NANTUCKET, Mass., Jan 7 (Reuters) - Former "House of Cards" star Kevin Spacey on Monday pleaded not guilty to sexually assaulting an 18-year-old man at a bar in Nantucket more than two years ago, while a judge ordered the man to preserve his mobile phone data from the time.

Dressed in a gray suit and tie, Spacey did not speak during a brief hearing Nantucket District Court to face one count of felony indecent assault and battery, though a plea of not guilty was entered on his behalf by the court.

Spacey's lawyer Alan Jackson persuaded Judge Thomas Barrett to order Spacey's alleged victim to keep all data from his cell phone for six months following the July 7, 2016, incident. Jackson said the data was "likely exculpatory."

Jackson said in court papers that police reports showed the 18-year-old busboy exchanged numerous text messages and Snapchat videos with his then-girlfriend about his interactions with Spacey at the Club Car bar on the beach resort island off the coast of Massachusetts but never mentioned the alleged sexual assault.

Spacey could face up to five years in prison if convicted.

His appearance in a crowded courthouse surrounded by television trucks came at what is normally a quiet time of year the island, a former whaling hub.

The 59-year-old actor is one of dozens of men in entertainment, business and politics who have been accused of sexual misconduct since accusations against movie producer Harvey Weinstein in 2017 sparked the #MeToo movement.

Spacey became embroiled in controversy in October 2017 when actor Anthony Rapp accused him of trying to seduce him in 1986 when Rapp was 14.

Spacey apologized for inappropriate conduct with Rapp. The controversy led to Spacey being dropped from the Netflix television series "House of Cards" and erased from the film "All the Money in the World."

The Nantucket allegations were first raised in 2017 by former Boston television journalist Heather Unruh, who told reporters Spacey groped her teenage son.

The victim told police Spacey had bought him several rounds of beer and whiskey and said at one point, "Let's get drunk," according to charging documents.

As they stood next to a piano, Spacey groped Unruh's son, the bus boy told investigators.

Reuters is not identifying Unruh's son because he is an alleged victim of sex assault.

"My client is a determined and encouraging voice for those victims not yet ready to report being sexually assaulted," attorney Mitchell Garabedian said in an email.

Kevin Spacey and his production companies must pay the studio behind House of Cards more than $30m because of losses brought on by his firing for alleged sexual misconduct, according to an arbitration decision made final on Monday.

A document filed in Los Angeles superior court requesting a judge’s approval of the ruling says that the arbitrators found that Spacey violated his contract’s demands for professional behaviour by engaging in “certain conduct in connection with several crew members in each of the five seasons that he starred in and executive produced House of Cards”.

MRC, the studio behind House of Cards, had to fire Spacey, halt production of the show’s sixth season, rewrite it to remove Spacey’s central character, and shorten it from 13 to eight episodes to meet deadlines, resulting in tens of millions in losses, the document claimed.

“The safety of our employees, sets and work environments is of paramount importance to MRC and why we set out to push for accountability,“ MRC said in a statement on Monday.

A representative for Spacey did not immediately respond to an email seeking comment. His attorneys argued that the actor’s actions were not a substantial factor in the show’s losses.

The ruling came after a legal fight lasting more than three years, and an eight-day evidentiary hearing that was kept secret, along with the rest of the dispute.

Spacey appealed against the decision to a panel of three more private arbitrators, who found for the plaintiffs, making the decision final, and public, on Monday.

“MRC stood its ground, pursued this case doggedly, and obtained the right result in the end,” plaintiff’s attorney Michael Kump said in a statement.

The 62-year-old Oscar winner’s career came to an abrupt halt late in 2017 as the #MeToo movement gained momentum.

Actor Anthony Rapp, who has appeared in Rent on Broadway and film as well as in Star Trek: Discovery on television, alleged that Spacey made an unwanted sexual advance on him when he was 14 at a party in the 1980s.

At the time, Spacey issued a statement saying he didn’t remember the encounter but apologised.

Several other accusers followed. Some, including Rapp, have filed lawsuits.

Independent investigations found widespread sexual harassment of those who worked under him.

Spacey was fired or removed from several projects, most notably House of Cards, the Netflix political thriller where for five seasons he played lead character Frank Underwood, a power-hungry congressman who becomes president.

The one criminal case brought against him, an indecent assault and battery charge stemming from the alleged groping of an 18-year-old man at a Nantucket resort, was dismissed by Massachusetts prosecutors in 2019.

British authorities are pursuing the return of Kevin Spacey from the US to face sexual assault charges.

An official familiar with the process told the Guardian the UK would seek the actor’s formal extradition unless he decided to come back voluntarily.

The international criminality directorate, a special Home Office unit, will act on behalf of police and prosecutors. Experts in extradition say US police may soon be sent to find Spacey, 62, and detain him on behalf of British authorities.

The Crown Prosecution Service (CPS) announced on Thursday that it had authorised four charges of sexual assault against Spacey relating to alleged attacks against three males between 2005 and 2013, after an investigation by the Metropolitan police.

