Facebook is in the centre of yet another data-breach scandal

EVER felt paranoid you’re being “watched” on social media? The latest scandal around Facebook won’t make you feel any better.

EVER paranoid that you’re being “watched” on social media? The latest drama surrounding Facebook probably won’t help lessen those feelings.

The social media giant is currently embroiled in the largest data scandal of its history, following allegations that Cambridge Analytica tapped the Facebook profiles of more than 50 million people without their permission.

The story was broken by The Guardian over the weekend, who reported the data may have been used to influence the outcome of the United States election in 2016.

Thousands have deleted their facebook accounts of it.

On a mission to spread "technical awareness and improve digital etiquette", Curran has published the results of his extensive research in The Guardian.

In the first revelation that will, to quote Curran, "freak you out", he makes a point that Google knows where you've been.

"Google stores your location (if you have location tracking turned on) every time you turn on your phone. You can see a timeline of where you’ve been from the very first day you started using Google on your phone," Waterford native Curran warns.

He points out to readers that they can click on this link to see your own data: google.com/maps/timeline?…

That's not even the scary part. Curran mentions that Google knows everything you've ever searched for even if you've deleted it, it knows all the apps you use, it has all of your YouTube history, and - gulp - Google even has built an ad profile based on your data.

Give this a minute to sink in: the data that Google has thus far stored on you could fill millions of Word Documents.

Curran notes that his own history is 5.5GB big - roughly three million Word Docs. Your own can be accessed here.

Google is not the only culprit, either. Facebook has made headlines recently over questionable use of user's personal data.

"Facebook offers a similar option to download all your information. Mine was roughly 600MB, which is roughly 400,000 Word documents," Curran writes.

And what is this data you might ask? According to Curran, it's "every message you’ve ever sent or been sent, every file you’ve ever sent or been sent, all the contacts in your phone, and all the audio messages you’ve ever sent or been sent."

When Facebook bought Instagram for $1 billion in 2012, it seemed like a big gamble for an unproven little app.

Six years later, that little app - along with Messenger and WhatsApp - are serving as Facebook's safety net for a future that could find its flagship service on the sidelines.
Sure, Facebook reigns in social media today, and this is not likely to change soon.





Mark Zuckerberg concludes his testimony before a combined Senate Judiciary and Commerce committee hearing in the Hart Senate Office Building on Capitol Hill April 10, 2018 in Washington, DC. Zuckerberg, 33, was called to testify after it was reported that 87 million Facebook users had their personal information harvested by Cambridge Analytica, a British political consulting firm linked to the Trump campaign.


Still, amid the company's seemingly endless troubles over elections meddling, misinformation, privacy lapses, hacking and hate speech, the idea that Facebook may not always be on top has begun to take hold.

'Facebook could collapse,' said David Kirkpatrick, who wrote a 2010 book on Facebook's early history.
In an interview, he said the elections manipulations issue 'could get so terrifying that advertisers could start to back away.
That's nowhere near happening now, but it could happen.'

That is, as Facebook stops being a virtual watercooler for friendly conversation, but a lair for trolls and misinformation - advertisers might find the service too dangerous to showcase laundry detergent and shoes.
For now, Facebook is a social and advertising powerhouse.

It has 2.23 billion users, a number that's still growing at a healthy pace outside of the U.S. Wall Street analysts project Facebook's 2018 revenue will top $55 billion.

While the company doesn't break out revenue among its apps, eMarketer estimates that Instagram will bring in 16 percent of Facebook's advertising revenue this year and 25 percent by 2020. (The research firm does not have estimates for Messenger ads, which are still new and nascent, and WhatsApp, which doesn't have ads yet.)

'It really speaks to the fact that advertisers love Instagram,' eMarketer analyst Debra Aho Williamson said. 'It has the appeal of being a generally positive environment.'

In fact, Instagram is becoming the top social media service for many brands to interact with consumers, said Yuval Ben-Itzhak, CEO of the social media marketing firm Socialbakers.

So even though these companies are reaching a smaller audience than Facebook, these people are 'engaging,' or interacting, a lot more with the advertisers, he said.

Facebook is working hard to ensure that Messenger and later, WhatsApp, become viable businesses as well.

On Tuesday, Facebook announced plans to make its Messenger app simpler and easier to use. But the redesign also makes it clear that messages from businesses - and ads - are becoming increasingly important.

Such messages are now front and center alongside messages with friends and other individuals.

