Newly revealed body camera footage shows police in Florida arresting a man at gunpoint for allegedly voting illegally as part of Gov Ron DeSantis’ crackdown on voting rights in the state.

The video shows the heavily armed officers approaching the home of Ronald Lee Miller, 58, identifying themselves as Miami-Dade police officers, and ordering Mr Miller to come outside while aiming guns at him.

Mr Miller answers the door dressed only in his underwear, seemingly with no idea why armed officers are pointing weapons at him. He’s then ordered to sit down in a chair stationed next to his front steps.


“What happened?” Mr Miller asks the police officers.

“I’ll explain it to you once you get dressed,” one of the officers says moments later.




On the same day, another video shows armed police arresting Robert Lee Wood at his home. When an officer remarks that it had taken Mr Wood a “minute” to open the door after they knocked, Mr Wood replies that he’d been asleep.

Both Mr Miller and Mr Wood were unarmed when they were violently arrested and both have been accused of the same crime: voting illegally in a state that has purportedly committed itself to combatting voter fraud.

Gov Ron DeSantis, widely regarded as a leading canddiate for the Republican nomination for president next year, held a press conference on the day that Mr Miller and Mr Wood were arrested. He heralded the work of a new statewide agency charged with investigating voter fraud that had just arrested 19 people for allegedly voting illegally — 14 of whom are Black.

Mr Miller and Mr Wood had both been convicted of second-degree murder more than 30 years before their recent arrest, served their sentences and were unaware that they had permanently lost their right to vote. They say that they were never informed that they’d permanently lost their right to vote and had even been sent voter registration cards in the mail.

A number of other people arrested for voter fraud had similar experiences.

However his lawyer said there had been no communication from law enforcement and the former president's post was based on media reports.


Prosecutors have been looking at a possible indictment of Mr Trump. Reports say it could come next week.

If he is indicted, it would be the first criminal case ever brought against a former US president.


This case focuses on alleged hush money paid on Mr Trump's behalf by his lawyer to porn star Stormy Daniels prior to the 2016 presidential election.

It is one of several cases in which the 76-year-old is currently being investigated, although he has not yet been charged in any and denies wrongdoing in each.

Mr Trump has pledged to continue his campaign to become the Republican nominee in the 2024 presidential election, even if he is indicted.

Past efforts to investigate him, including two impeachment trials, the Russia investigation and the Mar-a-Lago raid, have tended to make him more popular with his base, so an indictment could have a similar effect.

It is not yet known if he is going to be criminally charged this week or even, beyond broad strokes, what those charges might be.

But with the former president predicting an arrest, and calling for mass protests, this is a journey into unknown territory.





Trump has a loyal base of followers, and the 6 January 2021 attack on the US Capitol by his supporters following his repeated calls to protest has proven that a fraught situation can quickly escalate into violence.


On Saturday Mr Trump wrote on his social networking site Truth Social that "illegal leaks" from the Manhattan district attorney's office "indicate" he would be arrested on Tuesday.

The district attorney's office has not yet commented. Mr Trump's lawyer, Susan Necheles, said her team had not heard anything from law enforcement officials.

"Since this is a political prosecution, the district attorney's office has engaged in a practice of leaking everything to the press, rather than communicating with President Trump's attorneys as would be done in a normal case," she said.

The case of Stormy Daniels is one of several legal woes facing the former US president


The Republican Speaker of the US House of Representatives, Kevin McCarthy, has hit out at the investigation, calling it "an outrageous abuse of power by a radical DA [district attorney]".

In a tweet, he also promised to investigate whether federal money was being used to interfere in elections "with politically motivated prosecutions".

Any indictment would create a complicated calculation for Mr Trump's rivals within the Republican Party, as they decide whether to up their attacks on the former president while he is potentially distracted or keep their heads down and hope for the best.

If history is any guide, it will be the latter.

What Happens Next?


• Grand jury finishes its investigation

Trump's former personal lawyer, Michael Cohen, and ex-aides Kellyanne Conway and Hope Hicks, are among those understood to have given evidence so far. The Trump team has said the former president declined an invitation to appear, a sign the case is almost over, according to experts. Reports suggest one final witness could give evidence, possibly on Monday.

• Prosecutors decide whether to indict

Once the investigation is complete, the grand jury votes on whether to recommend criminal charges. However, their verdict is not binding. Ultimately, it is up to Manhattan District Attorney Alvin Bragg to determine what, if any, charges to bring. There is no deadline for this. It is a legal decision - what does he believe can he prove beyond a reasonable doubt to win a conviction - but also a deeply political one.

• A possible Trump court appearance in New York

A former US president has never been indicted before but Mr Trump's lawyer said he would follow normal procedure. Typically, a defendant is either arrested or surrenders to the authorities - if they are facing a more serious felony charge they would be handcuffed. They then have their photo and fingerprints taken. After an initial hearing - called an arraignment - a defendant in a white-collar crime case like this is usually released until the next court date.


The Stormy Daniels case is about how Mr Trump reimbursed his lawyer Michael Cohen after Cohen paid Ms Daniels $130,000. The record for the payment reimbursing Cohen says the payment was for "legal fees". Prosecutors may say this amounts to Mr Trump falsifying business records, a misdemeanour in New York.

US media organisations say law enforcement agencies in New York are preparing for the possibility of Mr Trump being indicted and appearing in a Manhattan courtroom as early as next week.

According to the Associated Press, they are considering the practicalities of taking a former president into court, including questions around security.

Donald Trump faces a separate criminal investigation over efforts to overturn his narrow loss in the state of Georgia in the 2020 presidential election - though it is not known if the former president is being directly investigated.

The Department of Justice is also looking at whether classified government documents were handled incorrectly after Mr Trump left office, as well as broader efforts to undermine the results of the presidential election three years ago - including the 6 January attack.

It's a contradiction that makes sense after investigating pro-Trump spaces online.

On mainstream social networks, messaging apps and Trump's own Truth Social, rumours are swirling.



There's breathless chatter about double agents and "false flags" - attacks carried out with the intention of blaming opponents for the violence.

Many of the former president's steadfast supporters believe that the Capitol riot on 6 January 2021 was instigated not by Trump fans and far-right groups such as the Proud Boys and Oath Keepers, but instead by federal agents or left-wing "antifa" - anti-fascist activists who hoped to discredit Mr Trump.

They point to the presence, revealed in court documents, of confidential FBI sources in the crowd that day.

But that's very different to saying there was a plot by federal authorities to spark violence. While there's no evidence of that - and voluminous evidence that the more than 1,000 people arrested in connection with the Capitol riot were Trump supporters - fringe news sites have been filled with wild speculation and suggestions about "deep state" plots.

Some of the coverage has even filtered up to more mainstream outlets such as Fox News.

The rumours, and fear of a repeat of the events of January 2021, have dissuaded many of those who would be out on the streets protesting over Mr Trump's possible arrest.

Ali Alexander, a far-right activist who organised protests leading up to the Capitol riot, announced that he wasn't planning to protest and said that conspiracy theorist Alex Jones of Infowars was also staying home.

Former president Donald Trump fuelled a media firestorm with his all-caps prediction of his own arrest, a claim apparently based on reports of a looming indictment from a criminal investigation in New York.

His own team followed up to clarify that he did not receive any indications from prosecutors that he had yet been charged or would be imminently arrested.

But his claim fanned the flames of unrest with incendiary rhetoric and demands that his supporters “protest, protest, protest” a then-unannounced decision, with Mr Trump’s allies rushing to his defence and mounting an offensive on his behalf.



He also has used his announcement and his narrative of political persecution to raise money for his 2024 presidential campaign, relying on similar tactics that his fundraising arms have used after the federal law enforcement search of his Mar-a-Lago property last year and his spurious attempts to overturn the 2020 presidential election.

After his “arrest” and “protest” statements on Truth Social ignited a media frenzy on 18 March, his campaign sent a fundraising email with a headline from a Fox News story about the former president’s prediction. The email tells supporters that “you’re our country’s only hope.”

Donald Trump's prediction that he will be arrested this week has yet to come true - but as the waiting game for criminal charges goes on, the former president is plotting a strategy designed to both keep him out of jail and turbo-boost his historic bid to return to the White House.


It is a daunting task, and hunkered down in his Mar-a-Lago home, Mr Trump seems resigned to becoming the first US president to be indicted for a crime. Yet it's also clear he will not go quietly. His past choices in moments of political crisis are a useful guide to what we might see next.


When cornered by political adversaries, Mr Trump punches back.


Throughout his 2016 presidential campaign, he leaned in to conflict when other politicians might have backed off. Blasted for criticising war hero John McCain? Trump upped his attacks. Accused of sexual harassment before a debate with Hillary Clinton? He held a press conference with Bill Clinton's sexual accusers.

During his presidency, it was the same story through two impeachments, a special counsel investigation of Russia election meddling and countless smaller controversies.

"If Trump is indicted, the playbook remains exactly the same," says Bryan Lanza, a Republican strategist and Trump adviser. "Attack the legal as political."

The best defence, as the American football saying goes, is a good offence.



Mr Trump is already punching back against Manhattan District Attorney Alvin Bragg, framing him as a liberal prosecutor hell-bent on pursuing political retribution against the former president.

A press release on Monday referred to him as a "progressive activist", a "rogue prosecutor" and a "woke tyrant who has politicised the justice system".

Expect those attacks to continue if an indictment is announced and for Mr Trump to portray himself as a victim of a leftist plot - a common theme of persecution Mr Trump has also regularly relied on in his political career.

"If he's indicted, he becomes bulletproof," Mr Lanza says.

NEW YORK — A pivotal figure in the hush money payment investigation of Donald Trump returned on Monday to the building where a grand jury has been meeting for months, a repeat appearance suggesting his testimony could be key as prosecutors push toward potential criminal charges.



There was still no word on when the panel might vote on a possible indictment of the former president.


David Pecker, a longtime Trump friend and the former chief executive of the parent company of The National Enquirer, was back as the grand jury heard testimony in the probe for the first time since last Monday, when a witness favorable to the ex-president appeared.


The grand jury is now back on the Trump matter, according to a person familiar with the case who spoke on condition of anonymity to discuss secretive proceedings. The ex-president is being investigated over payments during his 2016 campaign to two women who alleged affairs or sexual encounters with him.

Trump denies being involved with either of the women, porn actor Stormy Daniels and model Karen McDougal, and claims he’s the victim of “extortion.”

Among the witnesses the grand jury has already heard from is Michael Cohen, Trump’s former lawyer and fixer who has said he orchestrated the payoffs. Cohen pleaded guilty in 2018 to federal charges arising from the payments and has become a potentially major witness for state prosecutors.

TRUMP has made history again. Never, in the 235 year history of the United States, has a former president faced a criminal indictment.

Former US President Donald Trump will be charged over hush money payments made to a porn star just before the 2016 presidential election.

The details of the charges he will face have not yet been released.






A grand jury voted to indict him on criminal charges, after investigating a $130,000 pay-out to Stormy Daniels in an attempt to buy her silence over an alleged affair. He denies wrongdoing.

Mr Trump, 76, is the first serving or former US president to face charges.

His lawyer, Susan Necheles, confirmed the indictment in a statement on Thursday evening.

"He did not commit any crime," she said. "We will vigorously fight this political prosecution in court."

The ex-president lives in Florida and is expected to travel to New York City for his formal arrest and first hearing in court.

According to his defence team, Mr Trump will surrender next week. The United States Secret Service - which is tasked with protecting serving and former US presidents - will be in charge of security for the court appearance

Mr Trump faces the prospect of having his fingerprints recorded and his mugshot taken, like all defendants in criminal cases.


In a statement, Mr Trump lashed out at Manhattan District Attorney Alvin Bragg, who has been pursuing the case. He called the prosecutor a "disgrace", and accused him of "doing Joe Biden's dirty work".

"The Democrats have lied, cheated and stolen in their obsession with trying to 'Get Trump,' but now they've done the unthinkable - indicting a completely innocent person in an act of blatant Election Interference," he said.

Mr Trump has repeatedly slammed the investigation in his hometown of New York as a political "witch hunt" led by his opponents. Mr Bragg is a registered Democrat.

The inquiry stems from an allegation that Mr Trump directed his then-lawyer Michael Cohen to pay Stormy Daniels, a former porn actress and stripper, less than two weeks before the 2016 presidential election to prevent her speaking out about an alleged affair with Mr Trump.

Ms Daniels has said she had a sexual encounter with Mr Trump at a Lake Tahoe hotel in 2006 - the year after he married his current wife, Melania.

Cohen has said in court that he made the $130,000 settlement "in co-ordination with and at the direction of" the former president. Cohen was jailed from 2018-20 on multiple charges.

Trump is currently the front-runner among all declared and potential contenders for the Republican White House nomination.

But there is nothing in US law that prevents a candidate who is found guilty of a crime from campaigning for, and serving as, president - even from prison...


Trump is also being investigated in several other cases.


The other investigations include probes into his role in the US Capitol riot of January 2021, his efforts to overturn his loss in the state of Georgia in the 2020 election, and his handling of classified documents after leaving office.

Trump - who served as president from 2017-21 - was twice impeached by the House of Representatives. He was acquitted by the Senate both times.

Joe Tacopina, a lawyer for Trump, confirmed Thursday that he had been informed that the former president had been indicted on charges involving payments made during the 2016 campaign to silence claims of an extramarital sexual encounter. The specific charges were not immediately made public.


Trump faces a string of 34 other inquiries as he campaigns for another term in 2024, including a criminal investigation over top secret documents found at his Florida estate, a probe in Washington into his efforts to undo the results of the 2020 presidential election, and an investigation in Georgia looking into whether he and his allies illegally interfered in the state's 2020 election.

Trump, a Republican, has denied any wrongdoing and says he is being targeted by Democrats trying to keep him from reclaiming the White House.




Here’s a look at the probes underway in various states and venues:


MAR-A-LAGO

Of all the inquiries Trump faces, a Justice Department probe into the retention of top secret government documents at his Florida estate, Mar-a-Lago, could present the most significant legal jeopardy, with investigators saying in court filings last year that they were examining potential violations of multiple felony statutes.

As part of that inquiry, agents and prosecutors have spent months interviewing multiple people close to Trump, including an aide who was seen on surveillance video moving boxes of documents at the property, as they examine whether Trump or his representatives sought to obstruct the classified documents probe.

Federal officials obtained a search warrant last year to search his home, convincing a Florida judge there was probable cause of criminal activity there, including the willful retention of national defense information – a statute that by itself carries a penalty of up to 10 years in prison.

A grand jury in Washington has been hearing evidence in the investigation. Prosecutors last year granted limited immunity to one close Trump ally to secure his testimony and more recently were able to compel the testimony of a Trump lawyer said to have drafted a document stating that a diligent search for classified records had been conducted.

Attorney General Merrick Garland in November named Jack Smith, a veteran war crimes prosecutor who previously led the Justice Department’s public integrity section, to serve as special counsel for the Mar-a-Lago investigation and key aspects of a separate probe into efforts to overturn the results of the 2020 presidential election.


2020 ELECTION AND CAPITOL RIOT


Smith has also been leading a team investigating efforts by Trump and his allies to overturn the election that Trump falsely claimed was stolen.

Federal prosecutors have been especially focused on a scheme by Trump allies to put forth a slate of fake presidential electors in key battleground states who falsely declared that Trump, not Democrat Joe Biden, had won the 2020 election. They have issued subpoenas to a number of state Republican Party chairs.

Federal prosecutors have brought multiple Trump administration officials before that grand jury for questioning, including the former Trump White House counsel and a top aide to Vice President Mike Pence. A federal judge recently ruled that Pence would have to testify before the grand jury, though his team was still deciding Thursday whether to appeal.

In a sign of the expanding nature of the investigation, election officials in multiple states whose results were disputed by Trump have received subpoenas asking for past communications with or involving Trump and his campaign aides.

A House committee that investigated the Jan. 6 attack on the Capitol has recommended that the Justice Department bring criminal charges against Trump and associates who helped him launch a wide-ranging pressure campaign to try to overturn his 2020 election loss.


GEORGIA


After his 2020 election loss, Trump called Georgia Secretary of State Brad Raffensperger and urged him to “find 11,780 votes” — just enough to overtake Biden and overturn Trump's narrow loss in the state.

That Jan. 2 phone call was part of a monthslong effort by a special grand jury in Atlanta investigating whether crimes were committed as part of the pressure campaign to overturn Trump's defeat.

Among those questioned by the special grand jury were Rudy Giuliani, the former New York mayor and Trump lawyer; Republican Sen. Lindsey Graham of South Carolina, and Georgia Gov. Brian Kemp.