Pursuing formal extradition could take many months. Nick Vamos, a former head of extradition at the CPS, said US Department of Justice officials would study papers sent from the UK. They would have to be satisfied there was “probable cause” the offences may have been committed. If so, police officers would be instructed to locate and detain Spacey.

“They will be under an obligation to arrest him,” Vamos said. “The US Department of Justice will task US marshals to find Mr Spacey and take him to a federal court. He always had the option of surrendering and not contesting extradition.”

Vamos, now in private practice, said Spacey could be extradited in weeks if he does not contest extradition and months if he does. He said the US system made it harder to resist an extradition request than in Britain.

He also said Spacey would have greater protections if he were formally extradited than if he simply flew back to the UK voluntarily. Only the charges agreed by a US court could be brought against him in Britain, for example.

Spacey’s return would not necessarily mean he had to stay here for the months or years the case might take to get to court, Vamos said. He could be granted permission to return to the US to work as long as a British court believed promises given that he would return to face trial.

“If he comes back to the UK he could get a bail package that allows him to return to the US,” Vamos said.

Spacey cannot be formally be charged until he returns to Britain, but British police have said the charges relate to alleged attacks against three males in London and Gloucestershire.

Two are alleged to involve a man now aged in his 40s in March 2005, and another a man who is now in his 30s in August 2008. Spacey is also alleged to have caused the latter to engage in penetrative sexual activity without consent. These alleged attacks all took place in London. The actor is also alleged to have sexually assaulted a male now in his 30s in Gloucestershire in April 2013.

Spacey was artistic director of the Old Vic theatre in London from 2004 to 2015, following acclaim and awards for an acting career during which he was hailed as one of the most skilled actors of his generation.

He won a best supporting actor for his role as Roger “Verbal” Kint in the Usual Suspects in 1996, and four years later won best actor for his lead role in American Beauty. He also starred in acclaimed films such as LA Confidential and went on the make the political drama House of Cards for Netflix.

Spacey has denied all allegations of wrongdoing.

A lawyer has told jurors Kevin Spacey was trying to satisfy sexual urges when he jumped on top of a then-14-year-old actor on a bed at a party in 1986, but a lawyer for the House Of Cards star said it never happened.

The House of Cards actor has denied the allegations against him.

Both Mr Rapp, now 51 and also an actor, and Mr Spacey were in the Manhattan federal courthouse when the trial opened with jury selection on Thursday.

Mr Rapp says that Mr Spacey was around 26 or 27 years old when he met him at a party at his Manhattan apartment.

In a Buzzfeed article from October 2017, Mr Rapp said that Mr Spacey had picked him up, placed him on a bed and lay down partially on top of him.

"I was aware that he was trying to get with me sexually," Mr Rapp said.

His lawsuit says the alleged encounter lasted no more than two minutes and "there was no kissing, no undressing, no reaching under clothes, and no sexualized statements or innuendo".

The legal action was filed in September 2020 and accuses Mr Spacey - whose real name is Kevin Spacey Fowler - of battery and intentional infliction of emotional distress.

The judge assigned to the case, Lewis A Kaplan, previously dismissed a charge of sexual assault, ruling the statute of limitations had expired.

One day after the Buzzfeed article was posted five years ago, Mr Spacey took to social media to say he had no memory of what Mr Rapp described.

"If I did behave then as he describes, I owe him the sincerest apology for what would have been deeply inappropriate drunken behavior," he wrote.

"And I am sorry for the feelings he describes having carried with him all these years."

In a video deposition he filmed with lawyers in January, Mr Spacey denied that the incident ever took place, according to news website Law & Crime.

Mr Rapp's account "couldn't have been true", he said, because "I am not interested in boys and I do not touch people inappropriately".

Mr Rapp stars in Star Trek: Discovery on Paramount+ and was previously in the Broadway musical Rent.

Separate sex assault charges - alleging that Mr Spacey groped an 18-year-old at a restaurant in Nantucket, Massachusetts, in 2016 - collapsed in 2019 after the actor's lawyers argued the accuser had manipulated text messages on his phone.

In August, a judge ruled that Spacey must pay $31m to the producers of House of Cards for the costs they incurred after firing him from the show.

In July, he entered a not guilty plea in London to criminal charges of sexually assaulting three men over a decade ago. That trial is due to begin in June 2023.

Deliberations lasted for more than an hour and, after the verdict was read out by the judge, Mr Spacey reportedly hugged his lawyers before leaving the courtroom.

In May last year, the Crown Prosecution Service authorised four counts of sexual assault and one count of causing a person to engage in penetrative sexual activity without consent against Spacey. The charges related to alleged offences against three men – now in their 30s and 40s – in England between 2005 and 2013. Spacey pleaded not guilty to the charges at the Old Bailey in July.

In November, Spacey was charged with seven additional offences – three of indecent assault, three of sexual assault and one count of causing a person to engage in sexual activity without consent – against a fourth man between 2001 and 2005. He pleaded not guilty to the charges at a hearing in January.

