A huge investigation has so far arrested 235 people, including far-right militants, members of the military – and otherwise unremarkable Trump fans

As prosecutors from the House of Representatives prepare to present their case against Donald Trump at his impeachment trial next week for incitement of insurrection, supporters who heeded his call on 6 January to “fight like hell” and went on to storm the Capitol Building are finding themselves in far greater legal peril.

The trial that kicks off in the US Senate on Tuesday could lead to a further vote that would permanently debar Trump from holding office in the future. By contrast, the mob of fervent Maga acolytes who broke into the US Capitol following an incendiary rally headlined by Trump could face prison for up to 20 years.

One month after the events which left five people dead including a US Capitol police officer, there is no sign of the Department of Justice and FBI letting up in their relentless pursuit of the insurrectionists. In the past week alone there have been arrests of alleged rioters in Seattle, Washington; Las Vegas, Nevada; Corinth, Texas; Garner, North Carolina; and Marion, Illinois.

All 56 FBI field offices are engaged in a huge investigation that ranks alongside the biggest the bureau has conducted. As Michael Sherwin, acting US attorney for Washington DC which is leading the hunt, has put it: “The scope and scale of this investigation are really unprecedented, not only in FBI history but probably DoJ history.”

David Gomez, a former FBI national security executive who spent years countering domestic terrorism, told the Guardian that the bureau would classify and handle the search as a “major case”.

“It is probably one of the largest investigations since 9/11,” he said.

Already the number of people who have been arrested, either by the FBI, Capitol police or local Washington DC officers has reached 235, spanning more than 40 states. As the investigation widens and deepens, the focus is tightening on anyone considered to have acted as a coordinator of the action in an attempt to take out the ringleaders.

The FBI has set up a special strike force of experienced federal prosecutors who have been given the express instruction to pursue aggressive sedition and conspiracy charges. So far at least 26 people have been charged with conspiracy or assault.

“Sedition is the most serious crime that anybody could be accused of from 6 January,” Gomez said. “It’s advocating the overthrow of the US government. It involves not just talking about overthrowing democracy but having the means and wherewithal to carry out those actions.”

As more has become known about those arrested, the strategy being pursued by the FBI has also revealed itself. In several cases, people who participated in the storming of the Capitol were picked up and charged with relatively minor offenses such as trespassing or theft of mail simply as a means to get them into prosecutorial clutches.

Once in the system, more serious charges could then be added as intelligence came in. That pattern of escalating charges can be seen in the cases of Nicholas DeCarlo from Texas and Nicholas Ochs from Hawaii.

Initially, the pair were accused of unlawful entry into federal property. But new conspiracy charges were added this week in which they are alleged to have planned out their travel across state lines, raised money to pay for it, and then made the trip to Washington DC in a premeditated attempt to obstruct the certification of Joe Biden as winner of the US presidential election.

If convicted, DeCarlo and Ochs each face maximum sentences of 20 years in prison and a $250,000 fine.

Prosecutors have made clear that they are ramping up the charges against select individuals as a means of discouraging further violence from Trump supporters and their far-right and white supremacist allies. “We are going to focus on the most significant charges as a deterrent, because regardless of if it was just a trespass in the Capitol or someone planted a pipe bomb, you will be charged and you will be found,” Sherwin said.

The FBI’s work has been greatly assisted by the plethora of intelligence swirling around online – in many cases posted by the suspects themselves. Take the hapless duo, DeCarlo and Ochs.

A photo of the pair, posing thumbs up in front of the memorial door of the US Capitol on which they had scrawled the words “MURDER THE MEDIA”, was easily found online. It has been included in the indictment against them, and earned them the special attentions of the media assault strike force set up by federal prosecutors to investigate violent threats against members of the media.

That photo is one of at least 200,000 digital media tips that have poured into the FBI from across the country, some coming from friends and even family members who recognized individual rioters from the profusion of video and stills footage plastered across the internet and promptly informed on them.


As federal agents work their way through this mountain of digital information they are starting to get a feel for the kinds of people who were present that fateful day on the Hill. As feared, the leadership role played by far-right and white supremacist groups has veered into sight.

At least 10 members of the extremist group the Proud Boys are among the mounting number of those arrested, including Ochs, who according to the justice department claims to have founded a Honolulu chapter of the network. This week’s Washington state arrest was also of a self-declared Proud Boys leader – Ethan Nordean calls himself “sergeant of arms” of the Seattle chapter and is accused in court documents of having led a group of rioters into the Capitol.

On the back of mounting evidence of the Proud Boys’ leadership role in the attack, the Canadian government this week moved to designate the group as a terrorist organization.

Meanwhile, several members of the Oath Keepers, one of the largest far-right militia groups in the US, have also been arrested.


Another chilling element emerging from the indictments is the number of current and former law enforcement officers and military personnel who are among them. An analysis of the first 150 people to be arrested by CNN found that at least 21 had military experience, some ongoing.

Of those, eight were former marines, underlining the danger of elite military training designed to defend the country from international threats being turned back on itself and used to attack the heart of US democracy at home.

At least four law enforcement officers who were actively serving in their positions at the time of the 6 January attack have been accused, and have left their jobs. They include a Houston, Texas, police officer and a corrections officer from New Jersey.

One of the emerging truths that FBI detectives and prosecutors will have to wrestle with is that, despite the substantial presence of white supremacists and military personnel, most of those who have been arrested are what might be described as unremarkable Americans with no previous criminal records or history of extremist behavior.

Political scientists at the University of Chicago who studied the profiles of arrestees and published their conclusions in the Atlantic found that many were middle-class and middle-aged – with an average age of 40. Almost 90% of them had no known links with militant groups. Some 40% were business owners or with white-collar jobs, and they came from relatively lucrative backgrounds as “CEOs, shop owners, doctors, lawyers, IT specialists, and accountants”.

The one common denominator uniting this large group is not any extremist group, website or media outlet, but an individual – Donald Trump. This is why the connection between the pending impeachment trial and the ongoing FBI roundup of suspects is so critical.

The link has been made overtly in the defense cases being compiled by lawyers on behalf of several of the arrested rioters. Take Jacob Chansley from Arizona, the self-styled “QAnon Shaman” who went shirtless and wore a furry headdress with horns as he battled as far as the Senate dais during the Capitol assault.

His lawyers have offered him up as a witness during Trump’s trial. They say Chansley, who faces six charges including civil disorder, used to be “horrendously smitten” by Trump but now feels betrayed by him. They are also likely to use the argument that Chansley was misled by the then US president as a central argument in his own defense.

But Gomez is doubtful that the ploy will prove effective.

“I don’t think that’s going to hold water in federal court,” Gomez said. “‘I only robbed that bank because somebody told me to do it’


– I’ve never heard that line working for any crime.”

US Lawmakers Call For 9/11-Style Commission to Investigate Capitol Riot

Democrats and Republicans both voice support for panel to ‘make sure it never happens again’

Democratic and Republican lawmakers have issued fresh calls for a bipartisan 9/11-style commission to investigate why government officials and law enforcement failed to stop the attack on the US Capitol in January, following Donald Trump’s acquittal in his impeachment on charges that he incited the insurrection.

The commission would be modeled after a panel created in the aftermath of the 9/11 terror attacks, which reviewed what caused the atrocity and laid out recommendations on how to foresee and prevent any future incursions.

“We need a 9/11 commission to find out what happened and make sure it never happens again, and I want to make sure that the Capitol footprint can be better defended next time,” said Lindsey Graham, a Republican senator of South Carolina and close Trump ally who voted to acquit the former president on Saturday. “His behavior after the election was over the top,” Graham said of the former president on Fox News Sunday.

Democrat Chris Coons of Delaware agreed. Speaking on ABC’s This Week, he said that a bipartisan commission would “make sure we secure the Capitol going forward and that we lay bare the record of just how responsible and how abjectly violating of his constitutional oath Trump really was”.

Using harrowing video footage from the day, Democratic House prosecutors laid out their case that the former president stoked the attack with violent rhetoric and dangerous insistence on the debunked conspiracy theories suggesting he had won the 2020 presidential election, against all evidence that he had, in fact, lost.

Seven Republicans joined 50 Democrats in the Senate to hold Trump responsible for inciting the deadly insurrection, led by armed supporters who announced intentions to kill or harm lawmakers including Mike Pence, the former-vice president, and Nancy Pelosi, the House speaker.

Though the result of the trial was the most bipartisan in history, House managers ultimately did not secure the 67 votes required to convict Trump.

But an independent commission could be another way for both Republicans and Democrats to hold Trump accountable.

Other investigations have already been planned, with two Senate committees set to investigate security failures during the riots. In the House, Pelosi has also asked for a review of the Capitol’s security process.


“There should be a complete investigation about what happened,” said Bill Cassidy, a Republican senator of Louisiana who has been censured by fellow Republicans in his home state for voting in favor of conviction.

A commission would reveal “what was known, who knew it and when they knew, all that, because that builds the basis so this never happens again”, Cassidy told ABC, adding that he was “attempting to hold President Trump accountable” with his vote in the trial.

Even Republicans who found Trump “not guilty” with their vote have tried to distance themselves from the former president. Most notably, the senate’s Republican leader, Mitch McConnell, said: “The people who stormed this building believed they were acting on the wishes and instructions of their president.”

McConnell, who insisted that he voted against impeachment because Trump was no longer in office, after refusing to hold the trial while Trump was still in office, statements on Saturday seemed to punt the responsibility of holding Trump responsible to civil courts: “We have a criminal justice system in this country. We have civil litigation. And former presidents are not immune from being held accountable by either one.”

Prior to the impeachment vote, Pelosi wrote a letter to her Democratic colleagues saying it is “clear that we will need to establish a 9/11-type commission to examine and report upon the facts, causes and security relating to the terrorist mob attack on January 6”. She renewed her support for the commission after Trump’s acquittal.

A commission on the Capitol riot would need to be approved via legislation like the 9/11 commission was, and lawmakers may ultimately disagree on who should sit on it. Still, the idea has been gaining steam.

“For the first time in however many years, we had an insurrection incited by the president of the United States where five people died, more have died since, hundreds were injured, people lost fingers, lost eyesight,” said Madeleine Dean, one of the House impeachment managers, said on ABC.

“Of course there must be a full commission, an impartial commission, not guided by politics, filled with people who would stand up to the courage of their conviction,” she said.

United States Capitol police say, militia groups, who launched the deadly attack on the Capitol last month, have indicated their wish to 'blow up' the building, and possibly during a coming address by President Joe Biden.

Acting Chief Yogananda Pittman called for continued high security around the building.

"We know that members of the militia groups that were present on January 6 have stated their desires that they want to blow up the Capitol, and kill as many members as possible, with a direct nexus to the State of the Union."

While a date has not yet been set for this year's State of the Union, it typically happens early in the year.

Washington D.C. has been on unprecedented security since last month's attack - including fences topped with razor wire and checkpoints manned by the National Guard.

About 5,000 troops are expected to stay through mid-March.

A Guardian investigation of a website leak from the American Patriots Three Percent shows the anti-government militia group have recruited a network across the United States that includes current and former military members, police and border patrol agents.

But the leak also demonstrates how the radical group has recruited from a broad swath of Americans, not just military and law enforcement. Members include both men and women, of ages ranging from their 20s to their 70s, doing jobs from medical physics to dental hygiene and living in all parts of the country.

Experts say the revelations of the broad scope of the movement’s membership shows the mainstreaming of the radical politics of militia and so-called “Patriot Movement” groups during the Trump era and beyond.

There has been a particular focus on the militia movement after the 6 January attack on the Capitol in Washington DC, in which a rampaging pro-Trump mob included militia members and others from far-right organizations.

According to members who spoke to the Guardian, the website from which the list was leaked was set up by national leaders of Patriot Movement group, which is affiliated with the broader Three Percenter movement.

Names, phone numbers and even photographs of members were obtained by activists who then posted the data to an internet archiving site, and the Guardian cross-referenced these with public records and other published materials.

One of the activists who discovered the leak, whose name has been withheld due to safety concerns, said that the Wordpress site’s poorly configured membership plugin left those details exposed to public view. Additional materials seen by the Guardian confirm that claim, and show that the materials were obtained by a simple search technique.

Many of the members revealed by the leak have extensive armed forces experience, including some who are still serving in branches of the US military.

