty of other people who will do that work for him.
