On The Docket: Prosecutors Push The Paper Trial, and Judge Threatens Jail – Again After weeks of testimony, TRUMPs’ trial turned to much drier – but arguably more crucial – details on Monday The Guardian 7 MAY 2024 https://ci3.googleusercontent.com/me...r=1&width=600& After weeks of testimony that focused on some of the more salacious, tabloidy aspects of why former president Donald Trump wanted to keep his alleged affairs under wraps before the 2016 election, his hush-money trial turned to much drier – but arguably more crucial – testimony on Monday. The trial shifted from a focus on how Trump and his allies coordinated to keep quiet the two women who allege they had affairs with him, to a focus on the felonies he has actually been charged with: 34 counts of falsifying business records. That requires following the paper trail of the money Trump paid to his fixer and attorney Michael Cohen. Trump’s former employees – not just at the White House but at his private company – are the ones that can speak to that. The day’s first witness was former Trump Organization controller Jeffrey McConney, who was there under subpoena, with his attorneys paid for by Trump’s company. His testimony helped solidify prosecutors’ claims that Trump was well aware of the allegedly illegal repayment plan to Cohen for paying the adult film star Stormy Daniels for her silence. Allen Weisselberg, the chief financial officer of the Trump Organization, was given the authority to greenlight major company invoices after Trump became president. McConney said that at a meeting, Weisselberg told him: “We have to reimburse Michael.” Referring to contemporaneous notes that he took during that meeting, McConney said Weisselberg told him to pay Cohen $360,000: $130,000 to reimburse the amount he’d paid Daniels, a $50,000 bonus, and an additional $180,000 to cover the taxes. That sum would allegedly be paid out in monthly installments. McConney said he was unaware of any other time in his 35 years with the company when an expense had been doubled because of taxes. McConney said that starting in March 2017, repayments would come from Trump’s personal account, not the trust that held his assets. That month, when Cohen asked him about the status of one of his monthly repayments, he emailed back: “DJT needs to sign check.” He testified that they had to get the physical check to the White House so Trump could sign it himself. Prosecutors displayed ledger reports showing repayments to Cohen, with McConney explaining how each was coded as a “legal expense” and a “retainer,” after testifying that he had never seen a retainer agreement for Cohen. Trump’s attorneys looked to undercut prosecutors’ argument by questioning whether Trump actually knew about those labels. McConney testified he had selected “legal expense” in the accounting system because he had to pick a drop-down category in the system and always selected that for payments to attorneys. He said he rarely talked to Trump, and never discussed the company’s accounting system with Trump. That casts some doubt on whether Trump knew about how the payments were being described, which undercuts the charge that he knowingly falsified business records. Next up on the witness stand was Deborah Tarasoff, an accounts payable supervisor with the Trump Organization. She testified that Trump kept close tabs on what he paid out of his personal checking account, bolstering the prosecution’s case that Trump knew what was going on when he signed Cohen’s reimbursement checks. Tarasoff pointed out that for some time in spring 2017 the payments to Cohen were coming from Trump personally, not from his trust, and confirmed that it was Trump’s own signature on checks from June and July 2017. Prosecutors had spent the first weeks of the trial focused on the lead-up to the 2016 campaign, working hard to show then National Enquirer boss David Pecker’s agreement to be the Trump campaign’s “eyes and ears” and kill stories to help his election prospects, his work to bury Playboy model Karen McDougal’s allegations of an affair, and Cohen’s agreement to pay Daniels directly at Trump’s alleged behest before the 2016 election. That’s necessary because they need to show Trump’s alleged falsification of business records as he repaid Cohen was done to cover up a previous crime to be able to charge Trump with felonies rather than misdemeanors: Under New York law, it’s illegal to “conspire to promote or prevent the election of any person to a public office by unlawful means.” Sidebar: Judge Holds Trump in Contempt, Threatens Jail (Again) https://ci3.googleusercontent.com/me...r=1&width=600& The day kicked off with Judge Juan Merchan once again holding Trump in contempt for violating his gag order – and once again threatening jail time if Trump continues to flout the order. “As much as I do not want to impose a jail sanction,” Merchan told Trump, “I want you to understand that I will, if necessary, and appropriate.” Merchan ruled that Trump had clearly violated Merchan’s gag order to not publicly discuss potential witnesses and the jury on one of the four instances that prosecutors highlighted, and fined him another $1,000 for the violation – the maximum financial penalty allowed under New York law, and the tenth fine Trump has accrued. “It appears that the $1,000 fines are not a deterrent,” Merchan told Trump. Trump made the four public comments and posts before Merchan had ruled on the previous gag-order violations. Merchan ruled on Monday that three of alleged violations were not “beyond a reasonable doubt” because in two instances, Trump was attacking his former fixer and attorney Michael Cohen, who has publicly attacked him. Despite Trump publicly discussing Pecker after his testimony in the case, Merchan said the third example was not definitively a “veiled threat” to witnesses. But Merchan made clear the fourth instance, where Trump had discussed the jury, was out of bounds. Trump had whined in a 22 April interview that he could not get a fair jury because Manhattan was “95% Democrats” and “just a purely Democrat area”. Merchan said that wasn’t acceptable. After trial concluded on Monday, Trump didn’t sound ready to back off, however. “This judge has given me a gag order and said, ‘You’ll go to jail if you violate.’ And frankly, you know what, our constitution is much more important than jail. It’s not even close. I’ll do that sacrifice any day,” he told reporters. What’s Next The trial will resume on Tuesday morning. Trump attorney Todd Blanche argued that the power dynamic Daniels described and the mention of Trump’s bodyguard looming outside did nothing but “inflame the jury”, calling it “extraordinarily prejudicial to insert safety concerns” into a trial about business record falsification. Merchan agreed with the defense that “there are probably some things that would have been [left] better unsaid,” but said that Daniels had been a difficult-to-control witness for the prosecution. She grilled Daniels about how she lost a defamation case against Trump, and why she’d consistently refused a judge’s order to pay a half-million dollars in lawyers’ fees she accrued in that case. Much of this doesn’t go to the core of the case – whether Trump falsified business records when he repaid his fixer and attorney Michael Cohen for paying Daniels $130,000 to sign a non-disclosure agreement right before the 2016 election. Trump was sure to point that out in the hallway after court ended. Numerous witnesses made it clear during testimony just how bullying, aggressive and unlikeable he could be in their interactions with him. But he’s the witness who can tie everything together. And we may start hearing his story when court resumes on Monday. Michael Cohen, the former attorney and fixer for the ex-president, testified that his old boss had directly instructed him to pay off adult film star Stormy Daniels to buy her silence. Cohen then walked the jury through how Trump paid him back, directly addressing the crux of the criminal charges against Trump. Cohen testified that when Daniels’ attorney approached him in early October 2016, less than a month before the presidential election, about a deal to keep Daniels quiet, Trump told him to “just take care of it.” He and Trump tried to avoid paying until after the election, but Cohen finally sent Daniels’ attorney $130,000 just days before the election, when Daniels threatened to go public with the story. Cohen testified that he would never have made that payment without Trump’s explicit approval, “because everything required Mr Trump’s sign-off and on top of that, I wanted the money back”. Cohen also went into specific detail about how he was finally paid back by Trump, with a little extra thrown in to make him happy. He testified he blew his top when he got his annual bonus in late December 2016, after Trump had won election, because it was two-thirds less than what it had been the previous year. He let Trump Organization chief financial officer Allen Weisselberg know, with some “colorful language”, just how “truly pissed off and angry” he was. Trump called Cohen a few days later, and Cohen testified the then president-elect told him not to worry and that everything would get taken care of. Cohen said that at a subsequent meeting shortly before Trump left for Washington DC for the inauguration, Weisselberg took the $130,000 Trump owed Cohen for the hush-money payment and added $50,000 Cohen said he’d paid to cover another expense for Trump, then doubled it to cover the taxes Cohen would have to pay on the amount and added $60,000 as an additional bonus to make Cohen happy. That’s $420,000 total, for those keeping score at home. Cohen said that he and Weisselberg then went into Trump’s office so Weisselberg could tell Trump what Cohen would be paid, and Trump approved it before saying “this is going to be one heck of a ride in DC”. Cohen said he turned down the role of assistant general counsel in the White House, and said he wanted to be personal counsel to the president instead. When asked what expectations he had to be paid for that role, he said “none at all”, explaining that he planned to monetize the title by getting other companies to pay him as a consultant. Cohen also testified that Trump’s concern about the Daniels and McDougal stories getting out was all about the impact on the 2016 election, not about how his wife Melania would react. Trump’s team has sought to make it look like he wanted to keep these stories out of the news because he wanted to keep them from his wife, not as part of an alleged scheme to unlawfully influence the election – the underlying criminal act that makes the charges against Trump felonies. Cohen, Trumps former attorney and fixer, is the only witness testifying in the case who has direct knowledge of the ex-president’s role in allegedly falsifying business records, the crime at the center of the trial. That explains why prosecutors brought him as their final witness and why Trump’s fate may rest on whether jurors find Cohen to be credible. Prosecutors finished questioning Cohen on Tuesday. Trump’s lawyers then got their crack at him in the afternoon, beginning a cross-examination that will continue into Thursday. The case is nearly over. Here are Tuesday’s biggest moments. What Cohen Told Prosecutors: Cohen says Trump discussed repayment of the hush money at a White House meeting. Cohen testified that he met with Trump at the White House on 8 February 2017, before Cohen received his first payment to cover the Daniels money, and said Trump checked in to make sure he was being taken care of financially. “He asked me if I needed money. And I said ‘no, all good’,” Cohen testified. He then said Trump told him to “make sure you deal with Allen.” That’s Allen Weisselberg, the Trump Organization chief financial officer who set up the hush-money