The new Messenger features a 'dark mode' that lets people switch to white text on a black background. It has fewer 'tabs' - or words and icons to tap to get to different sections in the app. The previous version had nine, including 'messages,' ''active' to show ongoing conversations, 'groups,' ''games' and a 'discover' icon to find bots to chat with for everything from the weather to horoscopes to shopping. The new version has just three: 'chats,' ''people' and 'discover' to connect with businesses, follow the news or play games.

Stan Chudnovsky, head of product for messaging at Facebook, said the primary intent wasn't to elevate messaging with businesses. But he said that 'when people spend more and more time communicating with each other on a platform, inevitably that is where businesses need to be. It's almost like print happened and then businesses needed to be on print.'

Facebook, of course, is working hard to nudge people and businesses in this direction, convincing them that chatting on Messenger is more efficient than, say, emailing, calling - or tweeting at - an airline, a clothing store or even your bank.

One thing Facebook has always understood is the importance of human connections and interaction. Chudnovsky considers one-on-one communications a 'basic human need.' Considering that people use Messenger, and not the main Facebook service, for such interactions, does this mean Messenger is more important than Facebook?

'We don't take a position on what is more important,' Chudnovsky said.

Still, considering that people no longer need a Facebook account to use Messenger, maybe some day it will be. After all, people (especially younger ones) are using Facebook less frequently, even as they flock to Instagram and its messaging services.

A Pew Research Center study recently found that just over half of teens use Facebook, while 72 percent use Instagram.

'The idea has always been not to replace Facebook, but to add to it,' said Nate Elliott, head of the market research firm Nineteen Insights. 'But now that Facebook's reputation has taken a beating, I'm sure that they see it as a very nice insurance policy.'

UK Parliament Seizes Cache of Facebook Internal Papers

Documents Alleged to Contain Revelations on Data and Privacy Controls That Led to Cambridge Analytica Scandal

Parliament has used its legal powers to seize internal Facebook documents in an extraordinary attempt to hold the US social media giant to account after chief executive Mark Zuckerberg repeatedly refused to answer MPs’ questions.


The cache of documents is alleged to contain significant revelations about Facebook decisions on data and privacy controls that led to the Cambridge Analytica scandal. It is claimed they include confidential emails between senior executives, and correspondence with Zuckerberg.


Damian Collins, the chair of the culture, media and sport select committee, invoked a rare parliamentary mechanism to compel the founder of a US software company, Six4Three, to hand over the documents during a business trip to London.

In another exceptional move, parliament sent a
Serjeant at Arms to his hotel with a final warning and a two-hour deadline to comply with its order.
When the software firm founder failed to do so, it’s understood he was escorted to parliament. He was told he risked fines and even imprisonment if he didn’t hand over the documents.

“We are in uncharted territory,” said Collins, who also chairs an inquiry into fake news. “This is an unprecedented move but it’s an unprecedented situation. We’ve failed to get answers from Facebook and we believe the documents contain information of very high public interest.”

The seizure is the latest move in a bitter battle between the British parliament and the social media giant. The struggle to hold Facebook to account has raised concerns about limits of British authority over international companies that now play a key role in the democratic process.

Facebook, which has lost more than $100bn in value since March when the Observer exposed how Cambridge Analytica had harvested data from 87m US users, faces another potential PR crisis. It is believed the documents will lay out how user data decisions were made in the years before the Cambridge Analytica breach, including what Zuckerberg and senior executives knew.

MPs leading the inquiry into fake news have repeatedly tried to summon Zuckerberg to explain the company’s actions. He has repeatedly refused. Collins said this reluctance to testify, plus misleading testimony from an executive at a hearing in February, had forced MPs to explore other options for gathering information about Facebook operations.

“We have very serious questions for Facebook. It misled us about Russian involvement on the platform. And it has not answered our questions about who knew what, when with regards to the Cambridge Analytica scandal,” he said.

“We have followed this court case in America and we believed these documents contained answers to some of the questions we have been seeking about the use of data, especially by external developers.”

The documents seized were obtained during a legal discovery process by Six4Three. It took action against the social media giant after investing $250,000 in an app. Six4Three alleges the cache shows Facebook was not only aware of the implications of its privacy policy, but actively exploited them, intentionally creating andeffectively flagging up the loophole that Cambridge Analytica used to collect data. That raised the interest of Collins and his committee.