Master Sergeant Andrew Holloway Selph performs quality assurance on fighter jets for the US air force in Hill air force Base, near Ogden, Utah, and is a 20-year service veteran. On 16 February, the Daily Dot reported that Selph had been nominated as a Utah contact for the Oath Keepers, another far-right Patriot Movement group which has been implicated in the organization of the Capitol riot.

The group also has retired soldiers, including Scott Seddon, who founded the group in 2009 as one of a number of Three Percent groups that arose in the wake of the election of President Barack Obama. In 2018, he told journalist, Chris Hedges that he had done so “out of fear”.

It also features the group’s similarly-named, self-styled “sergeant major”and website administrator, Scott Sneddon, a former air force sergeant and now a realtor in Layton, Utah. He joined the breached AP3% website with thesales email address of the group’s merchandise website.

Several other members of the group are current or serving police or military officers, including a reserve deputy police constable in Texas with a long police and US air force career behind him.

Meanwhile, Phillip Whitehead, 61, of Prescott Valley, Arizona, is the commander of that city’s American Legion post. In his bio on that site he boasts of six years’ military service in the 1980s, and then 34 years in law enforcement including stints in the Tucson police department, Yavapai county sheriff’s office, and the US border patrol.

In a telephone conversation, Whitehead blamed national leaders of AP3% for breaching members’ privacy. Describing his role as “sergeant at arms and zone commander” in the Arizona AP3%, he said he was “appalled that information attached to individuals” had been leaked from the site.

He explained that he had not specifically entered his own details on the site, and his understanding was that the information had been collected from state-level organizations to be stored in a “member-only database” which would serve as “a way to contact the organization and perhaps as a recruitment tool”.

Whitehead’s claims that he did not specifically provide information to the website matched the response of a serving US army non-commissioned officer who, when contacted by the Guardian, said that he had only attended one “meet and greet” several years before, and could not explain how his contact details came to be added to the website.

“A lot of us are former military, former law enforcement,” Whitehead said of the leak. “Some of us have had high level security clearance. This has put myself and my family at risk.”



Whitehead insisted that the group was “not a militia” and the goal as he understood it was to act as “community protectors at the request of local authorities”. Beyond the “distress” caused by the website, Whitehead criticized Sneddon, the national leader, for his “outbursts in a public forum, Facebook”, adding that “I don’t like his public behavior because I don’t think that’s what the organization should stand for.”

Devin Burghart is vice-president of the Institute for Research and Education on Human Rights (IREHR), which tracks far-right militants including the militia movement.

In a telephone conversation, Burghart said that AP3% were “one of the early attempts to build out a national network of Three Percent groups”, and that “they were successful early on in using Facebook for recruitment”.

He said that while AP3% “definitely have a far-right paramilitary structure and ideology”, they were “far more focused on action than they are on ideology”, and have in the past done extensive live fire drills and acted as vigilante security guards during protests, including recent Black Lives Matter protests around the country.

Burghart said that “military veterans involved in far-right paramilitary groups are not just betraying their oaths, they are threatening American democracy and national security”, adding that “there is a staggeringly long list of far-rightist veterans trained in the use of lethal force overseas who turned those techniques on Americans back home in pursuit of political aims.”

Not all of the members have experience in the armed forces or law enforcement, and many do workaday jobs. Members investigated by the Guardian include dental hygienists, Apple Geniuses and beekeepers.

Others work in advanced or specialized fields. John P Balog, of Rome, New York, has a PhD in medical physics and advertises a consultancy advising on radiation therapy for cancer patients.

Dr Balog was another AP3% member who responded to requests for comment on the website leak.

After emailing and calling on a protected number, Balog described the group as a “secret society”, and said that the website had been in existence for several years.

Asked why secrecy was necessary, Balog said that “honestly because most of the country doesn’t share our values”, which he characterized as “hardcore conservatism”.

Other members of the site have a documented history of joining online forums for similar groups. Data provided to the Guardian by IREHR indicates that many were members of a wide range of militia-related groups on Facebook before that company began reining in such organizing on its website.

Seth Weiner, 34, of Canton, New York, who is also the administrator of a Facebook group for collectors of German Iron Cross military medals, was a member of seven militia-related Facebook groups including “Q Patriots”, “Pissed Off Patriots of America”, and “Red Pilled Patriots”.

Brian Plescher, of Ottawa, Ohio, was a member of nine such groups on Facebook, including one attached to Ohio Militiamen, the Continental Militia Network and “APIII American Patriot the III%, Old School”, the Facebook group that once served as AP3%’s online hub. Jennifer Delane Hinson, a dental assistant in Pontotoc, Mississippi, was also a member of the AP3% Facebook group, along with groups like the “Mississippi Minute Man Militia” and “III% Militia national Contingency”, all under the alias, Jenny Plunk.

Members of the group are not concentrated in any region of the United States, but there are unusual levels of membership in some states and counties, including some outside the Patriot Movement’s heartlands in the midwest, south and west of the country.

New York state, for example, is home to 53 of the signed-up Three Percenters – more than 11% of the total members on the site – and 17 members are resident in and around Saint Lawrence county, in the state’s far north on the Canadian border.

While the leak disclosed the details of about 500 members, Burghart said the total national membership was probably “somewhere in the low thousands”.

The site is no longer online, and visiting the URL returns a page which says “this account has been suspended”. Internet records indicate that they abruptly lost hosting around 2 February, just after the leak was discovered. Their former hosts, wix.com, did not immediately respond to requests for comment.

AP3% made news in January when pictures emerged of Colorado members posing with the controversial Colorado congresswoman Lauren Bobert on the steps of that state’s capitol.


FBI director Christopher Wray condemned the January riot at the US Capitol as 'domestic terrorism' Tuesday as he defended the bureau’s handling of intelligence indicating the prospect for violence.

He also described in stark terms the threat from domestic violent extremists and said, contrary to some Republicans, there is no evidence that anti-Trump groups were involved in the riot.

Donald Trump has been served a civil rights lawsuit accusing him of inciting the Capitol riot along with Rudy Giuliani, the Proud Boys and other far-right groups, according to reports.


Trump was given the documents, filed by Democrat congressman Bennie Thompson and civil rights group the NAACP in mid-February, at his Mar-a-Lago resort in Florida.

It is unclear who will represent the former president in the case: it was merely signed for by a “Ricky”, according to The Daily Beast.

The lawsuit alleges that Mr Trump and Mr Giuliani “incited a crowd of thousands to descend upon the Capitol” on 6 January to disrupt Congress, while the Proud Boys and the Oath Keepers – a far-right militia made up of former police and soldiers – spearheaded the assault.

They are also accused of violating the “Ku Klux Klan Act” of 1871, intended to protect lawmakers against “conspiracies through violence and intimidation”, by allegedly seeking to prevent Congress from carrying out their official duties.

Thompson, the representative for Mississippi’s 2nd district, said that Mr Trump’s “gleeful support of violent white supremacists led to a breach of the Capitol that put my life, and that of my colleagues, in grave danger”.

“We must hold him accountable for the insurrection that he so blatantly planned,” he added.

NAACP CEO Derrick Johnson accused the former president of trying to “disenfranchise African-American voters” and “destroy democracy”.

Mr Trump was acquitted of inciting the Capitol riot in the US Senate. But he is facing numerous civil and criminal cases, relating both to his years in the White House and his pre-presidential life.

Mr Trump’s one-time lawyer Mr Giuliani has also been served with multiple lawsuits in recent months.

US Capitol: First Picture of Suspect, 25, Who Mowed Down and Killed Policeman

This is the first picture of a man suspected of mowing down and killing a Capitol Hill police officer.

Noah Green, 25, has been named by US media as the driver believed to be behind the deadly attack on Friday.

Veteran officer Billy Evans, who served the Capitol Police for 18 years, died in the line of duty after a car rammed into a barricade in Washington, DC.

Evans' colleague was also wounded in the rampage which forced the grounds into lockdown, three months after Donald Trump supporting rioters stormed the US Capitol building in scenes that shamed America.

Green, who died after being shot by officers responding to the incident, was not known to Washington DC police but did have a record in another state.

A Facebook profile belonging to a man named Noah Green, which has now been taken down, reportedly showed he was a fan of Nation of Islam leader Louis Farrakhan

On it were posts in which the user claimed to have "unknowingly" taken drugs and spoke of being on a "spiritual journey".

Green wrote on March 17: "I was on the right track and everything I had planned was coming into existence. It required long hours, lots of studying, and exercise to keep me balanced while experiencing an array of concerning symptoms along the path (I believe to be side effects of drugs I was intaking unknowingly).

"However, the path has been thwarted, as Allah (God) has chosen me for other things.

"Throughout life I have set goals, attained them, set higher ones, and then been required to sacrifice those things," he added, signing off the message Brother Noah X.

Green had posted a speech of Farrakhan's on the social media platform and spoke about "end times" and the "anti-Christ".

Messages on the social media page refer to fears that the federal government were targeting him with "mind control".

The motive for Friday's attack remains unclear and police have said it does not appear to be terrorism-related.

President Joe Biden said he was "heartbroken" by the attack and ordered flags at the White House be lowered to half-staff in mourning.

"I want to express the nation's gratitude to the Capitol Police, the National Guard Immediate Response Force, and others who quickly responded to this attack.

"As we mourn the loss of yet another courageous Capitol Police officer, I have ordered that the White House flags be lowered to half-mast."

House Speaker Nancy Pelosi hailed Evans as "a martyr for our democracy."

She said in a statement: "Congress stands ready to assist law enforcement with a swift and comprehensive investigation into this heinous attack."

Footage earlier showed what appeared to be two people on stretchers being loaded into ambulances, and a police helicopter hovering overhead.

Yogananda Pittman, acting chief of the force, told a news conference that the suspect leapt from the car holding a blade.

"It is with a very, very heavy heart that I announce one of our officers has succumbed to his injuries," she said.




Tear gas was used against the rioters and security measures around the Capitol were ramped up in the aftermath until just last week


7ft razor wire fences and road blocks around the complex that had been in place around the Capitol since the deadly January riots was taken down just last week.

Capitol Police officer Brian Sicknick was one of five people who died after the attempted "insurrection."

Senate Minority Leader, Mitch McConnell, a Republican, tweeted he is "praying" for the officers and was grateful for first responders" on the scene after the latest incident.

Armed National Guardsmen were deployed immediately and have been seen patrolling the halls of government buildings but police say there is no outstanding threat.

Rows of National Guard troops could be seen lining the perimeter around the barricade and carrying shields around where the incident took place on Good Friday.

‘Oath Enforcers’ -How The Far-Fight Group Plans to Harass Political Enemies

Revealed: online chats indicate some members are threatening to unleash harassment tactics on officials and government workers

A national online network of thousands of rightwing, self-described “Oath Enforcers” is threatening to unleash harassment tactics on elected officials and government workers around the country, the Guardian can reveal.

While the network’s founder insists that the group is neither violent nor a militia, internal chats indicate that some members are planning for confrontations with law enforcement and their perceived political enemies.









The chats also indicate that white supremacists and others connected with the militia movement are aiming to leverage the group’s success in recruiting disillusioned supporters of Donald Trump and the “QAnon” conspiracy movement, who are being exposed to a wide range of conspiracy theories, white nationalist material, and rightwing legal theories inside the groups.



The group’s founder, who makes videos and organizes under the name Vince Edwards, lives off-grid in a remote corner of Costilla county, in Colorado’s high desert region. Arrest records from 2016 indicate that he has also used the name Christian Picolo, and other public records associate him with the name Vincent Edward Deluca.

Experts say that Edwards’ personal history reflects the potential danger in the spread of “sovereign citizen” ideology – along with voluminous online propaganda, that history includes an armed standoff with Costilla county sheriff’s deputies in 2016.

Edwards initially published videos and a printable flyer promoting the formation of “oath enforcement teams” of at least 30 people in every county in the nation during late January 2021, just weeks after his own self-documented attendance at a rally at the national Capitol on 6 January.











His initial videos explicitly appealed to QAnon supporters, pointing out that “Q”, the supposed Trump administration insider whose gnomic forum posts animated the conspiracy-minded social movement, had not communicated with the movement since December, and that rather than “trusting the plan”, as adherents are enjoined to do, they should begin taking action.

In the wake of the Capitol attack, his efforts seem to have resonated with a growing pool of grassroots rightwingers. The Guardian found over 3,100 members in 50 state-based Telegram chats and a national chat. Some state-based groups – in Texas, Washington and Alabama – were very active and had hundreds of members.

