The conservative judge who convinced Mike Pence he could not overturn the 2020 election has predicted “the beginning of the end of Dnald Trump” – the former president who incited the January 6 insurrection but is now trying to return to the White House.

J Michael Luttig also made a common comparison to another notorious former president, Richard Nixon, who resigned in 1974 over the Watergate scandal.



“What Nixon did was just an ordinary crime,” Luttig said, referring to the cover-up of a break-in at Democratic headquarters. “What Trump has done is quite arguably the worst crime against the United States that a president could commit.”

Luttig was a staffer for Gerald Ford, Ronald Reagan and George HW Bush, who put him on the federal bench in 1991. Now 68, he is a retired conservative jurist widely deemed unlucky not to have made the supreme court. He came to national attention last June, when he appeared before the House January 6 committee.

In a televised hearing, using precise and powerful words, Luttig explained why on 4 January 2021 he told Pence he could not do as Trump wished and block certification of Joe Biden’s election win, an argument Luttig also published on Twitter.


Luttig went on to paint a stark picture of America “at war against herself” and warned that a year and a half after the deadly Capitol riot, Trump and his supporters still posed “a clear and present danger to American democracy”.


Another six months on, Trump is in legal jeopardy amid investigations of his election subversion, his financial and campaign finance affairs and his retention of classified records, and a lawsuit brought by a writer who says he raped her, an allegation Trump denies.

But Trump is still the only declared major candidate for the Republican presidential nomination in 2024, dominating polls of the notional field.

In a lengthy profile published by the Post on Tuesday, Luttig said he had seen “ample evidence” of criminal activity and believed Trump would be indicted. He also cautioned that any decision about indicting the former president should consider how it might “split the nation”, given the inevitable “spectacle” of Trump’s fight to beat any charges.

But the Post said Luttig also thought Trump’s political future had been “dealt triple blows … by his recent assertion that parts of the constitution should be ‘terminated’ to return him to office, the criminal referrals by the January 6 committee and the failure of his favored candidates in the 2022 midterm elections”.

Trump made his remark about the constitution in a social media post in December. The Biden White House rebuked him for remarks it said were “anathema to the soul of our nation”.

The January 6 committee made four criminal referrals to the Department of Justice. The justice department investigation of Trump’s election subversion and incitement of the Capitol attack continues.

High-profile Trump candidates were beaten at the polls in November, costing Republicans control of the Senate and, arguably, a healthier House majority.

Luttig, the Post said, saw in the cumulative effect of such factors “the beginning of the end of Donald Trump”. But he added that Trump had not yet been stopped, and it might be down to the courts to do so.

“Donald Trump has proven that the only thing that can stop him is the law,” Luttig warned.

Fox News, owned by Rupert Murdoch, pictured, may be pushing to settle with Dominion Voting Systems out of court, according to a report.


The trial in the closely watched $1.6bn defamation lawsuit between Dominion Voting Systems and Fox will begin a day later than scheduled, the judge overseeing the case announced on Sunday evening, hours before opening arguments were set to begin on Monday and amid reports of settlement talks.

The trial was rescheduled to begin on Tuesday. Eric Davis, the Delaware superior court judge overseeing the case, did not say why the trial was being delayed. “The court has decided to continue the start of the trial, including jury selection, until Tuesday, April 18, 2023 at 9am. I will make such an announcement tomorrow [Monday] at 9am in Courtroom 7E,” he said in a statement


The Wall Street Journal, citing a person familiar with the matter, reported on Sunday that Fox had made a late push to settle the case out of court. Reuters also reported that the delay was due to settlement talks, according to a source familiar with the situation, as did the Washington Post, citing two sources. Spokespeople for Fox and Dominion did not immediately return a request for comment.

The announcement came on a quiet Sunday evening in Wilmington, the venue for the trial because Fox, like many US corporations, is incorporated in Delaware, where there are generous tax benefits. A reporter or two could be seen doing a television standup outside the courthouse on Sunday afternoon.

Dominion is asking a Delaware jury to award $1.6bn in damages because it says Fox knowingly or recklessly disregarded the truth when it broadcast outlandish lies about its voting equipment. US law sets a very high bar to win a defamation lawsuit and cases rarely go to trial.

Dominion’s case, experts say, is unusually strong. It has drawn national attention because it amounts to one of the most aggressive efforts to hold Fox, or anyone, responsible for spreading misinformation about the 2020 election. Over the last several months Dominion has produced a trove of internal communications from Fox employees showing they knew what they were broadcasting was FALSE.

The trial has been expected to be a blockbuster, with top Fox executives Rupert and Lachlan Murdoch expected to testify in person, along with top Fox hosts Sean Hannity, Tucker Carlson, Maria Bartiromo and Jeanine Pirro.

Fox accuses Dominion of cherrypicking evidence and has argued that it is defending the first amendment, and that a win for Dominion would lead to more lawsuits against media outlets and weaken press protections in the US. Some experts share that concern. “Unfortunately, I’d predict if Fox loses, we’ll see a significant uptick in libel cases against all news organizations,” Jane Kirtley, a professor at the University of Minnesota and former executive director of the Reporters Committee for Freedom of the Press, wrote in an email.

Other experts say the evidence against Fox is so strong that this case could show existing media standards still provide workable protections under which outlets can be held accountable

“The key question here is whether Dominion is asking for a watering down of the constitutional standard. Or whether it is arguing that it can clear even the staggeringly high constitutional barrier as it now exists. Everything that I have heard and read from Dominion suggests that it is the latter,” said RonNell Andersen Jones, a first amendment scholar at the University of Utah.

Fox News Settles Dominion Defamation Case For $787.5m

Fox News has settled a defamation lawsuit from the voting machine company, Dominion, over its reporting of the 2020 presidential election.

In a last-minute settlement before trial, the network agreed to pay $787.5m (£634m) - about half of the $1.6bn initially sought by Dominion.

Dominion argued its business was harmed by Fox spreading false claims the vote had been rigged against Donald Trump.

The deal spares Fox executives such as Rupert Murdoch from having to testify. The judge in the case is not required to give his approval for the agreement.


Fox said Tuesday's settlement in one of the most anticipated defamation trials in recent US history reflected its "commitment to the highest journalistic standards".

The Fox statement added without elaborating that the network "acknowledges the court's rulings finding certain claims about Dominion to be false".

