How Real is The Threat of Prosecutions for TRUMP Post-Presidency?

Legal threats range from investigations into his business dealings in New York to possible obstruction of justice charges – but all come with a political cost

At noon on 20 January, presuming he doesn’t have to be dragged out of the White House as a trespasser, Donald Trump will make one last walk across the South Lawn, take his seat inside Marine One, and be gone.

From that moment, Trump’s rambunctious term as president of the United States will be over. But in one important aspect, the challenge presented by his presidency will have only just begun: the possibility that he will face prosecution for crimes committed before he took office or while in the Oval Office.

“You’ve never had a president before who has invited so much scrutiny,” said Bob Bauer, White House counsel under Barack Obama. “This has been a very eventful presidency that raises hard questions about what happens when Trump leaves office.”

For the past four years Trump has been shielded from legal jeopardy by a justice department memo that rules out criminal prosecution of a sitting president. But the second he boards that presidential helicopter and fades into the horizon, all bets are off.





The Manhattan district attorney, Cyrus Vance, is actively investigating Trump’s business dealings. The focus described in court documents is “extensive and protracted criminal conduct at the Trump Organization” including possible bank fraud.





A second major investigation by the fearsome federal prosecutors of the southern district of New York has already led to the conviction of Trump’s former lawyer Michael Cohen. He pleaded guilty to campaign finance violations relating to the “hush money” paid to Stormy Daniels, the adult film actor who alleged an affair with Trump during the 2016 presidential campaign.

During the course of the prosecution, Cohen implicated a certain “Individual 1” – Trump – as the mastermind behind the felony. Though the investigation was technically closed last year, charges could be revisited once Trump’s effective immunity is lifted.





It all points to a momentous and fiendishly difficult legal challenge, fraught with political danger for the incoming Biden administration. Should Trump be investigated and possibly prosecuted for crimes committed before and during his presidency?

“It looks like the incoming administration will have to confront some form of these issues,” said Bauer, who is co-author of After Trump: Reconstructing the Presidency. “The government is going to have decisions to make about how to respond, given the potential that it becomes a source of division.”

Any attempt to hold Trump criminally liable in a federal prosecution would be a first in US history. No exiting president has ever been pursued in such a way by his successor (Richard Nixon was spared the ordeal by Gerald Ford’s contentious presidential pardon).

Previous presidents have tended to take the view that it is better to look forwards in the name of national healing than backwards at the failings of their predecessor. And for good reasons – any prosecution would probably be long and difficult, act as a huge distraction, and expose the incoming president to accusations that they were acting like a tinpot dictator hounding their political enemy.

That a possible Trump prosecution is being discussed at all is a sign of the exceptional nature of the past four years. Those who argue in favor of legal action accept that there are powerful objections to going after Trump but urge people to think about the alternative – the dangers of inaction.

“If you do nothing you are saying that though the president of the United States is not above the law, in fact he is. And that would set a terrible precedent for the country and send a message to any future president that there is no effective check on their power,” said Andrew Weissmann, who was a lead prosecutor in the Mueller investigation looking into coordination between Russia and Trump’s 2016 campaign.

As head of one of the three main teams answering to the special counsel Robert Mueller, Weissmann had a ringside seat on what he calls Trump’s “lawless White House”. In his new book, Where Law Ends, he argues that the prevailing view of the 45th president is that “following the rules is optional and that breaking them comes at minimal, if not zero, cost”.

Weissmann told the Guardian that there would be a price to be paid if that attitude went unchallenged once Trump leaves office. “One of the things we learnt from this presidency was that our system of checks and balances is not as strong as we thought, and that would be exacerbated by not holding him to account.”

Bauer, who was an adviser to Biden during the presidential campaign but has no role in the transition team, is also worried that a sort of double immunity would be established. Presidents cannot be prosecuted while in office under justice department rules, but under such a double immunity nor could they be prosecuted once leaving the White House in the interests of “national healing”.

“And so the president is immune coming and going, and I think that would be very difficult to square with the idea that he or she is not above the law.”

Biden has made clear his lack of enthusiasm for prosecuting Trump, saying it would be “probably not very good for democracy”. But he has also made clear that he would leave the decision to his appointed attorney general, following the norm of justice department independence that Trump has repeatedly shattered.

Other prominent Democrats have taken a more bullish position, adding pressure on the incoming attorney general to be aggressive. During the Democratic primary debates, Elizabeth Warren called for an independent taskforce to be set up to investigate any Trump corruption or other criminal acts in office.

