Alec Baldwin Fatally Shoots Woman With Prop Gun on Movie Set

A woman has died and after actor Alec Baldwin fired a prop gun on a New Mexico film set for the 19th Century western Rust.

The 48-year-old director Joel Souza, was also shot

Halyna Hutchins, 42, was shot while working on the set as director of photography. She was flown to hospital by helicopter but died of her injuries.

The man, 48-year-old director Joel Souza, was taken from the scene at Bonanza Creek Ranch by ambulance.

Police said they were investigating and that no charges had been filed.

A spokesperson for Mr Baldwin, best known for his role as Jack Donaghy on the NBC sitcom 30 Rock and for his portrayal of Donald Trump on sketch show Saturday Night Live, told AP news agency the incident involved the misfiring of a prop gun with blanks.

In a statement to AFP news agency, a Santa Fe sheriff spokesman said Mr Baldwin had spoken to detectives.

"He came in voluntarily and he left the building after he finished his interviews," the spokesman said.

Mr Baldwin is a co-producer of the film and plays its namesake, an outlaw whose 13-year-old grandson is convicted of manslaughter.

The eldest of four brothers, all actors, Mr Baldwin has starred in numerous TV and film roles since the 1980s.

Ms Hutchins was fatally shot while on set at Bonanza Creek Ranch, a popular filming location in northern New Mexico

Ms Hutchins was from Ukraine and grew up on a Soviet military base in the Arctic Circle, according to her personal website. She studied journalism in Kyiv, and film in Los Angeles, and was named a "rising star" by the American Cinematographer magazine in 2019.

She was the director of photography for the 2020 action film Archenemy, directed by Adam Egypt Mortimer.

"I'm so sad about losing Halyna. And so infuriated that this could happen on a set," Mr Mortimer said in a tweet.

In a statement, the International Cinematographer's Guild said Ms Hutchins' death was "devastating news" and "a terrible loss".

"The details are unclear at this moment, but we are working to learn more, and we support a full investigation into this tragic event," said guild president John Lindley and executive director Rebecca Rhine.


Police said sheriff's deputies were dispatched to Bonanza Creek Ranch, a popular filming location, at around 13:50 local time (19:50 GMT) after receiving an emergency call about a shooting on the set of Rust.

Incidents such as Thursday's fatal shooting on the Rust film set are extremely rare, but not unheard of.

Real firearms are often used in filming, and are loaded with blanks - cartridges that create a flash and a bang without discharging a projectile.
In 1993, Brandon Lee - the 28-year-old son of the late martial-arts star Bruce Lee - died on set after being accidentally shot with a prop gun while filming a death scene for the film The Crow.


It was later determined that the gun used had earlier fired a round that caused a cartridge to become lodged in the barrel. When blank rounds were later fired, the cartridge was dislodged and released.

Responding to Thursday's news, Brandon Lee's sister Shannon tweeted: "Our hearts go out to the family of Halyna Hutchins and to Joel Souza and all involved in the incident on 'Rust'. No-one should ever be killed by a gun on a film set. Period."


Aerial footage shows the scene where actor and producer Alec Baldwin misfired blanks from a prop gun that fatally wounded a cinematographer. The incident happened on Thursday on the set of his new Western film, Rust.

Cinematographer Halyna Hutchins was airlifted to hospital outside of Santa Fe, New Mexico where the movie is filming but later died.

Director Joel Souza remains in intensive care.

Alec Baldwin has described how his “heart is broken” after he accidentally shot dead a female cinematographer with a prop gun on the set of his new film.

A distraught Baldwin said in a statement on Friday that there are “no words to convey his sadness” over the death of colleague Halyna Hutchins while they were filming Rust.

Moving photographs taken in the hours after the incident showed Baldwin, a father-of-seven, bent double and seemingly distraught outside the local sheriff’s office.

The actor said he was doing all he could to support the family of the 42-year-old mother-of-one, who was killed in the tragic accident near Santa Fe, New Mexico on Thursday afternoon.

Baldwin, 63, paid tribute to "a wife, mother and deeply admired colleague of ours". He added: “My heart is broken for her husband, their son, and all who knew and loved Halyna.”

A shocked Hollywood is mourning the loss of the admired cinematographer whose ambitions took her from her native Ukraine to working with the biggest stars of Los Angeles.

However, many in the film industry were already demanding answers as to how the accident was allowed to happen during what is supposed to be a highly controlled film set.

It is believed Baldwin fired a single live round from a prop gun that somehow struck both Ms Hutchins and the movie's director, 48-year-old Joel Souza, who was lightly wounded.


Baldwin is reported to have repeatedly asked why he had been given what is known as a “hot gun”.


The Departed star said he was fully cooperating with police to investigate “how this tragedy occurred”. He gave a tearful interview to officers in Santa Fe, but no charges have been filed. A Santa Fe County Sheriff’s spokesman said a search warrant had been issued for the ranch, and searches would be carried out over the weekend.