Dominion chief executive John Poulos told a press conference the deal included Fox "admitting to telling lies, causing enormous damage to my company".

Justin Nelson, a Dominion attorney, told reporters that "the truth matters".

"Lies have consequences," he added. "Over two years ago a torrent of lies swept Dominion and election officials across America into an alternative universe of conspiracy theories, causing grievous harm to Dominion and the country."

Mr Nelson added that for "democracy to endure", Americans must "share a commitment to facts".

Opening arguments in the case had been due to start on Tuesday afternoon.


The announcement of a settlement came after an unexplained delay of several hours once jury selection had finished, prompting speculation that talks were under way behind the scenes.

On Monday, Delaware Superior Court Judge Eric Davis announced that the start of the trial would be delayed by 24 hours.

Although he gave no reason, US media reported that it was to give both sides an opportunity to reach a settlement.

On Tuesday morning, however, both sides appeared to be digging in for a lengthy trial.

Attorneys for Fox had repeatedly objected to the $1.6bn in damages sought by Colorado-based Dominion, characterising the figure as massively inflated.

The "real cost" of the case, Fox had argued, would be the "cherished" rights to freedom of speech and of the press enshrined in the First Amendment of the US Constitution.

The lawsuit said that the false claims were partly an effort to win over viewers who were angered by Fox's decision on election night to - correctly - declare that Mr Trump's then-challenger, Joe Biden, had won the crucial state of Arizona.

Two of the Fox executives responsible for the Arizona decision lost their jobs two months later.

Legal findings released ahead of the trial suggested that a number of Fox executives and journalists privately questioned and dismissed conspiracy claims that the 2020 presidential election was stolen, but still put them on air.

Court documents show that Mr Murdoch referred to the claims about Dominion as "really crazy", but failed to take any action.

In one series of text messages, top-rated host Tucker Carlson said some of the claims were "insane". Another host, Sean Hannity, said privately he did not believe them "for one second".

Fox has said the words were taken out of context.

Ahead of the trial, Judge Davis ruled that the claims against Dominion had already been proven false, emphasising that the falsehoods were "crystal clear".

Despite the mammoth pay-out, some legal experts believe the settlement was overall a positive outcome for the network.

Syracuse University professor and First Amendment expert Roy Gutterman said: "Looking down the line at a six-week trial, this was going to be gruelling for everyone involved and likely embarrassing for Fox.

"But a verdict against Fox could have been even costlier, and had serious implications on subsequent rulings on the actual malice standard and the First Amendment itself."

Had the defamation trial gone ahead, jurors would have been tasked with determining whether Fox News acted with "actual malice" by broadcasting claims it knew to be false.

Civil litigation attorney Michelle Simpson Tuegel told the BBC that the settlement "speaks to the massive threat Fox saw from this litigation".

"The reputational harm of having executives, including chairman Rupert Murdoch, and hosts take the stand seems to have moved the parties towards a resolution," Ms Tuegel added.


Fox still faces a second, similar defamation lawsuit from another election technology firm, Smartmatic, which is seeking $2.7bn.

Dominion still has litigation pending against two conservative news networks, OAN and Newsmax.

The company has also sued Trump allies such as Rudy Giuliani, Sidney Powell and Mike Lindell...

Donald Trump appeared at a CNN town hall on Wednesday night to unleash a litany of lies about the 2020 election and E Jean Carroll’s lawsuit, just one day after a New York jury found the former president liable for sexual abuse and defamation.

The town hall turned combative as soon as it began, with Trump reiterating his lies about the 2020 election as Collins repeatedly interjected.


Trump took questions from a friendly crowd of Republican and undeclared voters in New Hampshire, who often greeted the former president’s divisive comments and gestures toward moderator Kaitlan Collins with laughter and applause.

Trump offered his thoughts on everything from the debt ceiling to abortion access and the war in Ukraine, but he frequently deflected when asked to outline specific policy objectives if he takes back the White House next year.

Pressed by Collins on whether he would acknowledge Joe Biden’s victory in the 2020 election, Trump refused to do so. When Collins later asked if he would accept the results of the 2024 election regardless of the outcome, Trump replied, “Yeah, if I think it’s an honest election, absolutely.”

Collins appeared to grow exasperated as the 70-minute town hall drew on, telling Trump at one point, “The election was not rigged, Mr President. You can’t keep saying that all night long.”

Turning to Trump’s many legal liabilities, she asked the former president for his message to voters who argue that the verdict in Carroll’s lawsuit should disqualify him from seeking office. On Tuesday, a New York jury concluded that Trump had sexually abused Carroll 27 years earlier, ordering the former president to pay her $5m in damages for her battery and defamation claims.

Trump responded by attacking Carroll as a “whack job” and raising baseless doubts about the objectivity of the judge who oversaw the case. The New Hampshire crowd welcomed Trump’s offensive and often untrue statements, and some audience members laughed when Collins noted that the former president had been found liable for sexual abuse.

The verdict in Carroll’s case came a month after Trump pleaded not guilty to 34 felony charges of falsifying business records in connection to a hush-money scheme during the 2016 election. He also faces potential criminal charges in Georgia and Washington over his efforts to overturn the 2020 election and his alleged mishandling of classified documents.

Asked why he had refused to voluntarily deliver the requested documents to federal authorities, Trump replied by calling Collins as a “nasty person”, echoing his characterization of former Democratic nominee Hillary Clinton as a “nasty woman” in 2016.


Meanwhile, Trump often shied away from offering a direct response to policy questions. Asked whether he would sign a federal abortion ban, he replied, “I’m looking at a solution that’s going to work. Very complex issue for the country. You have people on both sides of an issue, but we are now in a very strong position. Pro-life people are in a strong position to make a deal that’s going to be good and going to be satisfactory for them.”

Trump would similarly not state whether he wanted Ukraine to win its war against Russia, which launched an unprovoked invasion last year. “I want everybody to stop dying,” Trump said. “Russians and Ukrainians, I want them to stop dying. And I’ll have that done. I’ll have that done in 24 hours.”



The few policy positions that Trump did clearly articulate may be unpopular with a wide swath of the American electorate. Trump said he was “inclined to pardon many” of those convicted for their participation in the January 6 insurrection at the US Capitol.

He also discouraged congressional Republicans from approving an increase in the government’s debt ceiling, which could soon cause a disastrous federal default.