Kamala Harris also took a stance that may come to haunt the new administration. The vice president-elect, asked by NPR last year whether she would want to see charges brought by the Department of Justice, replied: “I believe that they would have no choice and that they should, yes.”

There are several possible ways in which the justice department could be forced to confront the issue of whether or not to take on Trump. One would be through a revelation as yet unknown, following the emergence of new information.

Weissmann points out that the Biden administration will have access to a wealth of documents that were previously withheld from Congress during the impeachment inquiry, including intelligence agency and state department files. Official communications sent by Jared Kushner and Ivanka Trump through their personal emails and messaging apps – an ironic move given the flak Hillary Clinton endured from the Trump family in 2016 for using her personal email server – may also become available for scrutiny.

But the two most likely avenues for the pursuit of any criminal investigation would relate to Trump’s use of his presidential pardon power and alleged obstruction of justice. “Trump issued a series of pardons largely characterized by political self-interest,” Weissmann said.

Though the presidential pardon power is extensive, it is not, as Trump has claimed, absolute – including the “absolute right” to pardon himself. He is not immune from bribery charges if he were found to have offered somebody a pardon in exchange for their silence in a judicial case.

For Weissmann, the way Trump continually teased his associates – including Roger Stone and Paul Manafort – with the promise of pardons in the middle of federal prosecutions was especially egregious. “There may be a legitimate reason to give somebody a pardon, but what’s the legitimate reason for dangling a pardon other than to thwart that person from cooperating with the government?”

Perhaps the most solid evidence of criminal wrongdoing compiled against Trump concerns obstruction of justice. John Bolton, the former national security adviser, went so far as to say that for Trump, obstruction of justice to further his own political interests was a “way of life”.

In his final report on the Russia investigation, Mueller laid out 10 examples of Trump’s behavior that could be legally construed as obstruction. Though Mueller declined to say whether they met the standard for charges – the US attorney general, Bill Barr, suggested they did not, but gave no explanation for his thinking – he did leave them in plain sight for any future federal prosecutor to revisit.

In one of the starkest of those incidents, Trump tried to scupper the special counsel inquiry itself by ordering his White House counsel, Don McGahn, to fire Mueller. When that became public he compounded the abuse by ordering McGahn to deny the truth in an attempt at cover-up.

Weissmann, who played a key role in gathering the evidence against Trump in the Mueller report, said that such obstruction goes to the heart of why Trump should face prosecution.

“When the president, no matter who it is, obstructs a special counsel investigation there have to be consequences. If you can obstruct an investigation criminally but you don’t have to worry about ever being prosecuted, well then, there’s no point in ever appointing a special counsel.”

Rudy Giuliani guilty? That’s what they want you to think! And who are they? The sinister cabal of Hunter Biden, the Lincoln Project and Department of Injustice, of course.


That would have been the impression of Fox News viewers on Thursday night when Giuliani gave his first TV interview since federal agents seized mobile phones and computers from his New York apartment, part of an investigation into his dodgy Ukrainian dealings.

The host was Tucker Carlson, whose smirking sympathy for the white supremacist “great replacement” theory, and insistence that making kids wear face masks is “child abuse”, have made him the true heir to Donald Trump as the rightwing conspiracy-theory king.

A split screen of Carlson and Giuliani was not for the faint hearted. The former maintained his notorious expression, eyebrows furrowed, mouth open just enough to catch a fly. Giuliani, in suit and tie with white handkerchief in top pocket, was in his office, a bald eagle model and books including his own on display. Wearing a ring on his little finger, he played nervously with his spectacles.

What the former New York mayor turned legal hatchet man for Trump had to say didn’t make much sense, but left viewers with the notion that somehow it was all Hunter’s fault, so in that sense it was a great success. Such was the fixation that at one point Giuliani even said “Hunter” rather than “Tucker” by mistake.

First, Carlson tried to coax Giuliani into a poignant, heart-tugging account of having his home raided at dawn. The ex-mayor, who on 9/11 touched everyone with his lament “the number of casualties will be more than any of us can bear”, is less limpid these days.

“Well, about six o’clock in the morning, there was a big bang! bang! bang! on the door and outside were seven FBI agents with a warrant for electronics,” he recalled. “And I looked at the warrant and I said it was extraordinary because I offered to give these to the government and talk it over with them for two years.

“I don’t know why they have to do this. The agents seemed somewhat apologetic. They were very, very professional and very gentlemanly.”

The FBI agents had taken seven or eight electronic devices, he went on, but had not been interested in hard drives that, Giuliani claims, contain evidence of Hunter’s wrongdoing. He offered them over and over but still they refused. Could it be they don’t spend their days watching Fox or diving down rightwing blog rabbit holes?