Prosecutors have advised Giuliani and Georgia Republicans who served as fake electors that they are at risk of being indicted. The fake electors signed a certificate asserting Trump had won the election and declaring themselves the state’s electors, even though Biden had won the state and Democratic electors had already been certified.

Trump and his allies have denied wrongdoing, and he has repeatedly described his phone call to Raffensperger as “perfect.”

It's up to Fulton County District Attorney Fani Willis, a Democrat, to decide whether to convene a regular grand jury and pursue criminal charges in the case. The foreperson on the special grand jury that investigated the case at Willis' request indicated publicly in February that the panel had recommended multiple indictments.


NEW YORK


New York Attorney General Letitia James has sued Trump and the Trump Organization, alleging they misled banks and tax authorities about the value of assets including golf courses and skyscrapers to get loans and tax benefits.

That lawsuit could lead to civil penalties against the company if James, a Democrat, prevails. She is seeking a $250 million fine and a ban on Trump doing business in New York. Manhattan prosecutors investigated the same alleged conduct but did not pursue criminal charges.

A civil trial is scheduled in state court for October.


In a separate civil case in federal court in New York, Trump has been accused of raping a former magazine columnist in a dressing room in the mid-1990s.

That case is scheduled to go to trial on April 25.

Trump has repeatedly insisted he never met the columnist, E. Jean Carroll, at the store and has dismissed her rape claims, saying, “Physically she’s not my type.”

During an October deposition, he misidentified a decades-old photograph of her as one of his ex-wives.

The "most prolific political martyr in history"?





The news of Trump's criminal charges spread like wildfire online but getting a complete sense of the conversations reacting to it can be hard.






By getting inside US voters' social media feeds and joining the internet groups populated with Trump's most devoted fans, we can better see how all of this is unfolding.


That's where the BBC's "undercover voters" come in - social media accounts belonging to five fictional characters from across the US political spectrum, based on data from Pew Research.


These five profiles give us a snapshot of what US voters are seeing on social media, both on mainstream platforms and in the recesses out of the reach of most of us.

After searching for Trump-related material on their feeds, three key themes emerge.

Trump supporters 'sick to the stomach'

Let's start with the mainstream, right-wing profiles.

For our right-leaning voters Britney and Larry, their feeds are dominated by pro-Trump messages.


Echoing the language of the former president, there are defiant statements about a "witch hunt" and how Democrats have "weaponised the legal system".


Witch hunt or justice? US split on Trump indictment


These include tweets from Republican politicians, commentators and other pro-Trump accounts who are using this as a rallying call for his 2024 presidential bid.

Some accounts call for him to be reinstalled to the White House now and there is talk of supporters feeling sick to their stomachs.

News of the indictment has largely drowned out mention of Florida Governor Ron DeSantis, who could be Mr Trump's biggest Republican rival if he runs.

That includes on our apolitical voter Gabriela's feeds, where he's been a key character in recent months.

Instead, she is receiving lots of posts supportive of Mr Trump and claiming this indictment is an "unjust" attempt to thwart his presidential bid.

Unlike Trump's original post on Truth Social predicting his arrest, which called for protests, the posts these accounts are seeing have generally avoided direct calls to action.

'Trust the Plan'


On the sites like Telegram where Trump's most committed devotees gather, there's a different mood.

This is where the sprawling, unfounded QAnon conspiracy theory thrives - it says the former president is waging a secret war against elite, Satan-worshipping paedophiles in government, business and the media.

True to that, there's much chatter of how the indictment is part of a plot by the so-called Deep State.

There are two competing narratives unfolding simultaneously in these channels.

The first involves angry and sometimes violent rhetoric directed at the government, along with cryptic calls to action. Messages include "Here We Go!!" and "Their turn is coming soon".

Others refer to false claims the 2020 election was rigged and Trump was the rightful winner, explaining "see if we'll stand against this fake government should Trump [be] arrested".

The more extreme messages call for followers to "Kill the Deep State" but there is no visible evidence of plans to riot.


There is talk of pro-Trump rallies but the mood feels different to the US Capitol riots which was preceded by a social media movement rife with hateful language and calls for violent action.

The difference now could in part be explained by the other narrative swirling in these online circles - stay off the streets.

Several posting on Telegram fear there is a sinister plot enticing them to take action and be arrested. They say there is a bigger plan where Trump will emerge victorious - if they can stay out of trouble.

They've just made Trump the most "prolific political martyr in history", one writes.

While the chatter on the main channels seems to be absent of specific calls to arms, there are smaller, private groups we cannot see where a very committed few could pose the greater risk.

Celebrations and doubts

Trump's indictment is a huge topic of conversation on the left too.








Memes showing Trump in a prison jumpsuit behind bars appear at the top of the left-leaning voters' feeds, moments after the news breaks.


Posts targeting the profiles belonging to Emma and Michael are celebrating his imminent arrest - several remark how "no-one is above the law". But there are some niggling doubts too.

Several posts question whether Trump is being indicted for the right crime, given the gravity of other investigations he faces.

And some say that the way his base and the wider Republican Party are rallying to him could boost his presidential campaign. There are posts fearing the indictment will "backfire" by rousing support from those who might otherwise have been less committed.

But the conversation isn't all about Trump on the left. Within a few hours of the indictment news, other issues like trans rights and criticism of Ron DeSantis start to creep in too.

The former president appeared subdued in New York, only to return to his campaigning, inflammatory ways hours later in Florida

Simmering with anger and defiance, Donald Trump returned to the safe space of Mar-a-Lago and his loyal supporters on Tuesday night, seeking to turn his status as an accused criminal into a political war cry.

The former president ignored a plea from the judge in the case to refrain from inflammatory rhetoric, even launching a broadside at the judge’s daughter over her political connections.



Trump flew back to Florida from New York, where prosecutors had accused him of orchestrating hush-money payments to cover up claims of affairs before the 2016 election. Sitting in a Manhattan court, Trump pleaded not guilty to 34 felony counts of falsifying business records.

But on the evening of a sombre day for America and its judicial system, the frontrunner for the 2024 Republican nomination walked into the opulent ballroom at the Mar-a-Lago estate to the familiar strains of Lee Greenwood’s God Bless the USA, a staple of his campaign rallies.

Supporters wore “Make America Great Again” and “Trump 2024” caps and snapped pictures of the president turned defendant. The audience included Trump’s son Eric and his wife, Lara, Florida congressman Matt Gaetz and pillow maker and conspiracy theorist Mike Lindell.

Wearing a blue suit, white shirt and red tie, and standing behind a lectern that said “Text Trump to 88022” amid an array of US flags, he portrayed himself as a political martyr.

“I never thought anything like this could happen in America,” Trump said. “I never thought it could happen. The only crime that I have committed is to fearlessly defend our nation from those who seek to destroy it.”

The Manhattan district attorney, Alvin Bragg, alleges that Trump – the first former president to face criminal charges – falsified business records to conceal a violation of election laws.

Payments were made to the adult film actor Stormy Daniels and the former Playboy model Karen McDougal. Another was made to a former Trump Tower doorman, $30,000 to buy the rights to an untrue story about a child fathered out of wedlock.



Trump appeared subdued as he pleaded “not guilty” but at Mar-a-Lago felt liberated to protest his innocence and lash out with typical invective.

He described Bragg, an elected Democrat, as “a local failed district attorney charging a former president of the United States for the first time in history on a basis that every single pundit and legal analyst said there is no case.

“There’s no case. They kept saying there’s no case. Virtually everyone. But it’s far worse than that because he knew there was no case.”

Some experts have said Bragg might have to rely on untested legal theories but few have said he has no case at all.

Trump added: “The criminal is the district attorney because he illegally leaked massive amounts of grand jury information for which he should be prosecuted or, at a minimum, he should resign.”


In court, prosecutors requested protective orders for discovery materials, including Trump’s incendiary posts on his Truth Social platform, including a warning of “death and destruction” if he should be indicted.

The judge, Juan Merchan, advised Trump: “Please refrain from making statements that are likely to incite violence or civil unrest.”

But in his prime-time address, there was no sign Trump was prepared to modify his rhetoric. He assailed Merchan, claiming: “I have a Trump-hating judge with a Trump-hating wife and family whose daughter worked for Kamala Harris.”

In fact Merchan’s daughter, Loren, is a partner at a digital campaign strategy agency that has worked for many prominent Democrats, including Joe Biden and Kamala Harris in the 2020 election.



Trump addressed multiple other cases against him, including an investigation into his attempt to interfere in the election in Georgia.

“In the wings they’ve got a local racist Democrat district attorney in Atlanta who is doing everything in her power to indict me over an absolutely perfect phone call,” he claimed, referring to a call in which he was recorded asking state Republicans to overturn the result.

Trump also went into a lengthy denunciation of the investigation of his mishandling of classified materials at Mar-a-Lago. “They’re looking at me through the Espionage Act of 1917, where the penalty is death,” he said.

He described the special counsel, Jack Smith, as a “lunatic” and complained: “Our justice system has become lawless. They’re using it now – in addition to everything else – to win elections.”

Trump could not resist reverting to his usual campaign stump speech, railing against Democrats’ handling of the withdrawal from Afghanistan, urban crime, the threat of a third world war, a military “gone woke” and high inflation.

He listed baseless grievances including “impeachment hoax number one”, “impeachment hoax number two”, “millions of votes illegally stuffed into ballot boxes” and Hunter Biden’s laptop which, he claimed, “exposes the Biden family as criminals”.

There is no evidence to support that assertion.



The indictment has led to a surge of support for Trump in Republican polls and a $7MIL surge in cash donations. But many commentators are sceptical about whether Trump could prevail in a general election.

The Lincoln Project, an anti-Trump group, said in a statement: “Tonight at Mar-a-Lago we saw a paranoid and delusional speech cheered on by fanatical cult members who do not care about democracy and American values. Trump got the circus he wanted. The rest of the GOP has fallen in line.”

Bill Burton, a former White House deputy press secretary under Barack Obama, was also unimpressed.

“This is the worst I’ve ever seen Trump,” he tweeted. “I watch all of his speeches – saw him ramble in Waco, watched him ramble in his ‘announcement’ to run again – this is the very worst of it. Puffy face, bloodshot eyes, his precious hair a mess. And his cadence just plain sad.”

The environmental lawyer's campaign treasurer, John E Sullivan, confirmed the filing on Wednesday.

Mr Kennedy is an outspoken anti-vaccine campaigner. Instagram removed his account in 2021 for "repeatedly sharing debunked claims", the company said.

Both Democratic and Republican parties hold their own contests - called primaries - to find their presidential nominee. Mr Kennedy will be a rank outsider for the Democratic nomination.

President Joe Biden has indicated he will run for re-election, though he has not yet formally declared his candidacy.

He was previously expected to launch his campaign in early April, but aides say his timeline has shifted.

CBS News, the BBC's US partner, has reported that he is expected to formally announce a run in early summer.

Last month, another Democrat, Marianne Williamson, joined the presidential race.

At the time, he said: "If I run, my top priority will be to end the corrupt merger between state and corporate power that has ruined our economy, shattered the middle class, polluted our landscapes and waters, poisoned our children, and robbed us of our values and freedoms."

Mr Kennedy told a New Hampshire crowd in March that he had "passed the biggest hurdle" - his wife greenlighting the run...



As the co-founder of an environmental law firm, Mr Kennedy won plaudits for campaigning on issues such as clean water, including working to clean up the Hudson River in New York.

But his anti-vaccine views go back years and have provoked a strong backlash, including from his own family. In 2021 his sister, Kerry Kennedy, called him "very dangerous" on the issue.

In 2019, three other family members penned an op-ed in the news outlet Politico, denouncing Mr Kennedy's anti-vaccine views.

His sister Kathleen Kennedy Townsend, brother Joseph P Kennedy II and niece Maeve Kennedy McKean said his views were "tragically wrong" and have "deadly consequences".

In 2022, Facebook and Instagram removed accounts for an anti-vaccine group founded by Mr Kennedy, Children's Health Defense, for "repeatedly" violating company policies on medical misinformation.

Although Mr Kennedy's vaccine scepticism long predates Covid, he found a new audience during the pandemic, when revenues to Children's Health Defense doubled to $6.8m (£5.5m).

Mr Kennedy also published a book, The Real Anthony Fauci, in which he accused the former US infectious disease chief of "a historic coup d'etat against Western democracy".

Mr Kennedy has a voice disorder, spasmodic dysphonia, which affects the muscles in his voice box.

TRUMP Sues Former Lawyer Michael Cohen For $500m

Ex-US President Donald Trump is suing his former lawyer for $500m (£400m), alleging breach of contract.

He says Michael Cohen breached his duty as attorney to act in his client's best interests.

The lawsuit comes amid escalating attacks from Trump allies on Cohen, who is a key witness in a New York investigation into the ex-president.


A Manhattan prosecutor last week charged Mr Trump with fraud in relation to hush money payments to a porn star.

Cohen's spokesman and lawyer, Lanny Davis, told the BBC he was confident the lawsuit against his client would fail.

The legal action, filed in a Florida federal court, also accuses Cohen of making "improper, self-serving, and malicious statements about his former client, his family members, and his business".

Cohen worked as Mr Trump's attorney for over a decade. He was also a vice-president at the Trump Organization, and was often described as Mr Trump's fixer.

But the two had a major falling out after the 2016 election, as investigators began looking into several of Mr Trump's aides.


In 2018, Cohen was sentenced to three years in prison and a fine after pleading guilty to charges of fraud and campaign finance violations.

Now out of prison, Cohen has become a high-profile critic of Mr Trump, and a frequent guest on news programmes.


He has written a book and hosts a podcast, both of which Mr Trump cites in the lawsuit.

It says Cohen fabricated conversations and wrongfully called Mr Trump a "racist" in his 2020 book Disloyal.

Cohen's lawyer, Mr Davis, said in a statement to the BBC: "Mr Trump appears once again to be using and abusing the judicial system as a form of harassment and intimidation against Michael Cohen.

"It appears he is terrified by his looming legal perils and is attempting to send a message to other potential witnesses who are co-operating with prosecutors against him."

New York prosecutors have charged Mr Trump with 34 felony counts of falsifying business records, in what they say was an effort to cover up payments intended to keep a porn star, Stormy Daniels, quiet about her alleged affair with him.

On 4 April, Mr Trump appeared in Manhattan criminal court - the first former US president ever indicted on criminal charges. He pleaded not guilty.

Cohen has admitted that as Trump's fixer, he facilitated a $130,000 pay-out to Ms Daniels.

As Mr Trump's court date approached, Cohen made numerous appearances on major network news programmes and criticised his former boss.

"He's not thick-skinned," Cohen told CNN after Mr Trump's indictment. "He's actually very thin-skinned, and he has a very fragile ego."

TRUMP Hush-Money Trial Date Set For March 2024

TRUMP will face a criminal trial in March 2024, a New York judge has ruled, as the Republican's campaign for the presidential nomination will be in full swing.

The former US president received the news at a hearing on Tuesday in the case about the alleged concealment of a payment to a porn star.

Trump was charged with 34 felony counts of falsifying business records.

He pleaded not guilty to each charge last month.


After the hearing, Trump aired his frustrations at the timing of the trial on his social network, Truth Social.

"They forced upon us a trial date of March 25th, right in the middle of the primary season," Trump wrote, adding it was "very unfair" and "election interference".

The post appeared just hours after Judge Juan Merchan said restrictions on what Mr Trump can do and say in relation to the case would not restrict his ability to campaign.

Judge Merchan said Mr Trump "is certainly free to deny the charges, he is free to defend himself against the charges."

Mr Trump has long since decried the case as a "political Witch-Hunt, trying to take down the leading candidate, by far, in the Republican Party".

March 2024 is set to be a busy month for Mr Trump and the other candidates vying to become the Republican presidential candidate.

Candidates zig-zag across the US for a series of conventions, primaries and caucuses in every US state and territory, beginning in early states like Iowa in February and ending in or around early June.

The latest hearing was the second time Mr Trump appeared in court for the case.
He was first arrested and appeared in a New York courtroom in April, where he was charged with 34 felony counts of fraud in a 16-page indictment.


These charges relate to a $130,000 (£105,000) payment made to adult film actress, Stormy Daniels, who says she was paid to stay quiet after having sex with him.

Providing so-called hush money is not illegal, but the case against Mr Trump centres around how his former lawyer, who paid Ms Daniels, had his reimbursement recorded in Mr Trump's accounts.

Mr Trump is accused of falsifying his business records in the first degree by saying the payment was for legal fees.



It is alleged the payments were intended "to conceal damaging information and unlawful activity from American voters before and after the 2016 election".