“I say to the Republicans out there – congressmen, senators – if they don’t give you massive [spending] cuts, you’re going to have to do a default,” Trump said. “I don’t believe they’re going to do a default because I think the Democrats will absolutely cave.”

Trump’s position represents a reversal from his stance during his presidency, when he repeatedly suspended the debt ceiling to allow the government to continue borrowing money. Asked why he had changed his tune, Trump replied, “Because now I’m not president.”

The flippant comment was met with laughter and applause, underscoring the former president’s enduring hold on the Republican base. Despite his many legal challenges, Trump remains the frontrunner in polls of the Republican primary field.

A number of commentators who had criticized CNN for agreeing to host the town hall cited the contentious nature of the conversation and the audience’s positive reaction to Trump’s lies as confirmation of the network’s poor judgement.

“CNN should be ashamed of themselves,” progressive congresswoman Alexandria Ocasio-Cortez said on Twitter. “They have lost total control of this ‘town hall’ to again be manipulated into platforming election disinformation, defenses of Jan 6th, and a public attack on a sexual abuse victim. The audience is cheering him on and laughing at the host.”

But CNN defended its decision, arguing voters deserved the opportunity to hear from the current frontrunner in the Republican presidential primary.

“Our job, despite his unique circumstances, is to do what we do best,” a CNN spokesperson said in a statement on Wednesday morning. “Ask tough questions, follow up and hold him accountable to give voters the information they need to sort through their choices. That is our role and our responsibility.”

The 300-page conclusion to a three-year probe also dealt another blow to the Federal Bureau of Investigation over its handling of the reputation-shredding 2016 election.


Durham said that the bureau’s full-scale probe into multiple links between the Trump campaign and Russians should never have been launched, arguing that investigators “discounted or willfully ignored” information that did not support preliminary theories that there was collusion between Trump and Russia. And he called on the Justice Department to appoint an official to oversee politically sensitive probes.

But while Durham criticized confirmation bias and mistakes in the FBI, he did not unveil any new prosecutions – undermining Trump’s predictions of a sweeping purge of the bureau – and had no recommendations for further reforms in the FBI.

Still in a passage of the report that is certain to be highlighted by the former GOP president for political purposes, he argued that neither US law enforcement officials nor the intelligence community appears to have had “any actual evidence of collusion” before investigating Trump.

And the special counsel also criticized the FBI’s use of the Steele dossier, a now largely debunked document that was used by the FBI to secure surveillance warrants against a former Trump campaign adviser.

But not much of what Durham revealed on Monday was new and while it was not the complete fail that some partisan media commentators on the left claimed, it certainly lacked the kind of blockbuster indictments once predicted by the former president and his family.

Those debates aside, the polarization of American politics, everything involving Trump and the bitter aftermath of the 2016 election means that perceptions of links between his team and Russia will depend for many citizens on their ideological perspective and opinion of Trump.

Author and columnist E Jean Carroll is going back to court to demand “very substantial” additional damages from Donald Trump for the disparaging remarks he made about her during a televised CNN town hall just a day after he was found liable in a civil case for sexually assaulting her.



An amended lawsuit seeking an additional $10m in compensatory damages – and more in punitive damages – was filed in Manhattan on Monday by lawyers for Carroll, who say remarks made by the former president in response to her rape allegations have so spoiled her reputation that she lost her longtime job as an Elle magazine advice columnist.



On 9 May, a New York jury ruled that Trump had sexually abused the advice columnist in a New York department store changing room 27 years ago. It also awarded about $5m in compensatory and punitive damages: about $2m on the sexual abuse count and close to $3m for defamation, for branding her a liar.

The following night, during a live town hall where Trump was interviewed on CNN in New Hampshire, Trump further and repeatedly insulted and demeaned Carroll and her experiences.

Trump said her account of a sexual assault, in the case which he is appealing, was “fake” and a “made-up story” and referred to it as “hanky-panky”. He repeated past claims that he’d never met Carroll and considered her a “whack job.”

Carroll’s new filing aims to inflict a further financial penalty against Trump for those remarks, claiming they are defamatory.

Lawyers for Carroll said that Trump had “doubled down” on derogatory remarks about her a day after the verdict.

The filing claimed Trump’s statements at the televised town hall “show the depth of his malice toward Carroll, since it is hard to imagine defamatory conduct that could possibly be more motivated by hatred, ill will or spite” and demanded “a very substantial punitive damages award in Carroll’s favor both to punish Trump, to deter him from engaging in further defamation and to deter others from doing the same.”

Carroll’s lawyer, Roberta Kaplan, told the New York Times on Monday evening that Trump’s remarks on CNN “makes a mockery of the jury verdict and our justice system” if the former president was allowed to get away with repeating defamatory statements.

Carroll, who testified during the trial, first revealed in a 2019 book her claims that Trump raped her in a dressing room. The jury decided Carroll hadn’t proved she had been raped, but found that Trump had sexually abused her.

Speaking after the verdict earlier this month, Carroll, 79, said her case was “not about the money” and that the outcome broke down barriers for women and “demolished” the myth of the “perfect victim”.

“Before yesterday there was a concept of the perfect victim,” Carroll said. “The perfect victim always screams, always reports to the police, always makes note when it happened and then her life is supposed to … fold up and she’s never sort of supposed to be happy again.

“And yesterday we demolished that whole concept. It is gone. It is gone. And I am overwhelmed with happiness for the women of the country. It’s really not about me so much. It’s about every woman.”

Ex-President Donald Trump can be held liable for disparaging comments he made about a woman who accused him of rape, the US Department of Justice has said.

Lawyers previously argued Mr Trump was legally immune as he was president when he made the remarks in 2019.

But on Tuesday government attorneys said they no longer had "sufficient basis" to conclude Mr Trump had acted within the scope of his duties.



The decision boosts E Jean Carroll's defamation lawsuit against Mr Trump.




In May, Mr Trump was ordered to pay the former magazine columnist $5m (£3.9m) after being found liable for sexual abuse of her in 1996 at a New York department store.

Ms Carroll, 79, is currently seeking $10m from Mr Trump in a defamation lawsuit, which is due to go to trial in January.



The legal action cites his remarks as president about her in 2019 while responding to reporters' questions.

The lawsuit has been updated to reflect further comments he made about her during a CNN town hall the day after the court's verdict two months ago.