One witness told Hollywood gossip site Showbiz 411 that the actor, known for his roles in TV show 30 Rock and his impression of former President Donald Trump on Saturday Night Live, immediately began asking why he was handed a hot gun - which typically means a gun loaded with real ammunition.

“In all my years, I’ve never been handed a hot gun,” the actor allegedly kept saying.



In a 911 emergency call, published by the website TMZ and yet to be independently verified, a woman who identified herself as a script supervisor said: "We have two people accidentally shot on a movie set by a prop gun. We need help immediately. We need some help. Our director and a camerawoman have been shot."

The dispatcher asked if the gun was loaded with a real bullet. The script supervisor said: "I cannot tell you that. We have two injuries from a movie gun. Shot. I was sitting, we were rehearsing, and it went off and I ran out. We all ran out. They were doubled over...the camerawoman and the director."

A man who took over on the call from the script supervisor said, at that stage, the two people shot were still "alert" and each had one wound.

Showbiz 411 has an eyewitness claiming that one "bullet" went straight through Ms Hutchins before hitting Mr Souza's clavicle. Prop masters union IATSE 44 told members on Thursday night in an email that a “single live round” was fired.

Friends and colleagues of Ms Hutchins wanted to know how the accident was allowed to happen.

“I just cannot believe what I just read. How is this even possible?!?!” Vera Sawalha, a make-up artist who has worked with Ms Hutchins, said. “Halyna Hutchins was one of the most talented women I’ve ever had the honor of working with. So many before her have died in this very careless and preventable way. I am in shock.”

White House press secretary Jen Psaki said: "Obviously, it is a tragedy and loss of life. Our thoughts and prayers go out to their families."

In a statement to the Deadline website Rust Movie Productions LLC said it was conducting an internal review.

It said: "The safety of our cast and crew is the top priority of Rust Productions and everyone associated with the company.

"Though we were not made aware of any official complaints concerning weapon or prop safety on set, we will be conducting an internal review of our procedures while production is shut down."

The statement added: "We will continue to cooperate with the Santa Fe authorities in their investigation and offer mental health services to the cast and crew during this tragic time."

Ms Hutchins’ death, which comes in the wake of discussions about crew safety, also prompted tweets from the industry about the need to ensure safe working practices on set.

IA Stories, an Instagram account that posts anonymous stories of crew mistreatment and endangerment, wrote: “A full investigation into the incident absolutely needs to be done. All crew should be safe doing our jobs.”

Gun safety protocol on sets in the US has dramatically improved since an on-set accident in 1993 which left Brandon Lee, son of the late martial-arts star Bruce Lee, dead after he was hit by a bullet left in a prop gun.

However, experts say one of the riskiest positions to be in is operating the camera - noting that the person would be in the line of fire in gripping scenes where someone appears to point a gun at the audience.






Richard Howell, of prop providers Foxtrot Production Ltd, who has personally overseen firearm scenes with Sir Ben Kingsley, told the Telegraph:


“It is absolutely beyond me, I can't think how that would actually happen.

“Armourers (in charge of the firearms used in a theatre production) should have nothing other than blank rounds. You read the script, the armourers understands the scene, the actor does, it will be rehearsed.”

James Cullen Bressack, a Hollywood writer and director, tweeted after the incident: "I will never use anything but airsoft and rubber guns on my movies ever again."

Production has been halted on the film, which chronicles the life of a 13-year-old boy left to fend for himself and his younger brother following the death of their parents in 1880s Kansas.

Rust Movie Productions halted work on the film indefinitely. The company said: “The entire cast and crew has been absolutely devastated by today’s tragedy and we send our deepest condolences to Halyna’s family and loved ones. We will be providing counselling services to everyone connected to the film as we work to process this awful event.”





NB; This is the second FATAL shooting on a set recently. Baldwin must take some responsibility...

NEVER EVER would I point, NOR fire a gun handed to me by anyone w.o. testing it first.
I feel sure many of our LEGALLY armed members would do the same

Armourer Hannah Gutierrez Reed, who has been identified on the set's call sheet, set three prop guns on a cart outside the filming location, and assistant director Dave Halls grabbed the revolver from the cart and brought it inside to Baldwin, mistakenly believing it was unloaded, a search warrant revealed.


Halls stated that the gun was 'cold, meaning that it was safe to fire for the scene, before handing it to Baldwin.

Seconds later, Baldwin aimed towards the camera and pulled the trigger, killing Hutchins who was filming him and injuring director Joel Souza, who was standing behind her.

Halls is a seasoned assistant director, having amassed production credits on a number of films involving prop guns, including Fargo, The Matrix Reloaded, and the TV cop series Reno 911.