The case is one of several legal woes faced by Trump.



Earlier in May, a New York civil trial jury found Mr Trump liable for the defamation and sexual assault of E Jean Carroll, a former Elle magazine columnist, and ordered him to pay her about $5m in damages.

Ms Carroll is now attempting to pursue further damages over remarks Mr Trump made after the jury in that case returned its verdict.

Florida Gov. Ron DeSantis has launched his campaign for the Republican presidential nomination, albeit trailing far behind former president Donald Trump. Still, observers say he can't be counted out this early in the primary season

The technical issues that plagued the launch of Ron DeSantis's 2024 Republican presidential bid on Twitter were certainly a poor start to kick off his national campaign, but there are far more pressing challenges facing the Florida governor.

Most significantly, while polls suggest DeSantis is the second-most popular pick among Republicans, he has officially entered the race down more than 30 points from the front-runner in the RealClearPolitics national average polls: former president Donald Trump.


After his big re-election months ago, DeSantis has sputtered along, his poll numbers cratering as he faces off against a challenger who has a hard-core base of support that no other candidate can match.


With Trump mounting such a significant lead, does DeSantis even stand a chance of catching up?

"Primaries are volatile things. Candidates rise and fall because voters don't pay that much attention early in the process," said Danny Hayes, a political science professor at George Washington University. "If anybody is writing off DeSantis right now, they're probably not looking clearly at the situation."

"Beating Trump, of course, will be difficult. But there's a lot that can happen between now and the Iowa caucuses."

Despite the poll gap with Trump, it's certainly not all bad news for the Florida governor. Trump's ongoing legal woes could be a potential boon for the DeSantis campaign. This month, Trump was found liable of sexual abuse and defamation of magazine writer E. Jean Carroll in the 1990s.

This week, a court date for his criminal trial in Manhattan relating to hush money payments to women who alleged extramarital affairs was set for March 2024, right in the heart of primary season. Trump may also face charges over his handling of classified documents and his actions regarding the 2020 election.

And DeSantis does have some political advantages that could give him a legitimate shot at winning, political experts say, advantages that include name recognition.

"The hardest thing to do when you're running for president is to get famous," said Chris Stirewalt, a senior fellow at the American Enterprise Institute and former political editor of Fox News Channel. "To reach the persuadable voter, you need for them first to know who you are."

Former Vice President Mike Pence is officially entering the race for the Republican presidential nomination, setting him up for a head-to-head collision with former running mate Donald Trump and several other White House hopefuls who see themselves as the heirs of the conservative movement Trump helped to stoke more than five years ago.


If early poll numbers are to be believed, Pence has much work to do to make space for himself in what is becoming an increasingly saturated field that has already faced challenges contrasting their positions with those of the former president.


In addition to former administration officials like onetime U.S. Ambassador to the United Nations Nikki Haley in the field, Pence will also have to pitch himself as a viable alternative to candidates like South Carolina Senator Tim Scott, Arkansas Governor Asa Hutchinson, and millionaire Vivek Ramaswamy. All support policies that largely represent the boilerplate issues embraced by Republican voters: strict laws on abortion, tight oversight of the border and the rejection of an American culture "gone woke."

But beyond the others in the race, Pence will also have to craft a pitch to voters that can steal support not only from Trump but candidates like Florida Governor Ron DeSantis, whom polling shows to be the most viable direct challenger to Trump at this early juncture in the race....


If early poll numbers are to be believed, Pence has much work to do to make space for himself in what is becoming an increasingly saturated field that has already faced challenges contrasting their positions with those of the former president.

Even with the stature afforded Pence as vice president, the numbers aren't too optimistic. Across all polls—conservative-biased, liberal-biased, or right down the middle—Trump is, by and large, the leader of the Republican field, with numbers showing support from more than 50 percent of likely voters in the GOP primary.

Out of the remaining half of the field, DeSantis is routinely the only candidate earning a double-digit percentage of the vote, with the support of roughly one-fifth of the Republican electorate according to polling averages compiled by aggregators like FiveThirtyEight, Real Clear Politics, and Race to the White House.

But at this point, that's not much: in a hypothetical head-to-head matchup, a May 25-30 YouGov/Yahoo News poll found DeSantis would lose to Trump by approximately 24 points in a one-on-one primary, while Pence—regularly the third-leading candidate in most polls with a weighted percentage of 5 percent across the entire field—would lose to Trump by nearly 60 percentage points.

Mike Pence Tears Into TRUMP at 2024 Campaign Launch

Former US vice-president Mike Pence has offered his most forceful repudiation of Donald Trump to date during a speech launching his 2024 campaign.

The Republican accused Trump of being unfaithful to the US constitution and of abandoning conservative values.

The former Indiana governor and congressman formally commenced his White House campaign on Wednesday.

The move pits him against his two-time running mate, who he served under in the White House from 2017-21.



At a speech in Ankeny, Iowa, Mr Pence argued that Mr Trump had encouraged the mob that attacked the US Capitol on 6 January 2021, and had incorrectly asserted that Mr Pence had the power to overturn the election result.

"But the American people deserve to know that on that day, President Trump also demanded that I choose between him and the constitution," he said.

"Now, voters will be faced with the same choice: I chose the constitution and I always will."

He added that Mr Trump's actions on 6 January should disqualify him from returning to power.

"I believe that anyone who puts themselves over the constitution should never be president of the United States," he said.

"And anyone who asked someone else to put them over the constitution should never be president of the United States again."

Mr Pence, 64, also took shots at Democratic President Joe Biden as well, arguing that neither he nor Mr Trump are similar to average Americans who know how to "treat each other with kindness and respect even when we disagree".

Much of his speech focused on his disagreements with Mr Trump, but he also hit out at another Republican 2024 rival, Florida Governor Ron DeSantis.

"Donald Trump and others who would seek the presidency would walk away from our traditional role on the world stage," he said, hitting out at Mr DeSantis for his recent remarks about the war in Ukraine.

In a later CNN town hall, he continued attacking his rivals, critising Mr Trump for having previously called Russian President Vladimir Putin a "genius".

"I know the difference between a genius and a war criminal, and I know who needs to win in the war in Ukraine," he said.


But he also condemned prosecutors for investigating Mr Trump's alleged mishandling of classified documents after leaving office, saying "indicting a former president in the United States sends a terrible message to the world".

It comes after Mr Pence was cleared of wrongdoing last week by prosecutors over his own handling of classified info.

Mr Pence was one of eight Republican presidential candidates who appeared at a fundraising event at the Iowa state fairground, known as the Roast and Ride, last weekend.

He arrived on a Harley Davidson along with another couple of hundred bikers who rode in convoy, raising money for military veterans. But that was not enough to provoke much excitement around his candidacy.

An energetic Ron DeSantis got the most enthusiastic response as he promised to "fight the woke" wherever he finds it.

Mr Pence's speech, by comparison, was flat and lacklustre, perhaps demonstrating why a former vice-president with nationwide name recognition is trailing badly in opinion polls.

According to a Reuters-Ipsos survey released last month, Mr Pence is polling at 5%, compared to 44% for Mr Trump.

One former Trump voter, Todd Wilson, said he felt Mr Pence "needs to be a little bit stronger".

The candidate's humility was a plus, he said, "but I think if you're going to be the president, you got to have to have a little bit of a bulldog in you. So I'm looking for that out of Pence."

The Republican field for the 2024 nomination is increasingly crowded.

On Tuesday, former New Jersey Governor Chris Christie launched a bid. On Wednesday, North Dakota Governor Doug Burgum also announced that he was entering the race.



What Happens Next?


Candidates for the Republican nomination will hit the campaign trail and begin a series of TV debates in the coming months


Elections in each state - called primary elections - begin next February


The person with the most support will be crowned at the Republican Convention in summer 2024


The winner of the nomination looks likely to face Democrat Joe Biden in the general election in November 2024


Mr Pence was seen as an unswervingly loyal deputy to Trump through much of their four years in office.

But he has distanced himself since the riot at the US Capitol.


Trump pressured Mr Pence to overturn Joe Biden's election victory when he presided over the certification of results in Congress and admonished him for lacking "courage" when he refused.

Some rioters were heard chanting "hang Mike Pence" as they stormed the halls of Congress, and many Trump loyalists view him as a traitor.

The ex-president said in a social media post he had been informed by special counsel Jack Smith on Sunday night that he was a target of their investigation.

Mr Trump posted that he was told to report to a grand jury, "which almost always means an Arrest and Indictment".



The special counsel did not immediately respond to media inquiries.

Such an indictment would be Mr Trump's third for alleged criminal offences, including 37 counts brought by Mr Smith's team in June accusing the president of mishandling classified documents.

Mr Trump has also been charged in New York City with falsifying business records in 2016 hush money payments to adult film star Stormy Daniels.

He is due to stand trial in that case next March, while a date for the classified documents case is still being contested by the president's lawyers.


In a post on his Truth Social platform, Mr Trump claimed that he had been sent a letter "stating that I am a TARGET of the January 6th Grand Jury investigation, and giving me a very short 4 days to report to the Grand Jury, which almost always means an Arrest and Indictment."

Mr Smith was appointed special counsel by US Attorney General Merrick Garland shortly after Mr Trump announced his presidential campaign last autumn.

His team was tasked with investigating Mr Trump's handling of classified documents after leaving the White House and of managing a sprawling federal investigation into the riot at the US Capitol and attempts by Mr Trump and his advisers to "interfere with the lawful transfer of power following the 2020 presidential election".

The special counsel's office has not discussed what specific criminal violations they are considering. It is not known if others have been told they are a target.

Last December, a House committee investigating the events of January 6 recommended four separate criminal charges be brought against the former president and his associates:

Inciting, assisting, aiding or comforting an insurrection
Obstruction of an official proceeding
Conspiracy to defraud the United States
Conspiracy to make a false statement



The Democratic-led committee - which included two Republicans - described the criminal referrals as a "roadmap to justice", but prosecutors do not have to follow a congressional committee's recommendations.

Mr Smith's own investigation has involved interviews with dozens of top Trump administration officials and advisers, including former Vice-President Mike Pence and Trump lawyer Rudy Giuliani.

According to public comments by some who have testified before the grand jury, questions have focused on efforts by Mr Trump's team to organise slates of "fake electors" who would claim that the former president had defeated Democrat Joe Biden in seven key battleground states.

State prosecutors in Atlanta, Georgia, are also investigating the former president on similar grounds, focusing on whether he illegally pressured state officials there to discard Mr Biden's victory.


In a December 2020 phone call with Georgia Secretary of State Brad Raffensperger, Mr Trump asked that Georgia officials "find 11,780 votes" that would flip the state to Mr Trump.

A decision by Georgia prosecutors on whether to indict Mr Trump is expected in August.


When a Mob Stormed The US Capitol

Speaking to CNN's Jake Tapper on Tuesday, Gov DeSantis suggested Mr Trump "could've come out more forcefully" to stop the Capitol riots but said he hopes the former president "doesn't get charged".

"I don't think it'll be good for the country. But at the same time I've got to focus on looking forward, and that's what we're gonna do," said Gov DeSantis.

Mr Trump's lead over his Florida rival has grown over the course of the past four months, even as his first two indictments were announced.

He has frequently painted the investigations - and indictments - as an attempt by his political opponents to prevent him from returning to the White House.

The former president's team has said that both indictments led to a surge in fundraising for his campaign.


In recently released figures, Mr Trump raised more than $17m (£13m) for his campaign from April to June, with millions more directed to an account that could be used to help finance his legal defence.

Michigan Attorney General Dana Nessel Files Charges in Fake Elector Scheme

Michigans' attorney general has announced charges against 16 people for their role in an alleged false electors scheme after the 2020 election.

Dana Nessel, a Democrat and the state's top legal official, accused the 16 of falsely claiming Donald Trump had won the state in paperwork.

She claimed their alleged actions "undermined the public's faith" in election integrity.


Each of the defendants was charged with eight felony counts, including forgery and conspiracy to commit forgery, each carrying a possible penalty of up to 14 years in prison.

This is the first time anyone has been charged in the US in the alleged "false electors" scheme.

The group of Michigan residents participated in an "orchestrated plan", Ms Nessel alleged, in hopes of flipping the winner of Michigan from Joe Biden to Donald Trump.

The accused are said to have met in the basement of the Michigan Republican Party headquarters to sign multiple certificates claiming they were duly elected and qualified electors for president and vice-president.

"This was a lie. They weren't duly elected electors and each of the defendants knew it," Ms Nessel said.

"They carried out these actions with the hope and belief that the electoral votes of Michigan's 2020 election would be awarded to the candidate of their choosing, instead of the candidate Michigan voters actually chose."

According to the Democratic-led congressional committee that investigated the 6 January Capitol Hill riots and Mr Trump's efforts to overturn the election results, the fake electors scheme was an attempt to interfere in the Electoral College system that decides presidential elections.

It centred on an attempt to persuade Republican-controlled state legislatures in seven states to select Republican electors or not name any electors in states that Mr Biden won, according to the committee.

The falsified certificates were then transferred to the US Senate in an effort to have their votes counted in the place of Michigan's real electors, and overturn Mr Biden's win both in Michigan and nationwide, Ms Nessel said.

President Biden won the state of Michigan by approximately 154,000 votes, which helped carry him to victory.

The group of defendants includes Meshawn Maddock, 55, a former co-chair of the Michigan Republican party and the wife of a state representative. Others include Amy Facchinello, 55, of Grand Blanc - one of the youngest defendants - and John Haggard, 82, of Charlevoix, the oldest.

Ken Thompson, a current Republican official who is among those charged, said the prosecutors will fail to win convictions.

"Not one of these prosecutions has bite," he told Michigan news website MLive.com, describing the charges as a political propaganda campaign.

The attorney general's announcement comes just hours after former president Donald Trump said he expected to be charged in connection with a federal investigation into other alleged efforts to undermine the 2020 presidential election.

In the wake of his loss, the former president and his team launched a widespread effort to challenge the outcome of the election. Without evidence, Mr Trump continues to deny the 2020 results and Mr Biden's victory.

The Former President was Indicted Tuesday on Four Federal Charges:

Conspiracy to defraud the United States
Conspiracy to obstruct an official proceeding
Obstruction of and attempt to obstruct an official proceeding
Conspiracy against rights.


The charges reflect what the indictment describes as three overarching criminal conspiracies related to the attempt to overturn the 2020 election, which culminated in the Jan. 6, 2021, attack on the U.S. Capitol.

Trump is accused of conspiracy in using “dishonesty, fraud, and deceit to impair, obstruct, and defeat” the efforts to count and certify the results of the election, as well as conspiracy to disrupt and impede the certification proceeding itself. It also alleges that Trump’s efforts to overturn the election amount to a conspiracy against the right to vote and have it counted.

“Each of these conspiracies — which build on the widespread mistrust the Defendant was creating through pervasive and destabilizing lies about election fraud — targeted a bedrock function of the United States federal government: the nation’s process of collecting, counting, and certifying the results of the presidential election,” the indictment reads.

In a statement posted to his Truth Social site, Trump called the charges “fake” and suggested they were an attempt to interfere with the 2024 presidential election, in which he is running for reelection.

Though Trump is the only named defendant in Tuesday’s charges, the indictment also lists six alleged co-conspirators, who are accused of helping his “criminal efforts to overturn the legitimate results of the 2020 presidential election and retain power.” While the alleged co-conspirators are unnamed in the indictment, they appear to line up with several notable Trump associates and advisers who disputed the results of the 2020 election.

Former US President Donald Trump has been criminally charged with plotting to overturn his 2020 election defeat.

He is accused of four counts, including conspiracy to defraud the US, tampering with a witness and conspiracy against the rights of citizens.

The indictment caps an inquiry into events surrounding the January 6, 2021 riot at the US Capitol.

Mr Trump, 77, who is again running for president, denies wrongdoing. On social media he called the case "ridiculous".

He is already charged in two other cases: with mishandling classified files, and falsifying business records to cover up a hush-money payment to a porn star.

The election investigation has focused on Mr Trump's actions in the two-month period between his loss and the riot in Washington DC, where his supporters stormed Congress as lawmakers certified Democratic President Joe Biden's victory.

The man leading the inquiry, US justice department-appointed special counsel Jack Smith, said on Tuesday evening: "The attack on our nation's capital on January 6, 2021 was an unprecedented assault on the seat of American democracy.

"As described in the indictment it was fuelled by lies."

Mr Smith wrapped up his brief statement by pledging to seek "a speedy trial", while emphasising that the former president "must be assumed innocent until proven guilty".

The 45-page indictment lists six unnamed co-conspirators: four lawyers, a justice department official and a political consultant.