The justice department had previously taken the position that Mr Trump could be defended by government attorneys because he was serving in his capacity as president when he made the remarks.

But on Tuesday its lawyers said "there is no longer a sufficient basis to conclude that the former president was motivated by 'more than an insignificant' desire to serve the United States Government".

In a letter filed with the judge presiding over the case, the justice department wrote that "Mr Trump was motivated by a 'personal grievance' stemming from events that occurred many years prior to Mr Trump's presidency".

The letter said new evidence had emerged since Trump, 77, left office, referring to the Manhattan civil trial earlier this year.

The justice department said that though Trump's comments were made via official channels, the accusation that prompted the statements were in regards "to a purely personal incident: an alleged sexual assault that occurred decades prior to Mr Trump's presidency".

"We have always believed that Donald Trump made his defamatory statements about our client in June 2019 out of personal animus, ill will, and spite, and not as president of the United States," said Roberta A Kaplan.

A federal judge ruled that the jury hearing E. Jean Carroll’s defamation lawsuit will only need to decide how much money Donald Trump will have to pay her, after the judge found the former president was liable for making defamatory statements.



The finding is a significant blow to Trump, who is facing numerous criminal indictments and civil lawsuits – many of them coming to a head as he embarks on a presidential campaign.

Judge Lewis Kaplan said that a federal jury’s verdict earlier this year against Trump will carry over to the defamation case set to go to trial in January involving statements Trump made in 2019 about Carroll’s sexual assault allegations.

Carroll, a former magazine columnist, alleged Trump raped her in a Bergdorf Goodman department store in the mid-1990s and then defamed her when he denied her claim.

In May after a two-week trial, a jury found Trump sexually abused Carroll and defamed her when he said in 2022 that he didn’t rape her, didn’t know her, and that she wasn’t his “type.”

In that case, the jury awarded Carroll $5 million in damages.

“The truth or falsity of Mr Trump’s 2019 statements therefore depends – like the truth or falsity of his 2022 statement – on whether Ms Carroll lied about Mr Trump sexually assaulting her,” the judge ruled Wednesday. “The jury’s finding that she did not therefore is binding in this case and precludes Mr Trump from contesting the falsity of his 2019 statements.”

Kaplan ruled the trial set for January 15 will be limited to damages.

Although her initial lawsuit was filed in 2019, the judge previously allowed Carroll to include comments Trump made at a CNN town hall earlier this year.

On Wednesday, Kaplan also rejected Trump’s argument that any future damages be capped, meaning the previous award shouldn’t be a factor for the jury. Carroll is seeking more than $10 million in damages.

Trump has denied any wrongdoing. He has appealed the jury’s verdict and all rulings against him.

TRUMP will be back in the court next week, facing a new defamation case brought by E. Jean Carroll. Conservative Attorney George Conway reveals to The Weekend co-hosts that he has been admitted into evidence in the case.


After Donald Trump last week faced the prospect of a $370m fine and potential collapse of his real estate empire in New York state court, he will now contend with yet another costly legal battle in Manhattan: a defamation case brought by a woman who, according to a jury of her peers, was sexually abused by the former US president.

On Tuesday, TRUMP will once again be on trial over the former Elle writer E Jean Carroll’s sexual assault claims against him – his second such proceeding in less than a year.


This trial – which comes as Trump also deals with a host of criminal cases against him – will play out at Manhattan federal court, just hundreds of feet away from the courthouse where the team of the New York attorney general, Letitia James, argued that he committed massive civil fraud.

Carroll has said that TRUMP raped her in a Bergdorf Goodman dressing room around late 1995; her statement was first published by New York magazine, from a portion of her then forthcoming book What Do We Need Men For? A Modest Proposal.

TRUMP denied Carroll’s claims, saying: “I’ve never met this person in my life. She is trying to sell a new book – that should indicate her motivation. It should be sold in the fiction section.” He also heaped further insults on her and accused her of being part of a political conspiracy.

Carroll sued TRUMP in 2019 over these statements, saying that TRUMPS’ denials damaged her reputation. At the time, Carroll could not sue TRUMP over her claim of sexual assault, as this was beyond the statute of limitations.

In 2022, however, New York state’s Adult Survivors Act – which, for a one-year period, permitted adult survivors of sexual misconduct to file civil suits against their alleged abusers – allowed Carroll to sue TRUMP again, this time over the claimed assault. That lawsuit, which also included defamation claims for statements TRUMP made after he was no longer president, went to trial in April 2023.

“I’m here because Donald Trump raped me and when I wrote about it, he said it didn’t happen. He lied and shattered my reputation. I’m here to try to get my life back,” Carroll said in harrowing court testimony.

Carroll won that lawsuit: after just three hours of deliberations, jurors found TRUMP liable of sexual assault and defamation, awarding her $5m.


TRUMPS’ upcoming trial will not relitigate Carroll’s claim of sexual assault. On 9 January, Judge Lewis Kaplan ruled that Trump cannot deny the sexual assault, pointing to a jury’s previous finding.

“Consequently, the fact that Mr Trump sexually abused – indeed, raped – Ms Carroll has been conclusively established and is binding in this case,” Kaplan also said.

“Mr Trump is precluded from offering any testimony, evidence, or argument suggesting or implying that he did not sexually assault Ms Carroll, that she fabricated her account of the assault, or that she had any motive to do so.”

This ruling means that TRUMP cannot fight Carrolls' claims at this trial. Jurors are tasked with deciding only if TRUMP defamed her with his 2019 statements and, if so, the financial penalties associated with said denial.



“He’s unlike any other client I could ever advise,” an expert told the Guardian. And if Trump attends Carroll’s trial, as he has claimed he will, it could hurt him even more.

“I think his presence in the courtroom would probably hurt him because I think he has such a machismo arrogant aura about him, and he’ll be very stern the entire time

Trump threw his arms in the air in frustration, shook his head, then said: 'I would love it. I would love it'.

Before the tense exchange, Carroll told the jury in the $10million defamation trial that Trump's 'lies' had sparked so many death threats she bought bullets for a gun she kept by her head.

A New York jury found last year that Trump sexually assaulted Carroll in a Bergdorf Goodman dressing room in the 1990s. The new trial is to decide how much he'll pay in damages for comments he made while he was president - including: 'This woman is not my type!'

The jury were shown some of the torrent of vile messages she received including some emails threatening her life.

