Mickey Rooney's stepson has been accused by his own mother - the star's eighth wife - of faking his will then poisoning him.

Daily Mail Online can disclose that a new lawsuit filed by Jan, the actor's widow, accuses Mark Aber of killing him.


Rooney died in April 2014, after nine decades in the Hollywood spotlight. Despite being at one time cinema's highest-earning star, he left just $18,000.

Now a simmering feud between his widow and her stepson, who was Rooney's carer in his final years, has exploded into a court battle.
It will also see Rooney's body exhumed for a fresh autopsy, in an attempt to prove Jan Rooney's claim that he was poisoned.

Relatives have not stopped fighting since the actor died at the age of 93.

Last wife: Jan Rooney was the eighth and final bride of Mickey Rooney. They had separated in 2012 after marrying in 1978, but had not divorced. it was the longest of his many unions



But this is a new low between the two camps - Jan and Chris versus Mark and Charlene, who looked after Rooney in the final few years of his life. Mickey's natural children are also against Mark and Charlene.

Earlier this year, Rooney's daughters Kelly and Kerry claimed that their father had been poisoned and demanded that the body should be exhumed for an autopsy.

As Rooney lay in his coffin, Kelly even clipped several strands of hair from her father's corpse, believing they would be the key forensic proof that will confirm he was poisoned, but she hasn't been able to afford for it to be examined.
Nor had they the cash to hire an attorney to take on the case against the will.

A family source revealed to Daily Mail Online that Chris Aber and mom Jan believe Rooney was poisoned by Mark, who even had literature about how to poison someone and information on autopsies delivered in the post.
Claims over the will lie at the heart of the dispute.

Just three weeks before his death, Rooney updated his will and left everything to Jan's son Mark Aber and wife Charlene, which was a mere $18,000.

But in papers filed with the probate court in Los Angeles and revealed for the first time by Daily Mail Online, Jan and Chris allege that it was invalid.

They claim that the only legal arrangement regarding Mickey's Estate was a will trust called 'The 2003 Mickey and Janice Rooney Irrevocable Trust', which they say was signed by both parties and approved by the courts, unlike his final will.

They say that a handwriting expert has proven that Mickey's signature on the final will was a fake or written under duress.

The suit states: 'A handwriting expert's professional opinion was that Decedent's Purported Signature on the aforementioned will and trust were either not that of the Decedent and If Signed by the Decedent, the Expert Concluded That the Decedent had no idea what he was signing.'

Chris and Janice allege that Mark and his wife Charlene made Rooney sign.
Chris told Daily Mail Online: 'They scared Mickey, they made him sign this document, to say that his wife is against him.

'His daughters are coming around. They [Augustine and Aber] thought that it was all over, but it's far from it.
'I have to show the court that he was under undue influence and throw the will out.'

The legal move will be accompanied by a fresh autopsy, as long as Jan and Chris gain permission.

A family insider told Daily Mail Online: 'It shouldn't be too difficult to get permission from the courts and the graveyard, and ultimately it's my mom who has the final say as the surviving spouse as to whether his body can be exhumed, and she wants it.

'He died exactly three weeks after signing a new Will, it's very, very suspicious, we believe he was poisoned.
'All mail for Mickey was forwarded to my house when he died and I was getting mail entitled "For Mickey Rooney, President of Mar [Mark Aber Rooney] Productions" and there were subscriptions to magazines about how to poison someone and not be caught, and information about medical supplies and autopsies.

'All these magazines, Mickey losing all the weight before he died, looking whacked out most of the time - it really made the family think he had been poisoned.
'This is one of the biggest scandals ever to happen to a Hollywood star, no one cared about Mickey when he died, now they will.'

The legal suit claims that Mark Aber and Charlene sold memorabilia worth thousands behind their back and alienated Mickey from her by concocting a fictitious story that he'd receive $2 million from a lawsuit if he didn't see his wife again.





Indignity: In the years before his death, Rooney spoke on the issue of elder abuse, including testifying to a Senate special committee on the issue in 2011


The papers also alleged that Mark, a former heroin addict, repeatedly stole money and credit cards from Rooney's wallet over several years, the suit says.

'There is documented evidence that Charlene and Mark Aber, decedent's supposedly caregivers… before he died on April 6 over several years until and including 2015 systematically stole memorabilia worth thousands of dollars belonging to decedent and his widow and plaintiff, Janice Rooney…[there were also] false hopes and tales about collecting a $2,000,000 lawsuit.

'Mark and Charlene kept Decedent isolated and informed Decedent that his Wife did not want to see him anymore, and that he would lose the $2,000,000 lawsuit if he spoke to her.'

The legal case is being brought against Michael Augustine, who was Rooney's attorney and is conservator of his state and executor of his will.
He has been told to respond to the claims in 30 days, with a hearing scheduled for March.

Chris told Daily Mail Online that the stress of the case was proving difficult for his family.

'I'm so tired of all this. This could make my mum seriously ill, it could even kill her; it's so stressful,' he said.
'We are representing ourselves - it's like David versus Goliath. Why is a widow having to fight for what is rightfully hers?'