The court document accuses Mr Trump of a "conspiracy to impair, obstruct, and defeat the federal government function through dishonesty, fraud and deceit".

Addressing Mr Trump's allegations of voter fraud in 2020, prosecutors say: "These claims were false and the defendant knew that they were false."

They also say Mr Trump tried and failed to convince Vice-President Mike Pence to attempt to block Mr Biden's certification as president on January 6, 2021.

"As violence ensued, the Defendant and co-conspirators exploited the disruption by redoubling efforts to levy false claims of election fraud and convince members of Congress to further delay the certification based on those claims."

The indictment also lists the numerous US officials and senior Trump campaign workers who, it says, informed the outgoing president that he had lost and that there was no evidence of voter fraud.

Trump, who now faces 78 criminal counts overall in three different cases, is currently the frontrunner in the Republican party's contest to pick its next presidential candidate.


Whoever wins will challenge the Democratic nominee, expected to be President Biden, in November 2024.

The Trump campaign said in a statement that Tuesday's indictment amounted to election interference.

"The lawlessness of these persecutions of President Trump and his supporters is reminiscent of Nazi Germany in the 1930s, the former Soviet Union, and other authoritarian, dictatorial regimes," said the campaign.
It added: "These un-American witch hunts will fail."

TRUMP has pleaded not guilty after being formally arrested and arraigned for conspiring to overturn the 2020 presidential election, in what marks his third – and potentially most serious – criminal case.

Trump’s motorcade was met with a chorus of derision as he departed the courthouse. “**** you, terrorist,” one man shouted. “Get the **** out of our city,” another said. “Good riddance, you prick,” a third man yelled. A woman posed for a selfie with her middle finger in the air.


Trump Appears to Stumble Over His Name and Age


Trump appeared to stumble over his words when he was asked to state his full name and age at his arraignment on charges of attempting to overturn the 2020 election on Thursday.


Donald Trump’s lawyer John Lauro calls it “absurd” for the government to suggest the case could go to trial within the 100 days required by the Speedy Trial Act.

He wants the case excluded from that.

“For the government to suggest this trial could be tried within the timeframe of the Speedy Trial Act is somewhat absurd, I think, given the scope of the discovery.”

The magistrate judge then ordered the government to fulfil its obligation to turn over exculpatory evidence, after which she formally arraigned former president Donald Trump.

Mr Lauro, the attorney for the ex-president, entered a plea of not guilty on all four counts on his behalf.

Thomas Windom, one of the prosecutors who represented the government at the arraignment, said the government was not seeking pretrial detention for Mr Trump, and said the ex-president had agreed to abide by release conditions that include not communicating with any witness in the case outside the presence of counsel.

The court proceedings began at 4.15 pm, with the courtroom standing for the magistrate judge’s entrance. After attorneys for the government and defence introduced themselves. Mr Trump was then asked to swear to tell the truth, the whole truth and nothing but the truth, and the judge reminded participants and media of court rules against recording.

Mr Trump was then asked to state his full name.

He replied: “Donald J Trump — John — Donald John Trump”.

Asked for his age, he at first said “seven seven,” then corrected himself and said “seventy-seven”.

After the magistrate judge read the charges and explained the penalties Mr Trump could face if convicted, she advised the ex-president — who she addressed as “Mr Trump” — of his right to remain silent, and his right to an attorney.

After explaining each right, she asked if he understood. Each time, he replied: “Yes” or “yes, I do”.

Jack Smith, the Department of Justice special counsel who has supervised the multiple federal investigations that have resulted in criminal charges against the former president, arrived in the courtroom at 3.45 pm, a quarter-hour before the proceedings were set to begin.

Mr Smith entered the courtroom with members of his team, but sat at a bench in front of the bar which separated the working part of the courtroom from the spectator area where a small group of reporters had assembled more than an hour before to allow for security screenings by Secret Service.

One member of Mr Trump’s defence team, Evan Corcoran, entered the room four minutes after Mr Smith and sat on a similar bench across the room’s central aisle.

The ex-president entered at 3.51 pm, accompanied by John Lauro, a veteran Washington-based criminal defence attorney, and Todd Blanche, the New York-based lawyer who is leading his defence in the other criminal cases against him.

Mr Trump, wearing his customary red tie, white shirt and dark blue suit, sat impassively between Mr Blanche and Mr Lauro. After the ex-president and his team were seated, Mr Smith was seen glancing over at the defendant and counsel.

Donald Trump was irritated by a judge who called him “Mr Trump” instead of “President Trump” as he pleaded not guilty to attempting to overturn the 2020 election results.

“One thing that irked him particularly was during that hearing... when the magistrate judge referred to him as simply ‘Mr Trump’.

A federal judge has denied the request of former President Donald Trump's legal team for an extension to respond to the Department of Justice's request for a protective order.

The DOJ asked U.S. District Court Judge Tanya Chutkan to issue a protective order after prosecutors said that the former president posted on social media a promise of revenge on anyone who went after him.

The post Trump made on his Truth Social platform on Friday said, in all capital letters,

This was posted a day after Trump pleaded not guilty to charges of trying to overturn his 2020 election loss and block the peaceful transition of power.

Prosecutors requested the protective order to restrict what information Trump and his legal team can publicly share about the case brought by special counsel Jack Smith. Their main concern is focused on Trump's social media posts about "witnesses, judges, attorneys, and others associated with legal matters pending against him."

On Saturday, Judge Chutkan gave Trump's legal team until 5 p.m. Monday to reply to the government's request. Trump's legal team subsequently filed a request for an extension until Thursday, along with a hearing on the matter, citing the need for more time for discussions.

But Judge Chutkan promptly denied the extension request on Saturday evening, reaffirming that Trump is required to adhere to the original deadline of Monday.

"The court will determine whether to schedule a hearing to discuss the proposed protective order after reviewing Defendant's response and, if included, his revised proposed protective order with modifications in redline," Chutkan wrote in the decision denying the extension.

Donald Trump has said he will ask the judge in his alleged election fraud case to step aside on what he called "very powerful grounds".

He gave no details of his grounds for asking her to step down.

His call came after the prosecution requested a court order that would limit what he can publicly say about the case.



The judge, Tanya Chutkan, was appointed by former President Barack Obama.

Trump took to his social media platform, Truth Social, on Sunday morning, describing the case as "the ridiculous freedom of speech/fair elections case" and saying that his legal team would immediately be asking for recusal of the judge.

Judge Chutkan, appointed in 2014, previously ruled against Mr Trump's efforts to shield evidence from the House January 6 Committee.

The 61-year-old judge has won a reputation for harsh sentences for those convicted of participation in the riots. According to Associated Press news agency she is one of the toughest punishers.

Under US federal law, any judge of the United States must disqualify themselves in any proceeding in which their impartiality might reasonably be questioned.



Recusal of the judge was not the only thing Mr Trump said he would request. He also said he wanted a "venue change" and for his case to be moved out of Washington.

He previously said there would be "no way I can get a fair trial, or even close to a fair trial, in Washington", which he describes as "anti-Trump", and has previously described the Department of Justice as "highly partisan and very corrupt".

Mr Trump's lawyer, John Lauro, said on Sunday that the former president "believed in his heart of hearts" that he had won the 2020 election - and that prosecutors will not be able to prove that Mr Trump did not believe this.

Speaking to US TV networks, Mr Lauro said Mr Trump was being attacked for exercising his constitutional First Amendment right to free speech.

Earlier this week, Mr Trump wrote in capital letters, "If you go after me, I am coming after you!" on Truth Social, just a day after he pleaded not guilty to four charges in the alleged election fraud case.

And the same night, the prosecutors said they feared there was a chance Mr Trump might disclose confidential evidence and asked for a protective order to prevent "the improper dissemination or use of discovery materials, including to the public".

Judge Chutkan gave Mr Trump's legal team until 17:00 local time on Monday to respond to the submission. Mr Trump's lawyers asked for three more days, but the judge denied their request.

The Fulton county district attorney investigating Donald Trumps’ efforts to overturn the 2020 election results in the state of Georgia is expected to present evidence to a grand jury and ask it to return indictments as early as next Tuesday, according to two people familiar with the matter.





TRUMP has said the indictment is a political witch-hunt and infringes on his first amendment rights.


The prosecutors in the office of district attorney Fani Willis completed its internal reviews for criminal charges in the TRUMP case weeks ago, the people said. The review process, to identify any weakness with the case, is typically seen as the final step before charges are filed.

Willis has also privately indicated to her senior staff that the prosecutors on the Trump case were sufficiently prepared that they could go to trial tomorrow, the people said.


In the Trump investigation, prosecutors have developed evidence to pursue a sprawling racketeering case that is predicated on a statute about influencing witnesses and computer trespass by Trump operatives in Coffee county, the Guardian has previously reported.

The extent of Trump’s legal jeopardy remains unclear. But the racketeering statute in Georgia is especially expansive and attempts to solicit or coerce certain activity – for instance, Trump’s call to the secretary of state, Brad Raffensperger – could be included in the indictment.

The district attorney’s office has also weighed several state election law charges, including: criminal solicitation to commit election fraud and conspiracy to commit election fraud, as well as solicitation of a public or political officer to fail to perform their duties and solicitation to destroy, deface or remove ballots.

Willis originally suggested charging decisions were “imminent” in January, but the timetable has been repeatedly delayed after a number of Republicans who sought to help Trump stay in power as so-called fake electors accepted immunity deals as the investigation neared its end.

The district attorney’s office has been issuing summons to witnesses to testify before the grand jury, as part of the final presentation by prosecutors that is expected to take just a couple of days before they ask the grand jury to return an indictment, the people said.

Charges stemming from the Trump investigation could come as early as next Tuesday if the presentment starts on Monday, the people said. That dovetails with a timeline inferred from Willis instructing her staff to move to remote work during that period because of security concerns, the Guardian has previously reported.

A spokesperson for Willis did not immediately respond to a request for comment.

The district attorney’s office has spent more than two years investigating whether Trump and his allies interfered in the 2020 election in Georgia, including impaneling a special grand jury that made it more straightforward to compel evidence from recalcitrant witnesses.

Unlike in the federal system, grand juries in the state of Georgia need to already be considering an indictment when they subpoena documents and testimony. By using a special grand jury, prosecutors can collect evidence without the pressure of having to file charges.

The special grand jury in the Trump investigation heard evidence for roughly seven months and recommended indictments of more than a dozen people including the former president himself, its forewoman strongly suggested in interviews with multiple news outlets.

Trumps’ legal team sought last month to invalidate the work of the special grand jury and have Willis disqualified from proceedings, but the Georgia supreme court rejected the motion, ruling that Trump lacked “either the facts or the law necessary to mandate Ms Willis’s disqualification”.

Donald Trump reacted furiously on Thursday to a proposed trial date of 2 January in special counsel Jack Smith’s case against the former president for allegedly trying to overthrow the 2020 election result.








“Deranged Jack Smith has just asked for a trial on the Biden Indictment to take place on January 2nd., just ahead of the important Iowa Caucuses,” Mr Trump wrote on his Truth Social platform on Thursday.

“Only an out of touch lunatic would ask for such a date, ONE DAY into the New Year, and maximum Election Interference with IOWA!

Such a trial, which should never take place due to my First Amendment Rights, and massive BIDEN CORRUPTION, should only happen, if at all, AFTER THE ELECTION. The same with other Fake Biden Indictments. ELECTION INTERFERENCE!”


'AFTER THE ELECTION'.... (So I can pardon myself by overturning any GUILTY verdict)....



Earlier in the day, Jack Smith’s office asked the District of Columbia judge to schedule the twice-impeached, thrice-indicted ex-president’s trial for a four to six week period beginning on 2 January next year.

In an eight-page filing authored by Senior Assistant Special Counsels Molly Gaston and Thomas Windom, the special counsel’s office said their proposed schedule would give Mr Trump and his defence team sufficient time to prepare a case and review the evidence which the government is prepared to turn over as part of the discovery process, as well as litigate any pre-trial matters such as the request for a change of venue Mr Trump has said he will call for.

The prosecutors also said that a 2 January 2024 trial date would “most importantly ... vindicate the public’s strong interest in a speedy trial,” which they described as being “of particular significance” because Mr Trump is “charged with conspiring to overturn the legitimate results of the 2020 presidential election, obstruct the certification of the election results, and discount citizens’ legitimate votes”.

“A January 2, 2024, trial date represents an appropriately speedy trial in the public interest and in the interests of justice, while affording the defendant time to prepare his defense and raise pre-trial legal issues with the Court,” they said.

At his arraignment one week ago, Mr Trump’s attorneys indicated that they would request significant delays and ask Judge Tanya Chutkan to stop the clock set under the Speedy Trial Act which sets out a 70-day period in which trials in criminal cases are required to begin.

The ex-president’s legal strategy in both civil and criminal matters, dating back decades, is to cause as many delays as possible through any means possible. The three criminal cases against him have not proved an exception to this pattern, as Mr Trump is understood to believe his best chance at avoiding any negative consequences from the cases is to win next year’s presidential election.
But the magistrate judge who presided over the arraignment, Moxila Upadhyaya, told Mr Trumps’ counsel that Judge Chutkan intends to set a trial date after a status conference on 28 August, and gave the government a full week to propose a trial schedule.


Mr Trump’s team will now have a week to respond to the departments’ proposed schedule, though it’s unlikely that the ex-presidents’ counsel will agree with the government’s timeline.

At the arraignment last week, Trump attorney John Lauro suggested that he and his co-counsel could not begin to consider any possible trial date until they’d received the evidence which the government must turn over as part of the pre-trial discovery process.

“We need all that information, I think, in order to address the issue of when we would be ready, and also the extent to which we would have an idea of how long the trial would be,” he said.

Mr Trump’s legal team has already prevented the discovery process from kicking off by objecting to the government’s proposed protective order on the grounds that it would violate the ex-president’s right to free speech by barring him from publicly revealing evidence while on the campaign trail.

The prosecutors noted the disconnect between the arguments made at arraignment and the Trump defence team’s refusal to agree to a protective order that would allow them to begin reviewing discovery, calling the contradiction “perplexing”.

They also slammed Mr Lauro’s claim that the defence is “starting with a blank slate” as “impossible” and “disingenuous,” citing Mr Trump’s awareness of and response to much of the evidence which was previously made public during the House January 6 select committee’s hearings last year and the panel’s final report.

Continuing, prosecutors also pointed out that one of Mr Trumps’ lawyers, Evan Corcoran, has long represented the ex-president in matters relating to his efforts to overturn his election loss.

“The defendant has a greater and more detailed understanding of the evidence supporting the charges against him at the outset of this criminal case than most defendants, and is ably advised by multiple attorneys, including some who have represented him in this matter for the last year,” they said.

“The Governments’ proposed schedule and January 2 trial date afford the defendant many months to review the discovery in this matter, raise pre-trial legal issues, and prepare his defense. No additional time is necessary or warranted under the Speedy Trial Act and in light of the public’s strong interest in a prompt trial”.

The special counsel’s office also responded to a separate motion Mr Trump’s attorneys made to exclude a 25-day period between his arraignment and the scheduled 28 August hearing from Speedy Trial Act calculations.

Prosecutors said they opposed the motion as unnecessary because the time Mr Trump’s team seeks to exclude “has already been and continues to be excluded under the Act”.

They added that Mr Trump’s legal team appeared not to understand that both the Speedy Trial Act and the Sixth Amendment to the US Constitution (which guarantees speedy trials in criminal cases) protects not just a defendants’ rights, but “the publics’ strong interest in the efficient administration of justice”.

“None of the defendants’ perfunctory and undeveloped arguments justify the Courts’ exclusion of time at this juncture of the case. The defendant cites his need to review discovery ... but the defense has steadfastly refused to accept the discovery that the Government has prepared and organized to facilitate the defenses’ review,” they said.

A Georgia grand jury indicted former President Donald Trump today, charging him as part of a sweeping investigation into the effort by him and his allies to overturn the 2020 election.

Fulton County District Attorney Fani Willis enlisted a special grand jury last year that heard testimony from 75 witnesses.

Among the best-known moments in the pressure campaign against Georgia officials was a call in which Trump asked Republican Secretary of State Brad Raffensperger to "find" the votes he needed to beat Joe Biden.

Several Trump allies also appeared to be subjects of the investigation, including former Trump attorney Rudy Giuliani.


Georgia grand jury investigating Donald Trump and his allies for potential election fraud in 2020 handed up 10 indictments Monday, but it was not clear immediately whether the former president was charged.