A Facebook spokesperson said that Six4Three’s “claims have no merit, and we will continue to defend ourselves vigorously”.

The files are subject to an order of a Californian superior court, so cannot be shared or made public, at risk of being found in contempt of court. Because the MPs’ summons was issued in London where parliament has jurisdiction, it is understood the company founder, although a US citizen, had no choice but to comply. It is understood that Six4Three have informed both the court in California and Facebook’s lawyers.

Facebook said: “The materials obtained by the DCMS committee are subject to a protective order of the San Mateo Superior Court restricting their disclosure. We have asked the DCMS committee to refrain from reviewing them and to return them to counsel or to Facebook. We have no further comment.”

It is unclear what, if any, legal moves Facebook can make to prevent publication. UK, Canada, Ireland, Argentina, Brazil, Singapore and Latvia will all have representatives joining what looks set to be a high-stakes encounter between Facebook and politicians.

Richard Allan, vice-president for policy who will testify at the special session after Zuckerberg declined to attend, said the company takes its responsibility around “a number of important issues around privacy, safety and democracy ... very seriously”.

Confidential Emails Sent by Facebook Executives Leaked Online

Communications between senior figures, including Mark Zuckerberg, shed new light on data use

Documents posted online Friday appear to be confidential internal Facebook communications that reveal new details of the company’s treatment of user data.

About 60 pages of un-redacted exhibits from a lawsuit between Facebook and Six4Three, an app developer, were posted anonymously on GitHub on Friday. They include emails between various Facebook executives, including CEO Mark Zuckerberg, and a “highly confidential” 2012 memo detailing various policy matters.

The Guardian has not been able to independently confirm the authenticity of the documents, but redacted versions of some of the exhibits have been previously published.


“Like the other documents that were cherrypicked and released in violation of a court order last year, these by design tell one side of a story and omit important context,” a Facebook spokesperson said in a statement. “As we’ve said, these selective leaks came from a lawsuit where Six4Three, the creators of an app known as Pikinis, hoped to force Facebook to share information on friends of the app’s users.

These documents have been sealed by a Californian court so we’re not able to discuss them in detail.”


The new cache of emails appears to refer to what could have been a catastrophic privacy breach for Facebook: a near-miss situation in which a third-party app could have disclosed the company’s financial results ahead of schedule.

In an email thread, the former Facebook vice-president Michael Vernal refers to some kind of issue with an app, noting that it “could have been near-fatal for Facebook Platform / Login / etc”.

“Wow that would have been a disaster,” responds Avichal Garg, a former director of product management at Facebook.

“If Mark had accidentally disclosed earnings ahead of time because a platform app violated his privacy … literally, that would have basically been fatal for Login / Open Graph / etc,” Vernal responded.

He went on to urge everyone on the thread to keep the incident confidential, writing: “Listen guys/gals – DO NOT REPEAT THIS STORY OFF OF THIS THREAD.” He added: “I’m super, super serious here. I want us to follow-up on this and respond urgently here, but I also do not want this story spreading inside of Facebook or off of this thread at all. I can’t tell you how terrible this would have been for all of us had this not been caught quickly.”


The sealed court dockets have been at the center of a transatlantic controversy since November, when they were obtained by the UK parliament under extraordinary circumstances. Produced by Facebook during the discovery process of a 2015 lawsuit filed by Six4Three, the documents were sealed by the California state judge overseeing the case.

When Six4Three founder Ted Kramer was in London in 2018, however, he provided them to Damian Collins, the chair of the parliamentary committee that was investigating Facebook, after Collins told Kramer that failure to do put him in “contempt of parliament”.

How Kramer came to have access to the documents in the first place, and whether he should have provided them to Collins while in the UK despite the court order, were the subject of considerable opprobrium by the California court – and by Facebook.

Collins, whose digital, culture, media and sport (DCMS) committee published the results of its inquiry into fake news and disinformation on Monday, released a redacted selection of the documents he had obtained in December.

Another of the newly exposed documents appears to be a July 2012 memo from Marne Levine, who at the time was Facebook’s vice-president global public policy. The eight-page memo, marked “highly confidential”, offers a fascinating look inside the company’s policy maneuvers.

In one section, Levine discusses plans for data collection on Android devices, writing:

“We’ll be collecting users’ location data and matching it with cell site IDs. This information will be stored in anonymous form but will allow us to roll out location-aware ‘feature phone’ products in the future. Second the growth team wants to begin collecting certain limited information about whether users have a non-Google app store enabled and which default applications they are using for certain Facebook functions (camera, messages, etc) for competitive analysis and product improvement purposes.”


