US Extradition Now Official -Mega Founder Kim Schmitz

Megaupload/Video Taken Down On Piracy Allegations

Popular file-hosting site Megaupload, probably known to our readers for a variety of reasons, has been taken down after the FBI charged some of its staff with copyright infringement and “conspiracy to commit racketeering.” Seven people have been charged, and four arrested (in New Zealand), and the site itself appears to be down as authorities around the world closed in on the site’s resources.

Bizarrely, it was also just revealed that the CEO of the company is none other than Swizz Beats, the husband of Alicia Keys. Clearly the rabbit hole goes much deeper than the FBI expected.

Mr. Beats is just the acting CEO, and probably was brought on by founder Kim Dotcom as part of the site’s efforts to legitimize itself in the eyes of the law. Part of this effort was the publication of the so-called “Mega Song,” in which a number of musicians espouse the service as a useful and fast way of transferring files.

In December, Will.I.Am, Sean “Diddy” Combs, and the others pulled their support, and it was claimed that they never consented to appearing in the video, which was subsequently removed from YouTube.

Naturally, it was quickly replaced by users who had downloaded it there doesn’t appear to be any movement by the company on today’s news. The Department of Justice has issued a press release, ( See Next Post), describing the action taken and the employees who were indicted; the release also alleges that Megaupload failed to comply with DMCA provisions.

The FBI stressed that the takedown had nothing to do with the ongoing SOPA/PIPA, (See Below), controversy; I ndeed, a direct takedown of the site with international cooperation is much more in line with existing methods for dealing with “rogue” websites.

It seems as if the whole story will have to come out in court, as Megaupload likely doesn’t have the resources to continue operating while its staff is on the lam. It should make for interesting reading once the dust settles.

Pathetic!! they can never win, how the heck can the FBI hope to prosecute all the many millions of warez & similar sites around the world. Are they going to send some rockets into space and blow up the internet.

Why dont they do something more useful, like stop all the Human Trafficking and the huge group of international pedos' rings around the world, that kidnap children and force them into sex, sell them to bidders and also sell the videos of the children being forced to have perverse sex with well paying "clients" ??? Eh??

The new SOPA (STOP ONLINE PIRACY ACT) has been passed by the US congress. So now the blyddy US Government and its' opos, is not only trying to control the world, but the internet too






and I, like many other millions of people around the world, am not only "displeased", but damn furious too. Imagine, what this new act that has been passed, will damage the US and make many in the world hate them even more.

It is the good American people that will suffer, no matter where they go in the world

House and Senate leaders abandoned plans to move on SOPA and PIPA on Friday — the surest sign yet that a wave of online protests have killed the controversial anti-piracy legislation for now and maybe forever.
SOPA sponsor Lamar Smith, the Republican chairman of the House Judiciary Committee, said his committee won’t take up the bill as planned next month — and that he’d have to “wait until there is wider agreement on a solution” before moving forward.

Senate Majority Leader Harry Reid, meanwhile, said he was calling off a cloture vote on PIPA he’d scheduled for Tuesday.
Reid tried to put on a brave face, saying in a statement that he was optimistic that progress could be made in the coming weeks. But there's no mistaking what happened. Many of the Senate bill’s co-sponsors have since come out against it, leaving Reid a no-win choice: Go forward with the cloture vote he'd planned for Tuesday and lose, or send the bill off into back-burner purgatory.
PIPA sponsor Patrick Leahy got the message — and he wasn’t happy about it.
In a steaming response to Reid's announcement, the Vermont Democrat said Internet thieves in China and Russia "are smugly watching how the United States Senate decided it was not even worth debating how to stop the overseas criminals from draining our economy.”

And he didn’t stop there. Leahy said “the day will come when the senators who forced this move will look back and realize they made a knee-jerk reaction to a monumental problem.”
The double-barrel decisions to punt on the bill capped an extraordinary week of public pressure — and an extraordinary reversal of fortunes for Hollywood, whose lobbyists seemed to think they were on cruise control to passage of bills aimed at protecting their content from online thieves.
Over the weekend, the White House expressed concerns about the legislation. Over the next several days, co-sponsor after co-sponsor jumped ship. And Thursday night, the four remaining GOP presidential candidates all said they’d oppose the bills as currently drafted.
The sudden shift left Smith and Reid no choice but to punt. And the tech interests who fanned the flames of protests were quick to celebrate the decisions.