In 2000, Halls was the second unit's first assistant director on the show The Crow: Salvation, the sequel to the film in which Bruce Lee's son Brandon Lee was killed in an on-set firearms mishap in 1993.

Neither Halls nor Gutierrez Reed have been charged or named as criminal suspects in the case, though a police investigation is ongoing.

Baldwin, who is the star and producer of the film, has also been questioned by police, and stated that he was "fully co-operating" with the Santa Fe County Sheriff's Office.

Baldwin took to Twitter to share his devastation over the incident.

Hours Before Fatal Shooting on Alec Baldwin’s ‘Rust,’ a Half-Dozen Crew Members Quit to Protest Work Conditions

Some crew members walked off the set of Alec Baldwin's movie Rust over safety concerns hours before a crew member was shot \dead.

Cinematographer Halyna Hutchins was killed and director Joel Souza injured in the incident.

Court records show an assistant director unwittingly handed Baldwin a loaded weapon and told him it was safe to use.

Hours before a shot on the set of the Alec Baldwin film “Rust” killed cinematographer Halyna Hutchins, a half-dozen camera crew workers walked off set to protest conditions on the film after days of strife over long hours, safety issues and staff housing.

In a series of scathing comments on Facebook, crew member Lane Luper described the working conditions on “Rust” as “absolute dog s—.”

“At the moment I’m fighting to get my crew, on this movie, hotel rooms when we go long or are too tired to drive the hour back from location to Albuquerque,” camera operator Lane Luper wrote. “They either say no or offer a garbage roadside motel that’s used as a homeless shelter. In fact the line producer on the flick complained the motel she booked charges her 10 bucks more per night than the homeless. They haven’t even paid the crew a proper check.”

Luper, a union member, was speaking on a thread in which Baldwin posted a video about a new IATSE contract.

According to a report in the Los Angeles Times, a half-dozen crew members walked off the set on Friday over working conditions. The report cited three individuals who said that several non-union crew members were brought in to replace them. Among the complaints were accusations that the crew was required to commute from far away rather than have a hotel paid for close by in Santa Fe and that crew members had not been paid.

The Times says that Hutchins was also among those to have raised concerns about safety conditions for her team. Prior to the accident that killed Hutchins however, an individual who spoke with the Times also said that there were two misfires on the prop gun on Saturday and one the previous week, and that one person told the Times there were a “serious lack of safety meetings on set.”

The shooting that killed Hutchins ultimately occurred about six hours after the union camera crew left, according to the Times.

“The safety of our cast and crew is the top priority of Rust Productions and everyone associated with the company,” a representative for Rust Productions told TheWrap in response to the article. “Though we were not made aware of any official complaints concerning weapon or prop safety on set, we will be conducting an internal review of our procedures while production is shut down. We will continue to cooperate with the Santa Fe authorities in their investigation and offer mental health services to the cast and crew during this tragic time.”

IATSE’s national branch had no additional comment beyond their earlier statement mourning the loss of Hutchins.

A tweet that contained a screengrab of a text message from an industry insider but was later deleted was also making the rounds of the web on Friday. It mentioned a lack of payment for three weeks, a lack of COVID safety and a lack of gun safety and that the entire camera crew had walked off the set for the lack of safety. Luper further complained about long hours on the set: “The show keeps arguing they don’t have to do anything because contract minimums don’t force them to,” he wrote. “In fact in the low budget agreement a hotel doesn’t need to be provided until 14 WORKED hours. And this shows doing hour lunches. So it requires a 15 hour elapsed day before they will volunteer a hotel. My BA tried to get them to agree to 13 hours elapsed and they agreed to 13 hours worked. So here’s where my crews at with this show and the unions involvement. 12.5 hour days worked, with an hour lunch, 2 hours of driving a day leaving exactly 8 hours of time not at work. Most folks on my show are getting 5 hours of sleep a night.”

According to law enforcement statements, Hutchins was shot around 1:50 p.m. Thursday local time and died of her injuries after she was airlifted to University of New Mexico Hospital in Albuquerque. The shot also injured director Joel Souza, who was released from the hospital on Friday.

Production began earlier this month at Bonanza Creek Movie Ranch, just south of Santa Fe, and production on the film is now suspended.

The investigation into the deadly incident is ongoing, the sheriff’s department said; no charges have been filed.

“According to investigators, it appears that the scene being filmed involved the use of a prop firearm when it was discharged,” the Santa Fe sheriff’s office said in a statement to media earlier on Thursday. “Detectives are investigating how and what type of projectile was discharged.”

Baldwin earlier on Friday said he’s cooperating with law enforcement and said his “heart was broken” over the loss of Hutchins.

“There are no words to convey my shock and sadness regarding the tragic accident that took the life of Halyna Hutchins, a wife, mother and deeply admired colleague of ours,” Baldwin said in a statement provided to TheWrap and in a pair of tweets Friday.