The stated aims of the group include posting flyers designed by Edwards, the formation of “constitutional enforcement groups”, for every person to hand out 1,000 of Edwards’s flyers, and the creation of local hotlines to help “enforce the contract we made with our public servants” by live-streaming interactions with them, or lodging spurious legal claims against them.

In an introductory video entitled “OE training”, Edwards encourages new recruits to the network to emulate so-called “first amendment auditors” (FAAs).

Professor Brian Levin, the director of the Center for the Study of Hate and Extremism (CSHE) at California State University in San Bernardino, said in a telephone conversation that FAAs are a social-media driven movement of libertarian provocateurs who “go to sensitive locations to see if law enforcement, security guards, or property owners will interfere with their activities, which are annoying, but not usually illegal”.

Meanwhile, some local groups show that well-known extremists are seeing opportunities in the group’s fast growth.

The Oregon Oath Enforcers group, for example, was joined on 5 February by Chester Doles of Dahlonega, Georgia. Doles, a long-time former member of the Ku Klux Klan and the neo-Nazi National Alliance, who was imprisoned in 1993 for beating a black man, and later marched in the Unite the Right rally in Charlottesville in 2017.

Doles received media attention recently as he and other members of the organization he currently leads, American Patriots USA, were among an armed crowd which protested outside the Georgia capitol on 6 January, an action which led Georgia’s secretary of state, Brad Raffensperger, who had been demonized by the far right for his role in Georgia’s election count, to flee the building.

In recent months, Doles has reportedly been seeking to build alliances with Three Percenters and other militia organizations in Georgia.

A former member of far-right group Patriot Prayer, Tusitala “Tiny” Toese, joined the Oregon Oath Enforcers chat on 9 February. Toese, a Proud Boy, was a prominent and frequently violent participant in a long string of brawling, contentious street protests in Portland throughout the Trump era. He was jailed in Clark county, Washington, last October after violating the condition of his probation after earlier being convicted for assault over an unprovoked daylight attack on a man in Portland.

In a video message to the Oath Enforcers group, Toese said: “You guys organizing? Me and my people will be there to take a stand with you.”

Elsewhere in the Oath Enforcers’ instructional Telegram channel, Edwards and others have shared documents from a range of organizations around the country which promote false legal and constitutional doctrines associated with the so-called sovereign citizen movement.

One document is presented as a judgment by a self-styled human rights tribunal, with an arrest order for a range of officials and philanthropists, including Anthony Fauci and Bill and Melinda Gates, for the crime of genocide.

The sovereign citizen movement does not hold a universally consistent set of beliefs, but most adherents believe in a false alternative history of the US, and that the present, and especially the law, reflects a conspiracy ordered by esoteric rules. Many treat all legal and governmental authority as illegitimate.

In the Oath Enforcers’s chats, sovereign doctrine is presented side by side with false beliefs about vaccinations and masks, assertions that the 2020 election was stolen from Trump, and conspiracy theories about links between anti-fascist activists and powerful figures such as the billionaire George Soros.

Vince Edwards and Chester Doles did not immediately respond to requests for comment.

In intelligence assessments and public statements, federal agencies have advised that sovereign citizens pose an ongoing and specific threat to law enforcement officers.

Levin, the extremism researcher, said of the apparent synergies between sovereign citizens and white supremacists that “there has been a realignment on the far-right extremist fringe”, wherein “law enforcement is viewed as an arm of a tyrannical government in much the same way that sovereign citizens viewed them decades prior”.

Levin adds that “not only is the ideology getting a rebranding, so too are many far-right figures like former Klan Leader Chester Doles”.

In a 28 March post on the Oregon Oath Enforcers page, a user reposted white nationalist broadcaster, Vincent James’s commentary on a clash between antifa and far-right street protesters in Salem the previous day.

In part, the post read: “Cops never were and never will be your friend. They’re also the American regime. Not allies.”

Proud Boys and Other Far-Right Groups Raise Millions via Christian Funding Site

Revealed: groups banned from other sites fundraising on GiveSendGo as data breach identifies high-dollar donors

A data breach from Christian crowdfunding site GiveSendGo has revealed that millions of dollars have been raised on the site for far-right causes and groups, many of whom are banned from raising funds on other platforms.

The far-right group ‘Oath Enforcers’ plans to harass political enemies

It also identifies previously anonymous high-dollar donors to far-right actors, some of whom enjoy positions of wealth, power or public responsibility.

Some of the biggest beneficiaries have been members of groups such as the Proud Boys, designated as a terrorist group in Canada, many of whose fundraising efforts were directly related to the 6 January attack on the United States Capitol.

The breach, shared with journalists by transparency group Distributed Denial of Secrets, shows the site was used for a wide range of legitimate charitable purposes, such as crowdfunding medical bills, aid projects and religious missions.

But the site’s permissive stance towards far-right actors meant groups who had been banned from other fundraising platforms and payment processors following episodes of hate speech and violence have also used the platform.

Across at least 11 crowdfunding campaigns associated with the Proud Boys, members of the group, including some now facing conspiracy charges related to the Capitol attack, raised over $375,000. Some of these fundraisers netted large amounts of money in a short period.

After the Proud Boys chairman, Enrique Tarrio, was arrested on 4 January on charges related to firearms and the vandalism of a black church at a previous rally, a fundraiser billed as a “defense fund” made $113,000 in just four days.

A large proportion of that money came from a number of high-dollar donors who elected to be anonymous on the website, but whose identifying details were nevertheless preserved by GiveSendGo.

The anonymous donations included $1,000 from an email address associated with Gabe Carrera, a Florida-based personal injury lawyer who bills himself as the attorney who rides. Another $1,000 which came to Tarrio was associated with an email address belonging to Paul C Gill, a Honolulu-based Hawaiian Airlines employee and former pilot who has previously made donations to Donald Trump’s campaigns and to the Republican party, and who has offered public political commentary in the form of letters to the editor in local newspapers.

Of Tarrio’s donors, none immediately responded to requests for comment except for Gerardo G Gonzalez, who anonymously donated $1,000 to Tarrio on 7 January.

Public records show that Florida-based Gonzalez is a former pharmacist who owns at least six properties in Miami Beach and Homestead, Florida. His apartments, apartment buildings and an acreage lot have an assessed value in excess of $2.4m, and in prior decades has sold other properties worth millions more.

In a telephone conversation, Gonzalez said that his support of the Proud Boys was motivated by his belief that “there is no systemic racism in this country”, and his opposition to “BLM and Antifa” who he said represented “the real extremism” in the United States. He also used derogatory terms for Latinos and Democrats.

Other Proud Boy fundraisers raised large amounts, and attracted a similar range of high-value anonymous donations.

Following the Capitol riots, a fundraiser in the name of “Medical Assistance to DC Proud Boy victims” made $106,107 on just 6and 7 January. One anonymous donation for $5,000 was associated with an email address belonging to Ou Yin Lu, a Hacienda Heights, California, resident and businesswoman who had previously donated $14,640 to Trump’s campaign funds, the Republican National Committee and a former California state representative Bob Huff during the 2020 campaign funding cycle.

Also, after charges were laid on the Proud Boys organizer Joe Biggs for his alleged role in the Capitol attack, an anonymous donation for $1,000 came from an email address belonging to a New York woman whose social media accounts list her as a state-employed special education teacher. Overall, Biggs raised over $6,000 on the site.

Other Proud Boy-related fundraisers included one for North Carolina Proud Boy, Jeremy Bertino, also known as Noble Beard, who was stabbed at a contentious rally in Washington DC on 12 December. Between 16 and 19 December, the effort netted $61,355.

Several parallel fundraisers sought to finance travel and equipment for Proud Boys who sought to attend the 6 January rally in person.

Two separate fundraisers asked patrons to fund protective gear and communications equipment for regional Proud Boys chapters, raising $4,876 and $12,900 respectively.

Later, fundraisers were mounted in the name of individual activists who are now facing serious charges arising from the events of 6 January.

One that netted $6,475 in just one day was for the benefit of the Washington state Proud Boy and national elder Ethan Nordean also known as Rufio Panman. Another for Nick Ochs, the self-described leader of the Proud Boys’ Hawaiian chapter, brought in $19,687 between 8 and 13 January.

Candyce Kelshall, the president of the Canadian Association for Security and Intelligence Studies-Vancouver, who at at Simon Fraser University researches violent transnational social movements, said that far-right crowdfunding on GiveSendGo was just “the tip of the iceberg”, and similar efforts were happening across up to 54 other crowdfunding sites that her research had revealed.

She said, however, that GiveSendGo was “particularly insidious” due to its presentation of such crowdfunding in the guise of religion-based charity.

A January meeting of mayors and police chiefs of large American cities criticized “failed leadership by Capitol police and a failure to plan” over the rightwing insurrection in Washington on 6 January, according to emails reviewed by the Guardian.

The revelations were contained in an email sent by a senior police officer in Washington state. Additional emails from local, state, and federal agencies sent in January show that following the attack, authorities in Washington state paid increased attention to far-right groups such as QAnon adherents, the Three Percenters, and Joey Gibson, the founder of Vancouver-based street protest group Patriot Prayer.

The emails, provided to the Guardian by transparency nonprofit Property of the People, show how the events of the attack on the Capitol sent ripples around the US, and how agencies in states across the country scrambled to monitor local far-right activists, track down locals wanted for their role in the insurrection, and protect their own state capitols from groups who were openly planning to breach them.

The first email was sent to officers in police departments in cities within Snohomish county, north of Seattle, by Ryan Dalberg, the police lieutenant in Everett, Washington.

The email summarized a “US conference of mayors/major cities police chiefs to discuss the riot at the US Capitol” and “the potential for ongoing civil unrest related to the election outcome and upcoming presidential inauguration”, which the email said Everett police chief Dan Templeman had attended.

Following the comment about “failed leadership”, Dalberg added: “Much of the intel about the number of participants and the potential for violence was available via open-source information, and for whatever reason, the US Capitol police did not appear to be fully prepared for what they encountered.”

Dalberg added that participants had connected the events of January 6 “to domestic terrorism, in that it is both real and perceived grievances that are driving people and groups to take violent and extreme actions”.

Property of the People’s executive director, Ryan Shapiro, said: “The intelligence was there, coming from the agencies and right in the open. Despite ample warning, US Capitol police leadership failed to defend democracy. The question is why.”

Everett police department did not immediately respond to a request for comment.

Other emails show that even before the Capitol attack, analysts at the Washington State Fusion Center had been keeping close tabs on far-right groups and their plans to occupy that state’s capitol, in Olympia.

On 28 December, Alexandria Forbush, an Intelligence Analyst at the Fusion Center, sent an email to Stefan Pentcholov, a University of Washington police department detective currently seconded to the Joint Terrorism Task Force based at the FBI’s Seattle field office.

In the email, which she later forwarded to Washington State Fusion Center director Curt Boyle, Forbush warns that “Washington 3 Percenters sent out an email calling for action at the Olympia legislative building when the session begins on 11 January”.

The plan outlined in the email was “to crowd all the entrances to the building and gain entrance to the gallery when people enter or exit the building by following after them”. In addition, they said they would be “making every attempt to enter the building – per the constitution. For every person that makes their way through our gauntleted entrances, we will attempt to go right along with them inside.”

Other signs of concern in the wake of the Capitol riot came in the form of an email sent by Pentcholov, the JTTF officer, to Sgt Debra Winsor, who runs the Critical Infrastructure Section of the Washington State Fusion Center, advising of a February 23 lecture at the University of Washington by Joey Gibson.

Gibson, the founder of Patriot Prayer, was the organizer of a long string of confrontational pro-Trump protests in Portland, Oregon, between 2017 and 2020. Many of the protests became violent, and some descended into riots.

In the email, Pentcholov advises that “the same setup applies- indoor venue, 100% ID and weapons check, etc”, adding “local antifa regulars are also aware of the re-scheduled event. There is unconfirmed info that Washington 3%-ers will also attend.”

Republicans widely expected to remove congresswoman from leadership as she resists ex-president’s election lie

Donald Trump is poised to tighten his grip on the Republican party with the ousting of one of his most prominent critics in Congress.

Liz Cheney, the only woman in Republican leadership in the House of Representatives, is widely expected to be voted out next week by members loyal to Trump.

Cheney is a diehard conservative and daughter of George W Bush’s vice-president, Dick Cheney. Her removal for refusing to parrot Trump’s “big lie” that last year’s election was stolen would exemplify how the Republican party remains beholden to the disgraced ex-president.

