December last year Kim Dotcom revealed his plan to put the “dinosaur record labels” out of business.


Dotcom’s Megabox to Launch “A Few Months” After Mega

Dotcom said his revolutionary music platform called Megabox was about to go public, but due to a well-known intervention from the U.S. Government that launch never happened.

Dotcom, however, is not giving up that easily. With a team of developers he’s working hard to get a new Megaupload (or Mega as it’s correctly titled) as well as Megabox ready for a public release.

The separation between the two projects hasn’t been made entirely clear in the press with several news outlets reporting that Megabox will launch next month, confusing it with the new file-storage platform Mega.

However, presently there is no official launch date for Megabox.

“Megabox will launch a few months after Mega,” Dotcom informs TorrentFreak, adding that he can release no further details at the moment.

The music service is currently being developed by the Portuguese company Triworks.


Megabox is coming “soonish”

When it’s released later in 2013 Megabox will give the public access to free music, while compensating artists through advertising revenue.

Dotcom believes that this “free music” business model has the potential to decrease music piracy while giving artists proper compensation for their work.

This revenue is expected to come from the Megakey application users will be required to install in exchange for free content. Megakey works like an ad blocker, but instead of blocking ads it replaces a small percentage with Mega’s own ads. Those who prefer not to install the app have the option to buy the music instead.

“Music will be free for users who install the Megakey App. Anyone who does not like the App can just purchase the music,” Dotcom told TorrentFreak previously.

Most of the revenue generated will go directly to the artists with Megabox keeping a small share. This fraction pales in comparison to the amounts held back by the major labels.

“These new solutions will allow content creators to keep 90% of all earnings and generate significant income from the untapped market of free downloads,” Dotcom said.

According to Dotcom there are several “top artists” lined up for the launch. Whether Megabox will be able to challenge the mighty influence of the major labels will become clear in a few months’ time.

Update Dotcom’s Mega Stopped-Finances Blocked by US Actions

It’s been exactly one year since Megaupload was destroyed by the United States government and exactly one year since Kim Dotcom and his business partners were arrested and thrown in jail by armed police.

For most people these developments would’ve heralded the beginning of a downward spiral, but for this resilient team it only added fuel to the fire.

This weekend, against what appeared to be insurmountable odds, Kim Dotcom, Mathias Ortmann, Finn Batato, Bram van der Kolk and a legal team headed by Ira Rothken and Paul Davison QC launched Mega, the most anticipated file-sharing and storage site in history.

Billed as “The Privacy Company“, the launch certainly went off with a bang. In the site’s first hour online it attracted 100,000 brand new users and just a few hours later signups had reached a quarter of a million and beyond. Demand was such that the site couldn’t cope, with many visitors struggling to gain access to the Internet’s newest cyberlocker.

“Server capacity on maximum load. Should get better when initial frenzy is over. Wow!!!” exclaimed Dotcom on Twitter.

A few minutes ago the New Zealand launch party kicked off and it had all the glitz the world has come to expect from the flamboyant entrepreneur. From a festival-sized stage in front of Kim Dotcom’s Coatville mansion proceedings began with a play to the home crowd via a traditional Māori musical performance. Then Dotcom took the stage.




“Today is the one year anniversary of the raid and destruction of Megaupload. The allegations against us are wrong, we are innocent and we will prevail,” he began.
“This is not about mocking any government or Hollywood. It’s about our right to innovate.”
Dotcom said the launch of Mega would begin a new conversation on Internet freedom.
“The Internet belongs to no man industry or government,” he said.


Dotcom went on to talk a little about the misuse of copyright by profit-motivated corporations aimed at taking control of the Internet and chilling free speech. He said Megaupload had first-hand experience of this type of action, it was taken away without a hearing, its users’ privacy was ruined and free speech was attacked.
“You will be left at the side of the road if you misuse copyright,” he said. “No matter how many politicians you lobby, no matter how many SOPAs, you will not take control of OUR Internet,” he declared.
The new Mega is billed as “The Privacy Company” and Dotcom pushed this aspect heavily in his speech.
“Why do we focus on privacy? According to the UN Charter of Human Rights, privacy is a basic human right. But lately it has become increasingly difficult to communicate privately,” he said.




“By using Mega you say NO to those who want to know everything about you. By using Mega you say NO to governments that want to spy on you. By using Mega you say YES to Internet freedom and your right to privacy,” he said.

Adding to the stats given out earlier, Dotcom said that Mega’s launch had exceeded expectations. The site had 1 million visitors in 14 hours and 500,000 registered users.
“Mega is going to be huge and nothing will stop Mega,” he said.
Then, adding to the performance, a black FBI-labeled helicopter swooped in and officers rappelled down ropes from the roof of the mansion in a reenactment of the raid one year ago. But Dotcom swiftly brought this to an end.
“Stop the madness, lets all be friends,” he said, launching into a performance of his own track “Party Amplifier.”


In a Q&A session, Dotcom spoke of a project Megaupload had been working on. Megamovie was aimed as a Netflix competitor and one which would’ve been integrated with Megakey, but it didn’t get off the ground due to the raids. On Twitter Dotcom teased the MPAA with the screenshot below and “Let’s talk!”




Following questions on the privacy and encryption aspects of the site, Dotcom said that he would be lowering his profile somewhat in the future. It’s not healthy to be constantly in the public eye he said, and with no further questions the press conference ended and the bar was declared open.

I watched this last nite on SBS World News and just smiled in amazement at this incredible man.

In more or less words he just said "F you USA"! Thats what I thought from his smile he gave in the interview.

He spoke too soon..... the site's server has gone down....
Soon after the announcement thousands of people registered an account, every minute.

“I have never seen anything like this. From 0 to 10 Gigabit bandwidth utilization within 10 minutes,” Dotcom wrote in a tweet.

A few hours later Mega’s user count hit 250,000.

Unfortunately, the site’s servers can’t keep up with the demand and Mega is suffering frequent downtime.




Kim Dotcom doesn’t appear to be worried and says things should be fine after the initial frenzy is over.

“The guys are working on balancing the load,” Dotcom says.

In a few hours Mega will launch officially with a Mega press conference.

Perhaps we’ll hear more about Megamovie as well then.....

Well his new Movie site will have to be well hidden and protected. But I dont think the US will let it survive for long without some action.
Kim shouldnt be making a fool of "The Grey Men", they have a lot of ways to bring sites down without going legal. Their favourite at the mo, is DDos attacks......

But if it continues, it will probably hit us and other similar sites very hard on new members coming it. Kim has a lot of money and followers and little sites like ours are struggling to survive as it is.

Dotcom’s Mega: US Anti-Piracy Group Moves To Cut Off Site’s Finances

Yesterday was the big day. After a year of turmoil for Kim Dotcom and this associates, Mega was born from the ashes of Megaupload, destroyed by the U.S. government in January 2012 at the behest of the MPAA.
The launch press announcement in front of 200+ guests and a worldwide audience of millions was a loud and at times bizarre affair, but a couple of serious messages were underlined time and again. User privacy via encryption is paramount at Mega but that will not be at the expense of rightsholders.
To that end, Mega says it has had a team of lawyers working to ensure that Mega meets its legal obligations in every respect and the claim that it is the most closely scrutinized start up in Internet history seems like a reasonable one. But already the hawks are circling, one in particular.

Robert King is the lead figure behind StopFileLockers (SFL), an anti-piracy group dedicated to bringing file-hosting services to their knees by strangling their finances. Last year King claimed his group had a hand in disrupting the cash flow to hundreds of sites and actually shutting down dozens more. Now he has a very big scalp on his mind.
King, an Australian and adult industry player, says that StopFileLockers have just begun a “campaign to have the payment processing of all Mega resellers terminated.”
“Mega itself does not process payments because nobody would process payments for it. A couple of Mega resellers have PayPal and they are being terminated,” he says

King says Mega can’t meet the standards required by PayPal.
“It has been widely reported that Paypal requires certain conditions to be met to become an approved file sharing merchant, on the face of it many of these conditions cannot be met by Mega,” he said.

A look at Mega’s premium account signup page reveals a selection of resellers , all apparently reputable companies. They include domain name registrar Instra, whose founder Tony Lentino is the new Mega CEO, and other domain companies including EuroDNS and Digiweb.
If these companies did indeed find their PayPal accounts closed or frozen, it could potentially disrupt their core businesses to the tune of millions of dollars.



King seems unconcerned and despite Mega’s stance that it is a legitimate business that abides by all relevant laws, he justifies his actions by describing Mega as an operation hiding behind a “thinly veiled appearance of a legitimate cloud hosting service.”

“We haven’t and wont go after legitimate services like Dropbox – however from its inception the new Mega was never intended to be a legitimate cloud storage service as it has all the fundamental qualities of an infringing file locker service, the only thing missing at this stage is an affiliate program,” King adds.