“I’m fully cooperating with the police investigation to address how this tragedy occurred and I am in touch with her husband, offering my support to him and his family. My heart is broken for her husband, their son, and all who knew and loved Halyna.”

Actor Alec Baldwin accidentally shot dead cinematographer Halyna Hutchins and wounded a director on the set of the Western film Rust.

Investigators said a "lead projectile" had been removed from the director's shoulder, and that it appeared to be a live round.

They said there was "some complacency" around safety on the set.

"All options are on the table," District Attorney Mary Carmack-Altwies said of any potential charges. "No one has been ruled out at this point."

Presenting the department's initial findings, Sante Fe County Sheriff Adan Mendoza said: "We suspect there were other live rounds found on set."

"We're going to determine how those got there, why they were there, because they shouldn't have been there," he added.

He said police had recovered 600 pieces of evidence so far - including three firearms and 500 rounds of ammunition.

Sheriff Mendoza also said the projectile removed from Joel Souza's shoulder had been handed over as evidence.

"I think the facts are clear - a weapon was handed to Mr Baldwin. The weapon [was] functional and fired a live round killing Ms Hutchins and injuring Mr Souza," he said about the killing.

The sheriff told reporters there had been up to 100 people on the set of the film when the shooting happened on Thursday.

He also confirmed that two other people had handled the gun, an antique Colt .45 revolver, before it was given to Mr Baldwin - the film's armourer Hannah Gutierrez-Reed and assistant director Dave Halls.

Mr Halls told investigators he had failed to check all the rounds in the gun before handing it over, according to a court document made public on Wednesday.

He reportedly called out "cold gun" as he gave it to Mr Baldwin, meaning he believed it to be safe.

Ms Gutierrez-Reed, meanwhile, told investigators that guns had been safely secured shortly before the shooting but ammunition had not been. She said guns were usually kept in a safe that only a few people had access to.

"We're going to try to determine exactly how [this] happened and if they should have known that there was a live round in that firearm," Sheriff Mendoza said.

Mr Baldwin and the film's producers have hired a private law firm to conduct an investigation into the circumstances surrounding the shooting, according to the Reuters news agency.

Several legal experts, however, have said it is unlikely that criminal charges will be filed against Mr Baldwin.

The actor, known for his work on shows like 30 Rock and Saturday Night Live, is named as both an actor and producer on Rust. He is co-operating with investigators and has expressed his shock over what he described as a "tragic accident".

The incident has sparked debate about safety regulations on Hollywood sets and the use of prop guns on productions.

"Obviously I think the industry has had a record recently of being safe," Sheriff Mendoza told reporters. "[But] I think there are some safety issues that need to be addressed by the industry and possibly by the state of New Mexico."

Serge Svetnoy, a friend of Hutchins, is alleging negligence that resulted in "severe emotional distress". He says the bullet narrowly missed him.

The authorities are still investigating the 21 October incident in New Mexico.

No criminal charges have been brought against anyone.

Assistant director Dave Halls has told investigators he failed to check all the rounds in the gun before handing it over to Mr Baldwin, according to a court document.

Mr Halls reportedly called out "cold gun" as he gave it to the actor, meaning he believed it to be safe.

A film director was also injured in the shooting on the set of the Western film Rust.

Mr Svetnoy's civil lawsuit was filed in Los Angeles. It names nearly two dozen defendants.

During a news conference on Wednesday, Mr Svetnoy, 63, said he had seen guns sitting unattended in the dirt a few days before the fatal shooting, adding that he had warned the people responsible for them.

His lawsuit alleges that on the day of the shooting he "felt a strange and terrifying whoosh of what felt like pressurised air", when the gun went off. He was struck by "discharge materials from the blast".

At the news conference, Mr Svetnoy said he had kneeled down to try to help Ms Hutchins.

Neither Mr Baldwin, 63, nor other defendants named in the lawsuit have so far publicly commented on the latest developments.

Meanwhile, a lawyer for the film's armourer Hannah Gutierrez-Reed, who was responsible for the guns and ammunition on set, issued a statement on Wednesday reiterating that she did not know how a live round came to be there.

"We are asking for a full and complete investigation of all of the facts, including the live rounds themselves, how they ended up in the 'dummies' box, and who put them in there," attorney Jason Bowles said.

"We are convinced that this was sabotage and Hannah is being framed. We believe that the scene was tampered with as well before the police arrived."

However, in an interview on Wednesday, Santa Fe county district attorney Mary Carmack-Altwies said investigators "do not have any proof" of sabotage.

Asked on ABC TV's Good Morning America whether she thought it was a possibility, she replied: "No."

The question of how live rounds got on set "will be one of the most important factors" when deciding whether to bring charges, she added.