repayment plan that Cohen testifies Trump had approved. Prosecutor Susan Hoffinger then showed Cohen an email he sent to a senior Trump Organization official asking for payment for services rendered from the “retainer agreement”. He testified that this was a false description and the real reason for the payment was “reimbursement, to me, of the hush money fee” along with repayment for another service and bonus money. Hoffinger then walked Cohen through each invoice he submitted and each check he received from Trump as payment. Cohen said each invoice made the same false representation. When asked if any were for legal services, he replied “No, ma’am, they were for reimbursement” for paying off Stormy Daniels. He testified that he did less than 10 hours of total legal work for Trump in all of 2017, when he was paid a total of $420,000. Cohen said Trump tried to keep him ‘in the fold’ after the FBI raided Cohen’s home. Cohens home and office were raided by the FBI in April 2018. Frightened, he called his boss. Cohen said Trump told him: “Don’t worry, I’m the president of the United States. There’s nothing here, everything is going to be OK. Stay tough. You’re going to be OK.” Cohen said that reassured him and kept him “in the fold, in the Trump camp”. Cohen said Trumps inner circle told him to consider Robert Costello for his attorney. Costello told Cohen that he was “as close as you can imagine” to Trump attorney and former New York City mayor Rudy Giuliani. Prosecutors then presented an email from Costello to Cohen that said Giuliani thanked Cohen for “opening this back channel” and “asked me to tell you that he knows how tough this is on you and your family and he will make [sure] to tell the president”. Later that day, Costello emailed: “I spoke with Rudy. Very, very positive. You are ‘loved’.” When Cohen pleaded guilty, Trump turned swiftly on him. In August 2018, Cohen pleaded guilty to a number of crimes, including an excessive campaign contribution that he testified was the hush-money payment to Daniels. He said he finally decided to put his family over loyalty to his boss. “I would not lie for President Trump anymore,” he said. I don’t mean we’re not getting the facts about what’s happening in Manhattan superior court. But something very big is being left out. The trial has introduced us to a world of moral and ethical loathsomeness in which people use and abuse one another routinely. It’s Trump world. Consider Stormy Daniels. Adult film stars are entitled to do as they wish to make money. But when they extort people who are running for public office – demanding huge payments in order to stay quiet about an affair – they’re contributing to a society in which every interaction has a potential price. Last week we heard Daniels’s story, even more detailed and lascivious than expected. But perhaps the most troubling aspect of her behavior is that the moment the former president ran for office, she saw a chance to extort money from him. She then “shopped” her account of their sexual liaison before finally accepting $130,000 to be silenced in the 2016 election’s final, critical days. Or consider Michael Cohen. Powerful people often need “fixers” – assistants that carry out their wishes and protect them from legal or political trouble. But when those fixers arrange payments to keep stories out of the media, they’re treading on morally thin ice. Cohen didn’t just fix. He boasted of burying Trump’s secrets and spreading Trump’s lies. In his work for Trump, he repeatedly acted illegally and found ways to cover up his actions. After he paid Daniels to keep silent and Trump was elected president, Cohen concocted with Trump a means of being reimbursed that involved falsifying records that disguised the repayment as ordinary legal expenses, according to his testimony. And then there’s David Pecker, publisher of the National Enquirer. Tabloids are part of a long tradition of US journalism. But when tabloid publishers buy stories to bury them on behalf of powerful people, thereby establishing a kind of bankable account of chits that can be cashed in with the powerful, it violates public morality because it corrupts our democracy. Two weeks ago, Pecker testified about “catching and killing” stories – buying the exclusive rights to stories, or “catching them”, for the specific goal of ensuring the information never becomes public. That’s the “killing” part. According to people who have worked for him, Pecker mastered this technique – ethics be damned. Which brings us to Trump himself. I don’t care that he had extramarital affairs. But when a presidential candidate tells his fixer to buy off someone – “just take care of it” – so the public doesn’t get information about a candidate before an election that they might find relevant to evaluating him, it undermines democracy. This cast of characters – and there are many, many others like them in Trump world – are loathsome not only because they may have violated the law, but because they have contributed to a harsh society in which everyone is potentially bought or sold. The people who inhabit Trumpworld live in a more extreme place, where there are no norms, no standards of decency It’s a sell-or-tell society, a catch-and-kill society, a just-take-care-of-it society. A society where money and power are the only considerations. Where honor and integrity count for nothing. I am not naive about how the world works. I’ve spent years in Washington, many of them around powerful people. I have seen the seamy side of US politics and business. I sometimes worry that the daily dismal drone of Trump world – the continuous lies and vindictiveness that issue from Trump and his campaign, the dismissive and derogatory ways he deals with and talks about others, the people who testify at his criminal trial about what they have done for him and what he has done for or to them – has a subtly corrosive effect on our own world.
