Update PBay Founder Remains in Jail in Sweden-NO charges

Pirate Bay founder Gottfrid Svartholm was arrested by Cambodian police on Thursday in Phnom Penh, the city that he made his home several years ago.


According to local sources he was arrested in an apartment above the Cadillac Bar on the riverfront, a place where he is known to have stayed in the past.

Neither Cambodian nor Swedish authorities have commented on the grounds of the arrest.

The 27-year-old became wanted internationally after he failed to return to Sweden to serve his 12 month jail sentence earlier this year.

Gottfrid’s lawyer Ola Salomonsson thinks the arrest could be related to The Pirate Bay case, but this hasn’t been announced officially.

“As far as I understand it is because he is on an international wanted list,” he said.

While there is no extradition treaty between Cambodia and Sweden the lawyer believes his client could be transferred to his home country eventually.

Gottfrid has been battling poor health ever since The Pirate Bay appeal in 2010. He failed to attend that hearing due to an illness which left him too sick to leave hospital in Cambodia.

Then, despite having supported his original absence with a medical certificate, Gottfrid failed to appear at a subsequent hearing. This prompted the Court of Appeal to finalize the initial verdict of one year jail time and a fine of $1.1 million.

All this time the Pirate Bay founder was nowhere to be found. Neither his lawyer nor his old Pirate Bay friends had heard from him. Sources in Cambodia, however, said last year that Gottfrid was still in bad shape.

Gottfrid should have returned to Sweden to begin serving his sentence January 2nd this year, but again he failed to appear.

Pirate Bay Founder Will Be Deported, Cambodian Authorities Confirm

Last week, police arrested Pirate Bay co-founder Gottfrid Svartholm in the Cambodian capital Phnom Penh.


Svartholm was arrested in his $750 per month rented apartment above the Cadillac Bar on the riverfront. Some early reports suggested that perhaps he had been arrested for something unrelated to his activities with The Pirate Bay, but by Sunday that notion had all but disappeared.


“His arrest was made at the request of the Swedish government for a crime related to information technology,” a police spokesman confirmed.


With no standing extradition treaty between Cambodia and Sweden, some observers questioned how easy it would be to get Svartholm sent back to Sweden to face his jail sentence. But as explained in our previous report, such matters aren’t an issue in Cambodia. There are few Kim Dotcom-style extradition battles there – when authorities want you out, that’s what happens.


Today we have confirmation that Svartholm will indeed be leaving Cambodia, sooner rather than later.
According to a report from the local Phnom Penh Post, this morning a meeting took place between National Deputy Police Commissioner General Sok Phal and Swedish authorities. Due to the lack of an extradition treaty, Sweden made a request for Svartholm to be deported. Cambodian authorities appear to have agreed.


“We will use the Immigration Law against him to deport him out of our country and Minister of Interior Sar Kheng will sign on the deportation request letter from the police commissioner soon,” said Phal.


In what TorrentFreak is informed is typical of the way issues like this are handled in Cambodia, General Sok Phal said although Svartholm would be deported, he didn’t know where the Swede would end up.


“We will have to just deport him, wherever he goes, we don’t know, but he has to be out of Cambodia,” he said.


Unless special arrangements are made it’s likely that Svartholm will end up at Cambodia’s deportation jail, 7 km west of Phnom Penh opposite Pochentong Airport. He is currently being held at an unknown location by the Ministry of Interior’s immigration department.

Pirate Bay Founder Arrest Related To Tax Hack, Not Piracy

The arrest of Pirate Bay co-founder Gottfrid Svartholm last week resulted in much speculation about the motives and forces driving the action. In most scenarios it was assumed that Svartholm was arrested for his role in The Pirate Bay, but this turns out to be untrue. Sources confirmed to TorrentFreak that Svartholm is being held at the interior ministry’s counter terrorism department in connection with the alleged hacking of a Swedish IT company and the subsequent leak of thousands of tax numbers.

Initially little was known about the reasons for the arrest, but after a few days the authorities confirmed that Sweden was the driving force behind the actions. According to a spokesperson for the Cambodian police, Svartholm’s detainment is connected to alleged cyber-crimes.

“His arrest was made at the request of the Swedish government for a crime related to information technology,” he said.

Following this statement it was assumed that “information technology” referred to Svartholm’s involvement with The Pirate Bay. However, several sources now dispute this and say that Svartholm’s arrest is related to a hacking operation that may date back to 2010.

The hack targeted Swedish IT company Logica, which supplies services to the Swedish tax office. Earlier this year the hack made the headlines when the tax numbers of 9,000 Swedes leaked online.

In the months that followed two Swedish citizens in their thirties were arrested in connection with the hack. One of the suspects in question was a member of Piratbyran, the group that founded The Pirate Bay back in 2003 and was disbanded two years ago.

Svartholm would be the third suspect in the hacking case, which was previously described by the International Public Prosecution Office as “a big and sensitive investigation.”

A source told TorrentFreak that Svartholm is not awaiting his deportation in prison but is being held at the interior ministry’s counter terrorism department. This is confirmed by former Pirate Bay spokesman Peter Sunde and the sources of Swedish news site DN.se.

On Twitter, Peter Sunde adds that Svartholm (aka Anakata) has not been offered a lawyer, and that the Swedish foreign ministry is not helping the Pirate Bay founder either.