Choking up, Carroll said that ‘many, many’ commented on her appearance, with the overall message that she was ‘too ugly to go on living’.

Carroll's dramatic testimony began after Trump was pictured leaving Trump Tower early Wednesday morning with mysterious red cuts on his hands.

She told the jury that Trump 'shattered' her reputation by repeatedly 'lying' about the attack and suggesting she was 'too ugly to assault' by claiming she wasn't his type.

The judge then admonished Trump for loudly muttering that Carroll had 'suddenly gotten her memory back' from behind the defense table throughout her testimony.

Judge Kaplan told Trump's lawyers he should ‘take special care to keep his voice down when conferring with counsel so the jury does not hear’.

It followed a complaint from Carroll's lawyer Shawn Crowley that the jury could hear what he was saying.

Mr Trump has been sitting at the back table and has been loudly saying things through Miss Carrol’s testimony,' her lawyer Shawn Crowley told the judge.

‘Mr Trump has been sitting at the back table and has been loudly saying things through Miss Carrol’s testimony, he added.

‘(He said) things she’s saying are false, noting she now seems to have her memory back.

‘It’s loud enough for us to hear, I imagine it’s loud enough for the jury to hear it’.

Asked by her lawyer Roberta Kaplan why she was in court, Carroll said: ‘Donald Trump assaulted me and when I wrote about it he said it never happened.

‘He lied and shattered my reputation’.

Trump could be seen shaking his head dismissively.

Carroll told the court that in the same courtroom at a separate trial last year another jury found that she had been ‘sexually assaulted by Donald Trump’.

After calling her a liar when she first went public in 2019, Trump has ‘continued to lie’ about her, Carroll said.

‘He lied last month, he lied on Sunday, he lied yesterday,’ she said: ‘I’m here to get my reputation back and to stop him from telling lies’.

Carroll said that she spent 50 years building up her reputation as an advice columnist because she ‘stuck to the truth’.

Asked how her reputation had been shattered, she said that the day before testifying she looked at Twitter, formerly X, and saw a comment that she was a ‘fraud’.

She said: ‘Previously I was noticed simply as a journalist. Now I’m known as a liar, a fraud and a wack job.

‘People are not dying to write to an advice columnist who the President says is a disgrace’.

Carroll talked about growing up in rural Indiana to a Republican family and won a beauty contest in her youth.

At the age of 13, she sent off her first article to be written but had to wait two decades to have her first success, which came at the age of 36.

But the mood remained testy and after an objection, Judge Kaplan said: ‘Let’s get this clear for both sides.

‘The first lawyer who says anything when a witness is (testifying). This is not tag team lawyering.

'Carroll talked the jury through her career and described how she wrote articles for magazines like Vanity Fair and an advice column titled ‘Ask E. Jean’ for decades with Elle magazine.

She once hosted an advice TV show and was for a time a writer on Saturday Night Live, as well as writing five books including essays, a memoir and a biography of journalist Hunter S. Thompson.

In 2019 she wrote a book called ‘What Do We Need Men For?’ and decided to go public with her claims about Trump for the first time.


As Habba objected again, Kaplan told her: ‘When you speak in this courtroom you’ll stand up’.

The judge overruled the objection and moved on.

Carroll said she felt like a ‘hypocrite’ because women she interviewed for her book trusted her with their stories yet she wasn’t going public with hers.

She said: ‘I’m 95 years old if I don’t do it now, i will never do it, So I included him’.

Carroll began to describe Trump sexually assaulting her, telling the court he asked her advice to choose some lingerie at Bergdorf’s, but Judge Kaplan stopped her.


The allegations against Trump appeared in an extract of the book in New York magazine on June 21st 2019.

Carroll said that given Trump was president at the time, she expected him to respond.

‘I expected him to deny it but to say it was consensual which was not, that’s what I expected him to say,’ she said.

Instead Trump posted on Twitter, formerly X, calling her a liar, hours later.

Carroll looked through the comments made by Trump and told the jury which were lies.

She said: ‘I’ve never met this woman in my life - that is a lie. I made up the accusation to sell a book - that is a lie

‘I made the accusation for publicity - that is a lie, he said my false accusation damages real victims of sexual assault - that is a lie’.

Habba objected on the grounds that Carool is ‘not a lawyer’ but Judge Kaplan overruled it, earning a shake of the head in frustration from Trump

Carroll said: ‘The thing that really got me about this is from the White House he asked if anyone had any information about me and to please come forward because he wanted to know what’s really going on and that people like me should pay dearly’.

Caroll’s lawyer Roberta Kaplan asked: ‘Have you paid dearly?’

‘I paid just about as dearly as possible to pay,’ Carroll said.

Trump followed up his Tweet with comments on the White House lawn the next day, June 22nd, saying it was a ‘false allegation’.

Carroll said that was a lie too.

She told the court: ‘The thing about this piece statement is he said numerous women had been paid to make false accusations about him….and he includes me in that group. That is not true.

‘He said people like me who make false accusations are very dangerous territory. (He said) I shouldn’t have done it for the sake of publicity. That is also a lie’.

The following Monday Trump, said in an interview that he couldn’t have assaulted Carroll as she was ‘not his type.

Carroll said: ‘It means I’m too ugly to assault’.

Asked how it felt to have the President say these three things about her, Carroll took a breath.

She said: ‘Well to have the President of the United States, one of the most powerful persons on Earth, calling me a liar for three days and saying I’m a liar 26 times it ended the world that I had been living in’.

Carroll said that after that she entered a ‘new world’.

She said: ‘I was attacked. On Twitter, Facebook, news blogs, brutally attacked in messages.

‘It was a new world. I had left the world of facts and I was living in a new universe’.

Carrol said the attacks were ‘instantaneous’ and that many repeated the same language Trump used.

A Facebook message an hour after Trump’s first denial read: ‘Your nothing but a liar! Trump did nothing do you! Your only saying this to promote your book! You have to answer to the LORD for your lies. I hope it is worth it?!’

An email to her ‘Ask E. Jean’ advice column email account on June 22nd 2019 from a sender called ‘Sports Justice’ read: ‘E. Jean Carroll (claims raped by Trump) = demented, lying old hag’


Another message read: ‘I want to tell you that you are a lying bitch! I believe Trump! Why would he want to rape you when you are so frickin ugly!’

Habba earned yet another rebuke from the judge when she tried to claim she could ask Carroll about who is funding her case because of a question by her lawyers.