Elsewhere in the memo, Levine details efforts by various Facebook executives and employees to curry favor with politicians around the world. Among other things, Levine celebrates a meeting between Gen Martin Dempsey, then chairman of the joint chiefs of staff, and Sheryl Sandberg, noting the Dempsey and his wife are “both active Facebook users”. The memo also references a successful effort to persuade the former Indian president Pranab Mukherjee to join Facebook.

The memo also references a meeting between a Facebook staffer and the head of California’s eCrime unit to discuss then California attorney general Kamala Harris’s office of privacy protection.

“The meeting went well and we were left with several useful assurances about the AG’s intentions – the most important being that they view Facebook as a good actor and they will keep communications with us open (we will not unknowingly be the subject of an investigation),” Levine wrote.

The Guardian has contacted Six4Three for comment. Ted Kramer declined to comment.

Facebook Security Lapse Affects Millions More Instagram Users Than First Stated

News that the company had insecurely stored passwords came on the same day as the release of Robert Mueller’s long-awaited report

Facebook chose one of the busiest news days in American politics this year to admit that millions more Instagram users were affected by a security lapse than it had previously disclosed.

At 10 am ET on Thursday, as the attorney general, William Barr, wrapped up his news conference on the release of the report of the special counsel, Robert Mueller, Facebook updated a 21 March blogpost, which revealed it had mistakenly stored the passwords of hundreds of millions of users unencrypted, to include a sentence admitting that millions more Instagram accounts had been affected.

The 21 March post initially said “hundreds of millions of Facebook Lite users, tens of millions of other Facebook users, and tens of thousands of Instagram users” had data stored in an insecure way.

In the update, the company said it had discovered additional logs of Instagram passwords being stored in a readable format. “We now estimate that this issue impacted millions of Instagram users,” it noted.

The clear implication of the timing of its admission is that Facebook is trying to bury this privacy oversight in the midst of its larger scandals of the week, said Evan Greer, deputy director at Fight for the Future, a privacy advocacy non-profit.

“Exactly zero people are surprised that Facebook would try to bury this damning story by releasing their response today,” she said. “It fits their MO of deflecting, downplaying and apologizing without addressing the fundamental problem: that their current business model is incompatible with user privacy and human rights.”

Facebook stored millions of passwords without encryption for years, a story from security reporter Brian Krebs initially reported. It is standard practice in the industry to store passwords with encryption so that even if they are hacked, stolen passwords cannot be read or used. In this case if passwords were taken they could have more easily been used.

A Facebook spokesman told the Guardian there is no evidence of abuse or misuse of the passwords.

“This is an issue that has already been widely reported, but we want to be clear that we simply learned there were more passwords stored in this way. There is no evidence of abuse or misuse of these passwords.”

The Mueller report released on Thursday mentioned Facebook more than 80 times in relation to potential efforts to affect results of the 2016 elections. It found the Internet Research Agency, an election interference group affiliated with the Russian government, paid more than $100,000 to Facebook for more than 3,500 advertisements.

Fake accounts and advertisements sponsored by the agency reached as many as 126 million Americans, the report found. The IRA also promoted and organized political rallies using Facebook events. Announcing additional security problems in the midst of scrutiny over 2016 election activity was no accident, said Ed Zitron, a tech industry public relations veteran and CEO of EZPR.

The timing of the announcement was the equivalent of Facebook “mumbling it under your breath while someone is playing loud music and hoping no one will hear,” he said. “The crazy thing is that they think they can still do this … They are acting like they’re still a cute startup, but they’re not.”

Ten years ago Facebook reached out to The Pirate Bay, asking the torrent site to remove the ‘share’ button from its site.

At the time, the torrent site was at the center of a high profile copyright infringement lawsuit, something the social media network didn’t want to be associated with.

Perhaps unsurprisingly, The Pirate Bay wasn’t very cooperative. The request remained unanswered which left Facebook with no other option than to block Pirate Bay URLs at its end.

“The Pirate Bay has not responded and so we have blocked their torrents from being shared on Facebook,” the company told us at the time.

Today, more than a decade later, the “share” button on The Pirate Bay is long gone. Somewhere during this period, Facebook’s ban was also lifted. When the social media site started blocking several other torrent sites a few weeks ago, we noticed that TPB was not among them.