“The whole @RepLizCheney saga has been so clarifying,” David Axelrod, former chief strategist for Barack Obama, tweeted on Thursday. “She’s as conservative as they come. Her only sin was to call BS on Trump’s election fraud. For that, she will be expelled as a @GOP leader. The party is branding itself.”

Multiple courts, as well as state and federal election officials, have rejected Trump’s false claims of widespread fraud. But Republican-controlled state legislatures are using his allegations to justify legislation imposing new restrictions on voting.

And far from backing down, Trump has issued several public statements in three days reiterating his baseless claims that Joe Biden’s 7m vote margin of victory was the result of fraud while attacking Republicans who refuse to buy into this narrative.

He also joined Republican House leaders in backing Elise Stefanik, a pro-Trump congresswoman, for Cheney’s job as chair of the party’s conference. A vote could come as early as next Wednesday.

Stefanik, 36, whose status in the party rose after she aggressively defended Trump during congressional hearings ahead of his 2019 impeachment, reportedly spoke to the former president by phone on Wednesday.

Trump said in a statement: “Liz Cheney is a warmongering fool who has no business in Republican Party Leadership ... Elise Stefanik is a far superior choice, and she has my COMPLETE and TOTAL Endorsement for GOP Conference Chair.”

Kevin McCarthy, the Republican minority leader, appears to have calculated that embracing Trump offers the party’s best chance of winning back the House in next year’s midterm elections. McCarthy was caught by a “hot mic” on Fox News saying of Cheney: “I’ve had it with her. You know, I’ve lost confidence.”

A statement from the office of Steve Scalise, the No 2 House Republican, made it explicit: “House Republicans need to be solely focused on taking back the House in 2022 and fighting against Speaker Pelosi and President Biden’s radical socialist agenda, and Elise Stefanik is strongly committed to doing that, which is why Whip Scalise has pledged to support her for Conference Chair.”

Congressman Jim Jordan, an outspoken Trump loyalist, insisted that “the votes are there” to oust Cheney. “You can’t have a Republican conference chair reciting Democrat talking points,” he told Fox News. “You can’t have a Republican conference chair taking a position that 90% of the party disagrees with, and you can’t have a Republican party chair consistently speaking out against the individual who 74m Americans voted for.”

During Trump’s presidency, Republicans lost control of both chambers of Congress as well as the White House. They are now looking to claw back narrow Democratic majorities in the House and Senate in the midterm elections next year.

But Cheney, the No 3 Republican in the House, is not going down without a fight. In an opinion column in the Washington Post on Wednesday, she urged her colleagues to reject the “dangerous and anti-democratic Trump cult of personality” in order to save the party, warning: “History is watching.”

Cheney wrote: “Trump is seeking to unravel critical elements of our constitutional structure that make democracy work – confidence in the result of elections and the rule of law. No other American president has ever done this.

“The Republican party is at a turning point, and Republicans must decide whether we are going to choose truth and fidelity to the constitution.”

Cheney, 54, held off an initial challenge to her leadership position earlier this year after she was among just 10 House Republicans to back Trump’s impeachment for inciting supporters to attack the US Capitol on 6 January. But she has few public supporters this time, dashing hopes that the former president might finally be losing sway.

Tara Setmayer, a former Republican communications director on Capitol Hill, said: “Most of the Republicans were just too cowardly to speak what Liz Cheney has been saying publicly, which is why she survived the vote of no confidence the first time. She’s not going to survive it this time because it’s been clear that Donald Trump still has that hold on the party and they need him to raise money.”

Stefanik, who represents an upstate New York district, began her House career in 2015 as a moderate who spoke out against Trump’s ban on immigration from seven majority-Muslim countries.

Setmayer added: “Elise Stefanik was an up-and-comer, a moderate who a lot of people saw potential to be a leader in the party. She was young, she was smart and she made a calculated decision to hop on the Trump train to bolster her political fortunes and if that’s not an example of selling your soul for political expediency, I don’t know what is.”

Biden, meanwhile, said a “mini-revolution” over identity appeared to be under way in the Republican party. “Republicans are further away from trying to figure out who they are and what they stand for than I thought they would be at this point,” he told reporters at the White House.

US Capitol Attack / Police Records Show Threats to Kill Lawmakers in Wake of Attack

Leaked files show how police stepped up surveillance efforts after January insurrections for signs of violence from far-right groups

Washington’s Metropolitan police department recorded threats to lawmakers and public facilities in the wake of the 6 January attack on the Capitol, according to documents made public in a ransomware hack on their systems this month.

The documents also show how, in the month following the Capitol attack, police stepped up surveillance efforts, monitoring hotel bookings, protests in other jurisdictions, and social media for signs of another attack by far-right groups on targets in the capital, including events surrounding the inauguration of Joe Biden as president.

The revelation of the seriousness of the threats comes amid Republican opposition to forming a 9/11-style commission to investigate the January attack, which saw the Capitol roamed by looting mobs hunting for politicians and involved the deaths of five people.

The police documents were stolen and published by the ransomware attack group Babuk, and some were redistributed by the transparency organization Distributed Denial of Secrets, from whom they were obtained by the Guardian. Various outlets last week published stories based on the data showing intelligence indicating that far-right Boogaloo groups planned to attack various targets in the capital.

But another collection of documents labeled “chiefs intelligence briefings” shows a broad, cross-agency effort in the days following the attack on the Capitol to identify suspects, monitor and apprehend far-right actors, and anticipate further attacks on Washington around events like the inauguration of Joe Biden and the second impeachment trial of Donald Trump.

In the aftermath of the riot, the attention of police and other law enforcement agencies was focused on far-right activity on social media platforms, and especially on a group calling itself Patriot Action for America.

One 13 January bulletin said that the group had been “calling for others to join them in ‘storming’ state, local, and federal government courthouses and administrative buildings in the event POTUS is removed as president prior to inauguration day”.

The bulletin also noted that the agency was facing broader challenges in monitoring far-right actors on social media websites, saying that “with the shutdown of Parler it has been a challenge to track down how activities are being planned”, and that they continued to “see more users on Gab and Telegram following the de-platforming of many accounts on more conventional social media companies”.

The bulletin mentions a “possible second suspect” in the placement of pipe bombs near the DNC and RNC, who was “observed on video scouting/taking photographs in advance of the placement”, who “took a metro to the East Falls church stop and took a Lyft from there”.

On 12 January, a bulletin noted that a supreme court agent had noticed “two vehicles stopped beside each other” outside the court building, and that in one an older white male was “videotaping the Capitol fence line and the court”, and in the other a passenger was “hanging out the window in order to videotape the court”.

A 22 January bulletin mentions that in Pennsylvania a man was arrested after “transmitting interstate threats to multiple US senators of the Democratic party”, having stated that he was “going to DC to kill people and wanted to be killed by the police”. When Pennsylvania state police apprehended him “he was in possession of a rifle, two handguns, and a large quantity of ammunition”.

A later bulletin described an incident in which a man with an illegal firearm was arrested after asking for directions to the “Oval Office”, and another man’s van was searched after he was observed sitting in the vehicle while parked outside the supreme court justice Sonya Sotomayor’s house.

The same day’s bulletin mentioned that Metropolitan police were cooperating with Capitol police in investigating “a number of threats aimed at members of Congress as the Senate impeachment trial of Donald Trump nears”.

The threats continued for weeks after the attack.


Almost a month later, a bulletin reported that “an identified militia group member” in Texas was claiming that if their “operation failed at the US Capitol”, there was a “back-up plan” involving the group “detonating bombs at the US Capitol during the State of the Union”.

The group was not named but was described as “a large organization allegedly with members from every state, which included individuals who were former military and law enforcement”.

The documents also reveal how law enforcement agencies secured the cooperation of private companies, from ride-share companies to hotels.

A bulletin includes the claim that “FBI [is] working with Lyft and Uber to identify riders to and from the protest locations”.

The same bulletin carries detailed figures on reservations in hotels across the capital leading up to the inauguration on 20 January, which was secured by an unprecedented mobilization of law enforcement and the national guard.

Two days later, another bulletin said that “MPD’s intelligence division has conducted extensive outreach with security directors of area hotels”, who they asked to be “vigilant for evidence of suspicious activity and firearms possession by hotel guests”.

Revealed: Majority of People Charged in Capitol Attack Aren’t in Jail

At least 70% have been released as they await hearings – compared with a typical rate of 25% of federal defendants

That high pretrial release rate stands in stark contrast with the usual detention rates in the federal system, where only 25% of defendants nationwide are typically released before their trial.

Eric Munchel, known as “Zip Tie Guy”, who was allegedly photographed wearing tactical gear and carrying wrist restraints in the Senate chamber, was released in late March, along with his mother, after an appeals court questioned whether he posed any danger outside the specific context of 6 January.

Richard Barnett, the Arkansas man photographed with his foot on Nancy Pelosi’s desk, was released in late April, nearly two months after screaming during a court hearing that “it’s not fair” that he was still in custody when “everybody else who did things much worse are already home”.

Multiple alleged members of the Proud Boys and the Oath Keepers, two groups facing the most serious conspiracy charges related to their alleged plans for violence, have been released before trial, though some prominent leaders in these groups remain in custody.

The disparity in pretrial detention rates highlights what legal experts said was a broader development in the 6 January cases: the likelihood that a substantial swathe of the alleged rioters may not serve any prison time at all, even if they are convicted or plead guilty.

Many Capitol defendants are being released ahead of trial because they are facing relatively low-level charges, experts said, though other factors, including racial bias, may also play a role.

“I’m both surprised and not surprised. Most of these people are white,” said Erica Zunkel, associate director of the Federal Criminal Justice Clinic at the University of Chicago Law School. “The majority of people in the federal system are people of color.”

The US attorney’s office for the District of Columbia, which is prosecuting the cases, said in a statement that the alleged Capitol rioters were facing very different kinds of charges than most people in the federal system.

“Comparing the per cent of January 6 defendants detained with the overall federal average is comparing apples and oranges,” a spokesperson for the office said. “The majority of federal defendants are charged with immigration or drug crimes, both of which are typically accompanied by detention. The January 6 defendants are charged with a variety of obstruction, assault, and trespassing charges. The comparison makes no sense.”

Zunkel, a former federal defense attorney, argued that it was absolutely fair to ask why prosecutors and judges were making different detention decisions for drug and immigration cases than for the people charged with participating in the 6 January attack, who are more than 90% white.

More than 96% of the people charged with federal immigration crimes are Hispanic, and more than 70% of those charged with federal drug crimes are Hispanic and Black, Zunkel said, citing federal sentencing data.

“We have a problem with our system, something has gone wildly wrong, if we have a 75% detention rate nationwide, and we have a subset where we have a more than 70% release rate,” she said.


Why aren't we calling the Capitol attack an act of treason?


Zunkel and a colleague, Judith P Miller, both former federal defense attorneys, said that the level of skepticism and care federal judges were bringing to the decision of whether Capitol defendants were truly dangerous enough to keep incarcerated was not at all the norm.

The problem, they said, was not that judges were making the wrong call in releasing Capitol defendants, but that judges were not making similar calls for the majority of people in the federal system.

“For my Black and brown clients, it feels like they have to meet such an impossibly high threshold to be released,” Miller, a University of Chicago law professor, said. “The kind of sensitivity the courts have shown to the capitol defendants’ claims for relief – I wish some of that sensitivity would be shown more broadly.”

The US attorney’s office for the District of Columbia declined to confirm how many Capitol defendants were currently in pretrial detention, noting that the number “has the potential to fluctuate frequently based on ongoing detention decisions”.

By mid-May, at least 440 people had been arrested on charges related to the 6 January Capitol breach, according to the justice department, including at least 125 charged with assaulting or impeding law enforcement.

Of 398 defendants listed on the justice department’s Capitol breach case site as of 10 May, at least 330 were listed on the site, or in federal court records, as released from custody. At least 56 of those defendants remained in detention.

The precise number and percentage of Capitol defendants who are released versus in detention changes often, as new alleged rioters are arrested, others secure release, and a few risk re-arrest for violating the conditions of their release. The number and status of cases on the justice department’s Capitol breach website also lags behind court filings.

But the broader trend in the cases is clear: the overwhelming majority of Capitol defendants are not being detained ahead of trial.

Based on their likelihood of flight risk or danger to their communities, some of the Capitol defendants have been required to meet more intensive release conditions, including GPS monitoring, curfews or home detention, and limitations on their access to the Internet or social media, according to court records.