A lawsuit against Alec Baldwin alleges that a film script did not require him to fire a gun when he fatally shot cinematographer Halyna Hutchins.

Script supervisor Mamie Mitchell - who called police after the shooting on the New Mexico film set - filed the suit.

Her lawyer accused the actor of "playing Russian roulette" when he fired the gun without checking it.

Mr Baldwin and the film's producers, who were also named in the lawsuit, have not yet commented.

The Hollywood actor has previously shared comments from a crew member rejecting suggestions that the film set was unsafe.

Authorities are still investigating the 21 October shooting that took place on the set of the Western film Rust. No criminal charges have been brought against anyone.

Ms Mitchell's lawsuit claims that the script called for three tight camera shots - one of Mr Baldwin's eyes, another of a bloodstain on his shoulder and a third of his torso "as he reached his hand down to the holster and removed the gun".

"There was nothing in the script about the gun being discharged by defendant Baldwin or by any other person," it says.

In a news conference on Wednesday, her lawyer Gloria Allred described the behaviour of Mr Baldwin and the film's producers as "reckless", as she accused them of failing to follow safety protocols.

According to court records, Mr Baldwin was handed the weapon by the film's assistant director who did not know it contained live ammunition and indicated it was unloaded by shouting "cold gun".

Ms Allred said Mr Baldwin "chose to play Russian roulette when he fired a gun without checking it and without having the armourer do so in his presence".

She added that a range of safety failures meant that it was "a case where injury or death was much more than just a possibility — it was a likely result".

Ms Mitchell was standing less than 4ft (1.2m) away from Mr Baldwin when the weapon was discharged, according to the lawsuit.

"I relive the shooting and the sound of the explosion from the gun over and over again," she told reporters.

Her lawsuit is claiming assault, intentional infliction of emotional distress, and deliberate infliction of harm, and is requesting unspecified damages.

It is the second to be filed over the incident, after the set's head electrician began legal action earlier this month.

The film's armourer, who was responsible for the guns and ammunition on set, has said she does not know how a live round came to be in the weapon.

Alec Baldwin says he did not pull the trigger on the gun that accidentally killed cinematographer Halyna Hutchins on the set of the movie Rust in October.



Hutchins, 42, was killed, and director Joel Souza, 48, injured when the gun Baldwin was holding went off during rehearsals for the western on a ranch outside of Santa Fe, New Mexico – a rare filming fatality that sent shockwaves through Hollywood and has forced a reckoning on the use of weapons on set and cutting corners on production safety.

In a promo for the ABC interview, Baldwin’s first since the tragedy, George Stephanopoulos is shown asking the actor to confirm that it wasn’t in the script for the trigger to be pulled. “Well, the trigger wasn’t pulled. I didn’t pull the trigger,” Baldwin says. Stephanopoulos confirms, “So you never pulled the trigger?” to which Baldwin answers, “No, no, no, no. I would never point a gun at anyone and pull a trigger at them. Never.”

Stephanopoulos, in an appearance on Wednesday morning on Good Morning America, described the 80-minute sit-down as “raw” and “intense”.

The journalist described Baldwin, 63, as “devastated” yet “very candid” and “forthcoming”. The actor “answered every question” and discussed Hutchins, meeting with her family, and his account of what happened on set that day. “I have to tell you, I was surprised in many places over the course of that hour and twenty minutes we sat down yesterday,” Stephanopoulos said.

“I’ve done thousands of interviews in the last 20 years at ABC,” he said. “This was the most intense I’ve ever experienced.”

The Sante Fe county sheriff’s office is investigating the shooting, largely focused on how live rounds, which are banned on set, came to be in the gun held by Baldwin.

According to reports, Baldwin believed the gun was empty. He had been handed the weapon by assistant director Dave Halls, who allegedly called “cold gun” as he passed it over. Weapons on set, including the gun given to Hall, were handled by 24-year-old Hannah Gutierrez Reed, a head armorer juggling her second ever feature gig handling weapons with the job of key props assistant.

Asked how he thinks a live bullet got in the gun, which was supposed to be loaded with blanks or dummy rounds, Baldwin said he had “no idea”.

Baldwin also answered Stephanopoulos unequivocally that the accidental shooting was the worst thing that’s ever happened to him: “Yep … yeah, because I think back and I think of ‘what could I have done?’”

The special, Alec Baldwin Unscripted, will air in the US on ABC on Thursday at 8pm ET, and will be available later on Hulu.

"It could be," the 63-year-old actor said in an interview to George Stephanopoulos of ABC News, adding that he did not care.

Mr Baldwin also said he "didn't pull the trigger" of the gun during the incident on 21 October in New Mexico.

"Someone put a live bullet in a gun" he said. "I know it's not me".


Mr Baldwin is best-known for his performances in films like Glengarry Glen Ross and The Hunt For Red October, as well as his impersonation of Donald Trump on US sketch show Saturday Night Live.