However, this changed recently. When we reviewed Facebook’s blocking efforts a few days ago we noticed that The Pirate Bay is now blocked as well. Similar to the other pirate sites, it apparently violates the platform’s “community standards.”

People who want to use Facebook to post a link to The Pirate Bay will see the following error message instead; “You can’t share this link. Your post couldn’t be shared, because this link goes against our Community Standards.”

Similarly, all Pirate Bay links are blocked in Facebook’s Messenger chats as well, returning a similar notification.

Facebook’s Community Standards and its Terms of Service allow the platform to take action against potential intellectual property infringements, which is likely what triggered this action.

While The Pirate Bay is now blocked again by Facebook, the current ban is substantially different from the previous one. Ten years ago the site only prevented people from linking to actual torrent pages, while all URLs, including the homepage, are banned today.

It is apparent that Facebook is gradually expanding its ‘piracy’ blocking efforts. In addition to adding The Pirate Bay, 1337x.to was recently added as well, and it wouldn’t be a surprise if more URLs will follow.

Hillary Clinton said there was a ‘war on truth’ to further the interests of a wealthy group.

Mark Zuckerberg “should pay a price” for what he is doing to democracy, Hillary Clinton has said, as she expressed doubts about whether free and fair elections were even possible in the wake of Facebook’s decision to not factcheck political advertising.

Speaking in New York at a screening of The Great Hack, a Netflix documentary about the Cambridge Analytica scandal, the 2016 Democratic presidential candidate cited the threat to upcoming elections in both the US and UK as she made the damning remarks about Facebook’s decision to allow politicians to lie in adverts posted to its platform.

Her intervention comes amid speculation she may mount a third bid for the presidency.

She said it was inevitable that false information on Facebook would have an impact on elections “because propaganda works”. In 2016, she said fake news on Facebook that Pope Francis had endorsed her opponent, Donald Trump, “really did have an impact” and predicted “it’s only going to be more powerful going forward because it is more well tested. They know what they were successful at.”

She added: “And we are getting warning signals all the time about what is happening right now and how it is likely to affect our next election.”

Cambridge Analytica used illegally harvested Facebook profiles to target voters in the US election but Clinton said this was just the “tip of the iceberg” in terms of the challenges facing democracy. Nonetheless her harshest remarks were reserved for Facebook.

“When Facebook is the principal news source for more than half of the American people, and the only source of news that most of them pay any attention to, and if it announces that it has no responsibility for the airing of false ads … how are you supposed to get accurate information about anything, let alone candidates running for office?”

Asked if she thought there was any connection between the closed-door meeting Zuckerberg had with Donald Trump at the White House and the subsequent decision by Facebook to change its policy around factchecking “false, deceptive or deliberately misleading content” by politicians, she said she couldn’t “draw any conclusions about closed-door meetings, not only with Trump but with Tucker Carlson [of Fox News] and with [rightwing website] Breitbart and with many others that have been going on at Facebook quarters”.

But she went on to say: “If I were of a conspiratorial mindset, I might suggest that there seems to be some connection.”

Clinton said she believed we were seeing “a war on truth” in which the “manipulation of information” served to further the interests of a set of “incredibly wealthy people who believe they can do whatever they want to do”.

She also drew attention to the connections between Brexit and the Trump campaign that she said she had not been aware of at the time. She had been “somewhat taken aback” by the Brexit result, she said, but “I didn’t, at that time, see the direct connection. I didn’t know about all the involvement of the same players in Brexit, the same players in our election.”

She said The Great Hack had been “a difficult film for me to watch” but also “so true to my own understanding of what had happened”. She said people needed to see the film because “still to this day there is a sense of disbelief about a lot of what has happened”.

The documentary, directed by Karim Amer and Jehane Noujaim, examined the use of data by Cambridge Analytica by the Trump campaign to target “persuadables” or floating voters and how the Russian government used Facebook’s platform to subvert Clinton’s campaign.

Clinton described how, when the first reports started coming in of Russian involvement, her team had tried to raise the issue but it had been impossible to get anyone to take it seriously.

“When the Russians started dumping emails out around our convention and my campaign went out and tried to talk about that on television they were basically laughed at. It was like: ‘Oh yeah, right, now she’s going to blame the Russians.’”