Of course, there will be Mega users who upload copyright-infringing material, just as people upload unauthorized content to YouTube every single minute of every day. However, while YouTube is also a file-locker of sorts, in King’s eyes there is no comparison, despite Mega only being online for a couple of days with no time to prove itself.

“At this stage there is no mechanism by which rights holders can gain access to remove files, there appears to be no plans to institute arrangements whereby files can be matched against MD5 or other fingerprinting technology for automated copyright removal and the detection of harmful content, and the site has not shown any wish to comply with the policies of the payment processors with whom it seeks to do business,” King says.
“Given the site lacks many of these safety features, we believe that Mega is no different to various other file locker services which have had various payment services canceled or suspended.”

But of course Mega is very different technically to most other mainstream file-hosting sites. While it does have a very clear policy on the takedown of illicit content, King suggests that only proactive filtering will be enough to quality Mega for taking payments via PayPal and other processors. However, due to the site’s encryption mechanisms, hash checking and matching simply won’t work.
In the meantime, StopFileLockers say they are watching how Mega is being used.

“We have already detected a significant amount of illegal and copyright infringing material being shared by the new Mega. There are sites already sharing links to hundreds of copyright infringing titles on Mega,” King says.

We asked King for evidence of the apparently illegal and copyright-infringing material but he declined and said that data would be released in due course.

As I posted in my last post in this thread, the "Grey Men" will not stop to bring Kim and his new sites down. They will find other ways.. Kim continues to pay thousands of $$ to hire all these different Gurus and lawyers in every part of the world..

Seems to me he should stop continuing to bait the US, and stop all these press announcements and be quiet for a while.....

A simple thing like a little old fashioned common sense might prevail best.

Hacker Bogus DMCA Requests Sent to Kim Dotcom

Warner Bros. Targets Kim Dotcom’s Mega With Bogus DMCA Requests

Copyright holders are increasingly trying to take down allegedly infringing links by sending millions of DMCA takedown notices to Google and elsewhere each month.

Unfortunately, not all of their requests are accurate.

Sometimes these mishaps are amusing, such as when copyright holders try to take down their own legitimate content. In other cases errors can lead to thousands of websites being censored by mistake.

Today we discovered another bogus takedown request, one that may bring a smile to Kim Dotcom’s face.

Last week Warner Bros. sent a DMCA notice to Google asking the search engine to remove 964 URLs that allegedly link to infringing copies of the movie “Gangster Squad.” The notice in question also lists 16 links to Mega.co.nz, Dotcom’s new cloud hosting service.

Nothing out of the ordinary, as all file-hosting services store some copyrighted content on their servers. However, Warner Bros’ request is inaccurate on several fronts.

First and foremost, Mega has decided that Google can’t index their site. This means that even if links to pirated content are posted publicly elsewhere on the Internet, Google will not add these URLs to their search engine.

In other words, the URLs that Warner Bros. asked Google to remove were never indexed to begin with.

The second problem with the takedown requests is that the URLs are inaccurate, and don’t point to any copyrighted material. Apparently the automated web scraper used by Warner Bros. can’t handle the format of Mega links, replacing “#!” with “?escaped_fragment=”.

The same errors were later repeated in DMCA notices Warner Bros. sent for other movies, including Argo.

The files that Warner Bros. meant to take down are currently still available on Mega, suggesting that the movie studio didn’t issue a separate DMCA notice to the file-hosting service itself.

Interestingly, Warner Bros. is not the only rightsholder to make the same mistake. Several others have also sent takedown notices to Google for allegedly infringing content on Mega that was never indexed.

The above once again shows the dangers of automated DMCA notices that are sent without any type of verification. Right now rightsholders and the anti-piracy outfits they employ have absolutely no incentive to improve the accuracy of their takedown systems.

Even the most fundamental checks, such as whether Google actually indexes the links, are ignored. Perhaps it’s time for these continual erros to have some kind of penalty attached?

Kim “Billy Big Steps” Dotcom Still Causing Headaches For Spy Agency

Yet more embarrassing information on the Kim Dotcom spying fiasco has surfaced in New Zealand. Documents show that in December 2011 when the spying began, police already had information which stated that Dotcom – codenamed “Billy Big Steps” – was a NZ resident. As those deemed responsible are held accountable, the GCSB spy agency’s deputy director has become the first high-profile casualty, and the Prime Minister is warning of more “big changes” to come.



It’s the headache that just won’t go away for New Zealand’s government and its top spy agency.

From December 2011 to January 2012 the spies of GCSB monitored Megaupload founder Kim Dotcom and his associate Bram van der Kolk. Both have New Zealand residency which rendered the surveillance illegal. Last month a High Court judge gave Dotcom permission to sue the government for damages over the incident.

Now, in documents obtained by the Labour opposition and handed to 3News, there is yet more embarrassment for officials tied up in the controversy.

Dotcom – who the papers reveal was given the codename of “Billy Big Steps” – was first subjected to monitoring on December 16 2011. The documents reveal that on this date the police were already in possession of papers which showed that Dotcom was a New Zealand resident and therefore exempt from GCSB spying.

By January 11 2012, just days before the huge raid on Dotcom’s mansion, the whole detailed immigration file was in police possession and by February 22nd GCSB knew that they had carried out illegal spying. Even so, it took until September 2012 for them to admit that to Prime Minister John Key.

Making matters worse and despite the catalog of errors, the papers show a GCSB operative stating that “..people here have been very relaxed about it all.” Perhaps unsurprisingly, high-profile heads are now beginning to roll.

The first casualty is Hugh Wolfensohn. He joined the agency back in 1988 as a legal advisor and was later promoted to Deputy Director of Strategic Policy and Corporate Services. From there he became Deputy Director of Mission Enablement, finally going on to become overall GCSB Deputy Director.

During the month-long monitoring of Dotcom and Bram van der Kolk, Wolfensohn was acting GCSB Director meaning that he was the person with overall responsibility for the illegal surveillance. After 25 years with GCSB Wolfensohn has now stepped down. When Prime Minister John Key was asked whether Wolfensohn was paid off he laughed and said that was something for the former spy to answer.

The news comes in advance of the findings of a high level inquiry ordered by Key into the spying fiasco and set to be published in a few weeks time. When pressed, Key admitted that there are still “big changes” to come at GCSB, which can only be good news for Dotcom.

New Zealand Gave Kim Dotcom Residency, Knowing He Was Wanted By FBI

Due to its location New Zealand is one of the first counties in the world to celebrate New Year and as December 2010 drew to a close, something special lay in store for Kiwis.

A flamboyant businessman called Kim Dotcom had just been granted New Zealand residency and in a show of thanks to his new hosts he planned a massive fireworks display. It would take place from a pair of barges anchored in Waitemata Harbour and be enjoyed by everyday citizens and politicians alike, including Auckland mayor John Banks to whom Dotcom later donated campaign cash.

But surprisingly, especially given the spectacular celebrations and apparent political endorsement, just months earlier Dotcom’s New Zealand residency was hanging by a thread due to some unusual issues turned up by a security background check.

Dotcom first applied for New Zealand residency in June 2010 under a special program for wealthy investors. He had previously been living in Hong Kong where the now-defunct Megaupload was registered.

Four months later behind the scenes discussions were clearly speeding up – and running out of time. Dotcom’s immigration agent David Cooper had informed an immigration manager on October 26 that if Dotcom hadn’t received a decision on his application by November 1, he would cancel and seek residency elsewhere.

But it wasn’t a straightforward case. Two months earlier Dotcom had been convicted in Hong Kong for failing to disclose information to the country’s Securities and Futures Commission and had received a token fine of around $1,000. There were also his historic convictions for hacking, computer fraud and phone card dealings to consider.

Although not required as a matter of policy, these past transgressions led New Zealand’s Security Intelligence Service to carry out a so-called “Match Check” on Dotcom to see if anything else turned up in his background.

According to an Immigration New Zealand report written in October 2010 and obtained by NZHerald under the Official Information Act, during the course of their inquiries the SIS discovered that the FBI were investigating Dotcom.

As a result, on October 13 the Megaupload founder’s application was put on hold and the next day the SIS wrote to the police informing them of the FBI’s involvement. The documents also reveal email correspondence between the SIS and Immigration New Zealand in the last week of October.

By October 29 Dotcom’s previously blocked application had been taken off hold and on October 31 – just a day before Dotcom’s self-imposed deadline had expired – he was granted New Zealand residency.

“I have spoken to Kim and passed on the good news,” wrote Cooper to Immigration New Zealand deputy chief executive Nigel Bickle. “He is absolutely delighted and extends his thanks to all those involved in getting [redacted] and himself across the line.”

Just a year and three months later, New Zealand and the United States teamed up to destroy Megaupload and very publicly arrest Dotcom and his associates as part of the biggest copyright case in U.S. history. This, despite knowing that a criminal investigation was running in parallel with Dotcom’s residency application.