"I don't know what happened on that set. I don't know how that bullet arrived in that gun. I don't know," Mr Baldwin said.

"But I'm all for doing anything that will take us to a place where this is less likely to happen again."

The actor said that during the rehearsal on 21 October Hutchins was directing his every move.

"She's guiding me through how she wants me to hold the gun for this angle.

"I'm holding the gun where she told me to hold it, which ended up being aimed right below her armpit."

To get the shot, the actor said he needed to **** the gun - but not fire it.




"The trigger wasn't pulled. I didn't pull the trigger.

"I **** the gun. I go, 'Can you see that? Can you see that? Can you see that?'

"And then I let go of the hammer of the gun, and the gun goes off," Mr Baldwin said.





The interview marks the first time Mr Baldwin has spoken about the incident on camera, except for a brief interview he gave to TMZ in October, in a bid to stop the paparazzi from following him and his family.

Hutchins was a "wonderful mother, first and foremost", a former colleague told the BBC

Ms Hutchins, 42, was flown to hospital by helicopter after the shooting - but later died of her injuries. Director Joel Souza, 48, was also injured.

According to court records, Mr Baldwin was handed the weapon by the film's assistant director, Dave Halls, who did not know it contained live ammunition and indicated it was unloaded by shouting "cold gun".

Mr Halls had been given the gun by Hannah Gutierrez-Reed, the 24-year-old armourer on the film.

Lawyers for Ms Gutierrez-Reed have said she did not know where "the live rounds came from". That question is now at the centre of a police investigation in the US.

Investigators have already obtained a warrant to search the premises of an arms supplier in the US.

An affidavit with the warrant says police have been told ammunition for the film came from several sources, including PDQ Arm & Prop.

The affidavit says the ammunition supplier's owner, Seth Kenney, has told the investigators the live round might have been from some "reloaded ammunition".

He says the ammunition he supplied for the film consisted of dummy rounds and blanks, according to the affidavit.

Mr Baldwin, 63, has insisted he "didn't pull the trigger".

The warrant was issued by a Sante Fe court in New Mexico - the state where Rust was being filmed.

It says "there may be evidence on the phone" that could be "material and relevant to this investigation".

Investigators asked to confiscate Mr Baldwin's Apple iPhone that is "believed to be in his possession".

They wanted to look at text messages, emails, web browser history and other information stored on the phone.

It comes two weeks after the star gave his first TV interview about the incident, in which he said he did not pull the trigger, but the gun went off anyway.

"I would never point a gun at anyone and pull a trigger at them. Never," he told George Stephanopoulos of ABC News.

Mr Baldwin said he had been told "it's highly unlikely that I would be charged with anything criminally".

The actor said he is fully co-operating with the police investigation into the shooting.

No criminal charges have been brought against anyone.

Alec Baldwin and "Rust" producers have reached a settlement in the wrongful death suit involving cinematographer Halyna Hutchins.

Baldwin and the production company behind the troubled Western "Rust" have reached a settlement in the wrongful death lawsuit filed by the family of cinematographer Halyna Hutchins, who was fatally shot on the movie's set last fall.



As part of the settlement announced Wednesday, her husband Matthew Hutchins will serve as an executive producer on the movie, which plans to resume production in January. He was a plaintiff in the suit along with the couple's 9-year-old son, Andros.

"We have reached a settlement, subject to court approval, for our wrongful death case against the producers of 'Rust' including Alec Baldwin and Rust Movie Productions," Matthew Hutchins said in a statement provided to USA TODAY by his attorney Brian Panish of Panish Shea Boyle Ravipudi LLP. "I have no interest in engaging in recriminations or attribution of blame (to the producers or Mr. Baldwin). All of us believe Halyna's death was a terrible accident. I am grateful that the producers and the entertainment community have come together to pay tribute to Halyna's final work."

USA TODAY also obtained a statement from Baldwin's attorney, Luke Nikas of Quinn Emanuel: "Throughout this difficult process, everyone has maintained the specific desire to do what is best for Halyna’s son. We are grateful to everyone who contributed to the resolution of this tragic and painful situation.”

Rust Movie Productions, LLC, through its attorney, Melina Spadone of Pillsbury Winthrop Shaw Pittman, added: “We are pleased the parties came together to resolve this matter, which, subject to court approval, marks an important step forward in celebrating Halyna's life and honoring her work."

The terms of the settlement were not disclosed.

The Santa Fe District Attorney's office indicated the agreement would have no bearing on the criminal case.

Alec Baldwin to be Charged With involuntary Manslaughter Over Rust Shooting

Actor Alec Baldwin will be charged with involuntary manslaughter over the shooting of cinematographer Halyna Hutchins, who was killed on a film set when he fired a prop gun.