The investigation was based on Trumps’ strategy to overturn the results of a state he lost to President Joe Biden, part of a broader federal indictment to which he pleaded not guilty earlier this month. His strategy included the recruitment of fake presidential electors for Congress to count and an extraordinary phone call urging state election officials to “find” him more votes, according to a House investigation.

The first count in the Georgia indictment charges Donald Trump and 18 others with racketeering for their alleged efforts to overturn the results of the 2020 presidential election in the state.

Announcing the charges, Fulton County District Attorney Fani Willis implicated the former president in a sprawling election subversion conspiracy, with him as the ringleader.

"The indictment alleges that rather than abide by Georgia's legal process for election challenges, the defendants engaged in a criminal, racketeering enterprise to overturn Georgia's presidential election results," she said.

These are the fourth set of criminal charges brought against Trump in recent months, but it is the first time a former American president faces charges once used to convict mob bosses like John Gotti and Vincent Gigante.

Organised criminal activity in the US is routinely prosecuted under the federal Racketeer Influenced and Corrupt Organizations (Rico) Act.



Rico laws help prosecutors connect the dots between underlings who broke laws and those who gave them marching orders.

More than 30 US states have implemented their own versions of the federal government's Rico Act and Georgia's adaptation is broader in scope than most.

Federal Rico statutes list 35 crimes that would qualify as evidence of racketeering, but Georgia's Rico laws choose from a list of 65.

Prosecutors are required to show that a criminal "enterprise" exists and to detail a pattern of racketeering that rests on at least two qualifying crimes.

Penalties under Georgia's Rico Act are steep - prison terms between five and 20 years, or fines of up to $250,000 (£197,000) - and can help persuade subordinates to cut deals with the prosecution in exchange for lesser sentences.





Such incidents may generate a wave of never-before-seen evidence and testimony prosecutors can use against the alleged ringleaders, according to Anthony Michael Kreis, a law professor at Georgia State University.

To convict Mr Trump himself, Mr Kreis said prosecutors will have to show the former president was "not some kind of passive participant" following legal advice, but the man "driving the bus".

Mr Trump is already facing federal charges from the US Department of Justice over his false election claims, in a trial whose evidence could factor into, and overlap with, the case in Georgia.

He is also awaiting trial over his alleged mishandling of classified documents and his hush-money payments to a porn star.

District Attorney Fani Willis has used the state's racketeering laws for high-profile prosecutions in the past.

In 2013, she led the prosecution - on Rico charges - of Atlanta public school teachers and administrators accused of cheating on state-run standardised tests in order to secure bonuses and promotions.

"You don't, under Rico, have to have a formal, sit-down dinner meeting where you eat spaghetti," Ms Willis explained as she indicted nearly three dozen educators about a decade ago.

"But what you do have to do is all be doing the same thing for the same purpose. You all have to be working towards that same goal."

Eleven of 12 officials were ultimately convicted at trial, the longest in state history, with most other co-conspirators taking guilty pleas.

"I am hoping Fani Willis has learned from this YSL case when Donald Trump's case finally gets to that level," said Keisha Steed, an Atlanta defence attorney. "The way it's playing out has been a mess!"


She said Ms Willis's office did not seem "prepared for the number of jurors that they had to call in, the logistics of having everybody be in one place, the time it takes for all attorneys to question jurors".

The plodding pace of Young Thug's trial has set it on course to beat the record set by the Atlanta educators' trial as the longest in state history.

That is not unusual for multi-defendant and multi-attorney Rico cases, which can create major backlogs in the legal system.

"The whole courthouse is basically closed," said Meg Strickler, another local defence attorney.

"I hate the Rico Act," she added, saying clients are frequently intimidated by the penalties they could face, and the time and money needed to defend themselves.

And, given how lengthy and complicated Rico trials are, she expects the Trump trial will prove a confusing and uncomfortable affair for a jury, if one can eventually be seated.


What About The Trial?


The man leading the inquiry, special counsel Jack Smith, is pledging to seek a "speedy trial", but it is far from certain that this will happen.

Trumps' lawyers are resistant, saying they will need time to organise their client's defence.

Also, the trial will be competing for time with the other cases against him and is unlikely to be held at key moments during the election.

So the possibility remains that Trump could have already been elected president by the time the trial starts.


What Are The Charges Against Trump?

Trump, who lost the 2020 presidential election to Democrat Joe Biden, has been charged with plotting to overturn his defeat.

He is Accused of Four Counts:

Conspiracy to defraud the US
Conspiracy to obstruct an official proceeding
Obstruction of an official proceeding
Conspiracy against the rights of citizens


These charges relate to Trumps' actions over a period of more than two months from soon after election day (3 November) until the day he left the White House on 20 January.

The first count refers to alleged attempts to obstruct the collection, counting and certification of votes.

The second and third deal with alleged attempts to obstruct the certification of electoral college votes in the US Congress on 6 January, which culminated in the Capitol riots.


The fourth charge is about alleged attempts to interfere with citizens' right to vote and to have their votes counted.

This is Trumps' third indictment and some legal experts have said it may not be the strongest case brought against him. He may face deeper legal peril elsewhere.

But in terms of the gravity of the charges, these are the most serious and consequential, says our North America editor, Sarah Smith.

This is the first time he is being indicted for something which took place while he was still in office, she says. And there is also a real-world impact laid out in this indictment which we have not seen in the other cases.


What Did Trump Do and Say Which Led to These Charges?


As votes were counted after the election, it soon became clear that Mr Trump was not prepared to accept that he had lost.

According to the indictment, he lied and echoed false claims of electoral fraud for months despite being told by Vice President Mike Pence and other senior officials that they were not true.

It is likely the former president's lawyers will argue that he has a right under the First Amendment of the US Constitution to express his views, even if they involve false claims.

These views were expressed on the morning of 6 January 2021 by Mr Trump in a tweet ahead of a rally of his supporters in Washington DC.

Later at the rally he urged supporters to converge on the US Capitol to "make your voices heard" and "fight like hell" as Congress was meeting.

What ensued became known as the Capitol riots, as a mob of Trump supporters violently attacked the Congress building, forcing lawmakers to be evacuated and delaying the proceedings.

Mr Trump tweeted that afternoon calling for rioters to remain peaceful and respect the law.

But he later praised the demonstrators as "great patriots". And he continued to falsely claim electoral fraud in his remaining two weeks in the White House.


What is Mike Pences' Role in The Affair?

The US vice-president is also president of the Senate, and has a mostly ceremonial role which includes the final certification of election results.


Trump publicly pressured Mr Pence to obstruct this certification.

Mr Pence refused, and maintains he had no right to overturn the election.

He has since accused Trump of endangering him and his family, as well as others at the Capitol who were threatened by the rioters.


Who Are Trumps' Co-conspirators?

The indictment mentions six co-conspirators including a Department of Justice official, four attorneys and a political consultant. None of them are named as they have not been charged with a crime.




However, quotes, anecdotes and other context in charging documents and previous investigations have allowed five of them to be identified.

They are former Trump attorneys Rudy Giuliani, John Eastman and Sidney Powell, Justice Department official Jeffrey Clark and pro-Trump lawyer Kenneth Chesebro.


The identity of the sixth co-conspirator, a political consultant, remains unclear.


Could Trump Go to Prison and Still Run For President?


The former president, at 77 years of age, is facing the possibility of a stiff prison sentence if convicted.


Trump is also facing jail terms of up to 20 years in the classified documents case.





Lyndon LaRouche, convicted of fraud, stood for president eight times


Under US law, nothing prevents an individual from running for office if they are facing criminal charges, or even if they are in jail.

Of course that doesn't mean that voters would want to support such a candidate.

At least two people have previously run for president with criminal convictions - socialist candidate Eugene Debs in 1920, convicted over a 1918 anti-war speech; and conspiracist Lyndon LaRouche, convicted of fraud, one of whose eight runs for president in 1992 was from a federal prison in Minnesota.

Both lost their elections.



Who is Tanya Chutkan?

The judge assigned to oversee the case, Tanya Chutkan, is an Obama appointee, known to be a tough sentencer in other 6 January cases.

She has come up against Trump on one previous occasion in 2021, blocking his efforts to stop a Congressional committee accessing White House documents.

As a district court judge for the District of Columbia, she has seen numerous people accused of participation in the Capitol riots, often going beyond sentencing recommendations by prosecutors.


What are Trumps' Chances Against Joe Biden?


Trump is currently way out ahead of the field of candidates for the Republican nomination for president.

Opinion polls since his indictment suggest his lead over his nearest rival, Florida Governor Ron DeSantis, has grown to some 37 percentage points.

But while his support among his base and the Republican Party in general has solidified, what about his popularity among voters in general?

Current President Joe Biden defeated Trump in 2021 and has always presented himself as the candidate who can beat him again.

Indeed early head-to-head polls suggest he has a lead of between two and four percentage points over his rival.

But this lead is slender and within the margin of error, suggesting Trump is again within striking distance of the White House.


What if He is Convicted But Still Wins The Election?

Some have suggested that Trump as President could try to pardon himself....

TRUMP and 18 allies, including former chief of staff Mark Meadows and attorney Rudy Giuliani, are accused of trying to overturn Georgia's 2020 presidential election results in an indictment handed down Monday night. 13 new criminal charges.


Donald Trump and 18-codefendants have been indicted under a law that is engineered to prosecute the mob. Fulton County District Attorney Fani Willis has assembled the most comprehensive and wide-ranging indictment of the Trump accountability era, depicting Trump and his allies’ attempt to overturn the 2020 election as a “criminal enterprise.”

The 41-count grand jury indictment claims Trump and his co-defendants “unlawfully conspired and endeavored to conduct and participate in criminal enterprise in Fulton County, Georgia, and elsewhere.” It doesn’t shy away from naming names.

The first page lists all 19 co-defendants and the adjacent 41 counts they’re accused of. Donald Trump is accused of 13 of the 41 counts, and his co-defendants include his former Chief of Staff, his former lawyers, a former DOJ official, a Georgia state GOP chair, fake electors, and county election officials.

The 19 defendants are Donald Trump, Rudy Giuliani, John Eastman, Mark Meadows, Kenneth Chesebro, Jeffrey Clark, Jenna Ellis, Ray Smith III, Robert Cheeley, Michael A Roman, David Shafer, Shawn Still, Stephen Lee, Harrison Floyd, Trevian Kutti, Sidney Powell, Cathleen Latham, Scott Hall, and Misty Hampton. The charges are serious and include racketeering, conspiracy to commit election fraud, false statements and writings, impersonating a public officer, forgery, criminal attempt to influence witnesses, computer theft, computer trespass, computer invasion of privacy, conspiracy to defraud the state, acts involving theft, and perjury.


The indictment outlines a sprawling criminal conspiracy built on the foundation of Georgia’s RICO (Racketeer Influenced and Corrupt Organizations) law. This law gives DA Willis the tools to piece together a “pattern of racketeering activity” encompassing multiple defendants who conspired to commit crimes as part of a broader, collaborative goal. And a pattern of organized criminal activity is exactly what is outlined in this indictment. Donald Trump and his allies were held accountable for just about every alleged criminal act we saw outlined in the January 6 hearings and more acts we didn’t know about until this week.

The indictment is structured around the 41 counts, with the bulk of the indictment detailing count 1: Violations of Georgia’s RICO Act. This section presents a robust timeline outlining the conduct of Trump and his co-conspirators, breaking down the methods and acts of the alleged “criminal enterprise.” The timeline spans conduct from October 2020 all the way to September 2022 and includes conduct that took place nationwide in furtherance of the conspiracy, including in Michigan, Arizona, and Pennsylvania. All 19 of the co-defendants are accused of this count and the conduct outlined within the count.

The indictment details the fake elector plot that included false statements, the creation of fake documents, and the solicitation of state legislatures to certify fake Trump electors instead of legitimate Biden electors. Trump’s phone call to Secretary of State Brad Raffensperger and other attempts to pressure state officials to overturn the election results is presented in this indictment as well. We all heard Trump’s “perfect call,” but seeing it laid out in the framework of “false statement” and “solicitation of violation of oath by a public officer” charges really puts the call into proper perspective.

The pressure campaign targeting former Vice President Mike Pence and Trump’s pressure on the DOJ is explicitly cited as well, including his infamous quote: “Just say that the election was corrupt, and leave the rest to me and the Republican congressmen.” The harassment and intimidation of election worker Ruby Freeman are also included in this indictment. The conduct outlined in Freeman’s riveting testimony during the January 6 hearings felt criminal, and now it’s being prosecuted as such.

One of the most stunning allegations in this indictment is the alleged conspiracy to breach voting machines. In their desperate attempt to prove their false voter fraud claims, Trump allies allegedly conspired to breach Coffee County voting machines and “stole data, including ballot images, voting equipment software, and personal voter information.” This was allegedly disseminated to other members of the enterprise and elsewhere. The co-defendants involved are allegedly former Trump lawyer Sidney Powell, former Coffee County election supervisor Misty Hampton, former Coffee County GOP official Cathy Latham, and pro-Trump poll watcher Scott Hall.

All of that conduct was listed in the RICO count in 161 separate acts, most of which are punctuated with the simple sentence: “This was an overt act in furtherance of the conspiracy.”

The RICO structure of this indictment is brilliant. By presenting each crime as part of an interconnected set of acts in furtherance of the broader conspiracy executed by the “criminal enterprise,” DA Willis can charge the enterprise as a whole with the conduct rather than proving everyone committed every single crime individually. This allows DA Willis to apply more pressure on the defendants and perhaps get some to cooperate with prosecutors. Another benefit of Georgia’s RICO law is that the charges would carry a mandatory minimum of 5-20 years in prison. Rudy Giuliani, who once used the federal RICO Act to take on the mob, has just been indicted himself under the same framework.

In a 1989 Supreme Court ruling on the federal RICO law, the high court ruled that RICO was created “broadly enough to encompass a wide range of criminal activity, taking many different forms and likely to attract a broad array of perpetrators.” Georgia is among the states who implemented their own RICO laws that are protected under this precedent. Given this context, legal experts have said that RICO could appropriately apply to Trump’s alleged criminal enterprise.

The seriousness of these charges and the threat they pose to Trumpworld are the key takeaways here, but the hypocrisy and irony of these charges are also notable. Donald Trump and his alleged “criminal enterprise” were indicted with charges that they falsely accused others of committing in the 2020 election. It’s Donald Trump and his team who are being indicted for a conspiracy to commit voter fraud, not Democrats. It’s Donald Trump and his team who are being indicted for allegedly breaching voting machines, not Democrats. It’s Donald Trump and his team who were trying to steal the 2020 election, not Democrats.

Georgia’s case brings Donald Trump his fourth criminal indictment, or fifth if you count the classified document case’s superseding indictment. It’s his second indictment in relation to his un-American effort to overturn the 2020 election. While Trump has been trying to make indictments part of his 2024 campaign for President, recently begging for another one, I highly doubt that he is happy with this one. This case complicates Trump’s plan to win the presidency to protect himself from criminal liability.


If Trump were convicted in this Georgia case, not only would he not have the power to pardon himself of the state charges, the Georgia governor doesn’t have that power either.

That power resides with the Board of Pardons and Paroles. As Trump’s indictments mount, the odds that Trump might not escape accountability are increasing.

If convicted and facing a mandatory minimum of five years, it would be impossible to run the country from a jail cell. Georgia poses the greatest threat to Trump’s 2024 plans to save himself.

The Lawyers


Rudy Giuliani
Perhaps the best known of the co-accused, the former mayor of New York City was a personal lawyer for Mr Trump at the time of the election.
He led legal challenges to dispute the outcome of the elections, and is accused of making numerous false statements about election fraud, including claims that errors had been made by the Dominion vote-counting machines.
He faces 13 charges, more than any of the co-accused except for Mr Trump himself. He has dismissed the investigation against him as politically motivated.
As mayor of New York, Giuliani was one of the most popular politicians in the US. As a close adviser after the 2020 election, he helped organise attempts to challenge Mr Trump's defeat at the polls.

John Eastman
Mr Eastman, a lawyer for Mr Trump, represented the former president in a lawsuit trying to overturn election results in four states he lost in 2020.
In Georgia he is alleged to be part of a plot to urge state senators to disregard the election results and appoint fake electors.
A California law professor who advanced the theory that Vice-President Mike Pence had the power to reject the certified results from certain states that Mr Trump lost in 2020, including Georgia, based on allegations of voting irregularities.

Sidney Powell
Another Trump attorney and a vocal promoter of false fraud claims.
Some of her more outlandish claims - that electronic systems switched millions of votes to President Biden and that he won thanks to "communist money" - led Mr Trump's team to distance itself from her in the weeks after the election.
A lawyer closely tied to Mr Trump's attempts to challenge the 2020 election results. She is also alleged to have been involved with an illegal breach of election data in Coffee County, Georgia, in an attempt to find evidence of voter fraud.