Many of the Capitol defendants are facing only relatively low-level federal charges, such as entering a restricted building or disorderly conduct within a restricted building. A Washington Post analysis of court documents in mid-May concluded that 44% of the Capitol defendants faced only misdemeanor charges.

Some of the federal judges hearing the Capitol cases have expressed concern that certain defendants may have already spent more time in custody than they are likely to face as a punishment for their crimes.

“For those who end up only charged with misdemeanors, it’s likely that they won’t serve any substantial time, or potentially no time at all,” said Mary McCord, an expert on extremism who served for nearly 20 years as a prosecutor in the US attorney’s office in Washington DC. “It’s quite possible if they were to plead guilty, they would be sentenced to whatever time was served, or 30 days.”

There is a tension between the dramatic collective effect of the 6 January mob, which halted the official certification of Biden’s election as president and threatened the legitimacy of American democracy, legal experts said, and what federal prosecutors can prove that individual people did.

“The irony is that we have so many laws – so many things are illegal – it’s somewhat surprising that they’re not able to find charges that are more serious,” Zunkel said.

Some more serious potential charges, like conspiracy or seditious conspiracy, would require evidence of prior agreement to commit a crime that appears to be lacking for many participants in the chaotic Capitol mob, said Daniel Richman, a Columbia University law professor and former federal prosecutor.

“When you look at each individual, what they did might amount to destruction of property or illegal entry, and that’s in all likelihood what they’ll be charged with, but the larger dimension of their participation in a massive attack falls by the wayside,” Richman said.

Part of the current dynamic of the Capitol cases, Richman cautioned, was seeing the very normal limitations of the criminal justice system come up against the heightened expectations of a public who watched the shocking violence of 6 January unfold in real time.

“Criminal prosecutions never end in these glorious accountability moments where everyone is satisfied that right was done,” Richman said.

For many Capitol defendants facing these lower-level charges, justice department prosecutors did not even attempt to keep them detained ahead of trial, and they were quickly released on standard conditions.

Federal prosecutors did fight for months to keep other defendants in custody, with federal judges eventually overruling them, particularly after the pivotal appeals court ruling questioning the detention of Munchel, the alleged “Zip Tie Guy”, and his mother, who both gave interviews talking about their willingness to engage in violence to further their beliefs but were not accused of any specific acts of violence or vandalism as they roamed the Capitol, wrist restraints in hand.

“My guess is the judges who decided to release some of these folks on bond were thinking: on January 6, there were an ideal storm of conditions for these people to commit a crime, and now there aren’t those ideal conditions any more, so they’re not likely to do it again,” said Wanda Bertram, a communications strategist at the Prison Policy Initiative, a non-profit that focuses on the harms of mass incarceration.

But the same logic could be applied to low-level crimes: “investing in people’s communities” to “create different conditions” that would make it unlikely for them to repeat the same behavior, Bertram said.

“The treatment of the people who are involved in the Capitol riot should show us what is possible and what is logical in terms of how to treat people in the future.”

Former prosecutors defended the justice department’s work in the Capitol cases, and said that the continuing effort to identify and arrest a large proportion of the hundreds of people who stormed the Capitol was a massive, demanding endeavor, and showed how much the government wanted to ensure that there were real consequences for participating in the attack.

“They’ve been aggressive, and continue to be, in trying to find everybody who was at that riot,” said Laurie Levenson, a professor at Loyola Law School. “For the attorney general, numbers matter. It really matters that hundreds of people are held responsible. That’s the message to people: you don’t want to game the system.”

“I think they pretty much want on everyone’s records that they were responsible for these actions,” Levenson added. “It means something that these people are going to walk away with even a federal misdemeanor record. That has an impact on their employment, on their life, on their situation in their community. Even if they just get probation, they’re going to have to watch their step.”

Politicians and the rightwing media downplay the attack or shift the blame, fears of a replay grow

Donald Trump tried to overthrow American democracy to remain in power, but his party is working to make America forget all about that riot at the U.S. Capitol.

It has been described as America’s darkest day since the terrorist attacks of September 11, 2001. But whereas 9/11 is solemnly memorialised in stone, a concerted effort is under way to airbrush the US Capitol insurrection from history.

Six months on from the mayhem on 6 January, when a mob of Donald Trump supporters stormed the heart of American democracy to disrupt the confirmation of Joe Biden’s election victory, Republicans and rightwing media have variously attempted to downplay the attack or blame it on leftwing infiltrators and the FBI.

Interviews with diehard Trump fans suggest that the riot denialism is working. Many refuse to condemn the insurrectionists who beat police officers, smashed windows and called for then Vice-President Mike Pence to be hanged. The swirl of conspiracy theories, combined with Trump’s deluded claims of a stole election, raise fears of a replay that could be even more violent.

“Rightwing media and some Republicans, including Republicans in the Senate and the House, are trying to make it seem as though what was a siege on the Capitol was not actually a siege on the Capitol,” said Monika McDermott, a political science professor at Fordham University in New York.

“We all saw it. We saw them breaking down doors. We saw our members of Congress running for cover and trying to get away. We saw Mike Pence being shuttled out of the chamber. All of these frightening things that we saw happen are now being denied or being or being laid at the feet of Antifa or the FBI or some other source, which just seems at this point ludicrous.”

Hours after the insurrection in Washington, members of Congress returned to the chambers to complete the certification of Biden’s electoral college win. Some Republicans did seem shaken and aware that a new, dangerous line had been crossed. Yet 147 still voted to overturn the election outcome, an ultimately futile gesture.

A month later a minority also voted to impeach and convict Trump for his role in sparking the insurrection, but not enough to stop him being acquitted. Since then, many party members have been eager to “move on” and minimize the events of that day.

Senator Ron Johnson told Fox News: “We’ve seen plenty of video of people in the Capitol, and they weren’t rioting. It doesn’t look like an armed insurrection when you have people that breach the Capitol – and I don’t condone it – but they’re staying within the rope lines in the rotunda. That’s not what armed insurrection would look like.”

Congressman Andrew Clyde – who was photographed barricading the House of Representatives chamber – told a hearing that, based on TV footage, “you would actually think it was a normal tourist visit”. His colleague Louie Gohmert added: “I just want the president to understand. There have been things worse than people without any firearms coming into a building.”

Even Kevin McCarthy, the House minority leader who had said the former president “bears responsibility” for the attack, ultimately bent to Trump’s will and backed the removal of congresswoman Liz Cheney – who was clear-eyed and outspoken about the gravity of the assault – from House leadership.

Mitch McConnell, the Senate minority leader who also condemned Trump’s role in the insurrection, nevertheless ensured that Republicans deployed a procedural rule known as the filibuster to block the creation of a 9/11-style bipartisan commission to investigate it. This was despite the justice department warning that domestic terrorism now poses a bigger threat than attacks from overseas.

Kurt Bardella, a former Republican congressional aide who is now a Democrat, said: “I’m old enough to remember when the Republican party was willing to launch this country into a global war, fought on multiple fronts over the course of many years, because of what happened on September 11. And yet here we are just six months removed from something that happened on our own soil and on our own Capitol and Republicans are actively trying to rewrite history to make it out to be something that it wasn’t.”

Bardella, a contributor to the Los Angeles Times and USA Today newspapers, added: “If those who would deny the gravity of what happened on January 6 achieved a position of power, it is almost a guarantee that this will happen again, only it will be even more violent and more deadly.

“The Republican party is creating a construct in which they are giving permission to their supporters to view any election that doesn’t result in them winning as illegitimate and that is a very dangerous and destabilizing position that will have violent consequences.”

Not for the first time, Republicans are being aided and abetted by rightwing media personalities amplifying their message, not necessarily to change minds but to muddy the waters, leave the events of 6 January open to speculation and give Trump supporters a way to rationalize and justify them.

Conservative television, fringe website and rightwing podcasts are pumping out the propaganda and disinformation. Laura Ingraham, a Fox News host, has told viewers flatly: “It was not an insurrection.”

Her colleague Tucker Carlson, who has a huge following, floated the groundless “false flag” theory that the FBI secretly orchestrated the riot. As he was speaking, a banner appeared on screen that said: “The left wants new information on Jan 6 to go away.”

Chris Hayes, a host on the rival MSNBC network, commented: “The purpose here is not for communicating information. It’s to break the consensus of reality so that people can be manipulated and radicalised. And it is incredibly dangerous. And it is working.”

It is indeed working. Riot denialism was rife at Trump’s first post-presidential rally in Wellington, Ohio, on 26 June, where supporters began from the premise that the election had been stolen.

Gary Sherrill, 65, a concrete mixer driver wearing a “Make America great again” cap, said the insurrection was justified. “They said those people were invading but they own the building. The people inside work for them.”

Rose Kidd, 63, a retired nurse, made the evidence-free claim: “That was all staged. [House speaker Nancy] Pelosi knew. Antifa and BLM [Black Lives Matter] were all bussed in. Video shows it was they who broke the windows. Patriots don’t do that.”

And Gary Bartlett, 65, a retired manual worker at a car manufacturer, added: “99% of the people there were peaceful. The ones who went inside, I don’t know if they were Trump supporters or Antifa who infiltrated. Most of them walked in and walked back out.”

Democrats are working to understand 6 January and ensure it takes it rightful place in the history books. On Wednesday the House passed a resolution to form a select committee to investigate the carnage, with Pelosi appointing eight members and McCarthy appointing five. Many believe that such a reckoning is necessary for a national catharsis and healing – the struggle of memory against forgetting.

McDermott, the political scientist at Fordham, commented: “This was an unprecedented historic event and it is not one that should be wiped off of the history books or hidden away as though it didn’t happen or be minimised in any way. What happened was very real.

“It’s something that the country has to come to terms with, which I don’t see happening right now. We’re in very real danger of forgetting that there is a part of our society that is willing to use violence to get what they want out of the government. And I’ve done polling on this myself and those people are out there. They do think violence is a legitimate way to go and, by giving them cover, this is a very dangerous precedent we’re setting.”





Insurrectionist-In-Chief To 2024 Front-Runner




DANGEROUS Insurrectionist...


Six months later, Trump’s actions in the weeks leading up to Jan. 6 and on that day itself seem almost irrelevant ― even though they triggered a record second impeachment.

The Republican National Committee cites him multiple times per week in fundraising pitches, as do its Senate and House arms. “You’re one of President Trump’s TOP supporters, so we wanted to make sure that you had a chance to sign his Official Birthday Card,” the RNC wrote to its email list on June 14.

Trump last month resumed his rallies with one in Ohio, ostensibly to push a former White House aide running against one of the 10 GOP House members who voted to impeach Trump. But during the rally, he again continued with the same lies about the election that led to the Jan. 6 insurrection.

Recently, he has started openly defending the violent mob he incited to attack the Capitol. “By the way, who shot Ashli Babbitt? Who shot Ashli Babbitt? Who?” he asked at his Florida rally on Saturday, referring to the woman who was fatally shot by Capitol Police as she tried to climb through a broken window into an anteroom from which House members were being evacuated.

He followed that by conflating the domestic terrorists who wanted to overturn democracy on his behalf with civil rights protests and street crime. “And how come so many people are still in jail over Jan. 6 when nobody paid a price for the fire and carnage and death that took place in Democrat-run cities throughout our country, including Antifa and BLM?” he asked the crowd. “How come? How come?”

And, notwithstanding criminal investigations into his business practices in New York and his attempt to coerce elections officials in Georgia, Trump is the preferred choice among Republicans as their 2024 nominee, with the majority of them now believing that Biden’s election was illegitimate.

Rick Tyler, a top aide to Texas Sen. Ted Cruz’s 2016 bid for the GOP nomination, blamed the polarized nature of politics today. “So skeptical are Americans now about what passes the lips of a politician that nothing is believed. Efforts to examine Jan. 6 are viewed entirely through a political lens where understanding what happened is secondary to political objectives. That’s a dangerous road upon which we should not travel.”

But Amy Fried, a political science professor at the University of Maine and co-author of the forthcoming book “At War With Government: How Conservatives Weaponized Distrust From Goldwater to Trump,” said the polarization is not symmetrical between the parties and that conservatives in recent decades have actively worked to sow distrust of institutions. “There are a lot of issues where the parties are polarized or have become more polarized over time; climate change is one. But this is rather extraordinary because we could all use our own eyes to see the footage of the insurrection.”

And that denial of a reality that was available for all to witness on live television is good reason for alarm, former President Barack Obama told the American Library Association conference last week.