“Did you ever post any tweets that could be considered sexually explicit?” Alina Habba, Trump’s lead attorney, asked.



Carroll’s team objected. Presiding judge Lewis Kaplan sustained the objection.

As Habba hammered on about the sexual commentary on Carroll’s social media accounts (the former Elle columnist has written about sex and relationships for years), questioning took a turn for the absurd.

“Ms Carroll, what does this say: ‘What CAN be done about the penis? It gets large when you want it small, and stays small when you want it large,’” Habba asked, showing a 2013 tweet. “Those were your words, correct?”

“Yes,” Carroll said.

“And you posted them on a public social media account?”

“Yes.”

“And you left that on your Twitter account as we stand here today, correct?”

Carroll answered in the affirmative.

Pressed to explain the tweet, Carroll said: “It’s a philosophical question.”

“Sometimes a woman doesn’t feel like making love and the man wants to,” Carroll explained, adding that sometimes it’s the reverse.

“You discussed penises?” Habba said.

Carroll said: “Yes.”

Carroll took the stand on Wednesday in the Manhattan federal court trial, which will determine financial penalties against the former US president over his denials of her rape allegation against him in 2019.

“I’m here because Donald Trump assaulted me, and when I wrote about it, he said it never happened,” Carroll told jurors. “He lied, and it shattered my reputation.”

Trump was present for Carroll’s opening testimony Wednesday and his lack of courtroom decorum quickly drew the attention of her team – and prompted a stern warning from judge Kaplan.

“Mr Trump has been sitting at the back table and has been loudly saying things throughout Ms Carroll’s testimony,” Shawn Crowley, one of Carroll’s attorneys, said.

“It’s loud enough for us to hear it,” Crowley stated, so “I imagine it’s loud enough for the jury to hear it.”

Before proceedings resumed after the break, Kaplan warned: “I’m just going to ask Mr Trump to take special care to keep his voice down when conferring with counsel, so that the jury does not overhear.”

Trump did not abide by Kaplan’s instruction.

“The defendant has been making statements again [that] we can hear at counsel table,” Crowley told the judge right before the lunch break.

“He said it is a ‘witch-hunt’, it really is a con-job.”

“Mr Trump has the right to be present here. That right can be forfeited, and it can be forfeited if he is disruptive, which is what has been reported to me, and if he disregards court orders,” Kaplan said.

“Mr Trump, I hope I don’t have to consider excluding you from the trial … I understand you are probably very eager for me to do that.”

Former president Donald Trump dramatically took the witness stand and told a court he had never met E. Jean Carroll, the writer who accuses him of sexually attacking her in a department store in the 1990s.


From the stand Trump told a civil jury he wanted to defend himself and 'the presidency' by calling out accusations that were 'totally false'.

Before giving evidence he was rebuked by the judge for speaking too loudly from his seat, and the judge then repeatedly cut him off during his testimony, making him stick to yes or no answers.

As he left Trump looked back at the packed courtroom, shook his head, and said: 'This is not America. Not America. This is not America.'

Trump was on the stand for three minutes as his lawyer Alina Habba asked him a short series of questions.

The former president has already been found liable for sexually abusing Carroll in a previous civil trial last year, which he did not attend.

She is now seeking at least $10 million in damages for defamation after Trump continued to publicly deny her allegations.

Trump is trying to convince the current jury that he should not have to pay Carroll anything.

As he was set to give evidence on Thursday in Manhattan, Trump turned to Habba and said loudly: 'I don't know who the woman (Carroll) is. I never met this woman.' That led to the rebuke from U.S. District Court Judge Lewis A. Kaplan.

'I'm sorry, Mr Trump, you're interrupting these proceedings by talking loudly while your attorney is talking and that is not permitted,' the judge said.

After Trump took the stand Trump said he '100 percent' stood by answers he gave in a deposition in October 2022 when he called the allegations “a made-up story.”

Habba asked if the former president if he saw Carroll's allegation as false.

'Yes I did,' Trump said. 'She said something that I considered a false accusation, totally false.'

Judge Kaplan then interrupted Trump, saying: 'Everything after "yes I did" is stricken (from the record).'

Habba asked Trump if he had made statements to hurt Carroll.

The former president said: 'No, I just wanted to defend myself, my family and frankly the presidency.'

Last May, another jury ordered Trump to pay Carroll $5 million after he denied her rape claim in October 2022.

Kaplan, who has presided at both trials, has ruled that the first trial established that Trump defamed and sexually abused Carroll.

The only issues for the nine jurors in the current trial is how much money Trump should pay Carroll, if any, for damaging her reputation - and how much, if any, he should pay as punishment and to dissuade him from defaming her again.



A damages expert testified on Carrolls' behalf that the damage to her reputation could be as high as $12.1 million.

Trumps legal team has said damages should be nominal or zero, and that Carroll has gained more than whatever she might have lost by pursuing and gaining her newfound fame.

An emotional E Jean Carroll held hands with her attorneys, who were sat either side of her, before the verdict was read out.





Meanwhile there was no sign of Trump who left the court at around 4pm when a decision was imminent.




Carroll, Roberta Kaplan and Shawn Crowley, glanced excitedly at each other as the judge queried what the 'm' on the jury's verdict form signified.

Carroll became teary after the jury foreman read out the decision that Trump had defamed her and she was to be paid an eye-watering $83.3million.

She and her legal team remained composed as the judge wrapped up the proceedings while Trumps' legal team looked stunned and stoney-faced.

Once the judge dismissed the jury, Carroll, Kaplan and Crowley leaped up and shared a warm embrace in celebration of their victory.

They hugged for a few moments as they let the reality of their victory sink in before calmly leaving the courtroom.





While Trumps' lawyers Alina Habba and Michael Madaio silently slinked away following the verdict.

A representative for Roberta Kaplan dismissed the claims, saying they merely briefly overlapped at the same law firm in the early 1990s







Trumps firebrand attorney Alina Habba claimed she was unaware that Judge Lewis Kaplan and Carroll's lawyer Roberta Kaplan - who are not related - worked together in the early 1990s, with the judge serving as her 'mentor'.



'It was never disclosed. It's insane and so incestuous,' Habba said, arguing their alleged close relationship was never disclosed and she only became aware of it after the conclusion of the case.