Giuliani led an effort to dig up dirt on Joe Biden and his son Hunter in Ukraine before last year’s election. Prosecutors are investigating whether he illegally lobbied the Trump administration on behalf of Ukrainian officials and oligarchs while also serving as Trump’s personal lawyer.

Ingeniously, Carlson and Giuliani cooked up the argument that Hunter’s position on the board of a Ukrainian gas company, and his fight against drug addiction, were equally worthy of a dawn raid. “We have a picture of him five days before, smoking a crack pipe behind the wheel of a car and then saying under oath that he’s not an addict.

“And it’s the left that gets all perturbed about people who are mentally unstable having guns. Well, he was unstable, unfortunately and tragically, I feel sorry for that part of Hunter Biden. I think his father exploited him but the reality is he’s still a danger to the public driving an automobile or holding a gun but they don’t care about that.”

Turning back to his own case, Giuliani said the FBI agents had hammered on his door “in a frightening way” but “I don’t get frightened very easily”. He added: “It is an illegal, unconstitutional warrant, one of many that this Department of Injustice tragically has done.”

And so it went on, deflated campaign slogans for an election that was lost six months ago when Giuliani ended up at Four Seasons Total Landscaping

The search warrant was, he said, “purportedly based on one single failure to file for representing a Ukrainian national or official that I never represented”.

Carlson sneeringly suggested that the Lincoln Project, a group of anti-Trump Republican consultants, had known in advance about the raid but noted that Biden says he did not. Giuliani duly scored more Fox points by mocking the president’s age: “Maybe he doesn’t remember. I’m not sure if he can retain anything for more than about the time it takes to read it.”

And so it went on, deflated campaign slogans for an election that was lost six months ago when Giuliani ended up at Four Seasons Total Landscaping outside Philadelphia. “Thirty years of the Biden crime family violating our laws. That is what’s on the hard drive that they have censored and that’s why they want to put me in jail.”

Giuliani claimed his iCloud account had been snooped upon in the middle of his attempt to defend Trump against impeachment (the first time around, for those who are counting). Cue a rapid escalation to comparisons with the Stasi.

“The prosecutors at the justice department spied on me and that is not taken seriously. If that doesn’t result in their being sanctioned, the case being dismissed and it stopping, this is no longer a free country. We might as well be in East Berlin before the wall fell. This is tactics only known in a dictatorship, where you seize a lawyer’s records right in the middle of his representation of his client.”

After 10 minutes that felt like 10 years, the interview was done, not likely to join the annals of David Frost and Richard Nixon. Even so, it was manna from heaven for a certain viewer at Mar-a-Lago in Florida. For these guys, he’s still the one that counts.

Ex-New York Mayor Rudy Giuliani, who is due to testify this week at court in Atlanta, dismissed the investigation as politically motivated.

Mr Giuliani led legal challenges to dispute the outcome of the election.

He also amplified Mr Trump's baseless claims about alleged voter fraud.




As the former president's election lawyer in December 2020, Mr Giuliani repeatedly made unfounded allegations about stolen ballots as he urged state lawmakers in Georgia not to certify President Joe Biden's election victory.

On Monday, Mr Giuliani's attorney Robert Costello told US media that prosecutors had informed their legal team that the former mayor was under investigation.

But Mr Giuliani will refuse to answer any questions about Mr Trump that might breach attorney-client privilege when he testifies in court on Wednesday, Mr Costello said.

On a radio talk show in New York on Monday, Mr Giuliani said Atlanta was one of "the most crooked cities in the country" and it was a "Democratic dictatorship".

Mr Biden, a Democrat, beat Mr Trump, a Republican, by 12,670 votes in Georgia, according to audited results.

Fulton County, where the investigation is based, launched its criminal inquiry after a recording surfaced from a January 2021 phone call in which Mr Trump was heard urging the state's top election official, Georgia Secretary of State Brad Raffensperger, to "find" enough votes to alter the outcome.

A prosecutor convened a grand jury in May to hear evidence. Fulton County District Attorney Fani Willis has said her investigation could result in racketeering or conspiracy charges.

But just because Mr Giuliani has been asked to testify it does not mean that he or anyone else will be charged with a crime.

Ms Willis has said she is also considering calling Mr Trump to testify before the grand jury.

On Monday, a federal judge rejected efforts by US Senator Lindsey Graham of South Carolina to avoid testifying to the Fulton County grand jury.