Spacey has said an acquittal in the case could revive a career that has largely been on ice since sexual misconduct allegations surfaced against the star who won his first Academy Award for supporting actor in “The Usual Suspects” in 1995. “There are people right now who are ready to hire me the moment I am cleared of these charges in London," Spacey said in a rare interview published this month in Germany’s Zeit magazine. He said the media had turned him into a “monster.”

The charges involving men now in their 30s or 40s date from 2001 to 2013 — covering most of the decade when he lived in Britain and served as artistic director of the Old Vic Theatre until 2015. The jury trial in Southwark Crown Court is scheduled to last four weeks. The actor — charged under his full name, Kevin Spacey Fowler — is free on bail.

Spacey's downfall came amid the #MeToo movement in the United States when allegations led to him being written off the Netflix political thriller “House of Cards," where he played lead character Frank Underwood, a ruthless and corrupt congressman who becomes president. He was cut from the completed film “All the Money in the World,” and the scenes reshot with Christopher Plummer.

Sir Elton appeared by video link from Monaco. He answered questions around whether Mr Spacey had ever attended the White Tie and Tiara Ball that the musician held every year at his home.

The singer said Mr Spacey attended in 2001. One of the actor's accusers had given evidence to say a sexual assault happened on route to the ball in 2002, which Spacey denies attending.

Speaking about the ball in 2001, Sir Elton said: "Yes, he came in white tie, and he came straight from a private jet. Yes, I don't think he'd wear white tie otherwise."

Sir Elton said Mr Spacey stayed overnight at his home in Windsor after the event, but could not remember him visiting the property after that.

Sir Elton's husband, David Furnish, also gave evidence and said he remembered Mr Spacey attending the event in question, adding "as an Oscar-winning actor, there was a lot of excitement he was at the ball".

Mr Spacey denies three counts of indecent assault, three counts of sexual assault and one count of causing a person to engage in sexual activity without consent.

He also denies four further charges of sexual assault and one count of causing a person to engage in penetrative sexual activity without consent.

The Hollywood star won an Oscar for Best Actor in 2000 for American Beauty as well as Emmy nominations for his role in House of Cards.

MRC, the studio behind House of Cards, had to fire Spacey, halt production of the show’s sixth season, rewrite it to remove Spacey’s central character, and shorten it from 13 to eight episodes to meet deadlines, resulting in tens of millions in losses, the document claimed. “The safety of our employees, sets and work environments is of paramount importance to MRC and why we set out to push for accountability,“ MRC said in a statement on Monday. A representative for Spacey did not immediately respond to an email seeking comment. His attorneys argued that the actor’s actions were not a substantial factor in the show’s losses. The ruling came after a legal fight lasting more than three years, and an eight-day evidentiary hearing that was kept secret, along with the rest of the dispute. An official familiar with the process told the Guardian the UK would seek the actor’s formal extradition unless he decided to come back voluntarily. The international criminality directorate, a special Home Office unit, will act on behalf of police and prosecutors. Experts in extradition say US police may soon be sent to find Spacey, 62, and detain him on behalf of British authorities. The Crown Prosecution Service (CPS) announced on Thursday that it had authorised four charges of sexual assault against Spacey relating to alleged attacks against three males between 2005 and 2013, after an investigation by the Metropolitan police. Pursuing formal extradition could take many months. Nick Vamos, a former head of extradition at the CPS, said US Department of Justice officials would study papers sent from the UK. They would have to be satisfied there was “probable cause” the offences may have been committed. If so, police officers would be instructed to locate and detain Spacey. “They will be under an obligation to arrest him,” Vamos said. “The US Department of Justice will task US marshals to find Mr Spacey and take him to a federal court. He always had the option of surrendering and not contesting extradition.” Vamos, now in private practice, said Spacey could be extradited in weeks if he does not contest extradition and months if he does. He said the US system made it harder to resist an extradition request than in Britain. He also said Spacey would have greater protections if he were formally extradited than if he simply flew back to the UK voluntarily. Only the charges agreed by a US court could be brought against him in Britain, for example. Spacey’s return would not necessarily mean he had to stay here for the months or years the case might take to get to court, Vamos said. He could be granted permission to return to the US to work as long as a British court believed promises given that he would return to face trial. “If he comes back to the UK he could get a bail package that allows him to return to the US,” Vamos said. Spacey cannot be formally be charged until he returns to Britain, but British police have said the charges relate to alleged attacks against three males in London and Gloucestershire. Two are alleged to involve a man now aged in his 40s in March 2005, and another a man who is now in his 30s in August 2008. Spacey is also alleged to have caused the latter to engage in penetrative sexual activity without consent. These alleged attacks all took place in London. The actor is also alleged to have sexually assaulted a male now in his 30s in Gloucestershire in April 2013. Spacey was artistic director of the Old Vic theatre in London from 2004 to 2015, following acclaim and awards for an acting career during which he was hailed as one of the most skilled actors of his generation. He won a best supporting actor for his role as Roger “Verbal” Kint in the Usual Suspects in 1996, and four years later won best actor for his lead role in American Beauty.