The fact that the Kiwi authorities knew about the FBI investigation yet still accepted Dotcom as a resident is not lost on the entrepreneur, who today described the process as “The New Zealand residency trap.”

“[Prime Minister Key] said ‘There is no conspiracy’. But why did we get residency after SIS learned of FBI case & declined approval?” Dotcom said. “Did we get New Zealand residency because the U.S. govt preferred its extradition laws & cozy politics over Hong Kong?”

Speaking on Monday, Dotcom said that his team don’t intend to let the matter drop.

“Our lawyers are getting to the bottom of this,” he said.

While New Zealand may have a been the preferred location from which to later pluck Dotcom, Hong Kong has also provided its fair share of headaches for the charismatic businessman. Those came to a head late last week when it was revealed that Dotcom will sue the Hong Kong government for its hand in the demise of his empire.

“We will take the Hong Kong government to court for the destruction of our business because they acted for the US government when shutting down our business and freezing all our bank accounts,” said the 39-year-old.

“We were in the process of preparing a listing on the Hong Kong stock exchange and the valuation of our company was over US$2 billion. Fortunately, the US government will have to indemnify Hong Kong for any damages awarded to us.”.

Pirate Kim Dotcom Granted Supreme Court Appeal>>U.S. Evidence

Since early last year Kim Dotcom and the rest of the “Mega Conspiracy” have been accused by the U.S. Government of running a criminal operation.

Despite the severity of the charges, Megaupload’s legal team does not have insight into all of the relevant documents relied on by the U.S. Government when it came to that conclusion.

Through the New Zealand courts Dotcom and his fellow defendants have requested access to the withheld information. To mount a proper defense they want to see the extent to which the U.S. authorities can back up their criminal charges.

On two earlier occasions, including once in the High Court, Dotcom’s legal team were granted full access to the U.S. evidence. However, in March these rulings were overturned by the Court of Appeal, which concluded that the United States could move forward with a summary case.

After the defeat Dotcom and his legal team quickly filed for an appeal at the Supreme Court, which was granted a few hours ago. This means that Megaupload has another shot at getting insight into crucial evidence.

“I am looking forward to the NZ Supreme Court review in our case and getting the discovery needed for a fair extradition hearing,” Dotcom commented on the news.

If the Supreme Court sides with Kim Dotcom and his associates, the evidence disclosed would be hugely helpful in ongoing legal battles on multiple continents. This includes the pending extradition battle in New Zealand.

Meanwhile, Megaupload’s lawyers haven’t been sitting still. In the United States they have a request pending to dismiss the case against the company, and last week two of their top lawyers released a white paper accusing the Obama administration of taking instructions from Hollywood.

Over in Europe, Germany was also added to the mix, with Megaupload lawyer Robert Amsterdam asking the Government there to intervene. Amsterdam argues that the human rights of Dotcom, a German citizen, have been violated by the U.S., and he wants the authorities to raise this issue in Washington.

Kim Dotcom’s extradition hearing in New Zealand is currently scheduled to take place in August this year, but that date could be further delayed now the Supreme Court has taken up the case.

Confused Google Doesn’t Believe Kim Dotcom is Real

Those who enter Kim Dotcom into Google’s search box will get millions of results.
Still, Google has doubts that the man is real.


“The name you provided on your Google+ page, Kim Dotcom, does not look like a name,” Google informed Dotcom.


The company suspects that Dotcom is a pseudonym or a business name instead.

If Mega’s founder doesn’t clarify his unusual name within 4 days Google+ says his account will be suspended.
Perhaps he should tell the Google+ team to Google his name?

Update Dotcom Sues LeaseWeb for Data Massacre

Dotcom Reveals Megaupload Data Massacre Emails, Plans to Sue LeaseWeb

Last week news broke that Megaupload’s former hosting provider LeaseWeb had deleted all Megaupload data from 630 servers without warning.

Petabytes of user data and backups, mostly from European users, were permanently deleted and the servers were re-provisioned to other customers. Kim Dotcom was outraged by the scandal and said Megaupload specifically requested that the host should preserve the data.

“They deleted petabytes of data in the face of Megaupload’s data preservation notices. Our legal team asked them multiple times not to delete the data while the U.S. court is deciding the pending cases including the rights of our users,” he said.

LeaseWeb counsel Alex de Joode disputed Dotcom’s account of the events, and the company released a statement explaining their actions. According to de Joode, Megaupload showed no interest in the data at all.

“During the year we stored the servers and the data, we received no request for access or any request to retain the data. After a year of nobody showing any interest in the servers and data we considered our options. We did inform Megaupload about our decision to re-provision the servers,” the counsel wrote.

“As no response was received, we commenced the re-provisioning of the servers in February 2013. To minimize security risks and maximize the privacy of our clients, it is a standard procedure at LeaseWeb to completely clean servers before they are offered to any new customer.”

Both sides clearly have different versions of the truth, but who is right? To back up his claims Kim Dotcom decided to share one of the date preservation request emails that Megaupload’s legal counsel sent to LeaseWeb during March 2012, less than a year before the data was deleted, and a similar request from EFF dated April 2012.

“LeaseWeb declined receiving data preservation requests regarding Megaupload servers and here is the proof that they did receive them on several occasions from EFF and the Megaupload legal team,” Dotcom informs TorrentFreak today.

“Megaupload continues to request that LeaseWeb preserve any and all information, documentation and data related to Megaupload – as destruction by LeaseWeb would appear to be in violation of amongst other things the applicable civil litigation data preservation rules and would interfere with evidence in a criminal matter[...],” Megaupload’s counsel Ira Rothken explains in the letter.

The email adds that “In addition, the Mega data on the servers at Leaseweb contain private and sensitive customer data and is subject to applicable privacy and data retention laws. Megaupload is negotiating with the United States to discern feasibility of consumer data access and the conditions for the same.”

The letter goes on to state that Megaupload is trying to get permission and funds to take over the servers from LeaseWeb, as it tried to do with US-based hosting company Carpathia last year.

“Megaupload would like to try to negotiate an amicable solution to the above legal conundrum with LeaseWeb via a purchase of the servers storing the Mega data and future payments amongst other things – similar to an agreement recently signed by Mega with Carpathia in the US.”

The EFF, who are representing a Megaupload user in the U.S. court case, made a similar preservation request to LeaseWeb USA in April, asking the company not to delete any data.

“We now write to formally request that you preserve that material both for purposes of contemplated future litigation and as a matter of obligation and courtesy to the innocent individuals whose materials have unfortunately been swept up into this case,” the EFF letter reads.

From the above it’s clear that LeaseWeb’s public statement contradicts the data preservation correspondence above, and that despite these requests LeaseWeb decided to wipe the data and re-provision the servers. But there’s more.

Adding to the controversy, Kim Dotcom today informed TorrentFreak that they have additional information the legal team is analyzing relevant to whether LeaseWeb violated the law. The new information allegedly shows that LeaseWeb may have broken applicable law in their handling of the servers after the raid.

“I can tell you that we are contemplating legal action against LeaseWeb,” Dotcom says.

While it’s clear that LeaseWeb’s initial statement in response to the data deletion was not correct, at this point it is impossible for us to report on the basis of the potential legal action. Dotcom says he will reveal more on that later.

LeaseWeb, meanwhile, maintains that it has done nothing wrong. The company operates under Dutch law and says it had no obligation whatsoever to preserve the data any longer than it did. In addition, the company says it informed Megaupload about the re-provisioning in January 2013. It further claims that it never received a lawful proposal to acquire the dedicated servers, as Megaupload suggested in their email.

Responding to LeaseWeb’s claim, Dotcom reveals that in April 2012 the Australian domain registrar INSTRA contacted the hosting company with a proposal to buy the Megaupload servers, to preserve them for later use. However, LeaseWeb allegedly refused to negotiate with the company, who are now one of the main investors in Megaupload’s successor Mega.

Regarding the email about the re-provisioning that Leaseweb says it sent in January, Megaupload’s counsel Ira Rothken informed us that he has no record of ever receiving it.

“Leaseweb was put on written notice repeatedly to preserve data relevant to both pending criminal and civil litigation, including potential civil litigation involving Leaseweb, whether one couches it in terms of e-discovery litigation holds or just being a good corporate citizen we believe that Leaseweb acted inappropriately under the circumstances when they destroyed data,” Rothken tells TorrentFreak.

“If they were really concerned about money they could have backed the data up to tape and made a minimal claim for reimbursement against the millions of dollars in Megaupload’s frozen assets.”

“Ultimately we blame the United States who exercised constructive control over Megaupload’s assets and who had the obligation, resources, and ability to preserve all relevant and exonerating evidence including the data located at Leaseweb and failed to do so,” Rothken adds.

It’s clear that Dotcom, who is still outraged and saddened by the mass data deletion, is determined to get to the bottom of the issue. He hopes that through a court proceeding the truth will eventually come out.

Update: Leaseweb issued a public response stating the Megaupload’s request was made before the servers were stored.