“The guardrails I thought were in place around many of our democratic institutions really depend on the two parties agreeing to those ground rules and … one of them right now doesn’t seem as committed to them as in previous generations. That worries me,” Obama said. “And I think we should all be worried.”

Work was under way on Saturday morning to remove a statue to a Confederate general that helped spark a violent white supremacist rally in Charlottesville in 2017.

The small Virginia city said the equestrian statue of Gen Robert E Lee and a nearby statue of Gen Thomas “Stonewall” Jackson would be removed to storage. Designated public viewing areas for the removals had been established.

A crane was moved into place and workers were preparing as the sun came up first to hoist Lee away. Just after 8am local time, the statue of the man on his horse was hoisted slowly off its plinth.

Charlottesville’s mayor, Nikuyah Walker, gave a speech in front of public and media as the lifting equipment was moved into position.

“Taking down this statue is one small step closer to the goal of helping Charlottesville, Virginia, and America grapple with the sin of being willing to destroy Black people for economic gain,” she said.

Lee led Confederate forces during the American civil war, which the Confederacy fought between 1861 and 1865 in an attempt to maintain slavery. Jackson rose to fame in the first years of the conflict before dying of pneumonia after being mistakenly shot by his own men.

The Jackson statue was erected in 1921 and Lee in 1924, nearly 60 years after the war ended in the total defeat of the Confederacy but was followed an era of official racial segregation across southern states.

The statues will be toppled more than five years after calls for their removal began to gain momentum. In 2016, Zyahna Bryant, then a 16-year-old high-school student, was given an assignment that asked her to describe something she could change. She started a petition to remove the statue of Lee.

In response, the city council set up a commission on race, memorials and public Spaces. In February 2017 the council voted for removal, angering white supremacist groups.

The Lee statue became a rallying point for such extremists, culminating in a “Unite the Right” rally in August that year. Neo-Nazis and other white supremacists congregated in Charlottesville to defend the Lee statue and a counter-protester, 32-year-old Heather Heyer, was killed. A white supremacist was convicted of her murder.

Because of litigation and changes to a state law, the city was unable to act before holding public hearings and offering the statue to any museum, historical society or battlefield. This week, the city said it had received 10 such expressions of interest, “six out-of-state and four in-state that are all under review”.

Take ’Em Down CVille, a group that campaigns for racial justice, applauded news of the planned removal.

“The messages from the public were moving and powerful,” it said. “No one believes that removing the statues will end white supremacy but this is an important step – and one long past due.”

Preparations included the installation of fencing, the city said, adding that both statues would be stored in a secure location on city property until the council reaches a decision on their relocation.

The removal follows years of contention, community anguish and litigation. A long, winding legal fight coupled with changes in a state law that protected war memorials had held up the removal for years.

Saturday’s actions came almost four years after violence erupted at the infamous “Unite the Right” extremist rally. After a torchlit march and racist chanting, rightwingers including members of known white supremacy groups clashed violently with counter-protesters, culminating in Heyer, a peaceful counter-protester, being murdered when she was mown down by a car driven into a demonstration.

The crisis sparked a national debate over racial equity and the then president, Donald Trump, inflamed the conflict by insisting there was “blame on both sides” of the issue in Charlottesville over that bloody weekend.

Capitol Riot: Policeman Tells 6 January Hearing He Feared He Would DIE

A police officer who defended the US Capitol during a riot by Donald Trump supporters on 6 January has said he feared he would be crushed by the mob.

Officer Michael Fanone testified he was knocked unconscious and suffered a heart attack


"This is how I'm going to die," a tearful Aquilino Gonell told a Congressional committee as an inquiry opened into the Washington DC attack.


Another officer, Harry Dunn, who is black, said he was racially abused.

At least 535 rioters have been arrested since the attack that left five dead, including one police officer.

Prosecutors have so far secured only a few convictions.

The assault led to the political impeachment and acquittal of Republican Mr Trump, who was accused by lawmakers of inciting the riot - a claim he has repeatedly denied.

The inquiry in the House Select committee is being conducted almost entirely by Democrats, after most Republicans boycotted the proceedings.

However, two Republicans - Liz Cheney and Adam Kinzinger - have broken ranks to join the investigation.

"If those responsible are not held accountable... this will remain a cancer on our constitutional republic," Ms Cheney said as the hearing began on Tuesday.

The nine-member select committee was formed after Republicans objected to an independent commission such as the one that investigated the 11 September 2001 attacks.

The panel - which has powers to summon witnesses - is expected to investigate the circumstances leading up to the riot and why law enforcement bodies were ill-prepared.


A 'Medieval Battlefield'


On Tuesday, four police officers described being beaten and assaulted by rioters who had come to disrupt the certification by Congress of President Joe Biden's election victory.

Officer Gonell described the scene as a "medieval battlefield".


Wiping away tears, he described returning home and pushing his wife away from him because of the amount of chemical irritant that had soaked into his uniform.

The Iraq War veteran went on to criticise Republicans for what he described as their "continuous shocking attempt" to "ignore or destroy the truth" about that day.

Asked by Ms Cheney about Mr Trump's claim that they were a "very loving crowd," Sgt Gonell hit back: "I'm still recovering from those hugs and kisses."

"If that was hugs and kisses, we should all go to his house and do the same thing to him."He later said that he did not mean for anyone to go to Mr Trump's home, and apologised for the "outburst".

Officer Dunn said he told several protesters that he had voted for Mr Biden.

"Does my vote not count? Am I nobody?" he told them, after they wrongly claimed that the election was fraudulent.

"That prompted a torrent of racial epithets," he testified. "One woman in a pink Maga [Make America Great Again] shirt yelled, 'You hear that, guys, this [expletive] voted for Joe Biden!"

"No-one had ever - ever - called me a [expletive] while wearing the uniform of a Capitol police officer."




'Those Words are Weapons'







Officer Michael Fanone recalled being dragged into the crowd, beaten and shocked repeatedly with a taser.


He said he heard chants of "kill him with his own gun". Fearing for his life, he pleaded with rioters, saying he had children.

At one point during his testimony the officer slammed his fist on the desk as he accused some Republicans of showing a "disgraceful" indifference and betraying their oaths of office.

Officer Dunn said he did not fully process the racial insults until days later.

"I was just trying to survive that day, and get home," he said.

"When I was able to process it, it was so emotional. It was so disheartening and disappointing that we live in a country like that, where they attack you because of the colour of your skin.

"Just to hurt you. Those words are weapons."


Officer Daniel Hodges' lip trembled with emotion as he was shown a video of himself trapped in a doorway being pummelled by rioters, who he repeatedly referred to as "terrorists" during his testimony.

"To my perpetual confusion, I saw the Thin Blue Line flag, a symbol of support for police, more than once, as the terrorists continued to ignore our commands and attacked us," he said.

Mr Kinzinger, one of the only Republicans who voted to impeach Mr Trump for his role in the riot, appeared to hold back tears as he criticised his colleagues.

"We still don't know exactly what happened. Why? Because many in my party have treated this as just another partisan fight. It's toxic and it's a disservice to the officers and their families," he said.

Officer Who Responded to US Capitol Attack is Third to Die by Suicide

A third police officer who defended the US Capitol during the 6 January insurrection by extremist supporters of Donald Trump has taken his own life, Washington DC’s Metropolitan police department confirmed on Monday.

Officer Gunther Hashida, who was assigned to the emergency response team within the special operations department, was found dead at home on 29 July, the department said.

DC Metropolitan Police office Michael Fanone said he received a death threat after his Tuesday testimony.

Hashida, 43, joined the force in May 2003 and was among those who responded to the Capitol attack, spokesperson Brianna Burch confirmed to the Guardian.

“We are grieving as a department and our thoughts and prayers are with Officer Hashida’s family and friends,” Burch said.

Hashida is survived by his wife, Romelia, and three children, his sister and other members of a “wonderful family”, according to an online fundraising campaign established in his memory.

The death of Hashida is the third known instance of a suicide by law enforcement officers related to the 6 January insurrection, when a mob of Trump supporters stormed the Capitol in a violent attempt to stop the certification of Biden’s election win.

The attempt failed and Biden’s victory over Trump from the 2020 election was certified by Congress in the early hours of the following morning.

The justice department’s decision marks a sharp departure from the Trump era, when the department repeatedly intervened on behalf of top White House officials.

But the attack on the Capitol, which lasted several hours, involved rioters attacking outnumbered officers to break into the building in a failed effort to hunt down lawmakers, including then-vice president Mike Pence.

Trump was impeached, for an unprecedented second time, on the charge of inciting the insurrection, and acquitted in February by the Senate.

Officer Jeffrey Smith, a 12-year veteran of the force, and Officer Howard Liebengood, a 16-year Capitol police veteran, also responded to the 6 January attack and later died by suicide.

Hashida’s death comes a week after officers testified to a House select committee about their harrowing experiences defending Congress. Almost 600 people have been criminally charged for their part in the events.

Capitol Riot Inquiry to Investigate Whether TRUMP’s White House was Involved in Attack

The Committee has issued sweeping requests for Trump executive branch records related to the insurrection

Congressman Bennie Thompson, chair of the House select committee investigating the Capitol attack, is preparing an expanded inquiry into Donald Trump that will scrutinize whether the White House helped plan or had advance knowledge of the insurrection.

The move amounts to an escalation for the committee as they embark on an inquiry into the events around the 6 January assault that could ensnare the former US president and some top allies in the White House and on Capitol Hill, portending an aggressive inquiry with far-reaching ramifications.

The justice department’s decision marks a sharp departure from the Trump era, when the department repeatedly intervened on behalf of top White House officials.

House select committee investigators in July started examining the events that left five dead and nearly 140 injured as a mob of Trump supporters stormed the Capitol in an unsuccessful attempt to stop the certification of Joe Biden’s election win.

But for the first time in a congressional inquiry, the committee will also scrutinize whether the White House was involved in efforts to precipitate the Capitol attack – and what Trump knew of such efforts ahead of time, according to a source familiar with the matter.

The committee’s intentions to examine potential White House involvement were telegraphed in part when Thompson last week issued sweeping requests for Trump executive branch records related to the insurrection, the source said.

In letters to the National Archives and seven other agencies including the justice department and FBI, Thompson said House select committee investigators were seeking documents and communications from the previous administration related to 6 January.

But in a notable additional request, Thompson also demanded communications of White House personnel and members of Congress that referred to attacks on the Capitol – on both the day of the insurrection as well as key dates before.

“Our constitution provides for a peaceful transfer of power, and this investigation seeks to evaluate threats to that process, identify lessons learned,” Thompson said in the letters.

The expansion of the dragnet to include 5 January is significant, the source said, since it raises the specter of the committee prying open a window into what Trump and his top allies were thinking and doing the day before the Capitol attack.

White House aides and members of Congress were among those who huddled that evening to pressure more Republicans to object to the electoral college results and push then-Vice-president Mike Pence to reject Biden’s certification, according to one Trump administration official.

The meetings alarmed some White House aides, the official said, because they feared it could leave White House aides vulnerable to charges that the administration was involved in plans to violently intimidate federal officials from carrying out the transition of power, a potential crime.

House select committee investigators are poised to examine whether Trump – who Republican senator Ben Sasse was told was “delighted” at images showing rioters storming the Capitol – contributed to such deliberations, the source said.

A spokesperson for the committee declined to comment on the direction of the investigation. But taken together, the committee’s moves mark a politically treacherous turning point for the former president and his supporters on Capitol Hill.

House and Senate Republicans in June blocked the creation of a 9/11-style commission into the Capital attack for fear it could conclude the GOP’s role in promulgating Trump’s lies about a stolen election incited the rioters and prove damaging in the 2022 midterms.

The House minority leader, Kevin McCarthy, and the top Republican on the House judiciary committee, Jim Jordan, were already certain to face scrutiny over their separate phone calls to Trump on 6 January.

But far from avoiding a close accounting of the insurrection, the dooming of the commission opened an avenue for House speaker Nancy Pelosi to empanel a select committee and start an inquiry overseen by some of Trump’s fiercest critics in Congress.

CNN reported on Monday that the committee plans to order that a group of telecom companies preserve the phone records of House Republicans suspected of playing a role in the “Stop the Steal” rallies and marches before the insurrection.

The list was said to be evolving but included Jordan and Republican lawmakers Lauren Boebert, Marjorie Taylor Greene, Andy Biggs, Paul Gosar, Mo Brooks, Madison Cawthorn, Matt Gaetz, Louie Gohmert, Jody Hice and Scott Perry.