The inquiry is also looking into a "fake electors" plan, under which Georgia Republicans allegedly signed phony certificates declaring that Mr Trump had won the 2020 presidential election.

Mr Trump is himself under congressional investigation for his activities surrounding last year's US Capitol riot and his attempts to challenge Mr Biden's election victory.

He is also being investigated under the Espionage Act after federal authorities said they found classified files in a raid last week of his Florida estate, according to a search warrant.

Ms Dunphy, who says she was hired by Mr Giuliani's firm in 2019 when he was working as Mr Trump's personal lawyer, filed the legal case in New York state on Monday.

The lawsuit, which sets out her allegations in graphic detail, says Mr Giuliani began to abuse her almost immediately after being hired and made it clear that satisfying his sexual demands was an "absolute requirement of her employment".


The lawsuit says the former New York City mayor coerced Ms Dunphy into giving him oral sex "against her will" in his flat.

It claims Mr Giuliani "often demanded that she work naked, in a bikini, or in short shorts with an American flag on them that he bought for her" and would visibly touch himself while on video conference calls.

Ms Dunphy's case alleges he would frequently take the erectile dysfunction medication Viagra and expose himself to her.

The lawsuit says Ms Dunphy made recordings of conversations with Mr Giuliani, which included sexual comments and demands for sex, as well as racist, sexist and antisemitic remarks.

Ms Dunphy is also suing for wage theft, claiming Mr Giuliani refused to pay her a promised $1m salary for the role as it would need to be deferred while his divorce was completed.

A spokesperson for Mr Giuliani said he "vehemently and completely denies the allegations", describing the claims as "pure harassment and an attempt at extortion".

"Mayor Giuliani's lifetime of public
'service' ... speaks for itself, and he will pursue all available remedies and counterclaims," said Mr Giuliani's communications adviser, Ted Goodman, as quoted by The Associated Press.

Georgia election officials have debunked Giulianis’ accusations of fraud happening during the ballot counting.






Rudy Giuliani concedes he made defamatory statements to support TRUMP, about Georgia election workers Ruby Freeman and Shaye Moss in an effort to resolve their lawsuit against him and to satisfy a judge who has considered sanctioning him.


The late-night Tuesday filing from Giuliani says he doesn’t contest Moss and Freeman’s accusations that he smeared them after the 2020 election. Yet the filing says he still wants to be able to argue that his statements about voter fraud in Georgia in the 2020 election were protected speech. Notably, he also refuses to concede that his statements caused damages to Moss or Freeman.


The new filing doesn’t immediately resolve the case against Giuliani, which had taken a thorny turn for the former prosecutor and New York City mayor after a judge cautioned him earlier this month that he could lose the lawsuit or face severe sanctions for not gathering his own records in a thorough way and turning them over to Moss and Freeman’s team as they move through the case.

The federal judge, Beryl A. Howell of the DC District Court, is still weighing parts of Giuliani’s filings from Tuesday, which also try to provide explanations for why he didn’t search his records more thoroughly.



On Wednesday, Howell acknowledged Giuliani’s concessions in the lawsuit and ordered him to pay more of Moss and Freeman’s legal fees, after previously ordering him to pay them $90,000.

It’s also not clear how criminal prosecutors from the Justice Department’s special counsel’s office, who have interviewed Giuliani, will perceive the unusual move Giuliani is making in the lawsuit.

Lawyers for Moss and Freeman are set to respond next week in court to many of Giuliani’s latest statements, though their lead attorney on Wednesday morning called Giuliani’s concessions a “major milestone” in the case.

“Giuliani’s stipulation concedes what we have always known to be true—Ruby Freeman and Shaye Moss honorably performed their civic duties in the 2020 presidential election in full compliance with the law; and the allegations of election fraud he and former-President Trump made against them have been false since day one,” their lawyer Michael J. Gottlieb, a partner at Willkie, Farr & Gallagher, said in a statement.



Thorny Legal Approach


Giuliani has scrambled in recent weeks to contain consequences he may face from the case Moss and Freeman are pursuing against him. At the same time, he has tried to handle legal issues that are arising in the lawsuit without damaging himself in the other legal situations that present risks around him.

In addition to federal and state criminal investigations around the 2020 election that have looked at Giuliani and defamation lawsuits, including Moss and Freeman’s, Giuliani is also facing disbarment proceedings in New York state and Washington, DC, for false election fraud allegations he surfaced in court, on Trumps’ behalfwithout verifying them first.

CNN’s senior legal analyst Elie Honig characterized the move by Giuliani on Wednesday as “desperate” and “trying to cut his losses here.”