“The MegaUpload request was part of a larger discussion while the servers were still racked. On March 29, 2012 the servers were stored and preserved, the initial MegaUpload request pre-dates this. I see therefore no discrepancy between our statement and the facts,” the company states.

U.S. Government Is to Blame for Megaupload Data Massacre, Court Hears

Megaupload has asked the U.S. District Court to renew negotiations over the preservation of 1,103 servers that remain stored at Carpathia Hosting. If no agreement is reached, Megaupload fears that this data may suffer the same fate as the servers that were recently wiped by Dutch hosting company Leaseweb. Megaupload tells the Court that the destruction of the LeaseWeb servers is a direct result of the U.S. Government’s failure to act.

Two weeks ago news broke that Megaupload’s former hosting provider LeaseWeb had deleted all Megaupload data from 630 servers without warning.

Petabytes of user data and backups, mostly from European users, were permanently deleted and the servers were re-provisioned to other customers.

Leaseweb defended their actions by pointing out that no party had shown any interest in the data, but this was later contested by Megaupload’s legal team.

Worried that the 1,103 servers that remain stored at Carpathia Hosting may also be wiped, Megaupload has now written a letter to the U.S. District Court with the request to take action. Not only for the sake of the millions of users whose personal files are at stake, but also to preserve crucial evidence.

“In addition to destroying petabytes of Megaupload user data, LeaseWeb’s actions have impaired our clients’ defense, as the servers contained vast amounts of potentially exculpatory evidence directly relevant to the U.S. criminal case,” the letter reads.

Megaupload tells Judge John Anderson that through its inaction, the U.S. Government is to blame for the lost data at LeaseWeb.

“While LeaseWeb’s deletion of relevant evidence in the face of explicit preservation requests is inexcusable, the United States is equally culpable. The Government was plainly on notice of the need to preserve the LeaseWeb servers.”

Megaupload explains that the authorities failed to reach an agreement to preserve the servers and wouldn’t unfreeze some of Megaupload’s funds to cover the storage costs. As a result, the Government failed in its duty to save the data from being lost.

“As Megaupload has long maintained, by freezing the Defendants’ assets and denying Defendants access to or possession of the servers, the Government has exercised de facto control over the servers and is therefore in constructive possession of them.

“Under Brady v. Maryland and its progeny, the Government had an affirmative duty to ensure the preservation of the LeaseWeb servers and the exculpatory evidence they may have contained. The Government failed to do so.”

After the LeaseWeb debacle, Megaupload now fears that the servers still hosted in the United States are also at risk of deletion. To prevent this from happening, they urge the Court to restart the negotiations so a workable solution may be reached.

“The destruction of the LeaseWeb servers demonstrates the urgent need to reach a workable solution for data preservation as soon as possible, lest the 1,103 servers currently in Carpathia Hosting’s possession meet the same fate. We therefore respectfully urge the Court to reconvene the interested stakeholders and renew negotiations as quickly as the Courts schedule permits.”

Megaupload previously reached an agreement with Carpathia Hosting to buy all servers for $1,000,000, but the Government said it did not trust Megaupload with the data and would rather see it deleted.

To find out what role the U.S. authorities have played in LeaseWeb’s decision to re-provision the servers, Megaupload’s lawyers have also sent a letter to the Dutch hosting company and the U.S. Department of Justice. Both parties were asked to share all correspondence following the raids.

“In light of this destruction of evidence, it is critical for us to understand the extent to which LeaseWeb consulted with the U.S. Department of Justice or other U.S. authorities prior to wiping the data. We therefore request copies of any correspondence or communications between LeaseWeb and U.S. officials, whether direct or through Dutch authorities, from January 19, 2012 to the present.”

Over the past months there has been very little progress in the U.S. case against Megaupload. The Court still has to make a decision on Megaupload’s motion to dismiss the indictment as well as the possible return of remaining Megaupload user data.

Through the current letter, Megaupload’s defense hopes to get the data negotiations re-opened, but whether a solution will be reached has yet to be seen.

Any day now there will be a new addition to the British Royal Family. The future heir to the throne, whether male or female, will be showered with gifts – including a rather unusual one if the Prime Minister of New Zealand has his way.

In the days to come the UK’s Duchess of Cambridge, wife to Prince William, will give birth and for the first time the sex of the baby won’t play a part in determining whether he or she will become heir to the throne.

As a private helicopter stands by at RAF Valley in Anglesey to fly Prince William, a search and rescue pilot, to his wife’s side at a moment’s notice, well-wishers are preparing their gifts for the newborn.

It’s expected that world leaders will send generous gifts to the Prince and Duchess, but apparently Kimi Prime Minister John Key has an extra-unusual idea up his sleeve.

“We’re giving them Kim Dotcom,” Mr Key said after a conference today.

While Key is obviously joking (he is joking, right?) it’s interesting to see how much Dotcom has got under his skin.

“First the Prime Minister sold me to Hollywood. Now he’s gifting me to the royal family,” responded Dotcom on Twitter. “I’ll pick palace over prison,” he joked.

Pirate United "Stasi" of America/Kim Dotcom Painted onto Embassy

Police Investigate Dotcom’s Face Projected Onto U.S. Embassy

Last weekend the words “United Stasi of America” were projected onto the side of the US embassy in Berlin alongside the face of Kim Dotcom. Police are now investigating whether a crime has been committed.

The spying activities of the U.S. Government have received massive coverage in recent weeks, largely thanks to the revelations of Edward Snowden.

As a result the NSA has been compared on a number of occasions to the Stasi, the secret police in the former East Germany. The NSA, however, appears to be carrying out spying on a much grander scale.

In an attempt to draw even more attention to the scandal, last Sunday German artist Oliver Bienkowski beamed an image of Megaupload founder Kim Dotcom onto the walls of the U.S. embassy in Berlin accompanied by the words “United Stasi of America.”

“The Stasi would have dreamt of being able to do what the Americans are doing,” Bienkowski told Reuters.

“The Stasi look like a bunch of boy scouts compared to what the NSA is doing. It’s the real deal in terms of a secret service with modern technology at their disposal. It’s far more dangerous.”

Dotcom was delighted with the result.

“I defaced the U.S. embassy in Berlin with a truth-projection last night. 0wned!” he said on Twitter.

Now, however, police are reportedly investigating whether Bienkowski can be charged with the crime of “slander against the organizations and representatives of a foreign state.”

Bienkowski’s lawyer Fabian Eickstädt said that since the projection was made onto what is technically U.S. soil, its questionable whether there was any offense committed under German law.

According to The Local, the U.S. Embassy says it has no interest in a prosecution.

Pirate Dotcom’s Mega Gets Unofficial Video Streaming Portal

When Mega-Search.me launched earlier this year there was a flurry of news reports branding it a Mega search engine.

Technically the site doesn’t search Kim Dotcom’s Mega. Instead, it allows users to submit links to files hosted on Mega and makes this repository searchable.

Thus far nearly 50,000 links have been added and the site is particularly popular in France where Mega has a large user base.

This week the search engine launched a new sister site, Mega-Stream.me, which makes it possible to stream video and audio directly from Mega. Streaming links appear in the search results but users can also paste in their own Mega links.

The streaming portal requires a decent internet connection and the VLC plugin for FireFox or Chrome, but works quite well for the files we tested. Here is a streamable Mega video of the Pirate Bay documentary TPB AFK that should start playing from Mega’s servers right away.

The developers of the site note that there may be some hiccups since the service is still in beta. It is not possible to skip forward and backward, but pausing works fine.
Whether Kim Dotcom and the Mega team are happy with the unofficial streaming portal has yet to be seen.


While Mega-Stream.me has plenty of legal uses, most links on Mega-Search.me point to copyrighted material. This didn’t go unnoticed by the Mega team either. When the site launched earlier this year MEGA disabled access to all files the search engine linked to, legal or not.

When the search engine added a proper take-down procedure and stopped using the Mega logo the counterattack stopped, but Dotcom stressed that his team would be keeping a close eye on sites that don’t play by the rules.

“You will be seeing us acting aggressively towards sites that try to mimic Mega and use our logos. We’ll also go after sites that don’t have any takedown facilities, because that’s the biggest problem,” Dotcom told TorrentFreak at the time.

Mega-Stream.me has no index of links and is reminiscent of Dotcom’s now defunct Megavideo site, so unless it breaches the Mega terms of use in another way, we don’t expect that it will be targeted by Mega’s team in the near future.

As the Edward Snowden fallout continues, yesterday Kim Dotcom revealed that if certain new surveillance laws are passed in New Zealand he will have little choice but to relocate some of Mega’s operations overseas.

Privacy and security have become a hot topics for Dotcom. He was a surveillance target not only for the United States but also for local security service GCSB. Dotcom is tied up in a legal battle with the latter after a court found they monitored him illegally.