Kenneth Chesebro
Mr Chesebro is an appellate lawyer who first became involved in the Trump campaign's post-election efforts in Wisconsin before expanding into other states lost by Mr Trump.
In Georgia he is accused of helping to devise a plan to submit fake slates of electors for Mr Trump.
It is alleged he wrote a memo that provided instructions for how such electors in states including Georgia should proceed to meet and cast votes for Mr Trump.
The indictment alleges this scheme constituted, among other things, fraud and forgery.

Jenna Ellis
Jenna Ellis is said to have written legal memos for the former president
Another of Mr Trump's legal team alleged to have been involved in trying to get false electors appointed in four states, including Georgia. She is said to have written legal memos for the former president advising how then vice-president Mike Pence could delay the certification of Mr Biden's election win.
A Trump attorney who, along with Mr Giuliani, was one of the most ardent supporters of allegations of election fraud and an organiser of attempts to reverse the election results.

Ray Smith III
A member of the Trump legal team who filed one of the campaign's election challenges in a state court and is alleged to have made false claims at a legislative hearing in the state.

Robert Cheeley
A Georgia-based lawyer, accused of making unfounded accusations that election workers were double and triple-counting votes.
He has also served as an attorney for another of the accused, Cathy Latham, according to the Washington Post.
Smith and Cheeley are attorneys involved in the Trump team's efforts to advance "alternate" presidential electors who claimed Mr Trump won Georgia


Federal and Trump Campaign Officials

Mark Meadows
The former congressman was Mr Trump's chief of staff at the time of the election.
He is alleged to have tried to pressure a chief investigator to speed up signature verification in Fulton County and to have been involved in a phone call in which Mr Trump tried to persuade Georgia Secretary of State Brad Raffensperger to "find" enough votes to overturn Joe Biden's victory in the state.
A former conservative leader in the House of Representatives, he headed the Trump White House team. He has been indicted for his involvement in that phone call.

Jeffrey Clark
A former Department of Justice (DoJ) official, Mr Clark is accused of trying to persuade the then acting attorney-general to write to the Georgian authorities claiming voting irregularities had been found there.
He is also alleged to be part of wider efforts to use the department to investigate voter fraud.
Trump reportedly considered making Mr Clark the acting US attorney general - but he backed down when other senior Justice Department officials threatened to resign en masse.

Michael Roman
A senior member of the Trump election campaign, he is said in the indictment to have played a role in organising the fake electors' plot.

Georgia State and County Officials


David Shafer
Mr Shafer was chairman of the Georgian Republican Party.
He is one of those charged with mailing a fake certificate of Trump electors to a federal courthouse, and making false statements to investigators.
He portrayed himself as the "chairperson" of the 16 fake Trump electors. He led the meeting of "alternate" electors who claimed Mr Trump won Georgia.

Misty Hampton
Former election supervisor of Coffee County, who is alleged to have helped Trump supporters gain access to the county's voting equipment.
She also made a video soon after the election claiming that voting machines used in the county could be manipulated.

Cathy Latham
Former Republican Party chair in Coffee County and one of the 16 fake Trump electors for the state.

Shawn Still
Then finance chair of the state Republican Party and now a Georgian state senator, he was another of the fake electors.


Others

Trevian Kutti
A former publicist for R Kelly and Ye (formerly known as Kanye West), accused of involvement in a plot to pressure a Fulton County election worker to falsely admit committing fraud.

Stephen C Lee
A Lutheran pastor from the state of Illinois accused of efforts to intimidate election workers in the Georgian state capital Atlanta.

Harrison Floyd
Former head of a group called Black Voices for Trump, also accused of intimidation of Atlanta election workers.

Scott Hall
Bail bondsman and Trump supporter involved in allegedly trying to gain access to sensitive election equipment in Coffee County.

Lee, Floyd and Kutti are Trump supporters alleged to have attempted to illegally pressure Ruby Freeman, a volunteer election worker, into admitting that she committed election fraud.

Fulton County Jail Has Come Under Fire For Allegations of Unsanitary Living Conditions and Negligence

The Fulton County Jail, known as Rice Street, is not a place for the faint of heart, said a veteran defense lawyer



In the coming days, Donald Trump will turn himself in to police in Georgia. His initial brush with the local criminal justice system is expected to last just hours - most other defendants are not so lucky.

Authorities announced on Wednesday that Mr Trump and his fellow 18 defendants are "expected" to be booked at the Fulton County Jail in Atlanta before being arraigned at the courthouse, though they warned "circumstances may change".


The local sheriff, Pat Labat, has said that officials will follow "normal practices" when processing Mr Trump.



But experts said he will probably have a very different experience from those who languish in the county's notoriously unsafe jail for weeks, months or even years while awaiting trial.

In the US, criminal defendants wait in a jail if they have been arrested, are awaiting trial without bail, or are serving a short sentence behind bars. Prisons are where criminals serve longer sentences after conviction.

Hundreds of people were held at Fulton County Jail for more than 90 days because they had yet to be formally charged or could not afford to pay the bail bond required for their release

A Report found 117 people had waited in jail for more than a year because they had not been indicted; 12 had been held for two years for the same reason.

"It's essentially been overcrowded since it was built," said Fallon McClure of the ACLU of Georgia. "This has just been a perpetual cycle over and over for years."


'Rapidly Eroding' Conditions


Built in 1985 to house around 1,300 inmates, Fulton County Jail has held more than 3,000 people in recent years.

The jail provides "unhygienic living conditions" that have led to outbreaks of Covid-19, lice and scabies, a report by the Southern Center for Human Rights said. It found inmates were "significantly malnourished" and dealing with a condition called cachexia, also known as wasting syndrome.

Waiting in these dilapidated conditions has proven deadly for some.

Last week, a 34-year-old man was found unconscious in a medical unit cell at the jail, where he had been held since 2019. He was resuscitated, but then died at the hospital, according to the Fulton County Sheriff's office.

He was the sixth person this year to die in the county jail system in 2023. A US inmate died in insect-infested 'death chamber'



Noni Battiste-Kosoko was just 19 when she died in Fulton County Jail custody in July after being arrested on a less serious misdemeanour charge. Deputies found her unresponsive in her cell in the Atlanta City Detention Center, an additional space the county is leasing to alleviate overcrowding at the main jail.

Battiste-Kosoko's family has still not been given a cause for her death or found out the results of her post-mortem examination, her family's lawyer told the BBC.

"There has been a consistent and unsettling pattern of poor healthcare and inmates dying at the jail under mysterious circumstances," said Roderick Edmond.

The Fulton County Sheriff's Office told the BBC it was still awaiting a final report from the autopsy, and that it was investigating the incident.

Battiste-Kosoko's death came just before Fulton County this month agreed to pay $4m (£3.1m) to the family of a man who died in the jail covered in bed bug bites.

An independent autopsy found 35-year-old Lashawn Thompson died in the jail's psychiatric wing last September because of "severe neglect" from jail staff. His death sparked an investigation from the US Department of Justice into conditions at the jail, access to medical care and excessive use of force by officers.


An Escalating Issue


When it was built in the 1980s, the jail was "state of the art", said Dr Edmond, the attorney. "But it is no longer. That jail needs to be demolished and the citizens of Fulton County need to dig deep and pay the tax dollars to build a brand new jail."

The Fulton County Sheriff's Office itself has acknowledged conditions at the building are "dilapidated and rapidly eroding". It has also called for the construction of a new $1.7bn jail.

"There's been a lot of talk of cleaning it up," said Ms McClure of the ACLU. "We have not really seen or heard anything particularly significant. It seems like a lot of posturing."

Ms McClure said a number of factors have led to overcrowding in the Fulton County Jail system. For one, people charged with misdemeanours in the county are arrested and taken into custody, unlike some other Georgia jurisdictions, where defendants are generally released and given a future court date for minor offences, she said.

The county has also faced a backlog of cases because of the Covid-19 pandemic, and most recently, a slew of indictments under the Racketeer Influenced and Corrupt Organizations (Rico) Act unrelated to the Trump case, she said.

Mr Trump and his co-defendants were charged for violating the same statute this week. But indictments under the law, passed in the 1970s to help take down organised crime groups like the mafia, are complex and resource intensive, experts say.

"There's the assumption that other cases aren't getting indicted because this is taking up so much time," Ms McClure said.


'Kid Gloves'


Trump is likely to bypass all of this dysfunction when he is processed in Fulton County, experts said.

While prosecutors have not released details of how Mr Trump will be booked this time, there are clues from the expedited process at his three previous arraignments in New York, Florida and Washington DC, where he has denied all charges.

Upon arriving at this courthouse, Trump had his basic information and fingerprints taken like any defendant. But he was sequestered away from other criminal defendants and quickly whisked up to a courtroom, surrounded by Secret Service and US Marshals. Authorities have cited heightened security concerns in making these arrangements.


Unlike many defendants, he has not had a mugshot taken nor has he been handcuffed. Authorities have said there is no need for either, since there are plenty of photos of Mr Trump already and he is not considered a flight risk.

When his hearings have concluded, his protective detail have quickly escorted him back to a waiting motorcade, which takes him to his private plane.

Some version of this routine is likely to play out in Fulton County, experts said.

The contrast in experiences rankled some defence attorneys who have worked in Fulton County for years.

"He's gonna be treated with kid gloves because he's a former president," said Keisha Steed, an Atlanta-area criminal defence attorney who once worked as a public defender.

"And our clients are going to be kicked in the teeth."

The Justice Department announced Thursday a civil rights investigation into dilapidated and unsanitary conditions at the Fulton County Jail in Atlanta, as well as violence against detainees.


The department will look into the conditions in which inmates are held, their access to mental and physical health care and violence perpetrated against detainees.

“Addressing conditions of confinement in our country requires focus on the conditions that exist inside our jails,” Clarke said, stressing jails should have “constitutional and humane conditions” in which people can live while they navigate the criminal justice process.


The investigation was sparked in part by the death of Lashawn Thompson, an incarcerated man who died in the jail last year “covered in lice and filth,” Assistant Attorney General Kristen Clarke of the DOJ’s Civil Rights Division said in a news conference Thursday.

Not content with trying to destroy Americas’ trust in the US election system with his big lie that the 2020 presidential election was stolen from him, Trump is now trying to destroy America’s trust in the US judicial system with another big lie.


The second big lie is that judges, prosecutors, witnesses and juries are corruptly prosecuting Trump as a means of keeping him from being re-elected.


Lawyers for Donald Trump asked a federal judge Thursday to put off until 2026 a trial in Washington on charges that the former president plotted to overturn the results of the 2020 election.

The suggested April 2026 date is a counterproposal to the Justice Department’s recommendation last week that the trial should begin Jan. 2, 2024. Special counsel Jack Smith’s team is expected to oppose the Trump team’s request, which seeks to put off his trial until nearly a year and a half after the 2024 presidential election, in which Trump is currently the early front-runner for the Republican nomination.

The question is ultimately up to U.S. District Judge Tanya Chutkan, who is expected to set at least a tentative trial date during an Aug. 28 court hearing.

In a court filing Thursday evening, Trump’s lawyers say the years-long delay is warranted because of the “massive” amount of information — prosecutors have already produced more than 11.5 million pages — they have to review and because of scheduling conflicts with the other criminal cases Trump is facing.

As it stands, they said they would have to review about 100,000 pages per day in order to meet the Justice Department’s proposed date for jury selection.

“If we were to print and stack 11.5 million pages of documents, with no gap between pages, at 200 pages per inch, the result would be a tower of paper stretching nearly 5,000 feet into the sky. That is taller than the Washington Monument, stacked on top of itself eight times, with nearly a million pages to spare,” the defense lawyers wrote.

They also contend that the case concerns unprecedented questions that will take time to sort out. A four-count indictment issued this month, with charges including conspiracy to defraud the United States, accuses Trump of working to subvert the results of the election in a futile attempt to cling to power.

“No president has ever been charged with a crime for conduct committed while in office. No major party presidential candidate has ever been charged while in the middle of a campaign — and certainly not by a Justice Department serving his opponent,” the lawyers wrote. “These and numerous other issues will be questions of first impression, requiring significant time for the parties to consider and brief, and for the Court to resolve.”


Trump’s 2024 calendar is expected to be packed with court dates and campaign appearances.


He is confronting both a presidential primary season and four criminal cases in four different cities. Next March 25, he is set for trial in a New York state case related to an alleged hush money payment to a porn actor. Prosecutors in Fulton County, Georgia, where Trump was charged earlier this week with scheming to undo the results of that state’s presidential election, have proposed a March 4 trial date — though that is likely to slip given the complexity of a sprawling racketeering case that involves 19 defendants.

And a federal judge in Florida has set a May 20 trial date on charges, also brought by Smith and his team, that Trump illegally hoarded classified documents and concealed them from investigators.

“Trump must prepare for each of these trials in the coming months. All are independently complex and will require substantial work to defend. Several will likely require Trump’s presence at some or all trial proceedings,” the defense lawyers wrote, adding that the cases would involve pre- and post-trial hearings that will conflict with prosecutors’ proposed trial calendar.

Meanwhile on Thursday night, Trump said he was canceling plans for a press conference next week to unveil what he claims is new evidence of fraud in the 2020 election in Georgia, citing the advice of lawyers.

A judge in Atlanta who is overseeing the former presidents' case has set bail at $200,000 (£157,000).

The agreement says Mr Trump can remain free pending trial so long as he does not attempt to threaten or intimidate witnesses.

Mr Trump denies 13 charges, including racketeering and false statements.



"The defendant shall perform no act to intimidate any person known to him or her to be a co-defendant or witness in this case or to otherwise obstruct the administration of justice," says the court filing posted on Monday.

"The above shall include, but are not limited to, posts on social media or reposts of posts made by another individual on social media," the order adds.

It was signed by Fulton County District Attorney Fani Willis, who is overseeing the case, and lawyers for Mr Trump.

Later on Monday Mr Trump posted to his social media platform, Truth Social: "Can you believe it? I'll be going to Atlanta, Georgia, on Thursday to be ARRESTED by a Radical Left District Attorney, Fani Willis."

"She campaigned, and is continuing to campaign, and raise money on, this WITCH HUNT," he added. "This is in strict coordination with crooked Joe Biden's DOJ [Department of Justice]."

He also suggested the bail conditions indicate the district attorney must have thought he might attempt to flee the US.

"Would I be able to take my very 'understated' airplane with the gold TRUMP affixed for all to see," he wrote sarcastically.

"Probably not, I'd be much better off flying commercial - I'm sure nobody would recognize me!"

Ms Willis has asked the judge to schedule arraignments - in which a defendant is formally charged and enters a guilty or not guilty plea - on 5 September.

She has also proposed that the trial begin in March.


Lawyers for Mr Trump were seen at the Fulton County court in Atlanta earlier on Monday.

According to reports, they were there to meet investigators and negotiate the bail bond's terms.

When Mr Trump does surrender, there will be a "hard lockdown" of the surrounding county jail area, according to the Fulton County Sheriff's Office.

Barricades have been erected outside the court ahead of Mr Trump's anticipated surrender this week.

The sheriff's office said on Monday the barricades would remain in place until Saturday. The 19 accused have until noon local time on Friday to turn themselves in for processing.

Mr Trump was charged last week alongside his co-defendants with attempting to subvert the will of the Georgia electorate by meddling in the state's election results following his 2020 loss to Democrat Joe Biden.

The former president was heard in a phone call pressuring Georgia's Republican Secretary of State Brad Raffensperger to "find 11,780 votes" during the ballot count.

The first former or serving US president ever to be indicted, he faces three other criminal cases.



Mr Trump has repeatedly denied any wrongdoing and calls the charges politically motivated.

He is currently leading the Republican race to pick its next White House nominee to challenge the Democratic candidate, probably Mr Biden, in the 2024 presidential election.

Mr Trump has already said he will skip the first Republican televised debate on Wednesday evening.

"The public knows who I am & what a successful Presidency I had," Mr Trump said on Truth Social on Sunday. "I will therefore not be doing the debates."

Sources close to Mr Trump say he has instead recorded an interview with former Fox News host Tucker Carlson.

When Donald Trump turns himself in as expected on Thursday in Georgia to be charged with an election plot, the process may follow a script unlike his previous three arrests this year.

During bookings in New York, Florida and Washington DC - where the former president has pleaded not guilty - he got special treatment.





Here's Why This Time Could be Different.

A First Mugshot?


The former president has until now been spared a booking photo and having to interact with other criminal defendants.