“Swedish foreign ministry has not offered anakata legal help. They must do that in Sweden, but ignore it when they are behind the warrant,” Sunde says.

Svartholm is being held in an office space accompanied by personnel from the interior ministry and is currently awaiting the authorities’ next steps. On Monday, Cambodian officials confirmed that the Pirate Bay founder will eventually be deported.


I look at this today as a maybe or maybe not deal. I am sure that the real story will come out in time.

One must conclude that the showing up of Ron Kirk, on the day of the arrest and the excessively large grant of money as heavy influences on the actions and that one item tends to say it isn't as portrayed in this article.

Pirate Bay Founder Flies Home Next Week As Mother Criticizes Swedish Authorities

Last week police arrested Pirate Bay co-founder Gottfrid Svartholm in the Cambodian capital Phnom Penh.

Now, according to comments made by Bertil Olofsson, Head of the International Section of the National Police, Gottfrid will soon be taken back to Sweden, the place he once called home.

Next week the Pirate Bay co-founder will be flown back to Sweden escorted by a police officer and an official from the prison service. Since there are no direct flights between Cambodia and Sweden he will first make a stopover in Bangkok, Thailand.

One person that will be keen to see Gottfrid home is his mother. Kristina Svartholm has speaking with DN.SE about events since Gottfrid was detained August 30. She says she has had a tough time obtaining information about her son’s health, whereabouts and his ultimate fate.

“I have not got to talk to my son and the embassy, through the contact I had, have withheld information from me,” Kristina explained.

Even finding out where Gottfrid is being held wasn’t straight forward. When Kristina spoke with the Interior Ministry she was told that Gottfrid was being detained at the Swedish embassy, but the embassy said that he was being held by the Interior Ministry.

“I need to know where he is and if he is alive,” Kristina said.

Now the position appears to be a little more clear. According to contact Kristina had with the Swedish embassy through a lawyer, Gottfrid is now being held at or close to the airport waiting to be deported.

As reported earlier this week, Svartholm’s lawyer Ola Salomonsson said he had not spoken with Gottfrid since he had not received the required request from his client. This lack of representation for Gottfrid is also a concern for his mother.

“When I asked the embassy why he has not been talking to a lawyer I was told that he must ask to do this,” Kristina explained. “But when I asked if he knows about this [requirement], I got no response at all. I do not even know if he has access to a phone so that he can contact the embassy.”

But even now, more than a week later, it is still not completely clear why Gottfrid is being detained. Pirate Bay co-founder Peter Sunde believes that the arrest was for something other than Gottfrid’s role in The Pirate Bay, a suspicion shared by Kristina Svartholm.

“[Gottfrid] has not committed a crime in Cambodia, he is not suspected of anything there. But he’s absent from his prison sentence in Sweden and therefore he can be recalled here. Gottfrid is apparently suspected of other things here in Sweden, and that is why they ask for his extradition,” she said.

As reported on Thursday, multiple sources in Sweden have linked Gottfrid’s arrest to a hack previously carried out against Logica, a Swedish IT company that handles data for the tax office. The hack made the headlines when the tax numbers of 9,000 Swedes later leaked online.

When approached yesterday, prosecutor Henry Olin who works on the case refused to be drawn on Gottfrid’s link to the Logica hack.

“I have no comment on it at all at present. I can can neither confirm or deny anything in this regard,” said Olin.

Kristina Svartholm says that whatever the case her son is just a suspect. He has rights and must be treated like a human being. That Cambodia has denied him his rights people might expect, but the fact that Sweden has done the same she describes as “outrageous”.

Pirate Bay Founder Remains Locked Up Without Charges

Following his arrest late last month, Pirate Bay co-founder Gottfrid Svartholm was deported from Cambodia to Sweden.

Initially it was assumed that Gottfrid was sent to Sweden because of the outstanding one year prison sentence in the Pirate Bay case. However, once he touched down at Stockholm’s Arlanda Airport, the authorities said he was suspected of being involved in the hacking of Logica, a Swedish IT company that works with the local tax authorities.

Since he hasn’t been charged officially in the Logica case the Pirate Bay co-founder could only be detained for a few days.

But, after a request from Prosecutor Henry Olin this term was extended for another two weeks mid-September, and last Friday the District Court decided that Gottfrid could be detained for another two weeks.

According to the Prosecutor the investigation into Gottfrid’s involvement in the Logica hack is still ongoing.

“He is suspected of this breach of data security. The court ruled that there is a risk he could affect the evidence in the investigation, and that there is a risk he could be committing crimes again,” Olin said.

To prevent Gottfrid from interfering with the investigation the Prosecutor believes it’s justified to detain him for more than a month without being charged. The Pirate Bay co-founder is not allowed to have visitors and is being refused access to newspapers and television.

“According to the Swedish system, when the preliminary investigation is finished, I as prosecutor will decide whether to prosecute him. [...] In the Swedish system it is quite usual for people to be detained on this legal ground, and it gives me the possibility to prevent him from having contact with other people,” Olin said.

The Prosecutor hasn’t ruled out a request for another extension of Gottfrid’s detainment in two weeks, if the investigation is still ongoing.

Two other Swedish citizens, both in their thirties, were previously detained under suspicion of also being involved the hack. One of the suspects was a member of Piratbyran, the group that founded The Pirate Bay back in 2003.

Both of these earlier suspects have since been released. Gottfrid, meanwhile, denies any involvement with the Logica hack