With Mega billed as ‘The Privacy Company’, Dotcom has a vested interest in battling the level of spying that can be carried out by the New Zealand government. Speaking with TorrentFreak, Dotcom explains why he sees the powers granted by these proposed new laws as a threat.

“The US government and the other Five Eyes partners (UK, Canada, Australia and New Zealand) have an agreement to push for new spy legislation that will provide them with backdoors into all Internet infrastructure and services. The NZ government is currently aggressively looking to extend its powers with the GCSB and the TICS act, which will force service providers with encryption capabilities to give them secret decryption access,” Dotcom explains.

Immediately it’s clear why this is an issue for Dotcom. All files uploaded to Mega are encrypted to the point where not even the company knows the data it’s carrying. Should the new legislation be introduced all that would have to change, but Dotcom says that isn’t going to happen.

“Mega doesn’t have decryption keys by design and we never will. Privacy companies like Mega will have to look for jurisdictions that care about basic human rights like privacy and freedom of speech,” he says.

Dotcom doesn’t go into detail on a full list of good candidates but says that smaller nations, particularly those with few enemies that don’t need a large spy apparatus, could be a good choice. However, one in particular stands out.

“Iceland is a friendly small country without enemies. They don’t spy on the world and they don’t care. It’s countries like Iceland that will see a rise in Internet services. There is a huge opportunity for smaller nations because the business that is going to leave the US is looking for a new home,” he predicts.

But while the small flourish, Dotcom says that the approaches taken by the ‘Five Eyes’ countries will see them ruin the growth of their own IT industries. And it seems that the United States will suffer the most.

“I expect that more and more Internet businesses will find the hostile US environment unbearable and will move their business elsewhere. Who wants to store any sensitive data on US based servers anymore?

“Over the next 10 years you will see a decline of US Internet giants and the rise of non-US Internet companies that care about user privacy. We will not see a strong NSA like before the Snowden leaks again. The truth is out there and when politicians and laws can’t protect our basic human rights, innovation and friendly jurisdictions will save us,” he says.

But can a country like Iceland cope with such a large influx of technology companies given their current infrastructure?

“Iceland has limited connectivity,” Dotcom admits. “But for now it’s a great option. Others will arise. I am sure of that. We have already setup a company in Iceland.”

So with preparations already underway should the worst-case scenario present itself, does it follow that Mega will desert the land of the Kiwis entirely? Dotcom told TorrentFreak that eventuality is unlikely but if any of their services face government demands for backdoors they will relocate elsewhere. Rest assured though, that won’t be in the United States.

“The US is on a path of destroying its massive lead in the Internet economy. Mass surveillance and copyright extremism will cost the US economy more than any terrorist attack or piracy,” Dotcom says.

“Remember, move your Internet business to small nations that are free of conflict and therefore don’t have a massive spy agenda. Look for countries that have robust privacy and human rights laws. Stay out of the US. Don’t even host a single server there,” Dotcom concludes.

New Zealand Kim Dotcom Intends to be President of New Political Party

Subjected to police raids, the closure of his Megaupload empire and the confiscation of his considerable assets, things could hardly have been worse for Kim Dotcom in January 2012.
But now, just 20 months later, the Internet entrepreneur is showing what can be done with hard work and determination. His Mega.co.nz file-hosting service is doing well and his popularity continues to rise, both online and locally with New Zealanders.

With TV appearances now becoming a regular thing, Kiwis are becoming more and more comfortable with the German-born businessman. It therefore comes as no surprise that he intends to make best use of that valuable asset.
Earlier today Dotcom published a tweet suggesting that he plans to enter the political arena.





The photograph of the magazine suggests that Dotcom might become PM, but speaking today the Mega founder said that at least for now, that won’t be possible.

“I’m not a citizen of New Zealand and therefore I can’t be elected into Parliament myself but I can be the president of a new party,” Dotcom explained.
“I have created a draft political program and I am in the early stages of meeting potential candidates to join me,” Dotcom added.
“I’m excited about the party and I’m confident that I can help make New Zealand a significant Internet economy player. Someone needs to lead New Zealand into the future. Unfortunately the current government doesn’t know what the future looks like,” Dotcom concludes.

So, with an eye on his presidency, work is already underway to form a brand new party.

The elections being eyed take place in November 2014 and Dotcom told us that leaves plenty of time to get the party registered and the program finalized. He’s hoping to attract quality candidates during the new few months.

Significant support for Dotcom in New Zealand will be an interesting thing to behold, particularly in light of the United States’ plans for the Megaupload founder.

Pirate Dotcom’s Baboom Launches With Good Times For Free

Say what you like about Kim Dotcom, but the man is certainly tenacious. After being well and truly dismantled by the combined efforts of the FBI and a New Zealand anti-terrorist force, most people would still be at home, licking their wounds.

But for this larger-than-life German with a colorful past worthy of a Hollywood movie (he’d love one of those of course), backing down was never an option. Once released from prison he picked up where he left off, building a brand new lawyer-pleasing cloud hosting company and becoming an outspoken privacy advocate and Internet surveillance critic.

Rewind more than two years ago, before that frankly stunning January day in 2012, Dotcom was working on a project intended to shake up the music industry. His Megakey product was a tool designed to block ads as users browse the web, replacing them with ones from Dotcom’s own ad network. This would generate revenue to help pay for ‘free’ music, a controversial technique which led to Dotcom stating that it would only activate itself on sites in the Alexa 100 – a take from the rich and give to the poor mechanic.

It was envisioned that Megakey would dovetail with another service, Megabox, but that particular naming convention will no longer see the light of day. In 2013 Dotcom confirmed that his new music offering would be called Baboom.

Today, the eve of Dotcom’s 40th birthday and the one-year anniversary of the launch of Mega.co.nz, will also see the release of Dotcom’s brand new album, Good Times. Various tracks have already been heard around the web, from the rowdy ‘Party Amplifier’ to the Dotcom alter-ego-featuring Live My Life. With production genius Printz Board, erm, on board, the sound quality is as good as you’d expect.

Good Times is being promoted online by Dotcom himself and on radio, but it is also enjoying some traditional offline marketing, with Dotcom’s face currently plastered over the back of around 100 buses.





The really unique aspect of the album, however, is its integration into the launch today of Baboom. Billed as a ‘soft launch’ of the yet-to-debut full service, Dotcom’s album is the centerpiece and sole musical attraction.

At the moment the Baboom site is a fairly straightforward affair. As an early preview most features are disabled although fans can read all about Kim, look at his pictures and videos and, of course, listen to his music. All of the tracks from the album are available to download for free in three formats – MP3, FLAC and .WAV. There’s also some samples to download for use in a remix competition.

Additionally, those who wish to pay for the album can do so, but no money changes hands on the Baboom site. All sales are directed to iTunes, Amazon and Bandcamp. Dotcom’s Twitter feed is embedded into his artist page but there are currently no other signs of ‘social’ elements woven into the music experience. Music discovery processes will also have to wait.
Of course there are many unanswered questions over where the service goes from here. Most iTunes or Spotify-like streaming services have the backing of the major labels which together provide tens of millions of licensed tracks. At this stage, considering Dotcom’s somewhat stormy relationship with U.S.-based rightsholders, it seems unlikely that Baboom will be able to compete on volume. While a focused and personal artist-to-fan experience could be on the cards, Dotcom only does big….so watch this space.

The full Baboom service is currently penciled in for a late-2014 launch.

Kim Dotcom Raid Warrants are Legal, Court of Appeal Rules

January 2012, New Zealand police carried out the largest ever action against individuals accused of copyright infringement.

Following allegations from the United States government acting on behalf of Hollywood, officers of STG, New Zealand’s elite counter-terrorist force, raided Kim Dotcom’s mansion, detaining the German-born businessman along with his wife and his children.

Adding momentum to mounting controversy, six months later a High Court judge found the warrants to be overbroad and therefore illegal. The decision was a huge boost to Dotcom’s fight against looming extradition to the United States.

On 18 Feb 2014 however, the case has taken a new twist, with the Court of Appeal overturning the earlier High Court ruling that the warrants lacked specificity. Conceding that the warrants contained flaws, a panel of three judges found that overall the warrants were legal.

“[We] are satisfied that the defects in the search warrants have not caused any significant prejudice to the respondents beyond the prejudice caused inevitably by the execution of a search warrant,” the judges write in their ruling.
“In this case the practical consequences for the respondents must be assessed in light of the nature of the electronic items that were seized when the warrants were executed. Assessed in this way it is clear that..[..]..no more items were seized than would have been without the defects in the search warrants.”
In support of this assertion the judges note that despite police seizing more than 135 electronic items containing 150 terabytes of data, a number of electronic items, which the police concluded did not contain relevant evidence, were not seized.

Noting that Kim Dotcom’s “life and soul is on his computer”, the judges said the entrepreneur would have understood what the warrants were all about.