“Hallelujah!” tweeted Gary Shapiro, president and CEO of Consumer Electronics Association.
“Dems, Sen. Reid has just saved u from a lot of embarrassment/loss of support,” tweeted Gigi Sohn, co-founder of Public Knowledge, which had helped organize protests.

Reid insisted talks would continue between the warring sides — Hollywood and content providers are on one side and Silicon Valley and the tech community on the other.
"We made good progress through the discussions we've held in recent days, and I am optimistic that we can reach a compromise in the coming weeks," Reid said.
"There is no reason that the legitimate issues raised by many about this bill cannot be resolved,” Reid added. “Counterfeiting and piracy cost the American economy billions of dollars and thousands of jobs each year, with the movie industry alone supporting over 2.2 million jobs. We must take action to stop these illegal practices.”

And at least until Reid pulled the plug on the vote Friday, Leahy was said to be negotiating a compromise bill to strip out provisions that required search engines to block pirate sites and to lessen a clause allowing copyright holders to sue.
"I admire the work that Chairman Leahy has put into this bill,” Reid said. “I encourage him to continue engaging with all stakeholders to forge a balance between protecting Americans' intellectual property and maintaining openness and innovation on the Internet."
The decision to delay the vote strikes a fierce blow to Hollywood, which has been lobbying the Hill hard for months to pass anti-piracy legislation.
But it also signals the burgeoning strength of the tech industry, which said the legislation threatened the very openness of the Internet and would thwart innovation.
Like Leahy, Reid tried to reframe the debate in terms of American jobs and income.
“We live in a country where people rightfully expect to be fairly compensated for a day's work, whether that person is a miner in the high desert of Nevada, an independent band in New York City or a union worker on the back lots of a California movie studio,” Reid said in the statement.
But with members wary of another Internet backlash — and with attention turning to the presidential race — it’s hard to imagine a scenario in which the bills reach the floor of either chamber this year.
Smith, more than Reid, seemed to acknowledge the long road ahead.
"I have heard from the critics and I take seriously their concerns regarding proposed legislation to address the problem of online piracy,” he said. “It is clear that we need to revisit the approach on how best to address the problem of foreign thieves that steal and sell American inventions and products."

So it looks like none of them have been extradited yet........I only heard that bail was denied last time I checked.

And I think the main worry for the people involved in this case isn't the location of the servers.....it's the fact that extradition treaties are being used to bring people from elsewhere to the US to be tried in the US legal system.

It's bad enough the US is all over the place telling people how they should live, now they want to try anyone that annoys them (or in this case US corporations) under US law.

Speaking of other legal matters (though unrelated)........... US citizens, politicians and military personnel should not have to be held accountable under international law (or laws of other countries)....God forbid.

That country is becoming more pathetic in the eyes of the rest of the world (and probably its own citizens) every day.

Sad times.

If New Zealand decides to hand him over to the US then it could lead to more mayhem for filehosts........although the Megaupload scenario will probably stand out as being different to many other filehosts that could possibly be targeted simply because of the profits made by the Megavideo service.


I see many links being deleted by filehosts in a panic......and I know people that are deleting their own uploaded files (admittedly these individuals are in the US).

The DoJ said that on the 19th of January police executed more than 20 search warrants in the United States and eight countries, seized approximately $50 million in assets and targeted sites where Megaupload has servers in Ashburn, Va., Washington, D.C., the Netherlands and Canada. In addition, the U.S. District Court in Alexandria, Va., ordered the seizure of 18 domain names associated with the alleged Mega conspiracy.

Megaupload's Skype IM chats obtained by FBI

Before US law enforcement officials shut down the Megaupload file sharing web site and arrested several of its employees earlier this month, the FBI obtained a search warrant from a US judge to obtain conversations between Megaupload employees. News.com reports that some of those conversations were critical of Megaupload's founder, Kim Dotcom.

Some of the records go back to 2007 and used both email and Skype IM logs. One chat log from an unnamed Megaupload employee stated that there were worries that Kim Dotcom was not "safe with his money". The chat files added that some employees felt that "the current situation is a bit risky."


At the moment, it's unknown as to how FBI investigators managed to obtain access to these Skype chat logs. Skype itself says it only stores the IM chat logs of its users for up to 30 days. Skype said they were not asked by the FBI to turn over any files and were never served with any court papers by the government.