Mr Baldwin had been rehearsing a scene for the Western film Rust when the shooting happened at a ranch near Sante Fe, New Mexico in October 2021.


Hannah Gutierrez-Reed, the film's armourer, will also be charged.

Lawyers for both said they intended to fight the charges in court.

On Thursday, Santa Fe's District Attorney Mary Carmack-Altwies announced in a statement that charges would be filed by the end of the month.

"Actor and producer Alec Baldwin and armourer Hannah Gutierrez-Reed will each be charged with two counts of involuntary manslaughter," the statement read. "I have determined that there is sufficient evidence."

"On my watch, no one is above the law, and everyone deserves justice," she said.

Both face up to 18 months in jail and a $5,000 (£4,040) fine if convicted. They will be tried by a jury, prosecutors said.

Film director Joel Souza was also wounded in the shooting, but prosecutors said no charges would be filed in connection with that.

In a statement, Ms Hutchins' husband, Matthew, said he supported the filing of the charges. "It is a comfort to the family that, in New Mexico, no one is above the law," he said.

Mr Baldwin's lawyer, Luke Nikas, called the decision to file charges "a terrible miscarriage of justice".

"Mr Baldwin had no reason to believe there was a live bullet in the gun - or anywhere on the movie set," Mr Nikas said. "He relied on the professionals with whom he worked, who assured him the gun did not have live rounds. We will fight these charges, and we will win."

Ms Gutierrez-Reed's lawyer, meanwhile, said the announcement was the result of a "very flawed investigation and an inaccurate understanding of the full facts".

"Hannah is, and has always been, very emotional and sad about this tragic accident," Todd Bullion said. "But she did not commit involuntary manslaughter."

Alec Baldwin Charged With Involuntary Manslaughter in Rust Shooting

Alec Baldwin was on the phone during firearms training for a movie where he fatally shot a cinematographer on set, prosecutors said, as they charged him with involuntary manslaughter.

The documents released on Tuesday detailing the charges - first announced on 19 January - portray a chaotic set with a reckless approach to gun safety.

Mr Baldwin was "distracted" talking to family members on his mobile phone during training on how to operate the prop gun, Robert Shilling, a special investigator for the district attorney's office, wrote in a statement of probable cause filed with the manslaughter charges.

If Mr Baldwin had performed mandatory safety checks with armourer Hannah Gutierrez-Reed and not pointed the gun at Hutchins, the "tragedy would not have occurred", Mr Shilling argued.

"This reckless deviation from known standards and practice and protocol directly caused the fatal shooting," he said.

"Baldwin knew the first rule of gun safety is never point a gun at someone you don't intend on shooting," Mr Shilling added.

The charging document outlines at least a dozen "acts or omissions of recklessness" leading up to the shooting, including:

Not using a replica firearm for an unscheduled rehearsal
Letting the armourer leave the set against protocol
Deviating from the practice of only receiving the gun from the armourer
Not dealing with safety complaints on set
Not performing required safety checks with the armourer, who was hired without adequate certification





Lawyers for Mr Baldwin and Ms Gutierrez-Reed have said they intend to fight the charges in court.

If found guilty, Mr Baldwin and Ms Gutierrez-Reed could face up to 18 months in prison and a $5,000 (£4,050) fine. They will be tried by a jury, according to prosecutors.

Ms Hutchins died in hospital after she was shot in the chest by a prop gun allegedly fired by Mr Baldwin during a rehearsal at Bonanza Creek Ranch near Santa Fe.

Mr Baldwin has previously denied responsibility for the shooting. He argued in media interviews that he did not pull the trigger on the gun and that it had just "gone off", prosecutors alleged.

But photos and videos from the Rust shooting depict Mr Baldwin practising drawing and firing the weapon with his finger inside the trigger guard and on the trigger multiple times, prosecutors said.

In addition, officials with the FBI found the gun could not be fired without pulling the trigger, according to a report the agency sent to the Santa Fe County Sherriff's Office.

The 30 Rock actor has filed a lawsuit against Ms Gutierrez-Reed and other people involved with the film, alleging they failed to check the gun carefully.

Ms Gutierrez-Reed has said she had checked that the rounds she loaded in the prop gun were dummies before it was handed to the film's assistant director Dave Halls, who then handed it to Mr Baldwin and told him it was an unloaded gun.

An initial investigation into the incident found there was "a degree of neglect", and producers were fined more than $136,000 by the New Mexico Environment Department for failing to enforce safety protocols.

Mr Halls has entered a guilty plea to a misdemeanour charge of negligent use of a deadly weapon, prosecutors said. He will spend six months serving probation.

A lawyer for Ms Gutierrez-Reed said she "will fight these charges" and blamed Mr Halls for not letting her know that a real gun was to be used in the moment when the fatal shooting occurred.