“In our view a reasonable reader in the position of the recipients of the search warrants would have understood what they related to. This view is reinforced by the fact that Mr Dotcom was a computer expert who would have understood without any difficulty the references in the search warrant to his companies (Megaupload, Megavideo and Megastuff Ltd) and the description of the various categories of electronic items,” the judges write.
“The defects in these warrants were therefore not so radical as to require them to be treated as nullities..[..].. here there was no disconnect between what there were reasonable grounds to believe might be at the properties and what the warrant authorized the police to take. In other words, this really was a case of error of expression. The defects were defects in form not in substance,” the decision adds.
“We therefore allow the appeal in respect of the validity of the search warrants. These warrants are consequently valid,” the judges conclude.
However, the decision by the Court of Appeal does not go entirely in favor of the authorities. The data contained on the electronic devices seized in the raid was previously cloned by the police and sent to the United States, an act that was found to be unlawful in earlier proceedings. This morning the Court of Appeal upheld that conclusion.

“In our view the words of the Solicitor-General’s direction in the present case plainly did not authorize removal of the clones to the United States,” the ruling adds.



Kim Dotcom’s US-based lawyer Ira Rothken announced on Twitter that his team his currently analyzing today’s ruling by the Court of Appeal.

“Our @KimDotcom legal team is reviewing the rulings made by the Court of Appeal and will likely seek leave to appeal to the Supreme Court,” Rothken said



Ahead of an extradition hearing currently scheduled for April, Dotcom took a swipe at US authorities and suggested that the fight would continue.

“I’m not sorry that fighting back, getting up and being successful are encoded in my DNA. I’m happy I can support my family & challenge evil,” he said.

Supreme Court Denies Kim Dotcom Access to U.S. Evidence

Since Megaupload was shut down two years ago, Kim Dotcom and several of his colleagues have been wanted by the United States, each standing accused of copyright infringement related crimes.

Despite the severity of the charges, Megaupload’s legal team does not have insight into all of the relevant documents the U.S. Government relied upon to arrive at its conclusions.
Through the New Zealand courts Dotcom and his fellow defendants have requested access to this withheld information. To mount a proper defense they want to see the extent to which the U.S. authorities can back up their criminal charges.
Initially the District Court granted the request for full access to the U.S. evidence. However, March last year these rulings were overturned by the Court of Appeal, which concluded that the United States could move forward with a summary case.

After the defeat Dotcom and his legal team quickly filed an appeal at the Supreme Court, which yesterday ruled against the entrepreneur and his associates. According to the Court’s ruling, the District Court was wrong to order full disclosure of all U.S. evidence.

The Supreme Court states that the New Zealand Extradition Act doesn’t require a foreign country to share all evidence with the accused, and the District Court had no statutory power to rule otherwise.

After hearing the verdict Dotcom responded on Twitter with a sad face; “Being defeated is often a temporary condition. Giving up is what makes it permanent,” he quoted a few minutes later.

Earlier this week Dotcom enjoyed success in another legal matter by obtaining a gag order against his former bodyguard Wayne Tempero. After resigning a few months ago, Tempero was supposedly planning to make “secret revelations” about Dotcom’s private life.
Under the injunction obtained by Dotcom, Tempero is “restrained from using or disclosing to any person, firm, corporation or entity, any confidential or trade information acquired whilst working for Kim Dotcom.”
The former bodyguard is reportedly going to appeal to the gag order in the hope of regaining his free speech rights. There is also talk of a possible lawsuit against his former boss.

For now, however, Dotcom’s legal team will shift its focus to the upcoming extradition hearing. After yet another delay, the hearing is currently scheduled to take place in July this year.

High Court: Kim Dotcom Can Have His Cars, Millions in Cash Returned

When Kim Dotcom’s New Zealand mansion was raided in 2012, some of the most memorable images were of his luxury car collection being loaded onto trailers and taken away. The authorities hoped the pictures would help to symbolize Dotcom’s fall from ‘power’ but two years later he might be burning rubber in them once again.
Just two days before the raid on Dotcom’s home, foreign restraining orders were granted to enable the seizure of the entrepreneur’s assets. As they are set to run out on Friday, the Crown applied to the High Court yesterday to have them extended.
Unfortunately for United States and local authorities, the application was turned down, which means that Dotcom’s assets including his car collection, substantial quantities of cash, artwork and other equipment, could soon be returned.
Shortly after the news broke, Dotcom took to his beloved Twitter to celebrate.




Dotcom added that when his cars are returned he will be treating member of his newly formed Internet Party to a day out racing.

“I will rent the Taupo race track for a track day with #InternetParty members when my cars are returned!” he tweeted.

While Dotcom is understandably excited, the Crown has two weeks to file an appeal.

That is almost certainly bound to happen....

i dunno. i don't have a paypal account actually. my brother does though and the last time i asked him to use it was when i used to obtain a membership for RS. and that's been at least 3 or 4 years. maybe come up with some kind of contest or something,

Megaupload Sues Hong Kong Over Unlawful Shutdown

Well over two years have passed since Megaupload was taken offline, and the U.S. Government still hasn’t found a way to serve the Hong Kong based company.

During all this time the Hong Kong authorities have kept Megaupload’s assets locked up, as part of a restraint order the U.S. Government had demanded.

In a move to unfreeze these assets, Megaupload has now filed an application in a Hong Kong court. Through this application Megaupload wants the local Department of Justice to set aside the restraint order.

According to Megaupload, the company should no longer be held hostage based on an order that was issued after a seemingly unlawful request by U.S. authorities. The restraint order has basically shut down the company by freezing all its bank accounts and other assets.

Among other things, Megaupload says it wants to use the assets to reunite former users with the personal files they lost access to after the raid.

“Over two years later, the US DOJ has yet to serve Megaupload or initiate substantive criminal proceedings against it, trapping Megaupload in a state of criminal limbo,” Megaupload’s global litigation counsel Ira Rothken says in a comment.

“During that time, the restraint order has prevented Megaupload from conducting business or paying bandwidth expenses needed to return cloud storage data to users. Needless to say, Megaupload and its cloud storage users have been severely prejudiced by the US Department of Justice’s conduct,” he adds.

Megaupload believes that the restraint order was issued unlawfully, in part because the U.S. Government failed to disclose how the Hong Kong company would be served.

“As further argued in Megaupload’s application, the US DOJ’s inability to prosecute Megaupload over this long period of time is grounds to discharge the injunction independent from the US Department of Justice’s nondisclosure,” Rothken says.

To back up its request, Megaupload has submitted affidavits from two criminal law experts. Richard Davis, who is a former Assistant U.S. Attorney and member of the Watergate Prosecution Force, and Stanford Law School professor Robert Weisberg.

Earlier today, the High Court of Hong Kong ordered the local Department of Justice to respond to Megaupload’s allegation. This response has to be filed early June, after which the court will decide on the issue.

If Megaupload wins its case the door will be open for a multi-billion dollar civil claim. Megaupload was previously valued at two billion dollars and before the raid was planning a listing on the U.S. stock market.

Big Grin Dotcom Thanks RIAA /MPAA for Mega’s Massive Growth

Acting on a lead from the entertainment industry, the U.S. Government shut down Megaupload early 2012.

Exactly a year later Kim Dotcom made a comeback with a new file-storage venture. Together with several old colleagues and new investors, Mega was launched. The new service, which has a heavy focus on privacy and security, has expanded ever since.

Earlier Dotcom posted an image showing how user uploads have increased more than 300% over the past six months. The graph doesn’t specify the scale, but the New Zealand-based entrepreneur told us that the service now processes over half a billion uploads per month.

That’s more than 10,000 files per minute….

“We are experiencing massive growth. We can’t add new servers and bandwidth fast enough,” Dotcom tells us.

According to Mega’s founder there are several factors that have contributed to the increasing
interest in the service.




Ironically, Dotcom believes that the same people who destroyed Megaupload are now partly responsible for the success of Mega.
“There are several growth factors. People spend more time at the computer due to the cold weather, the lawsuits by MPAA and RIAA which advertised Mega, and the ongoing advertising from the dumbest ever U.S. Department of Justice case,” Dotcom says.
“Some users get pleasure from the fact that the US government and Hollywood hate Mega’s success and that I continue to expose them. The more people use Mega the more powerful our defense becomes. So, why wouldn’t Mega grow like crazy?” he adds.
The continuing debate about the NSA’s mass-surveillance is also likely to have helped Mega. Unlike other popular cloud hosting services, Mega encrypts all stored files so they can’t be snooped on. Similarly, the fact that former U.S. Secretary of State Condoleezza Rice joined Dropbox may have also had an impact according to Dotcom.

During the months to come Mega will work on their recently announced backdoor stock market listing, which the company hopes to complete next year. In addition, the cloud hosting service will roll out many new features, all focused on counter surveillance.

“The people of the Internet love us. And we haven’t even launched our encrypted communication suite yet. That’s like a point-to-point encrypted Skype on steroids, running in your browser,” Dotcom tells us, teasing Mega’s upcoming tools.