Enraged at the sharpening contours of the committee’s inquiry, which raises the prospect of an embarrassing airing of Trump’s private attempts to reinstall himself in the Oval Office, the former president threatened last week to block its efforts.

“Executive privilege will be defended, not just on behalf of my administration and the patriots who worked beside me, but on behalf of the office of the president of the United States and the future of our nation,” Trump said in a statement.

It was not clear whether invoking executive privilege would be successful. The justice department previously declined to assert the protection over 6 January testimony after the White House office of legal counsel determined it did not exist to benefit private interests.

The National Archives also acknowledged to CNN earlier this month that they were in possession of records and communications from the Trump administration and indicated that they would comply with records requests from Congress.

Even as Trump threatened to mount court challenges against the investigation, House select committee investigators are expected to exercise a broad mandate that mirrors the framework used by Republicans for the select committee into the 2012 terror attacks in Benghazi, Libya.




The new line of inquiry – whether Trump and White House officials played a role in planning the Capitol attack – is expected to continue for months as the committee sifts through what is anticipated to be thousands of pages of documents, the source said.

Other investigative actions are also underway. The committee announced last week that it was seeking records from social media companies for material “related to the spread of misinformation, efforts to overturn the 2020 election or prevent the certification”.

House minority leader Kevin McCarthy’s claimed it would be illegal for telecom companies to comply with the investigation’s records requests.

Top Republicans under scrutiny for their role in the events of 6 January have embarked on a campaign of threats and intimidation to thwart a Democratic-controlled congressional panel that is scrutinizing the Capitol attack and opening an expanded investigation into Donald Trump.

The chairman of the House select committee into the violent assault on the Capitol, Bennie Thompson, in recent days demanded an array of Trump executive branch records related to the insurrection, as members and counsel prepared to examine what Trump knew of efforts to stop the certification of Joe Biden’s election win.

House select committee investigators then asked a slew of technology companies to preserve the social media records of hundreds of people connected to the Capitol attack, including far-right House Republicans who sought to overturn the results of the 2020 election.

The select committee said that its investigators were merely “gathering facts, not alleging wrongdoing by any individual” as they pursued the records in what amounted to the most aggressive moves taken by the panel since it launched proceedings in July.

But the twin actions, which threatened to open a full accounting of Trump’s moves in the days and weeks before the joint session of Congress on 6 January, has unnerved top House Republicans, according to a source familiar with the matter.

The House minority leader, Kevin McCarthy, decried the select committee’s investigation as a partisan exercise and threatened to retaliate against any telecommunications company that complied with the records requests.


“A Republican majority will not forget,” he warned, in remarks that seemed to imply some future threat against the sector.


The warning from the top Republican in the House amounted to a serious escalation as he seeks to undermine a forensic examination of the attack perpetrated by Trump supporters and domestic violent extremists that left five dead and nearly 140 injured.

But his remarks – which members on the select committee privately consider to be at best, harassment, and at worst, obstruction of justice – reflects McCarthy’s realization that he could himself be in the crosshairs of the committee, the source said.

Most of McCarthy’s efforts to undercut the inquiry to date, such as sinking the prospects of a 9/11-style commission to scrutinize the Capitol attack, have been aimed at shielding Trump and his party from what the select committee might uncover.

But deeply alarmed at the efforts by House select committee investigators to secure his personal communications records for the fraught moments leading up to and during the Capitol attack, McCarthy went on the offensive to pre-emptively protect himself, the source said.

Thompson previously told the Guardian in an interview that such conversations with Trump would be investigated by the select committee, raising the prospect that McCarthy could be forced to testify about what Trump appeared to be thinking and doing on 6 January.

The statement from McCarthy asserted, without citing any law, that it would be illegal for the technology companies to comply with the records requests – even though congressional investigators have obtained phone and communications records in the past.

The threat is unlikely to be viewed as a violation of federal witness tampering law, which, as part of a broader obstruction of justice statute, makes it a felony under some circumstances to try to dissuade or hinder cooperation with an official proceeding.

Congressman Jamie Raskin, a member of the select committee and the former lead impeachment manager in Trump’s second trial, said that he was appalled by McCarthy’s remarks, which he described as tantamount to obstruction of justice.

“He is leveling threats against people cooperating with a congressional investigation,” Raskin said. “Why would the minority leader of the House of Representatives not be interested in our ability to get all of the facts in relation to the January 6th attack?”

Meanwhile, other members on the select committee have also seized on McCarthy’s threat as a reminder that Republicans could not be trusted to engage in the inquiry in good faith, according to a source connected to the 6 January investigation.

It also underscored to them, the source said, the nervousness among top Republicans as the select committee ramps up its work, even though the inquiry is still in its early days and has yet to sift through thousands of pages of expected evidence.

Emboldened by McCarthy’s combative stance, Trump denounced the select committee as a “partisan sham”, while Republicans under scrutiny by the panel such as Marjorie Taylor Greene threatened any companies that complied with the records requests would be “shut down”.

The chairman of the House Freedom Caucus, Andy Biggs, is now also asking McCarthy to remove from the Republican conference Liz Cheney and Adam Kinzinger – the two vocal critics of Trump appointed to the select committee – whom he called “spies” for Democrats.

Biggs on Thursday suggested in a letter, first reported by CNN, that Cheney and Kinzinger should be ejected because they are involved in investigating Republicans over 6 January and the party should be able to strategize without having the pair present at conference meetings.

Still, McCarthy remains unable to shape an investigation likely to prove politically damaging to Trump and to Republicans at the ballot box at the midterms next year, a reality that has come largely as a result of his own strategic miscalculations.

The proposed 9/11-style commission into the Capitol attack had envisioned a panel with equal power between Democrats and Republicans, and McCarthy’s decision to boycott the select committee in a flash of anger inadvertently left Trump without any defenders.

Capitol Riot Committee to Investigate TRUMP's Allies

The committee investigating the Capitol riot has issued its first subpoenas of TRUMP's allies - including Mark Meadows and Steve Bannon.

Lawmakers are after information on TRUMP's actions leading up to the riot.




The committee's first four subpoenas were issued to Mr Meadows, former White House chief of staff; Mr Bannon, TRUMP's former advisor; former deputy chief of staff Dan Scavino; and Kashyap Patel, a former Pentagon chief of staff.

"The committee is investigating the facts, circumstances, and causes of the January 6th attack and issues relating to the peaceful transfer of power," the committee said in a letter on Thursday.

In four individual letters, the committee outlined the reasons for calling each witness forward.

Mr Bannon will be asked about his communication with TRUMP in late December and involvement in discussing plans to overturn the election, the committee said. They quoted him as saying "all hell is going to break loose tomorrow" on the eve of the riot.

Mr Meadows will be asked about his communication with the organisers of the rally that preceded the attack on the Capitol.

Mr Scavino reportedly told members of the House not to certify the election for Joe Biden, and Mr Patel was involved in discussions about security at the Capitol as the riot unfolded.

In a statement, Mr Patel said he was "disappointed, but not surprised" the committee had issued a subpoena before asking for his voluntary cooperation.

Democratic House Speaker Nancy Pelosi announced the creation of a committee to investigate the Capitol Hill riot in January this year.

Mrs Pelosi said the Democratic-led committee would aim to "establish the truth of that day and ensure that an attack of that kind cannot happen".

The move came after Senate Republicans blocked a bill to establish a bipartisan commission into the attack.

Allies of former President Donald Trump said a commission was not necessary.

US lawmakers investigating the 6 January Capitol riot have supported holding a top aide of ex-President Donald Trump in contempt of Congress.

Steve Bannon, a right-wing media executive who became Trump's chief strategist, was summoned to testify before the panel, but refused to do so.


Lawyers for Mr Bannon argued that communications involving the former president are protected.

If convicted, he could face a fine and up to one year in prison.

"It appears that Mr Bannon had substantial advanced knowledge of the plans for January 6, and likely had an important role in formulating those plans," congresswoman Liz Cheney, a Wyoming Republican and vice-chair of the committee probing the riot said in her opening statement.

Subpoena documents quote Mr Bannon as saying on his radio show the day before the riot "all hell is going to break loose tomorrow".

But Trump has urged his former aides to reject any requests to testify, claiming they have the right to withhold information because of executive privilege - a legal principle that protects many White House communications.

The former president filed a lawsuit on Monday seeking to block the House inquiry from obtaining records from the US National Archives.

Mr Bannon - who was fired from the White House in 2017 but remained loyal to Donald Trump - has not publicly commented on Tuesday's vote. Through his lawyer, he has said that he will not cooperate until Mr Trump's executive privilege claim is resolved by a court.


President Joe Biden's administration says Trump has no legitimate privilege claim.

The boundaries of the claim will be tested on Thursday, when the House of Representatives votes on whether to uphold the contempt charge against Mr Bannon.

If upheld, the case will be referred to the justice department, which has the final say on bringing charges.

The riot on 6 January saw a mob of Trump's supporters storm the Capitol building to disrupt the official certification of Joe Biden's election victory.

More than 670 people have since been charged with taking part.

Democrats argue that Mr Bannon is stalling to push back proceedings until after the midterm elections in November 2022, which may alter the balance of power in the House, which is the lower chamber of Congress.

Contempt of Congress cases are notoriously difficult to litigate - the last time such a prosecution took place was in 1983 against a Reagan administration official.

Before leaving office in January, Trump pardoned Mr Bannon of charges that he had defrauded donors who gave money to fund construction of a southern border wall.

The Duke of Sussex sounded the alarm over the January 6 insurrection attempt the day before it happened, he has claimed.

Speaking at Wired event The Internet Lie Machine, Prince Harry urged social media companies to do more to tackle hate and division.

When asked if he has spoken to the big tech CEOs to try and convince them to change their platforms, the duke admitted he had previously emailed Twitter chief Jack Dorsey.

"Jack and I were emailing each other prior to January 6 when I warned him his platform was allowing a coup to be staged. That email was sent the day before.

"And then it happened and I haven't heard from him since."

The violent outburst, which saw five people die after Trump supporters headed to Washington DC in a bid to overturn the presidential election, had been wildly pre-empted online.

Harry's admission that he was tracking the build up to the bloody event suggested that he may have a secret Twitter account, following claims earlier in the Wired debate that he wasn't on social media.

The duke went on to argue that a large amount of the hate speech that can be found online is being spread by a small number of accounts.

"More than 70% of the hate speech about my wife on Twitter can be traced to 50 accounts," he said.

The analysis found that the shockingly high percentage of 114,000 tweets about Meghan had come from just 83 accounts.

He said the internet is "being defined by hate, division and lies".

Harry argued for more and better regulation of social media platforms so that people can have good access to reliable sources of information.

"Misinformation is a global humanitarian crisis," he continued.

"People now more than ever want and need trust, transparency, and truth.

"We need to have a shared reality."

The dad-of-two remember to direct plenty of ire towards traditional media companies, which he blamed for causing the death of his mother Princess Diana.

The 37-year-old said: "I lost my mother to this self-manufactured rabidness.

"And obviously I'm determined not to lose the mother to my children to the same thing."

The Duke added: "The scale of misinformation now is terrifying."

Earlier today his wife Meghan Markle, speaking at a New York Times event, made her own calls for social media reform.

The Duchess highlighted the fact that Instagram has a like button and ability to comment, but not a 'dislike' option.

As a consequence, people either express their approval by hitting 'like', or explain their negative feelings in the comments.

A 'dislike' button would lead to less negative, angry comments, Meghan said.

"One of the things that seems like such an easy solve from my lens, if you look at Instagram for example, there's a like button and then there's comments," she said.

"So if you disagree with something you have to comment on it in a really vitriolic way. If there was a dislike button wouldn't that hugely shift what you were putting out there, because you could just like it or just dislike it.

"Now you have to like it or say something negative. It is just adding to this really unfortunate cycle that I think is having an unfortunate effect on women across the world.

Capitol Riot: Judge Rejects TRUMP Bid to Withhold Records

A US judge has ruled a congressional committee investigating the Capitol riot can access some of ex-President Donald Trumps' White House records.

Trump had sought to invoke executive privilege, under which presidential documents can be kept secret.

The inquiry is trying to find out if Mr Trump had prior knowledge of the riot.

Trump supporters stormed the Capitol building on 6 January as Congress was certifying President Joe Biden's election victory.