She pointed out that it had been proved that the Russian government, as well as stealing emails, had also stolen her campaign’s voter data. “And then you find out that Paul Manafort is giving polling data to a Russian who has obvious ties with Russian intelligence.

“And you piece all this together and you can’t make it up. And because it’s hard to make up, it’s hard for people to believe because it’s so far out there.”

The situation only seemed to have become worse, she said. “Everyone knows it’s still going on and it will be that much harder to combat.” And she said the amount of money going into the 2020 Trump campaign combined with exhaustive testing had already put it streets ahead of her fellow Democrats.

An explosive leak of tens of thousands of documents from the defunct data firm Cambridge Analytica is set to expose the inner workings of the company that collapsed after the Observer revealed it had misappropriated 87 million Facebook profiles.

More than 100,000 documents relating to work in 68 countries that will lay bare the global infrastructure of an operation used to manipulate voters on “an industrial scale” are set to be released over the next months.

It comes as Christopher Steele, the ex-head of MI6’s Russia desk and the intelligence expert behind the so-called “Steele dossier” into Trump’s relationship with Russia, said that while the company had closed down, the failure to properly punish bad actors meant that the prospects for manipulation of the US election this year were even worse.

The release of documents began on New Year’s Day on an anonymous Twitter account, @HindsightFiles, with links to material on elections in Malaysia, Kenya and Brazil. The documents were revealed to have come from Brittany Kaiser, an ex-Cambridge Analytica employee turned whistleblower, and to be the same ones subpoenaed by Robert Mueller’s investigation into Russian interference in the 2016 presidential election.

Kaiser, who starred in the Oscar-shortlisted Netflix documentary The Great Hack, decided to go public after last month’s election in Britain. “It’s so abundantly clear our electoral systems are wide open to abuse,” she said. “I’m very fearful about what is going to happen in the US election later this year, and I think one of the few ways of protecting ourselves is to get as much information out there as possible.”

The documents were retrieved from her email accounts and hard drives, and though she handed over some material to parliament in April 2018, she said there were thousands and thousands more pages which showed a “breadth and depth of the work” that went “way beyond what people think they know about ‘the Cambridge Analytica scandal’”.

Steele made a rare public intervention to comment on the leaks. He said that while he didn’t know what was in them, the context couldn’t be more important because “on our current trajectory these problems are likely to get worse, not better, and with crucial 2020 elections in America and elsewhere approaching, this is a very scary prospect. Something radical needs to be done about it, and fast.”

He said authorities in the west had failed to punish those practising social and other media manipulation, and “the result will be that while CA may have been exposed and eventually shut down, other, even more sophisticated actors will have been emboldened to interfere in our elections and sow social divisions”.

Kaiser said the Facebook data scandal was part of a much bigger global operation that worked with governments, intelligence agencies, commercial companies and political campaigns to manipulate and influence people, and that raised huge national security implications.

The unpublished documents contain material that suggests the firm was working for a political party in Ukraine in 2017 even while under investigation as part of Mueller’s inquiry and emails that Kaiser says describe how the firm helped develop a “sophisticated infrastructure of shell companies that were designed to funnel dark money into politics”.

“There are emails between these major Trump donors discussing ways of obscuring the source of their donations through a series of different financial vehicles. These documents expose the entire dark money machinery behind US politics.” The same machinery, she says, was deployed in other countries that Cambridge Analytica worked in.

Emma Briant, an academic at Bard College, New York, who specialises in investigating propaganda and has had access to some of the documents for research, said that what had been revealed was “the tip of the iceberg”.

“The documents reveal a much clearer idea of what actually happened in the 2016 US presidential election, which has a huge bearing on what will happen in 2020. It’s the same people involved who we know are building on these same techniques,” she said.

“There’s evidence of really quite disturbing experiments on American voters, manipulating them with fear-based messaging, targeting the most vulnerable, that seems to be continuing. This is an entire global industry that’s out of control but what this does is lay out what was happening with this one company.”

META Settles Cambridge Analytica Scandal Case For $725m

Facebook owner Meta has agreed to pay $725m (£600m) to settle legal action over a data breach linked to political consultancy Cambridge Analytica.

The long-running dispute accused the social media giant of allowing third parties, including the British firm, to access Facebook users' personal data.

The proposed sum is the largest in a US data privacy class action, lawyers say.



Meta, which did not admit wrongdoing, said it had "revamped" its approach to privacy over the past three years.

In a statement, the company said settling was "in the best interest of our community and shareholders".