Habba continued: 'This is news to us. We are going to include this in our appeal and take appropriate measures. The fact it wasn't disclosed is an ethics violation.'

The allegations of a conflict of interest were bolstered by an anonymous former Weiss partner, who reportedly claimed Roberta Kaplan - a junior associate - made an extra effort to stand out to the managing partners.

'Lew was like her mentor,' they claimed.




Before becoming a founding partner at law firm Kaplan, Keckler & Fink in 2016, Roberta Kaplan worked alongside the judge at Paul, Weiss Rifkin, Wharton & Garrison in Manhattan.



She began at the firm in 1992, according to her LinkedIn, where Judge Kaplan was a partner until he was appointed to the federal bench by President Bill Clinton in 1994.

In a statement to the Post, representative for Roberta Kaplan, Zak Sawyer, denied there was any conflict of interest and said the two barely knew each other.

'They overlapped for less than two years in the early 1990s at a large law firm when he was a senior partner and she was a junior associate and she never worked for him,' he said.




Judge Kaplan clashed with Trumps legal team on numerous occasions in the fiery defamation trial, including threatening to 'lock up' Habba as she continuously interrupted proceedings.

Judge Rejects TRUMPS' Mistrial Motions in E Jean Carroll Defamation Case

Judge Lewis Kaplan, who ruled from the bench, reportedly said allowing for a mistrial ‘would have been entirely pointless’

Donald Trumps’ motions for a mistrial in the defamation case brought against him by the writer E Jean Carroll have been rejected by a federal judge, who added that the former president’s issues with the verdict had no “merit”.


The case is the second in less that a year brought by Carroll against Trump: this seeks damages for comments made by the former President during in and after he was in office.

In an order filed on Wednesday, Judge Lewis Kaplan said the motion for a mistrial “made no sense” and that approving it “would have been entirely pointless”.

Trump’s lawyers had previously called for a mistrial in the middle of their cross-examination of Carroll, which the judge denied at the time, instructing the jury to disregard the counsel’s remarks. He reiterated his decision and sharply criticized the efforts of Trump’s attorney in the written order this week.

Last month, Trump was ordered to pay Carroll an additional $83.3m after Kaplan found that he had defamed her in 2019. A jury previously had found that Trump had sexually abused her, awarding her $5m. Shortly after the judge’s decision, Trump decried it on Truth Social as “absolutely ridiculous” and said he would be filing an appeal.

Trump lawyer Alina Habba requested the mistrial after Carroll discussed deleting some death threats she had received to help with her anxiety and “get control of the situation”. Habba accused Carroll of “deleting evidence” and made the unusual mistrial request in front of the jury.

Kaplan wrote that he had denied the motion “immediately” during that hearing “partly because it was untimely”, since the defendant had been aware of the alleged deletion of messages for nearly a year before the trial. The judge also noted that a mistrial is granted because of a procedural error or serious misconduct, meaning a mistrial would not have remedied any issue with improper disposal of electronic communications “if any there was”.

If a mistrial were declared, a new trial would be called and the same issues would be in effect, meaning it would have “served no useful purpose”, Kaplan wrote, saying Habba’s subsequent written motion for a mistrial was “at least doubly frivolous” and “entirely baseless”. “Granting it now would be even less sensible … [and] a bootless exercise,” Kaplan went on.

The judge also said that making the request in front of the jury had been “needlessly prejudicial to Ms Carroll”. The judge further said he would not grant any relief to Trump because the cross-examination had been sufficient and “he would not be justified in receiving anything more than what already oc
curred during trial”.

Carroll previously said that the multimillion-dollar award showed “we don’t need to be afraid” of the former president, adding: “It was an astonishing discovery for me – he’s nothing.”

Trump lost two defamation trials against Carroll, with a jury finding him liable in the first for sexually assaulting her. He was ordered to pay $5 million in the first trial, and more than $83 million in the second one.


MSNBC legal analyst Joyce Vance wrote Sunday evening that the former president is facing a critical deadline in that case this coming week.

In a post on Substack, Vance said it's "not all good news for Trump this week."

"That's because Trump has to post a bond in the E. Jean Carroll case by next weekend, or Carroll can begin to collect on her $83.3 million judgment against him," the legal expert wrote. "This is commonly referred to as an appeal bond."


"If Trump manages to either get a bond or pay the full amount of the judgment into a court account, then Carroll cannot begin efforts to collect it while the appeal is pending. If he fails to do so, her lawyer Roberta Kaplan can get to work."

A federal judge on Thursday denied Donald Trumps’ request to delay enforcement of the writer E. Jean Carroll’s $83.3MIL verdict in her recent defamation case.


The decision by US district judge Lewis Kaplan in Manhattan adds to pressure on Trump to line up an acceptable bond during his expected appeal.

In the 26 January verdict, jurors agreed with Carroll, a former Elle magazine advice columnist, that Trump had defamed her in June 2019 by denying he had raped her in the mid-1990s in a Bergdorf Goodman department store dressing room in Manhattan.

Kaplan made the verdict official on 8 February and gave Trump 30 days to post a bond or come up with cash during his appeal, which is expected to challenge the jury’s finding of liability and the amount of damages.

Trump had sought to delay enforcement of the verdict until the judge ruled on his motions to throw it out, which he filed on Tuesday.

But the judge said Trump should not have waited 25 days after the verdict before seeking a delay.

He also said Trump failed to show how he might suffer “irreparable injury” if required to post a bond.

“Mr Trump’s current situation is a result of his own dilatory actions,” the judge wrote.

Lawyers and a spokeswoman for Trump did not immediately respond to requests for comment. Carroll’s lawyer Roberta Kaplan, who is not related to the judge, declined to comment.

In seeking to avoid posting a big bond, or any bond at all, lawyers for Trump rejected Carroll’s claim that his finances were strained.

They assured that Carroll was “fully protected” and said a $24.5m bond would be more than enough to “secure any minimal risk” to her.

Carroll disagreed. She said Trump’s finances were opaque, called Trump the “least trustworthy of borrowers” and said his request “boils down to nothing more than, ‘Trust me.’”

Trump’s financial flexibility deteriorated last month, when the judge who found him liable in New York attorney general Letitia James’s civil fraud case ordered him to pay $454.2m.

He offered to post a $100m bond in that case, but James said any bond should cover the entire judgment.

An appeals court judge on 28 February denied Trump’s request to delay enforcement during the appeal.