But Fulton County Sheriff Pat Labat has said the departments' "normal practices" will be followed when processing Trump.


So far, two of his alleged co-conspirators have already been booked into the Fulton County Jail, which is notorious for hazardous conditions that some inmates endure for months.

At the jail, defendants typically undergo a series of procedures, including a medical screening, fingerprinting and a warrants check.

Trump may also be subjected to his first mugshot, as the county's normal steps include photographing all its defendants.

"The Fulton County Jail, amongst jails, is a very disturbingly dysfunctional place," said Rachel Kaufman, an attorney in Atlanta.

Trump and his 18 co-defendants "are going to witness some level of that dysfunction" when processed, she said.

Still, the former president won't be kept in a holding cell overnight like many other defendants, said Ms Kaufman.

"He's not going to feel the full force of what an average person experiences in the Fulton County Jail when they've been charged with several felonies," she said.

"And what they experience is their life being put at risk."



A Televised Appearance


Trumps proceedings in Georgia - where he is expected to plead not guilty - could be the first time the public actually sees him in court.

To date, video cameras have not been allowed during Trumps arraignments in New York, Washington DC and Miami.

That's because New York state and federal courtrooms do not usually allow video and microphone recordings.

But the state of Georgia does.



It's up to the judge to decide whether cameras are allowed, said Ms Kaufman, adding that the judge assigned to Trumps' arraignment, Scott McAfee, has often allowed them in the past.


"He's a full transparency judge," she said. "My guess is that whatever happens in front of him is going to be televised." That could mean cameras in the courtroom for Trumps' potential trial, too.

It would not be the first time that one of Fulton County District Attorney Fani Willis' high-profile cases took place on screen.

In 2014 and 2015, an eight-month long trial involving a controversial Atlanta Public School cheating scandal was broadcast on television and radio, capturing the attention of locals.

A Slim Chance of Pardon

Trump floated the idea of pardoning himself before leaving the White House in 2021, and some have suggested he might attempt to do so in the criminal cases against him if elected president in 2024.

But experts say that would be much harder for the Republican candidate to pull off in the state of Georgia.

For one, presidents can only issue pardons for federal crimes, and Trump is facing state charges in Georgia.



Trump would not be able to appeal to Georgias' governor for a pardon either, because unlike many other states, the governor there is not allowed to issue them.

Instead, Georgia's State Board of Pardons and Paroles is responsible for issuing pardons, which it only does five years after a convicted person has completed his or her sentence.

Trump is facing up to 20 years in prison in Georgia if convicted of the most severe charge of racketeering.

TRUMP made history again on Thursday, becoming the first former American president to get booked in jail and undergo the embarrassing process of having his mugshot taken—just like any other citizen charged with a crime.



At roughly 7:30 p.m., TRUMP was formally logged as the latest inmate at the Fulton County Jail northwest of downtown Atlanta. Deputies with the Fulton County Sheriff’s Office registered him under booking number 2313827.

According to county records, he was the 37th person booked at the jail since midnight—a group that included local residents accused of identity theft, domestic violence, and stalking.

TRUMP, meanwhile, faces 13 criminal counts, including racketeering and conspiracy charges, stemming from his effort to overturn his 2020 election defeat in Georgia.

Trump, his final White House chief of staff, several of his lawyers and others were criminally charged with running a mob-like criminal enterprise that aimed to throw out the 2020 election and keep Trump in power after his resounding loss at the polls.

Previously, Trump was spared the jailhouse embarrassment—and given preferential treatment—when he appeared in New York state court, as well as federal courthouses in Miami and the District of Columbia, for his three other criminal cases earlier this year.


But in Atlanta, the local DA—a Black woman who campaigned on promises to reform an office long accused of public corruption—swore she’d treat the most powerful man on the planet just like any other citizen. And she followed through with that promise, forcing Trump to get arrested and ensuring that he would have to pay a fine for his freedom as he awaits trial.


Trumps’ New Indictment Could Hurt the Georgia GOP for Years


Charles Shaw III, a local bail bondsman who has worked with Atlanta rappers like T.I. and Rick Ross, signed the paperwork allowing Trump to go free, according to one of his employees.







Earlier in the afternoon, Trump left his home in Bedminster, New Jersey, and took his private jet south to Atlanta. Flanked in a motorcade from the airport, the former president arrived at the county jail complex, which is notorious for its abysmal conditions—so much so that the Department of Justice opened an investigation into the facility last month.

Donald Trump could take the stand in just two months’ time over charges of election interference, as prosecutors in Georgia push for a speedy trial.


Fani Willis, the district attorney who is prosecuting Trump and 18 others for an alleged “criminal enterprise” to overturn the states’ presidential vote, has requested a trial date of 23 Oct.


On Thursday night, Trump surrendered to state authorities in Fulton County, Georgia, and had his mugshot taken.

The former president returned to Twitter after an absence of over two years in an apparent attempt to raise funds from his supporters for legal bills and election campaigning, with a post that displayed his mugshot


Ms Willis’s attempt to bring forward the trial date came in response to a demand from Kenneth Chesebro, Trumps’ former attorney, for a speedy trial beginning on the same date.


Scott McAfee, the judge overseeing the case, has only agreed that Mr Chesebro can be tried on 23 Oct “at this time”, but Ms Willis is pushing for all defendants indicted for racketeering to be tried at once.

Steven Sadow, Trumps’ attorney, immediately objected to the earlier trial date and requested that the former president’s case be severed from Mr Chesebro’s.

Trump is pushing for a trial date in April 2026 – more than a year after the next presidential inauguration that will follow the election in November 2024.

But an October trial would mean trial proceedings would begin well before the first Republican primary votes in January next year, and could mean Trump is handed a jail sentence before the next election.

Donald Trumps' campaign stops are just one part of his increasingly hectic schedule

Trump, seeking a return to the White House in 2024, already had a crammed political calendar. Now, with multiple legal dramas set to unfold, it is approaching the point of pure chaos.

A federal judge has scheduled the trial for his alleged effort to overturn the 2020 election for 4 March, the day before Super Tuesday, the biggest voting day in the Republican race.



That trial - in Washington DC - would pull Trump off the campaign trail for a pivotal stretch of his campaign, when he could be securing himself as the Republican standard-bearer or engaged in an extended struggle with one or more remaining rivals.

Trumps' lawyers have already vigorously complained about proposed trial schedules conflicting with the presidential campaign, which the former president and his supporters have branded "election interference" by his enemies.


Trump has vowed to appeal the trial date ruling. In a post on his social media site, he derided the judge as "biased" and "Trump hating" and said the timing was "just what our corrupt government wanted".

Trumps' legal team had initially proposed an April 2026 date for the federal trial - a timeline the judge said was unacceptable.

Since the 2016 presidential campaign, the question of whether it’s appropriate to compare Donald Trump to Adolf Hitler has come up repeatedly.

Trump has used a slogan popularized by Nazi sympathizers, dined with antisemites, evoked white supremacist tropes, and demonized the press and his political foes as the “enemy of the people,” to cite just a few examples of his allegedly Nazi-like behavior.


Plus, days before the Capitol riot, the nation’s top general, Mark Milley, reportedly warned aides that America was facing a “Reichstag moment” because Trump was preaching “the gospel of the Führer” with his stolen-election lies.

When people point out that this is all a little too Hitler-y for comfort, they’re often told they’re being hysterical. However, it’s getting harder to deny that Trump is using Nazi rhetoric. Last month, Trump said undocumented immigrants are “poisoning the blood of our country.”


In Mein Kampf, Hitler repeatedly described Jews and migrants as “poisons” to the “blood” of Germany and the Aryan race. Trump’s remark generated a few headlines but largely flew under the radar as it came 37 minutes into a video interview with the obscure right-leaning website the National Pulse.






Over the weekend, Trump used some Nazi terminology in a far more high-profile setting. During a Veterans Day speech on Saturday, he told a crowd in Claremont, New Hampshire, that his political enemies are “like vermin.”

Both Hitler and Italy’s Benito Mussolini compared their enemies to rodents during their rise to power in the 1920s and 1930s. Trump said:

'Today, especially, in honor of our great veterans on Veterans Day, we pledge to you that we will root out the communists, Marxists, fascists, and the radical-left thugs that live like vermin within the confines of our country — that lie and steal and cheat on elections and will do anything possible. They’ll do anything, whether legally or illegally, to destroy America and to destroy the American Dream.


The real threat is not from the racial right; the real threat is from the radical left, and it’s growing every day. Every single day. The threat from outside forces is far less sinister, dangerous, and grave than the threat from within. Our threat is from within.

Because if you have a capable, competent, smart, tough leader — Russia, China, North Korea — they’re not going to want to play with us'

TRUMP Isn’t Merely Unhinged. Many of his recent statements illustrate a profoundly un-American set of ideas.



The biggest danger the world faces in 2024 is if former President Donald Trump is elected to a second term, according to The Economists’ guide to The World Ahead.


In the 38 years since the predictive guide was first published, “no single person has ever eclipsed our analysis as much as Donald Trump eclipses 2024,” the article begins. It goes on to ponder what a Trump victory would mean for the world and claims that parliaments and boardrooms the world over are filled with “despair” at what may come:


A second Trump term would be a watershed in a way the first was not. Victory would confirm his most destructive instincts about power. His plans would encounter less resistance. And because America will have voted him in while knowing the worst, its moral authority would decline. The election will be decided by tens of thousands of voters in just a handful of states. In 2024 the fate of the world will depend on their ballots.


Trump would move his MAGA Republican allies into “the most important positions” in government, the article predicts, and Trump would be “unbound in his pursuit of retribution, economic protectionism and theatrically extravagant deals.”



The article posts that a Trump win would signal to China that American democracy is “dysfunctional,” and could give the communist nation the incentive to invade its island neighbor, Taiwan. In addition, the article predicts that Trump’s desire to quickly end the war in Ukraine would give Vladimir Putin the impetus to take over other neighboring countries like Moldova and the Baltic states.

The guide’s look ahead to 2023, was more optimistic about the presidential elections.

“Whoever ends up dispatching Donald Trump, at long last, will determine that future,” wrote columnist James Bennet. “Will it be a primary opponent? Or, in the general election of 2024, will it be President Joe Biden, or a Democrat representing a new direction for the party?”

But this year’s article resigns itself to the possibility that no one will end up “dispatching” Trump.

“That a TRUMP victory next November is a coin-toss probability is beginning to sink in,” the article concedes...



TRUMP Isn’t Merely Unhinged...




Many of TRUMPs’ Most Dangerous Statements Hide in The Plain Light of Day.



The problem is not that they don’t get reported on—they do—but even so, they are easy to tune out, perhaps because he’s been saying outlandish things for so long that people simply can’t bring themselves to parse the new ones; or perhaps because they’ve become accustomed, or at least numb, to his utterances

Or perhaps because they don’t want to let him occupy their headspace; or perhaps because he got kicked off Twitter (now X) and they had no interest in joining Truth Social.

Or maybe it’s because the more sinister material gets mixed up with his strange elocutions (“We’re gonna have a great country—it’s gonna be called the United States of America”), contrarian hot takes ..


(“You know, Hezbollah is very smart. They’re all very smart”), and gibberish (“All of these indictments that you see—I was never indicted. Practically never heard the word. It wasn’t a word that registered”).



Whatever the case may be, Trump has continued to make plainly dangerous and stunning remarks. Notwithstanding his rival Governor Ron DeSantis’s recent claim that Trump has “lost the zip on his fastball,” the former president continues to produce substantive ideas—which is not to say they are wise or prudent, but they are certainly more than gibberish.

In fact, much of what Trump is discussing is un-American, not merely in the sense of being antithetical to some imagined national set of mores, but in that his ideas contravene basic principles of the Constitution or other bedrock bases of American government.

Trumps talk of punishing his critics and seeking to “weaponize” the US justice department against his political opponents has experts and former DoJ officials warning he poses a direct threat to the rule of law and democracy in the US.



Trumps talk of seeking “retribution” against foes, including some he’s branded “vermin”, has coincided with plans that Maga loyalists at rightwing thinktanks are assembling to expand the president’s power and curb the DoJ, the FBI and other federal agencies. All of it has fueled critics’ fears that in a second term Trump would govern as an unprecedentedly authoritarian American leader.

Trump is currently the overwhelming favorite to win the Republican nomination for 2024 and has long maintained hefty polling leads over his party rivals. At the same time a slew of recent polls has also shown him ahead of president Joe Biden, including in key battleground states.

But scholars and ex-justice officials see increasing evidence that if they achieved power again Trump and his Maga allies plan to tighten his control at key agencies and install trusted loyalists in top posts at the DoJ and the FBI, permitting Trump more leeway to exact revenge on foes, and shrinking agencies Trump sees as harboring “deep state” critics.

Ominously, Trump has threatened to tap a special prosecutor to “go after” Biden and his family.

Trump’s angry mindset was revealed on Veterans Day when he denigrated foes as “vermin” who needed to be “rooted out”, echoing Fascist rhetoric from Italy and Germany in the 1930s.

“I’m hard pressed to find any candidates anywhere who are so open that they would use the power of the state to go after critics and enemies,” said Steven Levitsky, a Harvard government professor and co-author of How Democracies Die.

Donald Ayer, the former deputy attorney general who served in the George HW Bush administration, said: “It is appalling that a presidential candidate could suggest using the Department of Justice to go after his political adversaries, to go after Biden and his family, and to effectively make the Department of Justice an arm of the White House to be used for its political purposes.”

Facing 91 criminal charges in four cases including 17 for his efforts to overturn his loss in 2020, Trump has kept up a barrage of incendiary attacks on prosecutors, judges and critics, claiming he’s innocent of all charges and the victim of politically driven “witch-hunts”.

Trump’s revenge game plan has been palpable for months. At a kickoff campaign rally in Texas in March, Trump warned: “Either the deep state destroys America or we destroy the deep state,” and vowed that “for those who have been wronged and betrayed, I am your retribution.”






Similarly, Trump pledged to a CPAC gathering in March that: “I am your warrior. I am your justice,” and called 2024 “the final battle”.



On Veterans Day, Trump also warned: “The threat from outside forces is far less sinister, dangerous and grave than the threat from within.”







Trump has also told some associates he wants to launch probes into a few top former allies turned critics, including the ex-attorney general William Barr, the former chief of staff John Kelly and the ex-chairman of the Joint Chiefs of Staff, Gen Mark Milley


“US, democratic institutions are hard to kill,” noted Levitsky. “But Trump and people around him are better prepared this time. Trump learned he needs to purge and pack an administration with his loyalists.”

“Autocrats have to take state institutions and pack them. Trump has learned from experience which makes him more dangerous.”

Other scholars voice mounting concerns about a second Trump presidency.







“This is one of the most openly authoritarian campaigns I’ve ever seen.

You have to go back to the far-right authoritarians in the 1930s in Europe or in 1970s Latin America to find the kind of dehumanizing and violent language that Trump is starting to consistently use.”

Colorado Supreme Court Rules Donald Trump Ineligible For The US Presidency

Colorados' Supreme Court has ruled that Donald Trump cannot run for president next year in the state, citing a constitutional insurrection clause.


In a landmark decision, the court ruled 4-3 that Trump is not an eligible candidate.

It is the first time that Section 3 of the US Constitution's 14th Amendment has been used to disqualify a presidential candidate.


Several attempts to kick Mr Trump off the ballot in other states have failed.

Tuesday's decision - which has been placed on hold pending appeal until next month - does not apply to states outside Colorado.

The ruling only applies to the state's primary election on 5 March, when Republican voters will choose their preferred candidate for president, though it could have an effect on the general election in November.

The justices wrote in their ruling: "We do not reach these conclusions lightly. We are mindful of the magnitude and weight of the questions now before us.

"We are likewise mindful of our solemn duty to apply the law, without fear or favor, and without being swayed by public reaction to the decisions that the law mandates we reach."

The decision reverses an earlier one from a Colorado judge, who ruled that the 14th Amendment's insurrection ban did not apply to presidents because the section does not explicitly name them.

That same lower court judge also found that Mr Trump had participated in an insurrection in the 2021 US Capitol riot. His supporters stormed Congress on that day while lawmakers were certifying President Joe Biden's election victory.

The Colorado Supreme Court's decision does not go into effect until at least 4 January 2024. That is the eve of the deadline for the state to print its presidential primary ballots.

In a statement, Steven Cheung, a spokesman for the Trump campaign, called the ruling "completely flawed" and lambasted the justices, who were all appointed by Democratic governors.

"Democrat Party leaders are in a state of paranoia over the growing, dominant lead President Trump has amassed in the polls," Mr Cheung said.