With the ongoing legal battle against the U.S. Government and civil cases against the MPAA and RIAA, Mega is guaranteed a regular place in the spotlight. In any case, we certainly haven’t heard the last of Dotcom and his team yet.

Hacker Movie Studios Seek to Freeze Kim Dotcom’s Assets

In early April, Twentieth Century Fox, Disney, Paramount Pictures, Universal, Columbia Pictures and Warner Bros. teamed up to file a new lawsuit in a Virginia District Court.

Their targets were old adversaries Megaupload, Kim Dotcom and associates Mathias Ortmann and Bram Van Der Kolk. Running in parallel with the ongoing criminal proceedings initiated by the U.S. Government, the complaint followed much of the same path.

Earlier this month, Megaupload’s legal team responded by asking the court to freeze the MPAA’s case in order to protect their clients’ Fifth Amendment rights not to implicate themselves in advance of the U.S. government’s criminal case against them.

In the period since both sides’ legal teams have been in discussion over the potential terms of any stay. But, according to papers filed in a Virginia court yesterday, 20th Century Fox are concerned that Dotcom’s fortune could soon be back in the entrepreneur’s hands.

Megaupload’s and Dotcom’s millions were seized following the now-notorious 2012 raid. However, last month the New Zealand High Court said it would not extend the foreign restraining order against his assets.

That decision was quickly appealed by the Crown, but the possibility remains that Dotcom could soon regain his wealth and legally dispose of it. The studios want to stop that from happening.

“If the New Zealand Government loses the appeal, the assets will be unfrozen, and there is a significant risk that they will then be immediately dissipated,” the studios’ lawyers state in yesterday’s filing.

Led by Warner Bros., the studios add that since Dotcom and his associates “have or have had sophisticated global business interests” and with that an ability to “move assets offshore quickly and immediately”, they are taking legal action to try and prevent that.

“To ensure that Defendants’ New Zealand assets remain frozen even if the New Zealand Government loses the pending appeal, several of the Plaintiffs have initiated civil proceedings in New Zealand to freeze Defendants’ assets pending a judgment in the [studios' civil case against Megaupload/Dotcom].”





But the fight to secure Dotcom’s and Megaupload’s cash isn’t confined only to New Zealand. Hong Kong is another battleground and the studios are determined to narrow the options for release of assets there too.

“In addition to opposing extension of the asset freeze in New Zealand, Defendants are also seeking to unfreeze their assets in Hong Kong, which have also been frozen pursuant to this Court’s restraining orders issued in the Criminal Action,” the studio’s lawyers write.

“If Defendants are successful in their efforts to unfreeze their assets in Hong Kong,
there is a significant risk that those assets will be dissipated in very short order. Plaintiffs are monitoring developments in Hong Kong and assessing whether they may need to take legal action there to further preserve Defendants’ assets.”

In conclusion the studios state that while they do not oppose Megaupload’s request for a stay, the terms must not preclude them taking action to freeze the worldwide assets of Megaupload and Kim Dotcom.

But of course, just days after the studios filed their lawsuit in April, the RIAA jumped on board too by filing a a substantially similar suit against the same defendants, again demanding millions in damages.

Yesterday the labels also made their voices heard in the United States District Court for the Eastern District of Virginia in respect of Megaupload’s motion for a similar stay in their case. Although penned by different law firms, the labels’ filings are much the same as those from the studios.

In a slightly different conclusion, the labels oppose a stay order, but note that if one is granted it should not disallow them from seeking to “preserve the Defendants’ worldwide assets.”

Further hearings on the fate of the currently seized millions are scheduled for July 10 in Hong Kong and in the New Zealand High Court tomorrow.

ok the guy may be a douch bag but i admit i got a kick out of this one. cause in a way he's right. if they hadn't worked so hard against it and been closed down, etc.. no need to add anymore than i doubt the new site would be growing so damn fast.

so i can see why he'd thank them. it's ballsy as well to say that too. kinda like giving them the finger in a way just without actually doing it.

Green Arrow Kim Dotcom Extradition Hearing Delayed >2015

The United States Government is keen to get its hands on Kim Dotcom. He stands accused of committing the biggest copyright-related crime ever seen through his now-defunct cloud storage site Megaupload.
But their access to the entrepreneur will have to wait.

According to Dotcom, his extradition hearing has now been delayed until February 16, 2015.
Delays and postponements have become recurring features of the criminal case being built against Dotcom in the United States.

As March 2013 date came and went without a promised hearing, as did another in November the same year, a delay which Dotcom said would “save Prime Minister John Key embarrassment during an election campaign.”

Another hearing date for April 2014 also failed to materialize and now the date penciled in for the coming weeks has also been struck down.

Dotcom also reports that he still hasn’t received a copy of the data that was unlawfully sent to the FBI by New Zealand authorities.

Pirate Dotcom Loses Bid to Keep Assets Secret from Hollywood

20th Century Fox, Disney, Paramount, Universal, Columbia Pictures and Warner Bros are engaged in a huge battle with Kim Dotcom.


They believe that legal action currently underway against the Megaupload founder could lead to them receiving a sizable damages award should they win their case. But Dotcom’s lavish lifestyle gives them concerns. The more he spends, the less they could receive should the money begin to run out.

Those concerns were addressed by the High Court’s Judge Courtney, who previously ordered Dotcom to disclose the details of his worldwide assets to his Hollywood adversaries. Dotcom filed an appeal which will be heard in October, but that date is beyond the ordered disclosure date.
As a result, Dotcom took his case to the Court of Appeal in the hope of staying the disclosure order.

That bid has now failed.

Dotcom’s legal team argued out that their client’s October appeal would be rendered pointless if he was required to hand over financial information in advance. They also insisted a stay would not negatively affect the studios since millions in assets are currently restrained in New Zealand and elsewhere.

However, as explained by the Court of Appeal, any decision to stay a judgment is a balancing act between the rights of the successful party (Hollywood) to enforce its judgment and the consequences for both parties should the stay be granted or denied.

While the Court agreed that Dotcom’s appeal would be rendered pointless if disclosure to Hollywood was ordered, it rejected that would have an effect on Dotcom.

“The mere fact that appeal rights are rendered nugatory is not necessarily determinative and in the circumstances of this case I consider that this consequence carries little weight. This is because Mr Dotcom himself does not assert that there will be any adverse effect on him if deprived of an effective appeal,” the decision reads.
The Court also rejected the argument put forward by Dotcom’s lawyer that the disclosure of financial matters would be a threat to privacy and amounted to an “unreasonable search”.

The Court did, however, acknowledge that Dotcom’s appeal would deal with genuine issues. That said, the concern over him disposing of assets outweighed them in this instance.

In respect of the effect of a stay on the studios, the Court looked at potential damages in the studios’ legal action against the Megaupload founder. Dotcom’s expert predicted damages “well below” US$10m, while the studios’ expert predicted in excess of US$100m.

The Court noted that Dotcom has now revealed that his personal assets restrained in both New Zealand and Hong Kong are together worth “not less” than NZ$ 33.93 million (US$ 28.39m). However, all of Dotcom’s assets are subject to a potential claim from his estranged wife, Mona, so the Court judged Dotcom’s share to be around NZ$17m.

As a result the Court accepted that there was an arguable case that eventual damages would be more than the value of assets currently restrained in New Zealand.
As a result, Dotcom is ordered to hand the details of his financial assets, “wherever they are located”, to the lawyers acting for the studios. There are restrictions on access to that information, however.

“The respondents’ solicitors are not to disclose the contents of the affidavit to any person without the leave of the Court,” the decision reads.

As legal proceedings in New Zealand continue, eyes now turn to Hong Kong. In addition to Dotcom’s personal wealth subjected to restraining order as detailed above, an additional NZ$25m owned by Megaupload and Vestor Limited is frozen in Hong Kong. Next week Dotcom’s legal team will attempt to have the restraining order lifted.

Hacker Police Ordered to Return Clones of Dotcom’s Seized Data

January 2012, New Zealand Police carried out the largest ever action against individuals accused of copyright infringement.
The raid on Dotcom’s Coatesville mansion was requested by United States authorities who are now trying to extradite the Megaupload founder and several of his colleagues.

Despite protests from Dotcom about the legitimacy of the search warrants, the raid was found to be legal earlier this year. However, that doesn’t mean that all seized property can be kept from the New Zealand-based entrepreneur.

Today the New Zealand Court of Appeal ruled that clones of the seized electronic devices should be returned to Dotcom and his co-defendants “as soon as reasonably practicable.”

Last month the prosecution explained that the data hadn’t yet been handed over because some of it was encrypted, making it impossible for police to verify and investigate its contents.

In its ruling today, the Court of Appeal respects this hesitation but noted that all non-encrypted data should be returned. The rest can follow after the defendants give up their encryption passwords to two nominated police officers.