“He is now making the remarkable concession: ‘Yes, I lied about them,’ which you almost never see – maybe never see – in a defamation case because usually that’s the whole ball game,” Honig said. “But what he’s trying to do here is limit his exposure.”


His phrasing in his court filing makes clear Giuliani is attempting to have his concessions only apply to the lawsuit, in an attempt to avoid consequences from the judge for avoiding turning over documents.

In his court filing, Giuliani specifically said he “does not contest” that assertions he made about the women – whom he accused of being part of a vote-manipulation scheme in Georgia – “were false.”

“Defendant Giuliani concedes solely for the purposes of this litigation … that Defendant Giuliani made the statements of and concerning plaintiffs,” his filing said. “He does not dispute for the purposes of this litigation, that the statements carry meaning that is defamatory per se.”

Hours after making the filing, a political adviser to Giuliani issued a statement further parsing Giuliani’s concessions.

“Mayor Rudy Giuliani did not acknowledge that the statements were false but did not contest it in order to move on to the portion of the case that will permit a motion to dismiss,” Ted Goodman, the Giuliani adviser said.

“This is a legal issue, not a factual issue. Those out to smear the mayor are ignoring the fact that this stipulation is designed to get to the legal issues of the case.”


Election Workers Feared Harassment


In their complaint, Moss and Freeman accused Giuliani of scapegoating them in a fabricated effort to undermine how votes were counted in Georgia in 2020.

His statements about them, which they say are all false, included calling them ballot-stuffing criminal conspirators. Giuliani also drew attention to a video of them after the election, which was first posted by the Trump campaign and showed part of a security tape of ballot counting in Atlanta. Giuliani posted on social media and said on his podcast and other broadcasts that the video showed suitcases filled with ballots, when it did not capture anything but normal ballot processing, according to their lawsuit and a state investigation.


The mother-daughter duo have been candid about how their lives were impacted by Trump and Giuliani’s claims that they were guilty of election fraud.

“There is nowhere I feel safe. Nowhere. Do you know how it feels to have the President of the United States target you?” Freeman said last year in a video testimony to the House select committee that investigated January 6.


Moss’ privacy was destroyed when she learned that Giuliani had accused her mother, Freeman, of passing some kind of USB drive to her like “vials of cocaine or heroin” as part of an elaborate vote-stealing scheme. Trump attacked Moss 18 times, and the former president called Freeman a “professional vote scammer” and a “hustler.”


“I felt horrible, I felt like it was all my fault,” Moss said during her testimony last year. “I just felt like it was, it was my fault for putting my family in this situation.”

She added that she and her mother are now afraid to even go outside, or to the supermarket after getting threats “wishing death upon me, telling me that you know, I’ll be in jail with my mother and saying things like – ‘be glad it’s 2020 and not 1920.’”


During Giuliani’s disinformation campaign about the vote in Georgia, the FBI recommended Freeman leave her home for her own safety, according to the lawsuit.

Rudy Giuliani Is Bleeding Cash Thanks to His Defense of Trump





The lasting effects of his defense of Donald Trumps “Big Lie” has Rudy Giuliani burning through cash. The former New York City mayor is facing hundreds of thousands of dollars in outstanding legal bills, sanctions, and now, new criminal charges in Georgia.


He faces a slew of defamation cases from voting technology company Smartmatic, Dominion Voting Systems, and two Georgia poll workers—who he has yet to pay nearly $90,000 to in sanctions, plus another $44,000 in legal fees. Giuliani is also more than $320,000 behind in payments to document-hosting company Trustpoint.One, which he used to upload electronic records after the FBI seized his cell phones in 2021.

He admitted in a sworn statement from May that “I do not have the funds to pay this amount at this time” and has received some help from Trump’s PAC—$400,000, to be exact. In a Monday court filing, Giuliani revealed he’s effectively out of cash. His lawyers wrote that “producing a detailed financial report is only meant to embarrass Mr. Giuliani and draw attention to his misfortunes.” Earlier this month, Giuliani put his Manhattan apartment up for sale for $6.5 million.

The failure to pay Giuliani and his team came up last week in a private interview between special counsel Jack Smith’s team and Bernard Kerik, a Giuliani associate, according to an attorney for Kerik.

Trump and his allies raised $250 million off false claims that were peddled nationwide by people including Giuliani and Kerik, the House select committee investigating the Jan. 6 Capitol riot said.
That money is now helping Trump pay his own private debts and a small army of lawyers defending him against criminal charges.