The article hints that the FBI might have installed some kind of spyware on the PCs of Megaupload employees and obtained their chat and email conversations in that manner. The FBI has installed a type of spyware called CIPAV on suspects' PCs as part of its investigations in the past few years. It has been used to help with cases involving child molesters, hackers and organized criminals.

Nothing seems to be safe anymore, with keywords and Skype well I have known that to be a big target for years now with the FBI listening in on conversations.

Megaupload Founder Accuses Police of Assault, Denied Bail Again

Following a hearing today at the High Court in New Zealand, Kim Dotcom was again denied bail. The Megaupload founder, who authorities insist will likely flee should he be released, told the court that he’d been kicked and punched by police during his arrest. Dotcom added that during his time in prison he had been approached not only by women wanting to be his friend, but by an expert document forger.

Today, Megaupload founder Kim Dotcom appeared at New Zealand’s High Court to continue his fight against extradition to the United States on copyright infringement, racketeering and money laundering charges.

Dotcom has been held in custody since dozens of police raided his Coatesville mansion last month following a lengthy FBI investigation.

During the day-long hearing before Justice Asher, Dotcom’s lawyer, Paul Davison QC, appealed a decision by Judge McNaughton in the Auckland District Court last week which denied the 38-year-old German national bail.

Judge McNaughton had concluded that with all his resources, Dotcom posed a “significant” flight risk.

The defense said that Dotcom has several health-related conditions – one of which is thought to be diabetes – which cannot be properly dealt in prison, adding that the Megaupload founder wanted to be able to spend time with his wife who is currently carrying twins.

Just because Dotcom had access to a helicopter and private jet, Davison added, it did not follow that he would seek to use them to flee the country.

When it was Dotcom’s turn to take the stand he told the Court that during his high-profile arrest last month, police had assaulted him after finding him in a secure panic-room known as the “Red Room”.

“I was punched in the face, I was kicked down on the floor,” Dotcom said. “One guy was standing on my hand so my nail was ruptured and my hand was bleeding, it was quite aggressive.”

Dotcom also told of how that during his time in prison he had received “funny visits”, phone calls and contacts from people he had never heard of including a succession of women wanting to be his friend.

One unsolicited telephone call claimed he was a prosecutor who in return for receiving some money would help Dotcom get bail

“I immediately said ‘absolutely not’ and I gave the number to the officer,” Dotcom said.

Another, the court was told, was said to be an expert document forger.

“If people were to approach me and to offer such a service, I would tell them to go to hell,” Dotcom said. “I have no desire to run away.”

But lawyer for the United States government, Anne Toohey, said that the chances of the New Zealand resident fleeing were too high, a point on which the court eventually agreed.

Describing Dotcom as “an extreme flight risk”, Justice Asher again denied bail. Dotcom is set to appear in court again on February 22nd for an extradition hearing.

Kim Dotcom, the founder of the now defunct file-sharing site Megaupload, has been released on bail following more than a month behind bars in New Zealand. Now he’s preparing to fight extradition to America.

Dotcom, born Kim Schmitz in Germany, was apprehended by authorities on January 20 over allegations that the website he founded in 2005, Megaupload, was the centerpiece of a vast online conspiracy. Authorities attested that through the operation of the site, Dotcom and his associates immensely profited by selling subscriptions and advertisements for a file-storage service that is alleged to have hosted and distributed pirated material.

For nearly five weeks, Dotcom has been behind bars in New Zealand, where he was granted residency in 2010. Authorities had denied him bail twice during his five-week stint in jail, citing that the millionaire mastermind of Megaupload would flee the country if released. On Wednesday, a judge finally allowed Dotcom to return home after opining that he would be unable to escape on account of authorities having seized most of his fortune and he would be unable to afford any attempt at exile.

"I am relieved to go home to see my family, my three little kids and my pregnant wife," Dotcom tells reporters Wednesday upon exiting the court. "And I hope you understand that that is all I want to say right now."
Earlier this month, Dotcom pleaded with the court to allow him to rejoin his family.

"I will not run away,” he insisted then. “I want to fight these allegations on a level playing field. I have three little children. My wife is pregnant with twins. I just want to be with them.”

Dotcom remained mostly mum during his exit on Wednesday, offering little commentary aside from answering a question on how the police had treated him after his arrest made international headlines.