Previously the Court of Appeal ruled that police crossed a line when they shared cloned data with the United States. In a reference, today’s order prohibits the two police officers from revealing the encryption passwords with others.

“[...] in particular to any representative of the government of the United States of America,” the verdict reads.

Pirate Kim Dotcom Must Reveal Everything He Owns to Hollywood

Kim Dotcom has been associated with many things over the years, but one enduring theme has been wealth – and lots of it.

Even in the wake of the now-infamous raid on his New Zealand mansion and the seizure of millions in assets, somehow Dotcom has managed to rake in millions. Or did he also have some stashed away?


It’s an important matter for Hollywood. The businessman’s continued lavish lifestyle diminishes the financial pot from where any payout will be made should they prevail in their copyright infringement battles against the Megaupload founder.

The studio’s concerns were previously addressed by Judge Courtney, who had already ordered Dotcom to disclose to the Court the details of his worldwide assets. The entrepreneur filed an appeal but that hearing would take place in October, a date beyond the already-ordered disclosure date.
Dotcom took his case to the Court of Appeal in the hope of staying the disclosure order, but in August that FAILED.

Dotcom complied with the ruling and subsequently produced an affidavit. However, he asked the Court of Appeal to overturn the decision of the High Court in order to keep the document a secret from the studios. That bid has now
FAILED too.

Following a ruling handed down yesterday by the New Zealand Court of Appeal, Dotcom’s financial information will soon be in the hands of adversaries Twentieth Century Fox, Disney, Paramount, Universal and Warner Bros.


Court of Appeal Judges John Wild, Rhys Harrison and Christin French ordered the affidavit to be released to the studios on the basis that the information could only be used in legal proceedings concerning the restraining of Dotcom’s assets. And with a confidentiality clause attached to the affidavit, the public will not gain access to the information.

Another setback for Dotcom came in respect of who pays the bill for proceedings. The Megaupload founder’s attempt at avoiding costs was turned down after the judges found that having already supplied the affidavit as required, Dotcom’s appeal was not likely to succeed.

And there was more bad news for Dotcom in a separate High Court ruling handed down in New Zealand today. It concerns the extradition cases against not only him but also former Megaupload associates Finn Batato, Mathias Ortmann and Bram Van Der Kolk.



The theory put forward by Dotcom is that the United States and New Zealand governments had politically engineered his downfall in order to extradite him to the U.S. To gather evidence showing how that happened, Dotcom and the other respondents made a pair of applications to the extradition court (the District Court) requesting that it make discovery orders against various New Zealand government agencies, ministers and departments.
The District Court declined so the respondents sought a judicial review of that decision claiming that the Court acted unfairly and erred in law. In today’s ruling, Justice Simon France said there was no “air of reality” that political interference had been involved in Dotcom’s extradition case.

“It is, as the District Court held, all supposition and the drawing of links without a basis,” the Judge wrote.

“Nothing suggests involvement of the United States of America, and nothing suggests the New Zealand Government had turned its mind to extradition issues. These are the key matters and there is no support for either contention.”

Judge France said that as respondents in the case, the United States were entitled to costs.

Dotcom Loses Lawyers – Then They Erase All History of Him

All major Internet entrepreneurs with complex lives need legal advice. That is especially true for Kim Dotcom, who needs clerks just to keep up with the mountains of paperwork generated by his myriad legal issues.

Currently the Megaupload founder is dealing with legal action in three major jurisdictions – the United States, Hong Kong and New Zealand. In the former matters are handled by lawyer Ira Rothken, a veteran of copyright cases who also runs Dotcom’s worldwide legal operations. In the latter, however, Dotcom now has new issues to overcome.

The first signs of developments in New Zealand came on November 6 when Rothken tweeted, “We are looking for awesome lawyers in NZ and US to assist our global legal team in the @KimDotcom related cases.” Rothken also linked interested parties to a new site titled MegaScholar.

Now, almost a week later, it’s been revealed that high-profile Queen’s Counsel Paul Davison, QC, and Simpson Grierson, one of New Zealand’s biggest lawfirms, are stepping down from Dotcom’s legal team.

“Paul Davison & Simpson Grierson of NZ are stepping down from @KimDotcom legal team. They did world-class legal work & were great colleagues,” Rothken tweeted.

Davison has been representing Dotcom in his U.S. extradition case and various Simpson Grierson partners including William Akel and Tracey Walker have represented the entrepreneur in civil actions brought by the Hollywood studios.

While Rothken has made it clear that he was pleased with the work of the outgoing legal team, there is a rather unusual element to the story. When we searched the Simpson Grierson website for the history of the Dotcom case, it appears that the company has erased it, an unusual move for such a high-profile action.

And it doesn’t stop there. Senior litigation partner William Akel has removed all reference to Dotcom from his case history.

The image below shows his profile, before and after, with Dotcom’s case now erased.

1stly i've always thought the US wanted to bring his fat ass here. 2ndly i'm really surprised his lawyers didn't step down earlier! i hope he finds some good ones cause like i said we need a win for piracy THIS BIG for a change instead of all of us losing so many things in the past couple years.

U.S. Brands Kim Dotcom a Fugitive, ‘Spies’ on Others

It’s been nearly three years since Megaupload was taken down by the U.S. authorities but it’s still uncertain whether Kim Dotcom and his fellow defendants will be extradited overseas.


Two months ago the U.S. Government launched a separate civil action in which it asked the court to forfeit the bank accounts, cars and other seized possessions of the Megaupload defendants, claiming they were obtained through copyright and money laundering crimes.

Megaupload responded to these allegations at the federal court in Virginia with a motion to dismiss the complaint. According to Megaupload’s lawyers the U.S. Department of Justice (DoJ) is making up crimes that don’t exist.

In addition, Dotcom and his co-defendants claimed ownership of the assets U.S. authorities are trying to get their hands on. A few days ago the DoJ responded to these claims, arguing that they should be struck from the record as Dotcom and his colleagues are fugitives.

In a motion (pdf) submitted to a Virginia District Court the U.S. asks for the claims of the defendants to be disregarded based on the doctrine of fugitive disentitlement.

“Claimants Bram van der Kolk, Finn Batato, Julius Bencko, Kim Dotcom, Mathias Ortmann, and Sven Echternach, are deliberately avoiding prosecution by declining to enter the United States where the criminal case is pending,” U.S. Attorney Dana Boente writes.


“The key issue in determining whether a person is a fugitive from justice is that person’s intent. A defendant who flees with intent to avoid arrest is a fugitive from justice,” he adds.


Since Kim Dotcom and his New Zealand-based Megaupload colleagues are actively fighting their extradition they should be seen as fugitives, the DoJ concludes.

“Those claimants who are fighting extradition on the criminal charges in the related criminal case, claimants van der Kolk, Batato, Kim Dotcom, and Ortmann, are fugitives within the meaning of the statute, regardless of the reason for their opposition.”

Megaupload lawyer Ira Rothken disagrees with this line of reasoning. He told TF that the fugitive disentitlement doctrine shouldn’t apply here.

“The DOJ is trying to win the Megaupload case on procedure rather than the merits. Most people don’t realize that Kim Dotcom has never been to the United States,” Rothken says.

A person who has never been to the United States and is currently going through a lawful procedure in New Zealand shouldn’t be seen as a fugitive, according to Rothken.

The recent DoJ filing also highlights another aspect of the case. According to a declaration by special FBI agent Rodney Hays, the feds have obtained “online conversations” of Julius Bencko and Sven Echternach, the two defendants who currently reside in Europe.

These conversations were obtained by law enforcement officers and show that the authorities were ‘spying’ on some of the defendants months after Megaupload was raided.

“During a conversation that occurred on or about March 28, 2012, Bencko allegedly told a third-party, ‘I can come to Bratislava [Slovakia] if needed .. bu [sic] you know .. rather not travel around much .. ‘ Later in the conversation, Bencko states ‘i’m facing 55 years in usa’,” the declaration reads.

In addition to the two defendants, law enforcement also obtained a conversation of Kim’s wife Mona Dotcom, who is not a party in the case herself.

“During a conversation that occurred on or about February 9, 2012 a third-party told Mona Dotcom, ‘Also Julius [Bencko] wants Kim [Dotcom] to know that he will be supportive in what ever way possible that he needs’,”

According to the U.S. the ‘tapped’ conversations of Bencko and Echternach show that since they are avoiding travel to the United States, they too can be labeled fugitives.

It’s unclear how the online conversations were obtained, but Megaupload lawyer Ira Rothken told TF that he wouldn’t be surprised if civil liberties were violated in the process, as has happened before in the case.
Whether these fugitive arguments will be accepted by the court has yet to be seen. Highlighting the motion Megaupload submitted earlier, Rothken notes that regardless of these arguments the case should be dismissed because the court lacks jurisdiction.

“The United States doesn’t have a stature for criminal copyright infringement,” Rothken tells us. “We believe that the case should be dismissed based on a lack of subject matter jurisdiction.”