"We look forward to continuing to build services people love and trust with privacy at the forefront."

Tech author James Ball told the BBC it was "not a surprise" that Meta has had to agree to a serious pay-out but that it was "not that much" money to the tech giant.

"It's less than a tenth of what it spent on its efforts to create 'the metaverse' last year alone," he said.

"So Meta probably won't be too unhappy with this deal, but it does stand as a warning to social media companies that mistakes can prove very costly indeed."

The suggested settlement, which was disclosed in a court filing late on Thursday, is subject to the approval of a federal judge in San Francisco.

"This historic settlement will provide meaningful relief to the class in this complex and novel privacy case," lead lawyers for the plaintiffs, Derek Loeser and Lesley Weaver, said in a statement.


The complaint was filed on behalf of a large proposed class of Facebook users, whose personal data on the social network was released to third parties without their consent.

The class size is "in the range of 250-280 million" people, according to the ruling document, representing all Facebook users in the US during the "class period" which runs from 24 May, 2007 to 22 December, 2022.

It is not clear how the plaintiffs would claim their share of the settlement.

Janis Wong, a privacy and ethics researcher at The Alan Turing Institute, said it would only amount to two or three dollars per person if each individual decided to make a claim.

A further hearing on the settlement is due to take place on 2 March, 2023.

"Even though this $725m settlement doesn't cover UK users, earlier this year a competition law expert put forward a multi-billion dollar class action suit against Meta regarding users' data exploitation that does cover the Cambridge Analytica period.

"We should hear more about that from the UK Competition Appeal Tribunal in the new year," she told the BBC.

Meta Fined €390m Over Use of Data For Targeted Ads

Meta has been fined €390m euros (£346m) for breaking EU data rules.

The Irish Data Protection Commission (DPC) says the way Meta asked permission to use peoples' data for ads on Facebook and Instagram was unlawful.

Meta, which owns both platforms, has three months to change how it obtains and uses data to target ads.



Meta says it is "disappointed" and intends to appeal, stressing that the decision does not prevent personalised advertising on its platforms.

The regulator said that Facebook and Instagram can not "force consent" by saying consumers have to accept how their data is used, or leave the platform.

As Facebook and Instagram have European headquarters in Ireland, the DPC takes the lead in ensuring they comply with EU data law.

Privacy campaigners say the decision is a major victory and means Meta will have to give users real choice over how their data is used to target online advertisements.

It means Meta will potentially have to change the way a key part of its business works.

The bulk of the firm's money, over $118bn (£97.8bn) in 2021, comes from advertising.

The fine is the second significant penalty imposed by the watchdog in recent months.

In November it was fined €265m (£228m) by the DPC over a data breach that saw the personal details of hundreds of millions of Facebook users published online.

According to the Irish Times Meta set aside €2bn (£1.7bn) to cover potential European fines in 2023.




New law, new complaints


The DPC investigation was sparked by complaints made in 2018 by privacy campaigner Max Schrems, on behalf of two users in Austria and Belgium. The complaint was brought just as the EU's new data and privacy law, the General Data Protection Regulation (GDPR), came into operation.

In order to comply with GDPR both Facebook and Instagram asked users to click "I accept" to indicate that they agreed to updated terms of service setting out how their data would be used in ads.

If users did not accept, they were unable to use Facebook or Instagram.

The complainants argued that this meant Meta was "forcing" them to consent to their data being used in targeted ads - and this breached the GDPR.

Meta's representatives argued that Facebook and Instagram are "inherently personalised" and that, as part of that personalisation, targeted ads are a "necessary and essential part" of how the platforms work.

They said Meta was not giving users an ultimatum, and that there was just no way the platforms could work without using data for advertising.

But the DPC found that is not the case, and users were forced to consent.

The DPC also found that Meta was not clear enough with users about how it was using their personal data and why.

But the decision was only arrived at after a dispute with other European data authorities.

That was finally settled in December by the European Data Protection Board.

Meta's spokespeople say that it plans to challenge the size of the fines imposed, "given that regulators themselves disagreed with each other on this issue".

The company argues that far from forcing people to accept how it uses data, it gives consumers a number of tools to control how their data is used.

Privacy campaigner Mr Schrems wrote in response to the decision: "This is a huge blow to Meta's profits in the EU. People now need to be asked if they want their data to be used for ads or not.

"They must have a 'yes or no' option and can change their mind at any time".