"Well, it felt a little bit like an audition to 'American Idol,' Dotcom explained.

It was a questionable comparison for Dotcom to make, given that he has become public enemy number one of the entertainment establishment over his involvement with the file-sharing site. For operating Megaupload, Dotcom is being charged with duping the music industry out of hundreds of millions of dollars by allowing a way for users to share pirated movies, music and television shows — including American Idol.

reads the Department of Justice indictment filed earlier this year.

Within hours of his arrest last month — which was the pinnacle moment of a high-profile raid of Dotcom’s New Zealand mansion — online activists that supported Megaupload responded by flooding the servers of the Universal Music Group, the largest record label in America that lists Interscope-Geffen-A&M, the Island Def Jam Motown Music Group and Mercury Records under its umbrella. Hacktivists aligned with several online collectives managed to cripple not just the UMG website, but also disrupted the sites for the FBI, the US Department of Justice, Universal Music Group, the Recording Industry Association of America (RIAA) and the Motion Picture Association of America (MPAA) in response to the raid and arrest of Dotcom, which was coordinated along with the shutting down Megaupload.

As Dotcom prepares for his next court appearance in New Zealand now, he will also face a further American Idol-esque audition in the US. Authorities in the United States are hoping to extradite Dotcom to the US to charge him domestically for his role with Megaupload. After coordinating last month’s raid on Dotcom’s mansion, the DoJ equated the pending charges as being

“among the largest criminal copyright cases ever brought by the United States and directly targets the misuse of a public content storage and distribution site to commit and facilitate intellectual property crime.”

These charges come despite Dotcom operating Megaupload from half-a-world away. Although he primarily resided in New Zealand, Megaupload was hosted out of Hong Kong.

According to an Associated Press report early Wednesday, Dotcom confirmed that he will be fighting any extradition attempts by the United States government.

In the weeks during which Dotcom was behind bars, the International Intellectual Property Alliance (IIPA) submitted its annual watch list to the Office of the US Trade Representative where it singled out dozens of other countries for lax legislation that allows similar sites to still operate. The IIPA is pressing American authorities to consider harsh sanctions on foreign nations if they do not take measures to further prosecute persons linked to file-sharing sites such as Megaupload.

Now the newest thing is google keeping all your info and tracks, just as MS does, for 10 years once your msn acc, as been closed by you or inactive, they still keep everything for that length of time in cases like this and any other stupid reason the FBI might have a need to check you out within ten f#ckin years

It’s Official: US Demands Extradition of Megaupload Suspects

Authorities in the United States have put in an official request to extradite Megaupload founder Kim Dotcom and the three other suspects in the “Mega Conspiracy.” While the request doesn’t come as a surprise, the prosecutors waited till the official deadline last Friday before filing the paperwork. It will take a while before the fate of the accused is decided, as the first extradition hearing is planned for August.

Last Friday, US prosecutors filed an extradition request against four New Zealand-based suspects who were allegedly part of the so-called “Mega Conspiracy.”
Kim Dotcom is wanted in the United States alongside other key Megaupload employees on racketeering, copyright infringement and money laundering charges.

In the battle to extradite the defendants, US authorities intend to rely on a United Nations treaty aimed at combating international organized crime.
Previously a lawyer working on behalf of the United States government admitted that no copyright offenses are specifically listed in the extradition treaty. However, he also noted that certain offenses which involve transnational crime are covered by New Zealand’s Extradition Act.

In New Zealand crimes must carry a four year prison sentence to be deemed extraditable. Under the country’s Copyright Act, distributing an infringing work carries a five year maximum sentence.
Experts and observers are predicting that due to its groundbreaking status, the extradition battle for the Megaupload defendants will be both complex and prolonged, and could even go all the way to the Supreme Court.
For now, the first extradition hearing has been scheduled for August 20.

Megaupload programmer Bram van der Kolk recently called on the New Zealand authorities to remain dignified in their extradition dealings with the United States.
“I really hope New Zealand will keep its dignity and can show that it is a sovereign state that has its own justice system,” he said, referring to the extradition process.
Talking to TorrentFreak last week, Megaupload founder Kim Dotcom said that he and his co-defendants are positive that the law is on their side.
“We’re going for this and we’re confident we’re going to win,” Kim said