Asked on 5 March if he could pay what was owed or post bond in both cases, Trump told Fox News: “I have a lot of money. I can do what I want to do … I don’t worry about the money.”..

TRUMPS' attorneys notified the federal court in Manhattan that he had posted a bond of $91,630,000, coinciding with a notice that he had appealed the ruling to the U.S. Court of Appeals for the 2nd Circuit.





The bond payment is equal to 110% of the judgment against him, representing the amount he was required to provide to stay enforcement of the judgment while he appeals.

The Jan. 26 decision was the second time in less than a year that a jury had ruled in favor of Carroll, who accused Trump of attacking her in a New York department store in the 1990s. In May 2023, a different federal jury awarded Carroll an additional $5 million in damages, finding Trump liable for sexual abuse and a separate defamation claim.

Jurors in both cases unanimously reached their verdicts within hours.

The verdict in Carroll's second trial came just weeks before a New York judge ordered Trump to pay more than $450 million for fraud. The combined decisions plunged the Republican candidate for president into severe financial turmoil.

Roberta Kaplan, an attorney for Carroll, declined to comment on Trump's appeal.

The move came one day after U.S. District Judge Lewis Kaplan — who is overseeing the case, and is not related to Carroll's attorney — declined to issue a temporary stay that would have paused the judgment without requiring Trump to post the bond. A spokesperson for Trump's campaign criticized that decision in a statement to CBS News on Friday, calling it "a continuation of a totally lawless witch hunt."

"President Trump filed a timely motion to stay the ridiculous judgment, and many courts, including the Second Circuit, recognize the importance of temporary administrative stays while such motions are considered," spokesperson Steven Cheung said. "We look forward to continuing to litigate the case and to complete vindication of the truth."

After US District Judge Lewis F. Kaplan denied his petition for a stay, former President Donald Trump finally posted a $91.6 million bond for his appeal of writer E. Jean Carroll's judgment on Friday.



That $91.63 million includes the full $83.3 million judgment, along with a 9% statutory interest the State of New York tacks onto surety bonds. That money has been set aside in a court-managed account to be paid to Carroll in the event Trump loses his appeal. The ex-president's bond was guaranteed by the Federal Insurance Company — a New York-based subsidiary of the company Chubb Group LLC, which is headquartered in Switzerland.


In 2018, Chubb CEO Evan Greenberg served on a trade advisory committee in the Trump White House.

The Washington Post reported that "it was not clear from court records what collateral Trump presented to obtain the bond from Chubb."


The environmental nonprofit group Rainforest Action Network (RAN) noted on its website that Chubb does business around the world, including with several major American adversaries. The group pointed out that Chubb is "insuring oil and gas extraction and transport in Russia, fueling Russia’s war on Ukraine."

"In fact, Chubb called Russian oil and gas 'one of the most promising activities' of its Russian operations,'" RAN wrote. "The insurer was recently backing Nord Stream 2, a massive, controversial natural gas pipeline built by Gazprom, the world’s largest producer of gas and a majority Russian state-owned fossil fuel company (which also happens to be funded by JPMorgan Chase)."

Former federal prosecutor Andrew Weissmann tweeted Friday that while Trump is "$90M down, $400M to go," the details of the bond agreement are murky and that "the public has no idea who may have actually put up the money or provided a guaranty to support the bond."

"But one thing’s sure: Trump is beholden to someone for a lot of money," Weissmann wrote.

In response to Weissmann's tweet, attorney and journalist Daniel Miller expressed concern, opining that the bond guarantee was a "matter of national security," adding "the public has to know this information before voting in November."

Notably, the Post reported Chubb's CEO was vocal in his disdain for the January 6, 2021 insurrection at the US Capitol, condemning "the violence and display of demagoguery we witnessed in our nation’s capital."

"We should all hope for a new era of respect and decency as we meet the many common challenges facing our nation," Greenberg said the day after the capitol riot.

Trump has yet to post his bond for appealing the $454 million civil judgment that he's been ordered to pay to the State of New York after losing his civil fraud case. Earlier this week, CNN legal analyst Jeffrey Toobin said Trump may seek out foreign help to pay that judgment, particularly since American financial institutions may hesitate to give a loan to an adjudicated fraudster.

In February, a judge denied Trump's request to pay a $100 million bond, suggesting Trump may not have the cash to cover the judgment on his own despite his multibillion-dollar net worth.
"What does that mean if a candidate for president is is on the hook for multiple, multiple millions of dollars to a foreign source? Because that, it seems to me, is the most likely source," Toobin said.

Trump on Saturday stood by his 2019 statement that writer E. Jean Carroll made a "totally false accusation" against him, despite similar claims resulting in him losing a defamation case in January.


Campaigning at a rally in Rome, Georgia, Trump referenced the $91.6 million bond he posted on March 8, three days before his deadline to pay $83.3 million in damages to Carroll for defaming her in statements he made as president after denying her accusation that he'd raped her in a department store dressing room in the 1990s.

Carroll first came forward in 2019 with sexual assault claims against Trump before another civil trial in May 2023, where a New York jury found that the former president sexually abused Carroll but didn't rape her.

"I just posted a $91 million bond, $91 million on a fake story, totally made-up story," Trump said, adding that the judgment was, "based on false accusations made about me by a woman that I knew nothing about, didn't know, never heard of, I know nothing about her."

The 77-year-old made similar remarks in a June 22, 2019, statement, MSNBC legal correspondent Lisa Rubin posted on X on Saturday, including a document of Trump's denial of knowing "who this woman is."

"She wrote a book, she said things, and when I denied it, I said, 'It's so crazy, it's false,' I get sued for defamation," Trump said on Saturday before referring to New York's Adult Survivors Act, which lifted the state's statute of limitations for one year, allowing survivors of sexual assault to sue no matter how long ago the alleged abuse happened.

"They changed the law that allowed women to go back, like unlimited … then she went back and she said, mid-90s maybe, I have no idea," he said.

On top of the $83.3 million in damages is a $5 million sexual abuse and defamation verdict that Carroll won against Trump last year. In February, the former president was also ordered to pay $464 million in damages for a separate fraud case against Trump and top executives at his company — he plans to appeal all three verdicts.








Trump also shared his concerns about Lewis Kaplan, the federal judge who denied his request to delay the defamation judgment, calling him a "Trump-deranged, angry man."