Mr Trump has refused to acknowledge losing the election last year, claiming - without evidence - that it had been rigged.

The inquiry is being conducted by a committee set up by the House of Representatives which is dominated by President Biden's Democrats.

The panel wants to see a trove of phone records, visitor logs and other White House documents that could shed some light on the events leading up to the attack on Congress.

It has issued summonses to several Trump aides to testify before the lawmakers.

Mr Trump - a Republican - had argued his White House communications were protected and as such should not be released.

But US District Judge Tanya Chutkan ruled that the National Archives, the federal agency that holds the records, should comply with the panel's request.

In a 39-page ruling, Judge Chutkan said that Congress had the right to see the documents, particularly as the current president had agreed.

Mr Trump "does not acknowledge the deference owed to the incumbent president's judgment. His position that he may override the express will of the executive branch appears to be premised on the notion that his executive power 'exists in perpetuity,'" the judge wrote. "But presidents are not kings, and plaintiff is not president."

As a former president, Mr Trump enjoyed the right to executive privilege, she added, but the incumbent president "is best situated to protect executive branch interests".

However, it is unlikely the records will be accessible in the near future.

The legal battle is likely to wind up at the Supreme Court.


When a mob stormed the US capitol

A spokesman for Mr Trump, said the case was likely to be appealed.

Taylor Budowich said Mr Trump was committed to defending the right of US presidents to assert executive privilege and "will be seeing this process through".

But Bennie Thompson, the Mississippi Democrat who is chairman of the committee, called the lawsuit "little more than an attempt to delay and obstruct our investigation."

Sixteen of Mr Trump's closest aides have been subpoenaed in the past two days.

They include Kayleigh McEnany, the White House press secretary, Stephen Miller, who was Mr Trump's senior adviser, Bill Stepien, campaign manager, Mark Meadows, former White House chief of staff, and Michael Flynn, former national security adviser.

Bennie Thompson, the Mississippi Democrat who chairs the House committee, said in a statement he wanted to know every detail about what happened on 6 January, and in the days leading up to it.

The committee expects the witnesses to "comply fully", he added.

The panel has already subpoenaed Dan Scavino, former deputy chief of staff, and Steve Bannon, a former Trump strategist.

Mr Bannon refused to comply with the subpoena and was charged with contempt of Congress.

Following the Capitol riot, Mr Trump was impeached by the lower house of Congress, but cleared by the then Republican-dominated upper house, the Senate, of inciting an insurrection.

More than 670 people have been arrested for the invasion of the Capitol complex.

Steve Bannon Indicted For Refusal to Comply With Capitol Attack Subpoena

Donald Trump’s former adviser Steve Bannon has been charged with contempt of Congress after failing to appear before a committee investigating the 6 January attack on the US Capitol.


The justice department said Bannon had been indicted by a federal grand jury on two counts: refusing to appear for a deposition and refusing to provide documents in response to the committee’s subpoena.

The CNN channel reported that an arrest warrant for Bannon had already been signed by a judge, while MSNBC said he was expected to give himself up on Monday and appear in court that afternoon.

The US attorney general, Merrick Garland, said the indictment reflected the justice department’s steadfast commitment to ensuring it adhered to the rule of law, no matter who is accused of a crime.

“Since my first day in office, I have promised justice department employees that together we would show the American people by word and deed that the department adheres to the rule of law, follows the facts and the law and pursues equal justice under the law,” Garland said.

Each count carries between 30 days and a year in jail. The indictment – the first for criminal contempt of Congress in nearly 40 years – will come as a relief to Trump critics who feared that Garland was being overly cautious and moving too slowly.

Bannon, 67, is a former executive chairman of Breitbart News, which he once described as “the platform of the ‘alt-right’”, a movement that embraced racism and antisemitism. He became chairman of Trump’s 2016 election campaign and then his White House chief strategist but lasted less than a year.

Bannon pushed false conspiracy theories about the 2020 election and prophesied on his podcast on 5 January: “All hell is going to break loose tomorrow.” That evening he was part of a gathering of Trump allies at the Willard hotel in Washington that the House of Representatives committee has called the “war room”.

That naturally made him a person of interest but Bannon’s lawyer told the House committee in October that he would not cooperate, citing an assertion of executive privilege by Trump. Legal experts were quick to point out that Bannon was a private citizen at the time of the insurrection so this argument had little merit.

Last month the House voted 229-202 to hold Bannon in contempt. Nine Republicans supported the resolution.

The 6 January committee was created by the House to investigate the attack, in which a pro-Trump mob rampaged through the Capitol in an attempt to disrupt the certification of Joe Biden’s 2020 election victory over Trump.

Some of the committee’s work has been stymied by a lack of cooperation from top Trump administration officials who have refused to comply with subpoenas to testify or turn over documents.

Earlier on Friday, Trump’s former White House chief of staff Mark Meadows failed to appear before the committee. He also faces a criminal referral to the justice department for contempt.

The committee chairman, Bennie Thompson, and vice-chair, Liz Cheney, said in a joint statement: “It’s unfortunate that Mr Meadows has chosen to join a very small group of witnesses who believe they are above the law and are defying a Select Committee subpoena outright.

“The Select Committee has talked with more than 150 individuals who are engaging and cooperating with our probe and providing critical details. And while we’re determined to get all the information we’re seeking, Mr Meadows, Mr Bannon, and others who go down this path won’t prevail in stopping the Select Committee’s effort getting answers for the American people about January 6th.”

Congressman Adam Kinzinger, a Republican on the committee, told CNN he hoped the indictment of Bannon would send a “chilling message” to other subpoena recipients.

“It sends a really important message to future invited witnesses … You cannot ignore Congress,” Kinzinger said.

Joe Lockhart, a former White House press secretary, tweeted: “The only way to make the indictment of Bannon truly meaningful and a strong message to the others defying the law is to remand him prison, no bail available. That will send the message. Hope the Judge has been watching all this.”

Bannon’s attorney did not immediately respond to a message seeking comment.

Capitol Riot: Steve Bannon Defiant After Surrendering to FBI

TRUMP Ally Steve Bannon has lashed out at the Biden administration as he surrendered to the FBI to face charges over his refusal to co-operate with the congressional Capitol riot inquiry.

"This is going to be the misdemeanour from hell," the former strategist said outside the FBI's Washington office.

Mr Bannon, 67, faces up to a year in prison and a $100,000 (£75,000) fine if convicted.

He was formally charged on Friday in the case.

Mr Bannon is accused of defying a summons to testify on what he knew about plans for the protest that ended with Trump supporters storming Congress.

Supporters of former President Donald Trump stormed the Congress building on 6 January as results of the 2020 election were being certified inside.

Mr Trump, a Republican, has refused to acknowledge losing the election to Democratic President Joe Biden last year, making claims - without evidence - of mass voter fraud.

Mr Bannon was indicted on one count of refusing to appear for a deposition and one count of refusing to provide subpoenaed documents to a committee investigating the riot.

Appearing outside court on Monday afternoon, he said he believed the charges were politically motivated and vowed to fight them. "We're tired of playing defence. We're going to go on the offense on this," he said.

As part of restrictions set by the court, Mr Bannon will be required to check in weekly, remain at his listed address and notify authorities of any plans to leave the Washington DC area. He was also required to surrender his passport to authorities.

No plea has yet been entered, and a virtual hearing has been scheduled for Thursday morning.

Mr Bannon also live-streamed his arrival for his first court appearance, telling followers: "I want you guys to stay focused, stay on message."

"Remember: Signal not noise. This is all noise, that's signal."

He also urged his supporters to stay focused on taking on what he described as the "illegitimate Biden regime".

According to subpoena documents, Mr Bannon - who currently hosts the right-wing War Room podcast - said on the eve of the riot that "all hell is going to break loose tomorrow".

His lawyers have argued that his communications involving the former president are protected.

Mr Bannon's is the first such indictment to come out of the House of Representatives Select Committee's inquiry of the 6 January events.

Mr Trump has urged former aides to reject deposition requests, arguing that they are covered by executive privilege - a legal principle that protects many White House communications.

Another Trump official, former White House chief of staff Mark Meadows, could also face consequences for defying a similar subpoena to appear before the committee.

Dozens of subpoenas were issued last week, calling on former Trump officials to hand over documents and testify about the riot.

On Sunday, Mr Trump defended his former aide - whom he fired in 2017, saying: "This country has perhaps never done to anyone what they have done to Steve Bannon".

A US jury has awarded $25m (£19m) in damages against the Organisers of a Deadly Far-Right Rally Group TRUMP Supported in August 2017.

The defendants were found liable in four out of six counts over the bloodshed at the Unite the Right rally in Charlottesville, Virginia.

The civil lawsuit was filed by nine people who suffered physical or emotional injuries in the rally.

A woman was killed and dozens were hurt after an avowed neo-Nazi drove a car into counter-protesters.

In court, the jury awarded $500,000 in punitive damages against 12 defendants, and $1m against five white supremacist organisations. Punitive damages are awarded at a court's discretion to punish a defendant for conduct judged to be especially harmful.

A total of $12m in punitive damages was also imposed against the driver of the car in the fatal incident.

The jury of 11 deliberated for over three days following nearly a month of testimony at the trial in Charlottesville.

The two federal conspiracy charges that jurors could not agree on alleged that the defendants had plotted to commit racially motivated violence.

Roberta Kaplan, an attorney for the plaintiffs, said they plan to refile the lawsuit so a new jury can decide on those two charges.

The legal action alleged that the defendants "brought with them to Charlottesville the imagery of the Holocaust, of slavery, of Jim Crow and of fascism".

"They also brought with them semi-automatic weapons, pistols, mace, rods, armour, shields and torches," the lawsuit said.

The defendants include several prominent figures in America's white nationalist and far-right sphere.

Among those found liable in the case were Jason Kessler, the rally's main organiser, and Richard Spencer, who organised the CAPITOL Riot and came up with the term "alt-right" and spoke at the event.


Another defendant, Christopher Cantwell, became famous as "the crying Nazi" after an emotional YouTube video he posted once the rally went viral.



The lawsuit largely rested on an 1871 law passed after the US Civil War to protect black Americans, following their emancipation from slavery, from the Ku Klux Klan.


It allows private citizens to sue others believed to have committed civil rights violations - with the condition that the plaintiffs must prove that they conspired to do so.

Attorneys for the plaintiffs also collected more than 5.3 terabytes of data to help them make their case, including social media posts and chat exchanges.

The rally began as a protest against the removal of a Confederate statue.

Then-President Donald Trump came under fire after saying afterwards that there were "very fine people on both sides". In the same speech he also said neo-Nazis and white nationalists "should be condemned totally".

A counter-protester, 32-year-old Heather Heyer, was killed when James Alex Fields drove his car into a crowd. He was sentenced to life in prison in June 2019.

The civil case included testimony from survivors of the incident.

"It was a complete terror scene. It was blood everywhere," one of the plaintiffs, Marissa Blair, testified. "I was terrified."

The defendants sought to distance themselves from the violence and maintained that there was no conspiracy. They said none of them knew Fields and so they could not have predicted he would ram a vehicle into a crowd.

"None of these defendants could have foreseen what James Fields did," Mr Kessler's attorney said.

The defendants argued that their racist views were protected by the First Amendment of the US Constitution, which guarantees free speech, and that their rhetoric before the rally was just bluster.

They also said they had acted in self-defence and that the police bore responsibility for failing to keep the two sides from fighting.

Court testimony, however, suggested that some of the organisers could have foreseen the violence.

Former extremist Samantha Froelich, for example, testified that the idea of using vehicles to target counter-protesters was discussed ahead of the event.

Attorneys for the plaintiffs have said they hope the lawsuit acts as a deterrent against further extremist rallies.

Amy Spitalnick, executive director of Integrity First for America, which backed the legal action, told the BBC in October that "a case like this can also have much broader impacts in making clear there will be very real consequences for violence extremism".

Meadows once chaired a panel with oversight of personal communications issues. Now he has an issue of his own—and the Jan. 6 committee and the National Archives have taken note.







The US congressional committee probing the deadly 6 January assault on the Capitol voted on Monday to seek "Contempt of Congress" charges against Mark Meadows, who served as White House chief of staff to former President Donald Trump.

"He is in contempt of Congress," said Republican Liz Cheney, who sits on the U.S. House committee probing the deadly Jan. 6 Capitol riot, referring to former President Donald Trump's then chief of staff Mark Meadows, and his refusal to testify before lawmakers on the attack.