"Hannah asked Halls if they could use a plastic gun for the rehearsal scene and he said no, wanting a 'real gun'," her lawyer, Todd Bullion, said in a statement.

"Hannah asked to be called back into the church if Baldwin was going to use the gun at all and Halls failed to do that."

A representative for Mr Baldwin declined to comment to the BBC on Tuesday.

SANTA FE, N.M. (AP) — Filming on the Western movie “Rust” could resume this week in Montana, the production company said Wednesday, in the aftermath of the fatal shooting of a cinematographer during a rehearsal with actor Alec Baldwin on the original production in New Mexico.


Baldwin will continue his involvement as an actor and coproducer, and Rust Move Productions attorney Melina Spadone said via a representative that filming will restart Thursday at the Yellowstone Film Ranch.

The production company finalized a settlement last month with New Mexico workplace safety regulars over “serious” violations, agreeing to a $100,000 fine to resolve a scathing safety review that detailed unheeded complaints and misfires on set before cinematographer Halyna Hutchins was shot and killed in October 2021.

Plans to resume filming were outlined last year by widower Matthew Hutchins in a proposed settlement to a wrongful death lawsuit that would make him an executive producer on a rebooted “Rust.”


Prosecutors in Santa Fe are pressing forward with involuntary manslaughter charges against actor Baldwin and a weapons supervisor Hannah Gutierrez-Reed. Baldwin and Gutierrez-Reed have pleaded not guilty.

Baldwin was pointing a pistol at Hutchins during a rehearsal when the gun when off, killing Hutchins and wounding director Joel Souza.

Baldwin has said the gun went off accidentally and that he did not pull the trigger. An FBI forensic report found the weapon could not have fired unless the trigger was pulled.

New Mexico Gov. Michelle Lujan Grisham this month signed a new $360,000 allowance for prosecution of the case. Evidentiary hearings are scheduled in early May in state District Court to decide whether to proceed toward trial. Baldwin has indicated that he won’t attend those hearings.

Santa Fe District Attorney Mary Carmack-Altwies says her office is pursuing justice in the death of Hutchins and wants to show that no one is above the law when it comes to firearms and public safety. She says the Ukrainian-born cinematographer’s death was tragic and preventable.

“Rust” safety coordinator and assistant director David Halls pleaded no contest in March to a conviction for unsafe handling of a firearm and a suspended sentence of six months of probation.

Souza, the director, has said he’ll return to the “Rust” production to honor the legacy of Halyna Hutchins.

Parts of a documentary about Hutchins’ life will be filmed simultaneously with “Rust.”

The Hollywood actor Alec Baldwin has been charged with involuntary manslaughter in connection with the death of Halyna Hutchins, the director of photography on the set of the Western film 'Rust'.

But an independent forensic test has concluded that it could only have happened if the trigger had been pulled.



The charge comes more than two years after cinematographer Halyna Hutchins died during filming of the low-budget movie in New Mexico when she was shot by a gun Baldwin was holding during rehearsals for a scene.

The US actor was initially charged with manslaughter in January last year, but the charge was later dropped.

Baldwin reportedly faces up to 18 months in jail if convicted of the new charge.

Hannah Gutierrez-Reed, who was responsible for weapons and ammunitions on set as the film's armourer, faces her own manslaughter charge, as well as a charge of evidence tampering. She has pleaded not guilty and will stand trial next month.

Dave Halls, who was in charge of safety on set as the first assistant director, pleaded no contest last March to a misdemeanour charge of negligent use of a deadly weapon. His plea agreement entailed six months of unsupervised probation in lieu of prison time.

Rust was completed in May, after producers decided to finish the movie as a tribute to Ms Hutchins, and is currently awaiting distribution.


Ms Hutchins' widower, Matthew, and her son, who was nine at the time, will receive a portion of the film's profits in line with a wrongful death settlement approved in June by a judge.

The armorer for the Alec Baldwin movie Rust has been found guilty in the shooting death of the film's cinematographer.


A jury found that Hannah Gutierrez-Reed negligently allowed a live bullet to get into the gun on the set of Western that Baldwin used to accidentally shoot dead Halyna Hutchins, the movie's cinematographer.





After two hours of deliberations at the courthouse in Santa Fe, New Mexico, a jury found Gutierrez-Reed guilty on the manslaughter count, but acquitted her on a charge of tampering with evidence.

Gutierrez-Reed, 26, the daughter of respected film industry armorer Thell Reed, faces up to 18 months in jail. She showed little emotion as the verdicts were read, but a family member broke down while sitting behind the now-convicted felon.

Judge Mary Sommer remanded Gutierrez-Reed in custody telling her the reason is because, 'you are now convicted [...] it's criminal negligence, but still a death.'

The verdict seemingly spells trouble for Baldwin, 65, when he goes on trial in July in the same courthouse for involuntary manslaughter. If found guilty he faces 18 months in jail as well.