"They have lost faith in the failed Biden presidency and are now doing everything they can to stop the American voters from throwing them out of office next November."

Mr Cheung added that Mr Trump's legal team would "swiftly file an appeal" to the US Supreme Court, where conservatives hold a 6 to 3 majority.

Representatives for Mr Biden's re-election campaign declined to comment on the Colorado ruling. But a senior Democrat affiliated with the campaign told CBS News, the BBC's US partner, that the decision would help Democrats by supporting their argument that the US Capitol riot was an attempted insurrection.

The source said it would also aid Democrats in showcasing "the stark differences" between Mr Trump and Mr Biden.

Republican lawmakers condemned the decision, including House of Representatives Speaker Mike Johnson, who called it "a thinly veiled partisan attack".

"Regardless of political affiliation, every citizen registered to vote should not be denied the right to support our former president and the individual who is the leader in every poll of the Republican primary," he said.

Citizens for Responsibility and Ethics in Washington (Crew), the group that brought the case, welcomed the ruling.

"It is not only historic and justified, but is necessary to protect the future of democracy in our country," the group's president, Noah Bookbinder, said in a statement.

Similar lawsuits in New Hampshire, Minnesota and Michigan have failed.

The 14th Amendment was ratified after the American Civil War. Section 3 was intended to block secessionists from returning to previous government roles once southern states re-joined the Union.

It was used against Confederate president Jefferson Davis and his vice-president Alexander Stephens, both of whom had served in Congress. It has seldom been invoked since.

Mr Trump lost the state of Colorado by a wide margin in the last presidential election. But if courts in more competitive states followed suit on Tuesday's ruling, Mr Trump's White House bid could face serious problems.

During a one-week trial in Colorado last month, the former president's lawyers argued he should not be disqualified because he did not bear responsibility for the US Capitol riot.

But in its Tuesday ruling, the Colorado Supreme Court majority disagreed.

They said Mr Trump's messages before the riot were "a call to his supporters to fight and… his supporters responded to that call".

Carlos Samour, one of three justices who dissented, argued the government could not "deprive someone of the right to hold public office without due process of law".

"Even if we are convinced that a candidate committed horrible acts in the past - dare I say, engaged in insurrection - there must be procedural due process before we can declare that individual disqualified from holding public office," he wrote.

Mr Trump is facing four criminal cases, including one federal and one state case in Georgia related to his alleged election subversion efforts.


What The Colorado Ruling Means For TRUMP

A landmark ruling in Colorado on Tuesday found Donald Trump ineligible to hold office under the US Constitution’s insurrection clause because he incited a riot on January 6 – and the justices voted to remove him from the state’s ballot in next year’s primary race.


While it sounds like a potential dagger to the former president’s 2024 election hopes, it is unlikely the Colorado Supreme Court will do much to hinder the Republican frontrunner.

Mr Trump’s campaign has already vowed to appeal the decision to the US Supreme Court, whose 6-3 conservative majority includes three Trump appointees.

It will set up a showdown in the US’s highest court to decide whether Mr Trump can stay in the race for the GOP nomination.

While it is unlikely the country’s highest court will uphold the ruling, even if it does, it would only impact Mr Trump’s election chances if high-stakes states used it as a blueprint to follow suit.

Mr Trump has a strong poll lead over Joe Biden in many of the vital swing states, including Arizona, Florida and Pennsylvania.

The risk in Colorado itself is low for Mr Trump, 77, given he lost by 13 percentage points in 2020 and does not need the state to win next year’s election.

The danger lies in whether more courts and election officials could follow the state’s lead and exclude Mr Trump from the ballot in must-win states.

Dozens of similar lawsuits filed across the country have raised the same argument, though several have already been dismissed by state courts, such as in Minnesota.

Derek Muller, a Notre Dame law professor who has closely followed the Section 3 cases, said the ruling is “a major threat to Trump’s candidacy” and could “embolden other state courts or secretaries to act now that the bandage has been ripped off”.


Given how Mr Trump’s criminal indictments have so far only increased support for the former president, who has claimed he is being unfairly targeted, it is likely this ruling will bolster support from his fanbase.

Mr Trump’s campaign has already pointed to the fact that the Colorado Supreme Court’s justices were all appointed by Democratic governors.

Also, both groups who have brought the legal challenges are financed by liberal donors who support Mr Biden.

While Mr Trump’s Republican rivals could use this as an opportunity to claim the frontrunner is too much of a liability to be the GOP nominee, they have already started to fall in line behind Mr Trump.

On Tuesday, Vivek Ramaswamy volunteered to pull his name off Colorado’s March 5 Republican primary ballot in protest.

“I pledge to *withdraw* from the Colorado GOP primary unless Trump is also allowed to be on the state’s ballot, and I demand that Ron DeSantis, Chris Christie, and Nikki Haley to do the same immediately - or else they are tacitly endorsing this illegal maneuver which will have disastrous consequences for our country,” he wrote on Twitter.

The Colorado Republican Party has threatened to nix the states' planned primary election if Donald Trumps name isn't allowed on the ballot, replacing it with a caucus instead after a bombshell state supreme court ruling.









The state GOP issued the threat on X after Trump competitor Vivek Ramaswamy threatened to try to take his own name off the ballot in protest.


The threat came during the continuing fallout of the dramatic Colorado Supreme Court ruling barring TRUMP from the ballot under the 14th Amendment's clause on people who have committed 'insurrection' against the U.S.

Even one of the justices serving the state's highest court said in opposing the decision that there was no 'due process', warned it would cause chaos and said he has 'never seen anything like it' in his legal career.

Democrats have won Colorado in the last four general elections and Biden was victorious by 13 points in the state that will have 10 electoral college votes in 2024.


But the result in the Republican primary will still be crucial in deciding who will be on the ticket next November.



Colorado's Republican Party responded when Ramaswamy threatened to pull his name off the ballot and urged rivals Nikki Haley, Ron DeSantis and Chris Christie to do the same.

'You won't have to because we will withdraw from the Primary as a Party and convert to a pure caucus system if this is allowed to stand,' the party tweeted.

State GOP chair Dave Williams told NBC News, 'We're at the mercy of the U.S. Supreme Court' and that the state was 'figuring it out as we go.'

'But we'll make our preparations to convert to a caucus while this is all playing out. And if it [a Supreme Court ruling] does not go in our favor, we'll plan to do a caucus. But if it does go in our favor, then nothing will change.'

It is not clear that the state party would be able to pull off such a move. Coloradans voted to switch to a primary in 2019. It would require sign-off from the national GOP, where Trump has outsized influence, but would require state support and might need to overcome a court challenge.

The office of Colorado's Democratic Secretary of State Jena Griswold, who is ordered in the ruling not to put Trumps name on the ballot, would not likely go along with the new scheme.


'Colorado law does not allow a presidential primary election to be cancelled at the request of a political party,' said Jack Todd, a Griswold spokesman.

'If the Colorado Republican Party attempts to withdraw from the presidential primary or ignore the results of the election, this would likely be a matter for the courts,' he said.

The re-election of Donald Trump in 2024 could “end American democracy as we know it”, according to three women who worked for him in the White House during his chaotic term in office.

“People in general have short memories, and might forget the chaos of the Trump years,” Sarah Matthews, a former deputy White House press secretary who resigned on the day of the deadly Capitol riot, said on ABC’s This Week.



All three gave testimony to the US House committee investigating Trump’s efforts to overturn his 2020 election defeat as well as the 6 January 6 Capitol attack staged by his supporters. And they warned in an unprecedented television interview on Sunday that time was short to prevent a second Trump administration in which they insist his behavior would be much worse.



“They also might not just be paying attention to what he’s saying now – and the threat to democracy that exists. It does really concern me if he makes it to the general [election] that he could win. I’m still hopeful that we can defeat him in the primaries, but we’re running out of time.”

Matthews was joined in the interview by former White House aide Cassidy Hutchinson, a key witness against Trump during the House committee’s public hearings in 2022, and Alyssa Farah Griffin, his former communications director, who said she dreaded him returning to office.

“Fundamentally, a second Trump term could mean the end of American democracy as we know it, and I don’t say that lightly,” Griffin said.

“We all witnessed him trying to steal a democratic election before and go into historic and unconstitutional lengths to do so. That just shows he’s willing to basically break every barrier to get into power and to stay into power.

“What scares me as much as him and his retribution is the almost cult-like following he has, the threats, the harassment, the death threats that you get when he targets you, is really horrifying and has no place in our American discourse.”


About two days before the interview aired, someone placed a fake emergency call to police that prompted armed officers to arrive at the home of Maine’s secretary of state, Shenna Bellows, after she removed Trump from the state’s presidential primary under the US constitution’s insurrection clause. Bellows was not home when the attempted “swatting” call was made.

Hutchinson, ex-aide to Trumps chief of staff Mark Meadows, said voters needed to believe Trump when he said he would be a dictator on his first day back in the White House.



“The fact that he feels that he needs to lean into being a dictator alone shows that he is a weak and feeble man,” she said.

Matthews, meanwhile, said Trump had already signaled what his second administration would look like.

“We don’t need to speculate because we already saw it play out,” she said.

“To this day, he still doubles down on the fact that he thinks that the election was stolen and fraudulent. And his rhetoric has just gotten increasingly erratic.


He’s literally called for things like doing away with parts of the constitution, [and] wanting to weaponize the department of justice to enact revenge on his political enemies.

The US supreme court will hear Donald Trumps appeal of the Colorado ruling that he should be removed from the state ballot under the 14th amendment to the US constitution, for inciting an insurrection.

The court issued a brief order on Friday, setting up a dramatic moment in American history.

The case will be argued on 8 February. As the Republican presidential primary will then be well under way, with Iowa, New Hampshire and Nevada having voted – and as Trump has also been disqualified from the ballot in Maine, a ruling appealed in state court – a quick decision is expected.

The Colorado primary is set for 5 March. The state government must begin mailing ballots to overseas voters on 20 January and to all others between 12 and 16 February. The ruling suspending Trump is stayed, however, as long as the supreme court appeal is ongoing.

In the year of a high-stakes presidential election, the case is set to move rapidly, under a fierce spotlight. Carl Tobias, a law professor at the University of Richmond, said that with “oral argument set for 8 February, the appeal will be extremely expedited … thus, briefs will probably be due as soon as possible, maybe [in] a week or 10 days for each side.”


The 14th amendment was approved after the civil war, meant to bar from office supporters of the rebel Confederate states. But it has rarely been used.

Cases against Trump were mounted after he was impeached but acquitted by the Senate over the attack on Congress by his supporters on 6 January 2021, then swiftly came to dominate the Republican presidential primary for 2024, all while maintaining the lie that his defeat by Joe Biden in 2020 was the result of electoral fraud.

Fourteenth-amendment challenges to Trump in other states have either failed or remain undecided.

The Colorado supreme court ruled against Trump on 19 December but stayed the ruling until 4 January, pending appeal. That appeal came earlier this week, Trump’s lawyers arguing that only Congress could arbitrate such disputes and saying the relevant text in the 14th amendment – in section 3 – did not apply to the presidency or vice-presidency as they are not mentioned therein.

ABC News has reported debates from the passage of the amendment, in 1866, in which the presidency was said to be covered.

Prominent legal scholars including Laurence Tribe of Harvard and the retired conservative judge J Michael Luttig have said Trump should be disqualified from seeking the presidency under the 14th amendment.

Luttig, who testified memorably before the House January 6 committee, called the Colorado ruling “historic … a monumental decision of constitutional law … masterful and … unassailable”. He has also said the US supreme court ruling will be “arguably … the single most important constitutional decision in all of our history”.

Other voices, including conservative lawyers and professors and all Trump’s major opponents for the Republican nomination, have questioned whether section 3 applies to the presidency, or to someone not convicted of insurrection. Most (and some senior Democrats) have also said the Colorado ruling is anti-democratic, because only voters should decide Trump’s fitness for office.

Luttig has countered such arguments, saying: “The 14th amendment itself, in section 3, answers the question whether disqualification is ‘anti-democratic’, declaring that it is not. Rather, it is the conduct that gives rise to disqualification that is anti-democratic, per the command of the constitution.”

TRUMP also faces extensive legal jeopardy: he faces 91 criminal charges under four indictments, 17 concerning election subversion, and civil threats including cases over his business affairs and a defamation suit arising from an allegation of rape a judge said was “substantially true”.


Nonetheless, he leads Republican polling by vast margins. Were the supreme court to rule against him in the Colorado case, the US would find itself in uncharted waters.

On Friday, Steven Cheung, Trump’s spokesperson, said the campaign welcomed “a fair hearing at the supreme court to argue against the bad-faith, election-interfering, voter-suppressing, Democrat-backed and Biden-led, 14th amendment abusing decision” in Colorado.

Cheung also claimed the Colorado case and others like it were “part of a well-funded effort by leftwing political activists hell-bent on stopping the lawful re-election of President Trump this November, even if it means disenfranchising voters”.

Writing on his blog, Richard Hasen, an election law professor at the University of Los Angeles, California, pointed to uncertainties about how the supreme court case will unfold, given what he called a “blob” of a filing from Trump’s lawyers, while saying lawyers for Colorado “raised three questions, which somewhat overlap with Trump’s claims”.

“This seems like it could be a free-for-all in arguments and briefing,” Hasen wrote, adding: “Buckle up; it’s going to be a wild ride from here on out.”

That seems assured. The supreme court is not just dominated 6-3 by rightwingers who have delivered historic rulings including removing the federal right to abortion. It includes three justices installed when Trump was president.

On Thursday, a Trump lawyer, Alina Habba, caused controversy when she told Fox News one such appointee, Brett Kavanaugh, would now “step up” for the man who put him on the court.

Controversy also surrounds Clarence Thomas, the longest-serving justice whose wife, the rightwing activist Ginni Thomas, was involved in Trump’s election subversion.


On Friday, Christina Harvey, executive director of the progressive advocacy group Stand Up America, said Thomas should not take part in the Colorado case.

“The American people deserve a fair and impartial review … free from any conflicts of interest,” Harvey said. “Justice Thomas’s continued refusal to recuse himself from this case and others related to the efforts to overthrow the 2020 election … raises questions about the integrity of the judicial process and the influence of political bias.

“As trust in the supreme court reaches new lows, decisions like these only reinforce Americans’ belief that supreme court justices are politicians in robes.

During a final bid to Iowa Republicans just hours before the caucuses on Monday, the ex-president's eldest son and his fiancé Kimberly Guilfoyle delivered remarks to supporters in Ankney, Iowa.


Trump Jr., serving as the top surrogate for Trump's campaign in Iowa, was asked by an audience member whether he would consider a presidential run in 2028 – a potential that he didn't completely rule-out.

He took particular issues with Florida Gov. Ron DeSantis' 2024 bid, slamming his father's competitor for his footwear choice and his loss of 'billionaire donors.'

'I see exactly what's happening right now,' Don Jr. said to a room of Iowans at Whisky River restaurant in Ankeny, Iowa just hours before the caucus commenced on Monday.

'They're trying desperately to suppress the vote by saying we have it in the bag,' he said. 'When you see these games, whatever happened over the last 48 hours… There's always going to be something. There's always a scheme. And that includes our side.'

He continued: 'At this point in time we understand it's actually the D.C. elite versus Trump. You see that from the Republicans involved, you see that from the billionaire donors disappearing from Ron DeSantis' campaign because they realize he doesn't have it.'

Polling released two nights before the caucus from the NBC News/Des Moines Register/Mediacom poll in Iowa showed Trump walking away with 48 percent support.

Former United Nations Ambassador Nikki Haley came in second with 20 percent – while DeSantis dropped to third place with 16 percent.

But Trump and his oldest son are now claiming that those pushing that narrative of a predicted big win are trying to suppress the ex-president's supporters and encourage them not to caucus on Monday evening.


The frigid temperatures, icy roads and surging negative 40-degree windchill has resulted in speculation that Trump supporters might stay home because they believe he has enough backing to win without everyone showing up.

But Trump and his surrogates have urged supporters not to give into that thought-process.

Florida governor was given internal polling showing him facing a crushing defeat in South Carolina where he had focused all his resources - and told he had no path to the White House





Ron DeSantis had given up on New Hampshire, turning his campaign towards the more conservative state of South Carolina.

But on Saturday, he was given internal polling data that showed he had no chance of winning the state and would finish far behind former President Donald Trump, according to two sources familiar with discussions.

His aides cancelled appearances on the Sunday morning shows as they debated what to do next.

And on Sunday afternoon, the Florida governor formally pulled the plug on his 2024 campaign.

'I can't ask our supporters to volunteer their time and donate their resources, if we don't have a clear path to victory,' he said.
